单包工形式承建房屋合同

甲方：

乙方：

甲方现需新建房屋一栋，在遵循平等，自愿，公平和诚实信用的原则下，双方就本建设工程施工事项协商一致，特订立本合同。

一、工程承包形式

本工程采用单包工形式承包给乙方，乙方自行承担施工作业所需要的机械、模板(清水木)、马儿柱、安全绳、切割机等工具。撮箕、钉子、铁丝、扎线、焊条等辅助材料由甲方负责。

二、工程承包范围

1、基础工程：以设计施工图为准。基础应挖至甲方认可的硬土层，乙方还应负责基础的回填和夯实。

2、主体工程：砌砖、钢筋制作、模板(清水模板)、砼浇灌等分项工程，严格按照设计施工图及双方商量的改动方案进行施工作业。

3、抹灰工程：内墙及外墙东面为乳胶漆，南面为墙砖。腻子由乙方负责，甲方负责乳胶漆。如需改动甲方应提前通知乙方。

4、门窗工程：乙方施工过程中应严格按照施工要求留好门窗口尺寸，同时配合做好相关工程施工作业。

5、水电安装工程：由甲方提出方案，甲方出材料乙方负责安装。如需改动甲方应提前通知乙方。

6、附属及装饰工程：化粪池和屋面水池，整栋房屋的飞檐、内、外墙粉刷、地板砖、门窗、大玻璃、外墙马蹄、提脚线及卫生间和厨房的装饰、吊顶、操作台、防水均由甲方出材料，由乙方按设计施工图和甲方的要求进行施工和铺设。

7、按实际施工建筑面积以每平方米贰佰柒拾元整(270元/㎡)计价。坡屋面和阳台根据国家建筑面积计算规则按半价计算，即每平方米壹佰叁拾伍元整(135元/㎡)，大门及围墙双方另行协商。

三、质量要求

乙方必须严格按照图纸及双方约定施工，施工质量应符合设计要求和国家现行施工规范及有关标准的规定，由于施工方的因素达不到质量要求所造成损失，乙方除自行承担工时费外，还应承担一切损失。乙方在施工中必须节约材料，不得人为造成浪费。

四、承包价格及工程款支付方式

甲方以每平方米(建筑面积按国家标准规定计算)270元/平方米价格承包给乙方。在基础浇灌完工后支付1万元;每层封顶后各支付1万元;内外抹灰完工后支付2万元;整栋房屋粘贴完工后支付2万元，其余在全部完工后一个月内验收，验收合格后结算付清余款，但甲方应该扣取乙方工程款元作为维修保证金，待一年后支付。

五、施工安全

在施工期间乙方必须搞好施工现场安全管理和安全防范及出

入施工范围内的其他人员安全工作，由于乙方在施工过程中所造成的安全事故及工伤事故均由乙方自负全责。所伤害的施工人员及其他人员一切责任由乙方负全责，甲方概不负责。

六、其它：甲方应积极配合乙方做好周边的邻里关系。需甲方购买的材料乙方必须提前测算和通知甲方。

七、施工工期：3月1日至7月31日完工。

八、未尽事宜：甲、乙双方共同协商解决。

九、本合同一式二份，甲、乙双方签按手印即生效，待工程完工双方验收结算完毕至工程款付清后，本合同自行终止。
