甲方：福建省侨兴轻工学校

乙方：

甲、乙方经充分协商后签订本合同，双方应共同遵守，严格执行，以保证办好食堂，服务广大师生。具体合同条款如下：

一、甲方的权力与义务：

1、甲方于________年月日将第三食堂内场地即原后山第二食堂(注：若后山新盖食堂完工，则转入后山新盖食堂内经营)及学校固定资产(注：固定资产清单另付)提供给乙方使用。

2、甲方允许乙方在第三食堂内经营饮食、开水供应。不得经营烟、酒、生活用品、食杂(面包、蛋糕除外)、文具、水果、冷饮。乙方不得在食堂内开设小卖部，否则视为违约。

3、甲方向第三食堂供水、供电(注：若停电，甲方应及时发电;若自来水厂停水，甲方应及时供井水，以确保乙方能正常营业。)

4、第三食堂的开业停业时间由甲方根据校历安排统一规定;

5、甲方对乙方经营的食堂存在卫生、质量、价格、服务态度等方面有检查监督权力，乙方应服从甲方职能部门管理。

6、在甲方召开膳食工作会议(每月一次)时，乙方(承包者)应亲自到场参加，听取学生代表及职能部门意见，及时改正，提高服务质量以利于乙方将食堂办得更好;若两次不亲自参加，当作不亲自经营管理，视为违约;

7、甲方保证在承包期内不在校内开设第四家食堂。但甲方实验室进行面包、蛋糕等工艺实验或教工活动中心的正常活动不受此限。

8、乙方对第三食堂的水、电装修及房屋结构改造需经甲方同意后方可施工;

二、乙方的权力与义务：

1、乙方对其承包的第三食堂享有独立自主、自负盈亏的经营自主权。乙方应严格遵守《食品卫生法》、《环境保护法》、《学校食堂与学生集体用餐卫生管理规定》及学校的相关规定。承包期内乙方不得随意中途停止营业或不正常营业，或转包他人经营。

2、乙方在签订合同时应向甲方上交风险抵押金人民币贰万元整。若乙方在合同期内无违反本合同规定，甲方在合同期满后应如数退还乙方;承包期内第三食堂内的甲方固定资产由乙方负责管理使用，维修年检一切费用由乙方自己承担。乙方应于________年9月1日前取得卫生部门颁发的卫生许可证，从业人员个人健康证。

3、第三食堂的水电费由乙方自负，并按季度上交甲方财务科。甲方每月补贴第三食堂70吨水，主要用于自来水厂停水时，供学生使用，乙方必须提供学生用水方便。第三食堂内严禁使用一次性泡沫快餐盒。第三食堂油锅炉使用柴油为燃料，其它加工项目可使用蜂窝煤为燃料。食堂内娱乐设施不得播放内容反动或黄色音像制品。在晚自习及上课时间不得播放音像制品。4、食堂内粗加工间、更衣间、仓库、面点间等功能区区分应明确。食堂采购应有厂家卫生许可证及每批产品检验合格证的复印件。餐具应严格洗、消、冲、保洁。应配备大型消毒柜两台并正常使用，对餐具进行严格消毒。应保证消毒柜正常运行和使用。食堂员工衣帽应统一、穿戴整齐，保持整洁，每个员工应有冬、夏工作服各两套。食堂内应有健全的防鼠、防蝇、防尘“三防”措施(特别是分菜间、加工间、餐厅等场所的门窗)。乙方应认真搞好食堂内外卫生，制订食堂卫生管理制度，建立食堂卫生工作自查记录。食堂内所有垃圾应倒在甲方指定的地点，否则应另支付卫生管理费用每月1000元。

5、乙方应认真做好防火、防盗及有关安全工作，若出现安全事故，其责任完全由乙方承担。承包期满合同终止后，除可拆除的如空调、消毒柜、电视、音响及不影响装修的设备外，其余改造设施归甲方所有。乙方应向师生供应符合卫生要求的开水，每壶价格不得超过0.2元，每桶价格不得超过1元，并确保开水供应。

6、乙方在承包期内对食堂经营负全责，必须参与有效管理，不能转包，如发现转包，甲方有权收回，风险抵押金及承包金不予退还。乙方在承包期间，不得在校内饲养家禽家畜，否则视为违约。乙方在经营过程中，与甲方发生的一切经济往来，其手续必须由乙方亲自办理(不得委托办理)。

7、乙方承包者应在岗在位，亲自参与食堂管理，倾听甲方师生意见，不断提高服务水平和饭菜质量，在甲方召开膳食工作会议(每月一次)时，乙方应到场参加，虚心听取学生代表及职能部门意见，并及时进行整改。乙方应树立热情为广大师生服务的观念，降低成本，减轻用膳师生的负担，努力做到饭热、菜香、价廉物美，优质服务。

8、乙方不得干涉学生在校内外选择就餐的自由，乙方应在分菜间设一个教工售菜窗口。

9、乙方不得与第一、第二食堂之间存在半成品及成品连代加工。乙方的家属及亲戚均不得参与第一食堂及第二食堂的经营与管理。否则以转包论处。

10、乙方的经营场所以甲方提供的现有场所为限，乙方不得扩大经营场所，不得在现有场所范围外搭盖。

11、若工商、税务等校外行政部门需要收取有关费用(含税费)由乙方自负。

12、第三食堂设备投入费用的部分人民币壹拾万元整。由乙方于中标后两天内上交甲方财务科。

三、违约责任及解决办法：

1、乙方若中途停止营业，所交纳承包费及风险抵押金作为乙方不正常营业给甲方造成损失的补偿，不予退还。

2、乙方因违反《食品卫生法》、《环境保护法》、《学校食堂与学生集体用餐卫生管理规定》给学校及师生造成损失，乙方应负相关法律责任及全部经济责任。

3、合同期满后，甲方所有固定资产应完好交还学校，否则甲方将按实际收取修理费或赔偿费。

4、乙方逾期无法办理卫生许可证及从业人员健康证，甲方有权责令乙方整改。因乙方不具备上述两证而被卫生防疫部门处罚，乙方应负赔偿责任。

5、若乙方违反本合同的条款，甲方将有权责令其限期整改，并视情况直接从乙方所交的风险抵押金中每次抵扣500元直至全部，做为乙方违约给甲方造成损失的补偿，若违约金使用超过贰万元，超出的部分由乙方如数交纳。

6、在合同期内，若甲方需要收回第三食堂，则应赔偿乙方在第三食堂投入的经济损失。

7、若乙方将所承包的食堂转包给他人经营，则甲方有权中止合同。乙方的风险抵押金及所交承包费不予退还外，且停聘乙方或乙方担保人三年。

8、甲方若违反本合同的有关约定，甲方应赔偿因甲方违约给乙方造成的相关经济损失。

But I was born and brought up in a village surrounded by mountains,where there happened a more wonderful childhood than what is descriped in luxun’s short story guxiang. And I got an admission of scut 3 years ago.

My father is both a construction worker and farmer. I said to myself “maybe I can do better than my father ”when I was considering what as my first choice.

I am easygoing . I’d like to communicate with different people. In my spare time, I have broad interests to color myself. Basketball and swimming is my favor. I also play billiards and do rock climbing in my spare time. I love reading. besides novels , books about real estate, economic, management are also my love.

In my past uni time , I have been growing up enormously. For one side I gain knowledge from teachers and books and take part in activities inside or outside class. I was always the captain or the organizer of our team. whatever you choose to work or Continue study .everyone know Four years’ uni study is not enough. someone prefers to train himself at work. But I prefer at graduate school. I hope I can form systematic view of civil engineering. Graduate study is very helpful for one who want to know civil engineering comprehensively and deeply.If possible, I will go on with my study for doctorate degree.

If luckily I got the chance to learn civil engineering in southeast University, I will concentrate on the study , research and practical application in this field. First, I will work hard on the theoretical knowledge and contact different branches of civil engineering, constructing a solid base for my future work; Second, I would like to do some practical work with the help of the supervisor and classmate. And through this, I can get something that cannot be acquired from the textbooks. last, I wanna broad my view, besides knowledge on civil engineering, management、real estate、software are also what I interested in. I will make full use of my graduate time to enrich myself. I believe after 3 years of learning, my dream will finally come true?
