在试用期内，乙方被证明不符合录用条件的，甲方有权随时解除劳动合同。

所谓试用期不符合录用条件包括：

①乙方体检或身体健康未能通过甲方入职前所要求的;

②乙方在日前未能完备所规定的手续的;

③乙方不能达到所担任岗位的绩效指标或者相应的要求的;

④乙方的背景调查或者在履历中发现有弄虚作假行为的;

⑤乙方顶撞上司或在工作期间发生殴斗行为的;或者其他任何主管认为乙方不能符合该职位的要求的。

二、工作内容

第二条乙方同意根据甲方工作需要，在____________部门，担任_________岗位(工种)工作，工作地点为：____________，其主要工作职责见其“职务说明书”。

三、劳动保护和劳动条件

第三条甲方安排乙方执行定时的工作制。

甲方安排乙方每日工作时间为八小时(不包括吃饭时间)，每周40小时。

第四条甲方由于工作需要安排乙方加班的，应安排乙方同等时间补休或支付加班工资。

乙方未经有关领导同意不得自行加班加点。

第五条甲方为乙方提供必要的劳动条件和劳动工具，建立健全工作规范和劳动安全卫生制度及其标准。

第六条甲方负责对乙方进行政治思想、职业道德、业务技能、劳动安全卫生及有关规章制度的教育和培训。

四、劳动报酬

第七条甲方的工资分配遵循按劳分配原则，甲乙双方同意，乙方的劳动报酬分为三部分：基本工资、职务工资和岗位工资。

第八条甲方实行下发薪制，每月5日以货币形式支付乙方上月的工资，总计______元人民币，(包括①基本工资为_______元;②岗位工资______元;③职务工资_______元)。

第九条乙方的劳动报酬按国家规定缴纳个人所得税，甲方在支付乙方工资时代扣和代缴。

此部分奖励的应纳税部分由乙方自行负担。

五、保险福利待遇

第十一条甲乙双方应按国家和_______市社会保险的有关规定缴纳职工养老、失业和大病统筹及其它。

甲方应为乙方填写《职工养老保险手册》。

双方解除、终止合同后，《职工养老保险手册》按有关规定转移。

第十三条乙方患职业病或因工负伤的工资和医疗保险待遇按国家和北京市有关规定执行。

第十四条甲方为乙方提供以下福利待遇：工作午餐及年休假。

六、劳动纪律

第十五条乙方应遵守甲方依法制定的各项规章制度;严格遵守工作规范;爱护甲方的财产，遵守职业道德;积极参加甲方组织的培训，提高思想觉悟和职业技能。

第十六条乙方违反劳动纪律，甲方可依据本单位规章制度，给予处分，直至解除本合同。

七、劳动合同的变更、解除、终止、续订

第十七条订立本合同所依据的法律、行政法规、规章发生变化，本合同相应变更有关内容。

第十八条订立本合同所依据的客观情况发生重大变化，致使本合同无法履行的，经甲乙双方协商同意，可以变更本合同相关内容。

第十九条乙方在试用期间，被证明不符合录用条件的，甲方可以随时通知乙方解除合同。

第二十条乙方有下列情形之一，甲方可以解除本合同、扣发岗位工资、向乙方要求经济赔偿直至追究司法责任：

1、严重违反劳动纪律或甲方规章制度的;

2、严重失职、营私舞弊，对甲方利益造成重大损害的;

3、构成渎职、犯罪和被依法追究刑事责任的。

第二十一条下列情形之一，甲方可以解除本合同，但应提前三十日以书面形式通知乙方。

1、乙方患病或因工负伤，医疗期满后，不能从事原工作，也不能从事由甲方另行安排的工作的;

2、乙方不能胜任工作，经过培训或者调整岗位，仍不能胜任工作的;

3、双方不能依据本合同第十八条规定就变更合同达成协议的。

第二十二条乙方有下列情形，甲方不得依据本合同第二十三条、第二十四条终止、解除本合同：

1、患病或因工负伤、在规定的医疗期内的;

2、女职工在孕期、产期、哺乳期内;

第二十三条乙方患职业病或因工负伤，医疗终结，经市、区劳动鉴定委员会确认丧失或部分丧失劳动能力的，按国家有关规定办理，不得依据本合同第二十一条、第二十二条解除劳动合同。

第二十四条乙方解除本合同，应当提前三十天以书面形式通知甲方。

第二十五条有下列情形之一，乙方可以随时通知甲方解除本合同：

1、在试用期内的;

2、安排在经劳动部门认定为保护不完备的地方或让乙方从事法律不允许的工作;

3、甲方不按照本合同规定支付劳动报酬或者提供福利待遇的。

第二十六条本合同期满，劳动合同即终止。

甲乙双方可协商，续订劳动合同。

八、经济补偿与赔偿

第二十七条下列情形之一，甲方违反劳动合同约定条件的，应按下列标准支付乙方经济补偿金：

1、甲方克扣或者无故拖欠乙方工资的，以及拒不支付乙方延长工作时间工资历报酬的，除在规定的时间内全额支付乙方工资报酬外，还需加发相当于工资报酬百分之二十五的经济补偿金;

2、甲方支付乙方的工资报酬低于本市最低工资标准的，要在补足低于标准部分的同时，另外支付相当于低于部分百分之二十五的经济补偿金。

第二十八条下列情形之一，甲方根据乙方在甲方工作年限，每满一年发给相当于乙方解除本合同前十二个月平均工资一个月的经济补偿金，最多不超过十二个月，所应交纳的税额由乙方自行负担。

1、经与乙方协商一致，甲方解除本合同的;

2、乙方不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作，由甲方解除本合同的。

第二十九条下列情形之一，甲方应根据乙方工作年限，每满一年发给相当于本单位上年月平均工资一个月的经济补偿金：

1、乙方患病或因工负伤，经劳动鉴定委员会确认不能从事原工作，也不能从事由甲方另行安排的工作而解除本合同的;

2、同订立时所依据的客观情况发生重大变化，致使本合同无法履行，经当事人协商不能就变更劳动合同达成协议，由甲方解除劳动合同的;

3、甲方濒临破产进行法定整顿期间或者生产经营状况发生严重困难，必须裁减人员的。

以上三种情况，如果乙方被解除本合同前十二个月的月平均工资高于本单位上年平均工资的，按本人月平均工资计发。

第三十条甲方解除本合同后，未按规定给予乙方经济补偿的，除全部发给经济补偿金外，还须按该经济补偿金的百分之五十支付额外经济补偿金。

第三十一条甲方违反本合同约定的条件解除劳动合同或由于甲方原因订立无效劳动合同，给乙方造成损害的，应按劳动部《违反有关劳动合同规定的赔偿办法》赔偿乙方损失。

第三十二条乙方违反本合同的约定解除劳动合同或违反本合同约定的保守商业秘密等事项，给甲方造成损失的，乙方应按劳动部《违反有关劳动合同规定的赔偿办法》赔偿甲方损失。

第三十三条乙方的服务期为_________个月。

乙方解除本合同的，凡由甲方出资培训人员，应向甲方赔付培训费。

其标准为：

一般员工：培训费÷合同期限/月×未完合同时间/月;

业务骨干：服务不满一年(含一年)的：赔偿全部培训费;服务不满二年(含二年)的：赔偿80%培训费;服务不满三年(含三年)的：赔偿60%培训费(以每年递减20%类推)。

业务骨干：指部门经理、副经理及专业性较强的技术人员。

第三十四条乙方自行解除本合同的，甲方不支付经济补偿金。

九、劳动争议处理

第三十五条因履行本合同发生的劳动争议，当事人可以向单位申请调解;调解不成，当事人一方要求仲裁的，应当自劳动争议发生之日起六十天内向北京市劳动争议仲裁委员会申请仲裁，对裁决不服的，可以向人民法院提起诉讼。

十、其他

第三十六条甲方所制定的各项规章管理制度均做为本合同的附件。

第三十七条乙方应按甲方规定将档案转入甲方制定管理机构，非北京户口及未转档案者，不执行本合同第十三条。

第三十八条本合同未尽事宜或今后国家、北京市有关规定相的，按有关规定执行。

第三十九条本合同一式两份，甲乙双方各执一份。
