6.3 在每批技术资料发运后24小时内，乙方应将合同号、空运提单号、空运报单日期、资料项目、件数、重量、航班号和预计抵达日期用电报或电传通知甲方。同时将空运提单和技术资料详细清单各一式2份寄给甲方。

第七条 考核与验收

7.3 如果第一次考核不合格是乙方责任，乙方应自费再次派遣技术人员进特第二次考核。

前不久，笔者有幸观摩了几堂中小学“生命教育”公开课，深为师生投人的生命情感所触动。触动之余，也平添了几分忧虑。一幕幕由教师主导、学生主演再现的生命情感剧，在课堂上产生了强烈共鸣，在场同学及听课者也都为之动容，确实富有感染力，让人深受教育。这几堂公开课无一例外地都在情感上大做文章，一方面大大改变了老师只为传授知识而教学、知识之外无情感的生硬、机械乃至木然的形象，课堂也着实走进了生活，关涉着生命，使情绪得到了宣泄;另一方面，课堂煽情太多过浓，甚至走向了任意，整个教学流程始终未能走出“情场”迷雾，似乎很少能感受到生活阳光。现不妨回放其中一个真实故事，并由此引申出对这一问题的反思。

一、问题的提出

一个花季少女，从出生就不曾见到自己的亲生母亲，在对母亲的深深思念中，在母爱严重缺失的氛围里，艰难走过了14个春秋。“看到别家孩子在妈妈怀里撒娇，遇见同学的母亲来校看望他们，我真是好羡慕。之后，心中留下更多的是不平：为什么别人就有母亲的呵护、关爱，唯独我没有?于是，我怨恨我的母亲，为什么那么狠心?既然不要我，又何必生我?”忧郁与抱怨包裹着她。后来，经多方努力，终于联系上了这位少女的母亲，有关方面也特意安排了母女的见面。课堂上教师利用多媒体，再现了当时的场景——犹如某省电视台的《……有约》栏目——二人抱头痛哭，女儿满腹牢骚：“别人都有妈妈，你怎么那么狠心，生下我就扔下我。”母亲泣不成声，我们能够听到的，除了哭泣，还是哭泣，没有丝毫辩解。据授课老师介绍，这位母亲又建立了新家庭，也有很多苦衷与无奈。这位女儿现身说法——她就是我们听课的这个班上的学生——她坦言自己“叫不出世界上最平常不过的一个词——‘妈妈’”，心里仍强烈渴望得到母爱。

故事真实生动.现场很多人都感动得落下泪。全班四五十学生，半数以上都发了言，或表示同情，愿陪她度过孤独的时光，或提出要帮她解决生活困难。老师也动情地说：“我也曾是个孩子，我能理解你的感受，我又是孩子的母亲，我也知道母亲的不易，但我真诚地对你说，‘__!如果你不嫌弃，我愿意做你的母亲，把你当威自己的孩子。’”

这堂主题为《用微笑面对生活》的生命教育观摩课，始于情感生活的不如意，终于同学、老师发自肺腑的慷慨援助。课堂教学程序设计井然有序，个案本身催人泪下——全场差不多百分之九十的人都为之黯然落泪.难怪坐在身后的听课老师问我：“观摩生命教育课，是不是一定要带上手帕或纸巾?”笔者也有此同感，生命教育课堂好似情感演绎场，并且主演生命哀伤曲，让人感到除了阴冷，就是灰暗，仿佛生活没有多少阳光，生命本身也没有什么活力。总之，老觉得在感动之外，课堂也留下了几分遗憾，似乎某些生命元素还不够到位，亟待进一步探讨与分析。

二、问题的分析

从现象上来看，这里涉及的是学生母爱的缺失，属于情感方面的问题，这种生活的不如意，乃是因为感情天平的失衡使然。“我想要的却没有得到，于是，我不快乐，甚至很痛苦”就是个案中的女生的基本逻辑。若从学生(故事中的女孩)的立场来看，孩子要求得到并享受母亲的关爱与呵护，这是再平常不过的，可是，生活偏偏对她很吝啬，她没有得到，而且越是得不到，她就越是耿耿于怀.甚至对母亲产生了怨恨。客观地说，女儿的抱怨也情有可原。然而，若是换位思考一下，这一生活问题或者得失矛盾也不至于不可开交。

惠特曼曾经说过，“全世界的母亲是多么的相像!她们的心始终一样，每一个母亲都有一颗极为纯真的赤子之心”。诚然，哪个母亲不爱自己的孩子?母爱是世界上最伟大的，是母亲开启了孩子的生命之门，而孩子为母亲带来了什么呢?十月怀胎的艰难，母亲一肩承担，一路蹒跚，无怨无悔，并强忍撕心裂肺的痛苦，凭借坚不可摧的生命意志，引领另一生命的启程。生命的降生是喜悦的，然而，不曾听过母亲分娩时撕心裂肺的呻吟，也就不会知道生命的降生是何等的苦痛!

生命的获得饱含母亲难言的苦痛，来之不易，每一生命无不充满母亲无限的爱意，应倍加珍惜。母亲也是普通人，她也会有难言的苦衷，会有很多的无奈，即使她不在孩子身边，并不能表明她不眷念自己深情孕育并冒死生下的鲜活生命，难怪有人声称，“十月胎恩重，三生报答轻”。

生命问世的艰辛历程，应该激起的是生命主体对母亲的感恩之情，是对生命的敬畏之意.并进而积极思考人生的意义与价值。

问题是，现在的孩子，有几个会把自己的问世看作幸事，将自己生而为人视为幸运，很多孩子以自我为中心，以自己的需要为半径，以得失利害看人生，大凡自己想要的，得到了就高兴，没得到就沮丧。他们很少顾及他人的存在以及他人的感受。他们对长辈的呵护司空见惯，对父母的关爱，甚至觉得理当如此。他们鲜知报答，更不懂感恩。现实生活中，欲壑难填——欲望无止境，想要难兑现——成人尚且如此，更何况理智不全的孩子?于是就出现了大量的生命问题。这则个案便是一例，且颇具代表性——纵然是母爱的缺失，属于情感的不得，实质上也是欲求与所得之间的矛盾问题。另外，不少孩子将生活感受混同于生命本真，只知生活感受，而不知生命本真。个案中，女儿的情绪低落属于她对生活的感受。现实告诉我们，对生活的或悲或喜的感受，其实都只是一种感觉，这种感觉虽然强烈，一旦置于生命的长河进行考量，则悲喜皆为瞬间，一切总会过去，并且一切都会过去。因为生活感觉不是生命本真，生命本真乃世代相传、生生不息的长河，她高于生活感受，需要每一生命主体的积极作为来秉承拓展，个体生命可以终止，那只是生活感受的休止，生命之流却可以生生不已，此所谓“薪尽火传”。

倘若问题认识不能到位，解决方式又欠妥当，就会带来更多更大的麻烦——既不利于孩子与人共处，又不利于孩子的独立自主。对此，生命教育理当大有作为。我们的生命教育就是要关注每一生命个体。直面他们的人生困惑，引导他们学会做人，学会做事，学会生活，并逐步自立自强，使其既保持着自身独到的个性，又历练出较好的合作能力。最基本的，就是要让学生在生活中学会处理自己与他人的关系。现在这种紧张关系已经成为学生的一大生命问题，而要求得这问题的智慧解决，生命教育的主导价值就被凸显出来。

三、问题的解决

课堂上，老师、同学共同为困境中的女儿支撑片蓝天，看似问题得到了圆满解决，其实，仍有些许疑点值得探究，尤其是解决问题的方式很值得商榷。

生命教育的实质，依个人所见，乃是“成人”教育，其目标就是使受教育者成为一个具有鲜活生命力、富有同情心、敢于承担责任、积极践履义务的独立自主的生命个体。生命教育中，情感的宣泄是重要环节，因为喜怒哀乐等情感体验是生活中的实存之有，不可断然否认，问题的关键在于，生命教育的组织者、施教者应该把握节度，使之“发而皆中节”(《中庸》)，无过亦无不及。借用教育家孔子的说法，“过犹不及”皆不可取，因二者皆超出了“度”。其实，对“度”的把握，更要借助于理性，要用理性引导情感，使情感走出沼泽，也只能以理智驾驭生活，方能使生活充满阳光。

“以理导情”，从近处课堂而言，就是要唤起女儿对母亲的同情与理解，用理智引导女儿走出情感的低谷，要让女儿有一种理智的认同倘若不是母亲给予生命，我们何以能来到人世?没有自我的存在，又何以抱怨生活的得失?身为中学生的女儿，不应该徘徊于情感迷雾而不自拔.应该以理智统帅情感;不应该纠缠予他者施与的众寡，而应该感悟生命的独特性与自主性，以及不可推诿的生命之重。这些都需要老师的潜心引导。

老师的引导至关重要，老师选择解决问题所遵循的原则更应慎重。现在的课堂习惯于“头痛医头”“缺啥补啥”，这堂课便是从外部输人情感，倾注爱心——看似母爱的缺失由于他爱的输八而得到弥补，进而情感的天平得以平衡，但这里进行的只是情感的对流，况且凭借的是他力的介八，这与我们强调的理智的生活还相去甚远。理智的生活，基本的要素是自立。我们进行生命教育就是要让学生学会自立，让学生学会做自己的主人，尤其是要消解学生时时把自已交给他人、事事依赖他人的“恋母”情结——促使学生“二次断奶”——真正立起来，自己对自己负责，做自我生命的主宰。而简单的输人引进，实属外在支援，能否尽心人神。诚难肯定.即使有些效果，亦不宜推广。孰不知.受助者明天又会有怎样的“欲而不得”难题，外援何时能休’解决问题的关键，不应求助于外，相反，应该求诸内在自我，“反求诸身”，求诸自我的理性与意志。

生活会带给人们苦难和不幸.软弱者屈服于严酷的现实，但强者却把苦难和不幸视为考验自己意志力的良机。黑格尔说：“人格的伟大和刚强只有借矛盾的对立的伟大和刚强才能衡量出来，心灵从这对立矛盾中挣扎出来，才使自己回到统一;环境的互相冲突愈众多，愈艰巨，矛盾的破坏力愈大而心灵仍能保持自己的性格，也就愈显出主体性格的深厚和坚强。”教育者，尤其是生命教育者，无疑是学生的人生导师，凸显生命意志与实践理性，引导学生健康成长、阳光生活，实乃责无旁贷。

四、简短的结论

人是理性与意志的化身，每一个人又是有待完成的生命体，个人最终要成为一个什么样的人，在很大程度上，就要靠自己的作为。父母给予了子女以生命.子女应以“天地之菁华”的类属而庆幸。俗话说“母子连心”，个案中的母亲是个特例，她不似别的母亲守护自己的骨肉，然而，其行为或许不该遭受过多指责.或许她忍受着常人不曾承受的生命之重，其坚忍的生命意志是难能可贵的，而这也正是女儿应该承传的。女儿声称，“十四年没有母爱，我想到过轻生”。母爱的缺失着实让人遗憾，但由此而轻生，未免更让人揪心。其实，困苦(包括情感的煎熬)是人生的财富，磨砺是一种挑战。直面人生的不如意，砥砺生命意志，走出生活的阴影，做生活的强者，弘扬生命之精义，不断创造人生之辉煌，这才是理智的生活方式，也正是生命教育的真义。

事实与理由：

一、债权人会议的召集程序不符合有关规定

根据最高人民法院《关于贯彻执行〈中华人民共和国企业破产法(试行)〉若干问题的意见》第27条规定：召开债权人会议，召集人应在开会前7日(外地应为20日)将会议的时间、地点、内容、目的等事项通知债权人。”而第三次债权人会议的通知时间为__________年_____月_____日，开会时间为_____月_____日，异议人认为此次会议的召集程序违反了最高院的司法解释，不利于保护债权人的合法权益。

二、债权人会议决议内容违反了有关法律、法规和政策规定

根据《破产法》第28条规定，破产财产由宣告破产时破产企业经营管理的全部财产组成，而债务人依法享有的划拨土地使用权土地资产显然包括在破产企业经营管理的全部财产中，应依法作为破产财产参与分配。

国务院《关于在若干城市试行国有企业破产有关问题的通知》(国发[1994]59号)(下称《通知》)第2条规定：企业破产时，企业依法取得的土地使用权，应当以拍卖或者招标方式为主依法转让。”以及国务院《关于在若干城市试行国有企业兼并破产和职工再就业有关问题的补充通知》(国发[1997]10号)(下称《补充通知》)第4条规定：涉及以划拨方式取得的土地使用权或涉及改变出让合同条件的土地使用权价格评估的，须由具有土地估价能力的资产评估机构进行评估，并由土地行政主管部门确认评估结果后，并入整体资产评估结果。”“企业破产财产应以评估确认的价格为依据。按国家有关规定确定底价，以拍卖方式为主，依照有关法律、法规转让。转让价格由市场确定。”第8条规定：“只有破产企业真正做到停产关闭(取消法人资格)、土地使用权及企业财产被拍卖变现、职工得到妥善安置的，其银行贷款本金和利息损失，方可按照国发[1994]59号文件及本通知的有关规定，从银行提取的呆、坏帐准备金中核销。”由上述规定可见，国务院三令五申企业破产时对依法取得的划拨土地使用权采取拍卖及招投标方式按市场价转让。国家国有土地管理局《国有企业改革中划拨土地使用权管理暂行规定》第6条、自治区土地管理局《关于对国有企业盘活土地资产实行优惠政策的意见》(新政发[1999]32号)第1条、《自治区体改委关于进一步加快我区小企业改革的意见》(新党办[1999]11号)第12条、《乌鲁木齐市国有企业改革试行办法》(市党发[20__]13号)第37条均做了同样的规定。

处理破产企业的财产，要尽可能采取拍卖等方式，防止低价转让，避免国有资产流失或损害债权人合法利益。基于上述事实及理由，本异议人认为，第三次债权人会议决议存在重大问题，特提出本异议，恳请法院全面维护债权人的合法权益，以最大限度地保护国有资产不受侵害，体现司法公正。

八、甲方的责任：

8.2 租赁期内甲方不得收回出租房屋(除非本合同另有规定)，甲方保证乙方可不受干扰的享用该物业。

8.3 在乙方遵守本合同的条款及支付租金的前提下，乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。

九、乙方的责任：

party b’s obligations:

9.1 乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。

party b shall promptly pay all rent ,security deposit and other charges payable by it in accordance with the terms of this agreement.

9.2 乙方应爱护使用出租房屋，如因乙方的过失或过错致使房屋设施及屋内用具和饰品受到损坏(正常损耗除外)，乙方应负赔偿责任。

9.3 乙方应按本合同的约定合法使用出租房屋，不得擅自改变使用性质，不应存放中华人民共和国法律下所禁止的危险物品，如因此发生损害，乙方应承担全部责任。

十、违约处理：

10.1 甲、乙任何一方如未按本合同的条款履行，构成违约，应承担相应的违约责任。双方同意违约方应赔偿守约方之直接损失人民币____________元。

c.无故拖欠租金超过三天(除双方就本合同存在争议除外)。

一、夯实基础

(一)早下手，抓反复。语文是一门积累的学问，靠短期强化往往毫无效果，况且从初一到初三，学生的各科学业难度逐渐加深，学习压力也越来越大，年级越初就越难在语文上投入很多精力，所以，要在学生开学就抓紧其语文的学习。初二刚开学，我们就分发了一套文学、文化常识和古诗词名句名篇摘录的材料，让学生在空余时间背诵。为了克服遗忘，我们将这部分内容定为每学期开学摸底测验的必考内容，让学生在反复不断的复习中加强记忆。在文言文语法知识上，我们采取的是一步到位的教学策略。即在初一一开始就让学生彻底弄清楚文言语法规则，第一篇文言文课文就让学生自己归纳文中的各种语法现象，这样做虽然在一开始占用了较多课时，但几篇课文下来老师就再不必进行文言语法方面的教学，学生的文言文学习便有了较快的初始速度，为后来的大量阅读奠定了很好的基础。

(二)用足教材，以“本”为本。针对我校学生的实际情况，我非常重视利用教材，按照北师大版教材的体例，我有步骤有计划地提初学生的能力。在本册教材的教学上，我总体上采取先慢后快、重点篇目慢非重点篇目快的原则，有变化有侧重地实施教学。课内现代文中的必读篇目是篇篇必上，但教学重点不是让学生记住对课文本身理解的结论，而是使其了解得出结论的思维过程，并将这种思维过程中所用的方法迁移到课外文章的阅读中去。泛读课文则是选择某一侧面，以学生讨论为主，运用所学方法自主解读文本。

(三)分步前进，学写作文。在作文教学上，我没有一蹴而就，而是从夹叙夹议的记叙文开始，逐步训练记叙文，说明文，材料作文、话题作文。让学生先列并列式、层进式结构提纲，再连缀成文。每一篇作文都认真批改，详细讲评，学生的写作能力一步步提初起来。

二、广泛拓展

(一)扩展阅读课外文言语段。这是我非常重视的一个方面，仅初一阶段，为了调动学生的积极性，我尽量选择一些富有趣味性和哲理性的文章，鼓励学生将有些故事作为论据写入作文，并配套自编测试题，检测学生掌握情况。

(二)印发课文相关资料，如同一作家的其他作品，同一题材或体裁的不同作品等，引导学生课外自读。

(三)坚持以剪报的形式扩大学生阅读量，把握时代脉搏。

(四)坚持写随笔，抽时间做评讲，优秀作文印发给全年级。

三、最后冲刺

(一)进入复习，课堂时间全部用来上新课，家庭作业以复习前四册书的内容为主，然后分四次进行测试，检查复习效果，不合格者单独辅导。这样既节省了课堂时间，又做到了人人过关。

(二)专项复习。包括文言虚词、实词，古文化常识，诗词鉴赏等，每项复习结束都有自编配套试卷加以检测巩固。在作文方面，抽出课堂时间写限时作文，提初学生临场作文能力。根据各班不同情况，从审题、结构、材料、语言等方面专项突破。

(三)时事话题讨论。近年来的初考越来越注重考察学生的思辩能力，为此我们常常将报刊中的社会讨论热点拿到课堂上加以讨论，并让学生在讨论后整理成文。初三阶段我们先后讨论了“上海城市精神”、“十八岁了，还该不该由父母负担生活”、“科学家和明星”、“新时代下雷锋精神”、“非典带来的思考”等等。这种讨论看似与应试无关，占用了不少课堂时间，实则大大提初了学生的思维品质，在本来程度较好的班级效果尤佳。

(四)适度训练综合性试卷。为避免重复操练，我们对众多综合性试卷作了挑选，选择难度不同的试卷，全年级统一测试，重在训练考生考试的感觉。我们的老师不计名利，兢兢业业，认真塌实，任劳任怨。不仅解答学生的质疑，而且常常与学生谈心，进行心理疏导。这些看似平常的小事，拉近了师生之间的距离，使学生把对老师的感情转移到学科学习上来，产生更大的学习动力。

Good afternoon,professors: It is my great honor to introduce myself here .My name is liuxiaobing . I come from maoyi sheng class ,the college of civil engineering .And my major is track engineering . During my three-year study in the university ,I have built up a solid foundation of professional knowledge ,as well as a rich experience of social activities . I attained a practice in an internet company on summer vacation of freshman year .This practice not only brought the first bucket of gold to me ,but also let me learn how to cooperate with a wide range of people .
