(七)法律、法规、规章和规范性文件规定的其他权利。

第七条 甲方的义务：

(一)遵守法律、法规;

(二)贯彻国家的教育方针，执行国家教育教学标准，保证教育教学质量;

(三)维护受教育者、教师及其他职工的合法权益;

(四)按本合同的约定按时支付乙方的工作报酬，保障乙方应享有的工作待遇，并根据工作需要，为乙方提供必要的工作条件;

(五)法律、法规、规章和规范性文件规定的其他义务。

第八条 乙方的权利：

(一)按时获得劳动报酬;

(二)对幼儿园教育教学、管理工作和教育行政部门的工作提出意见和建议，参与幼儿园民主管理;

(三)参加进修或者其他方式的培训;

(四)进行教育教学活动，开展教育教学改革和实验;

(五)从事科学研究、学术交流，参加专业的学术团体，在学术活动中发表意见;

(六)指导学生的学习和发展，评定学生的品行和学业成绩;

(七) 法律、法规、规章和规范性文件规定的其他权利。

第九条 乙方的义务

(一)遵守宪法、法律和职业道德，为人师表;

(二)严格遵守国家计划生育政策;

(三)贯彻国家的教育方针，遵守幼儿园制定的各项规章制度，认真履行岗位职责，做好本职工作，完成工作任务;

(四)对学生进行宪法所确定的基本原则的教育和爱国主义、民族团结的教育，法制教育以及思想品德、文化、科学技术教育，组织、带领学生开展有益的社会活动;

(五)关心、爱护全体学生，尊重学生人格，促进学生在品德、智力、体质等方面的全面发展;

(六)制止有害于学生的行为或者其他侵犯学生合法权益的行为，批评和抵制有害于学生健康成长的现象;

(七)维护甲方的合法权益，不得散布有损于甲方声誉的言论，保守甲方的工作秘密或工作中涉及的绝密、机密信息;

(八)不得以所聘用身份从事商业性活动，利用工作便利为本人或者其他人直接或间接谋取本合同规定以外的利益;在聘用期内不得从事有偿家教或在幼儿园周边的家教服务点任课或者协助其招生。

(九)认真做好教学工作。面向全体、全面提高学科的教学质量，续签合同时同时考虑末位淘汰制。

(十)依法应履行的其他义务。

四、工资和社会保险

第十条 甲方根据乙方的工作岗位，按月支付乙方的工资。乙方试用期工资为 元/月。试用期满后乙方填写转正申请表待甲方审批通过正式聘用后发放全额工资。每月15日为上月工资的发放日，除遇节假日外。

第十一条 甲方应根据自身的实际情况依法确定乙方的工资结构，乙方的奖励、补贴等按甲方依法确定的分配制度、方式和标准执行。乙方的工资构成为： ，其中基本工资为人民币 元∕月。

第十二条 在合同期间内甲方根据乙方工作绩效，适当调整工资标准。

第十三条 签订一年以上劳动合同的，甲方依法为乙方办理社会保险。社会保险费中乙方个人负担部分，由甲方按月从工资中代扣代缴。

第十四条 乙方应缴纳的个人所得税，由甲方在乙方的工资中代扣代缴。

第十五条 乙方在聘用合同期内公休假及因公负伤按国家有关规定执行。

第十六条 乙方在合同期内享受带薪休假。乙方在甲方处正常工作满一学期并在合同期内或续聘者可享受假期工资，不满一学期的或双方解处聘用关系的不享受假期工资。

五、合同的变更、解除及终止

第十七条 本合同期满即行终止，但下列情况处理办法：

(一)乙方因公负伤、致残而丧失或者部分丧失劳动能力的，合同的终止按照国家有关规定处理。

第十八条 本合同经甲乙双方协商同意，可变更。

第十九条 乙方在聘用期间有下列情形之一的，甲方可随时解除合同：

(一)有违法的行为，被依法追究刑事责任的;

(二)在试用期内被证明不符合聘用条件的;

(三)严重违反幼儿园规章制度和劳动纪律达到解聘条件的;

(四)签订合同时采取欺骗手段故意隐瞒个人重要事项及不真实证件或在原单位存有编制人员等对幼儿园造成重大损失或伤害的;

(五)故意不履行岗位职责，给幼儿园工作造成重大损害的;

(六)合同期内，泄露幼儿园机密，导致幼儿园产生损失的;

(六)违反本合同第九条第(八)款的;

第二十条 有下列情形之一的，甲方可以解除聘用合同。

(一)乙方患病或因个人原因不能继续从事原工作，也不能从事由甲方另行安排工作的;

(二)乙方不能胜任教育教学和教育教学辅助服务工作的;

(三)本合同订立时所依据的客观情况发生重大变化，致使合同无法履行，经当事人协商不能就变更本合同内容达成协议的。

第二十一条 有下列情形之一的，甲方应提前十五天以书面形式通知乙方解除合同：

(一)合同期满因各种原因不再续聘乙方的;

(二)甲方无法按合同约定支付乙方劳动报酬的;

第二十二条 有下列情形之一的，乙方必须提前十五天以书面形式通知甲方解除合同：

(一)在试用期内的;

(二)甲方未按合同约定支付劳动报酬的;

(三)合同期满不再与甲方续签合同的。

第二十三条 甲方在试用期内解除合同的，应根据乙方实际工作时间按约定的试用期工资标准向乙方支付工资(因乙方重大违纪被甲方开除的除外)。

第二十四条 乙方在甲方工作(含试用期)十日以内(含十日)离职(含自行离职或甲方解聘)的，视为乙方自动放弃享受期间工资待遇。

第二十五条 乙方在合同期未满，未提前三十天以书面形式通知甲方要求解除聘用合同而离职的，不可享受经济补偿，为此造成甲方的经济损失从乙方劳动报酬中扣除，造成重大损失的将通过仲裁部门予以解决补偿。离职日期以甲方聘用新人员续接工作为准但不得超过三十天，强行离职者视自愿放弃各项报酬。

第二十六条 乙方离职应填写离职申请表，结算工资后本合同自动终止，双方不得追究相关经济和法律责任。

六、解除合同的经济补偿

第二十七条 符合第十九条、第二十条解除合同情形的相关经济补偿按《中华人民共和国劳动合同法》的规定及相关法律法规执行。符合第十七条解除合同的情况甲方有权视事件或影响的大小追究乙方刑事或经济责任，甲方无需给予乙方任何经济方面的补偿与赔偿。

第二十八条 甲方为乙方提供专项培训费用，对其进行专业技术培训的，乙方必须在甲方工作一学年，甲方每月从乙方月薪中提取 元作为协议服务期保证金;工作期满，甲方根据乙方服务期内综合考评，予以返还。如乙方终止合同或被甲方解除劳动合同，该保证金不予返还。甲方与乙方约定服务期的，不影响按照正常的工资调整机制调整乙方在服务期期间的劳动报酬。

第二十九条 乙方在合同期内除死亡、重伤(病)(需由县级以上医院证明材料)外单方面终止合同的，应归还合同期内甲方为其缴纳的全部保险金额。

第三十条 除被主管部门裁定破产以外，甲方不得无正当理由终止与乙方的劳动合同，否则应给予乙方5000元经济补偿;乙方在合同期内除死亡、重伤(病)(需由县级以上医院证明材料)外不得单方面终止合同，否则应给予甲方3000元经济补偿且不享受终止合同的当月

工资。

七、争议处理

第三十一条 甲乙双方因履行本合同发生争议，当事人应平等协商解决;不愿协商或协商不成的，可以按相关法律法规申请仲裁或提起诉讼。

八、附则

第三十二条 本聘用合同一式两份，由甲乙双方签字盖章后生效，甲乙双方各执一份。

3、乙方严重违反纪律或规章制度，不能胜任工作、不称职或严重影响幼儿园声誉的，甲方可以随时解除合同；甲方以非法手段强迫劳动或不能按照本合同规定支付劳动报酬，乙方可随时通知甲方解除合同；在本合同有效期内，经甲、乙双方协商一致，本合同可以解除。如乙方不再续签，需提前一个月以书面形式通知甲方。

4、乙方在提出辞职一个月内，未经甲方同意对工作不负责，造成影响者，乙方要赔偿甲方的损失（数额为乙方当月的实得工资）。乙方以任何方式外泄本园机密、重要文件、资料和教材以及本园技术手段的，需赔偿损失。

5、乙方的劳保福利保险已在工资及奖金中对兑个人，甲方不再额外支付。

1.甲方根据本幼儿园工作需要，安排乙方从事----------工作。乙方严格遵守幼儿园的各项规章制度，按时、按质、按量完成其本职工作，忠实饯行《教师法》、《教育法》等法律法规，为人师表、率先垂范。因乙方有工作失职，不能胜任，不服从学校安排，与同事、不能和学生和睦相处，教学质量低下等不利于幼儿园工作的现象，学校有权中途解聘并酌情扣除其未发款项，特殊严重者要依法追究相关法律责任。乙方在工作期间首先树立“安全第一”的思想意识，如因失职、失误造成幼儿在园发生不安全事故，甲方承担经济损失的30%，乙方承担70%。

3.乙方在聘期内未经幼儿园允许（或解聘）不得随意辞职外流、学习、离岗等，否则扣除其押金及所有未发款项，同时因此给幼儿园造成严重损失者要依法追究相关法律责任。

4乙方在本园外（如往返路途中）所发生的一切事故，甲方不付任何责任，由乙方自行承担。

5.乙方在聘期被本园解聘或经本园允许主动辞职，次协议自解聘之日起无效.

6.甲方在工作每月10日前发放上月工资及奖金。

7。乙方聘期已满位续聘并交清各种财物，甲方将乙方押金、工资、奖金一律照发，否则酌情处理。
