七、劳动合同的解除

（一）经甲乙双方协商一致劳动合同可以解除。任何一方中途解除劳动合同应提前一个月以书面形式通知对方，否则视为违约。

（二）乙方有下列情形之一的，甲方可以解除劳动合同，属2、3两种情况者不返还保证金；

1、严重违反劳动纪律或者甲方规章制度的；

2、严重失职、营私舞弊，对甲方利益造成重大损害的；

3、被依法追究刑事责任或被劳动教养的。

（三）有下列情形之一的，甲方可以解除劳动合同，但是应当提前通知乙方：

1、乙方患病或非因工负伤，医疗期满后不能从事原工作也不能从事用人单位另行安排的工作的；

2、乙方不能胜任工作，经培训或调整工作岗位仍不能胜任的；

3、劳动合同订立时所依据的客观情况发生重大变化，致使原劳动合同无法履行，经当事人双方协商不能就变更劳动合同达成协议的。

（四）甲方符合裁员条件裁减人员的可以解除劳动合同。

（五）有下列情形之一的，乙方可随时通知甲方解除劳动合同：

1、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的；

2、甲方未按本合同约定支付劳动报酬或提供劳动条件的。

八、违反劳动合同的责任

违约责任：若甲方违约，甲方将以乙方工资按月赔偿乙方，若乙方违约，甲方将不发放工资。

九、本合同依法订立，即具有法律约束力，双方必须履行。

Reasons for taking postgraduate exams：

First of all, I love my major. Chinese literature is the symbol of the start of Chinese literary modernization. It plays an important part in modernization of our citizens‘ thoughts. What’s more, modern literature is very close to our daily life and it can deeply reflect the styles and features of our society. I am fascinated by the great masters‘ refreshing or warm or profound styles as well. But I am not easily satisfied with such superficial knowledge. I hope I could have a better understanding in modern literature by studying further. This is a very important reason for me to take the postgraduate exams.

Next, I love the feeling in the university. It is full of youthful spirit. And I am deeply attracted by the scholarly atmosphere. And the most important, it‘s my great honor to open my ears to your teaching.

教师职责：

1、负责本班教育和保育工作，结合本班实际，制定班级工作计划、教育教学活动计划，并认真执行，定期向园长做工作汇报;

2、服从园长的安排，发扬团队精神，积极主动，与本班教师团结合作，确实做好本园教育、保育及生活护理等工作;

3、对幼儿态度和蔼可亲，做到爱心、耐心、关心、热心、细心;随时维护幼儿在园所内之健康与安全及辅导幼儿之身心发展与个别差异;

4、严格执行幼儿园作息制度，认真安排好幼儿一日生活，做到动静交替，手脑并用，确保幼儿户外活动时间及游戏时间;

5、培养幼儿良好的行为习惯，使幼儿身心健康成长;

6、做好家访工作，保持经常与家长联系，落实与家长双向沟通，了解幼儿与家长的需求，指导家长科学育儿。每周向家长公布本周及下周教育内容，使“优质教育、愉快教学、健康成长”等得到充分体现;

7、坚持正面教育原则，尊重幼儿，积极启发诱导，严禁体罚和变相体罚;

8、作好交接班工作，对家长要求、物品要登记交接;

9、认真学习，努力钻研业务，积极参加教研活动及业务学习，积极创编教材，制作教具，不断写出教育教学论文，提高自身素质和业务水平;

10.园内举办的各型活动之准备与执行等各项工作;

11.其他上级支付之任务。

劳动纪律、奖励与处罚

1、必须遵守国家法律、法规;

2、必须按国家教委有关规定，实施教育教学工作;

3、甲方有权按国家政策制定管理本园的规章制度，并对违反行为进行处罚;

4、乙方应遵守本园的规章制度及工作时间，不得擅自离开工作岗位;

5、甲方对工作中确有成绩或违反纪律者，将按程序予以奖励与处罚(详见《园务制度》)。

聘用合同的解除与终止

1、聘用期间乙方触犯法律经判刑、服刑的本合同将自行终止;

2、聘用期间乙方未经甲方允许，不得擅自受聘其他与本园工作时间有冲突的工作，如违犯者视作违约行为，合同解除;

3、在聘用期内，如果乙方违反国家法律法规、国家教委的有关规定，或严重违反本园的《园务制度》，或在家长中反响不良，或教育质量严重下滑，教学成绩不佳的情况，甲方有权在聘用期内解聘乙方;

4、(因行业特性，教师不得在学期中途提出解除合同)乙方需提出解除合同，应在学期结束前一月提出。

本合同一式二份，甲乙双方各一份，经双方签字后生效，两份合同具有同等效力;
