根据《中华人民共和国民法典》、《中华人民共和国劳动合同法》、《保安服务管理条例》等有关法律、法规，本着诚实守信、平等互利的原则，甲乙双方经友好协商，就甲方聘请乙方提供保安服务事项达成以下一致意见。

一、保安服务内容

乙方向甲方提供保安服务，并按照甲方的管理模式对保安队员进行管理，根据双方确认的岗位职责要求，执行安全防范任务，承担相应的保安服务责任。

二、保安员数量、服务期限

1、甲方共聘用保安人员________名，其中保安队长________名，保安班长________名，保安员________名，全部由乙方提供。

2、服务期限：自________年____月____日起至________年____月____日止。

三、酬金、付款办法

1、甲方向乙方交付有偿保安服务费为：保安人员________元月人，每月合计

四、保安员的管理

1、保安员由甲乙双方实行双重领导，根据任务需要双方共同研究部署保安力量。

2、甲乙双方共同负责保安员的业务、技术、政治思想教育及日常行政管理工作。

3、按《劳动法》规定保安员每天工作时间不超八小时，每周工作时间不超过40小时，每人每周休息二天。因甲方工作需要加班时，乙方保安员应给予积极配合，但甲方须按《劳动法》有关规定支付加班费给保安员。

4、保安员在护卫范围内因工作致伤、致残、致死和遭遇不测时，由乙方按社保局有关规定处理。但甲方应本着人道主义精神对保安员给予精神和经济上的补偿。

5、保安员须服从辖区派出所领导和指挥以及业务上的指导。

6、在符合国家法律法规的前提下，保安员应当遵守和执行甲方的各项规章制度。

五、甲方的权利和义务

1、甲方有权对保安员的各项工作进行监督、检查和具体指导，有权对工作不合格保安员提出处理意见。

2、甲方可根据本单位工作实际和需要为保安员配备所需的场内通讯器材。

3、甲方要建立健全三防等各种安全防范措施和规章制度，以便于保安员依章执行，同时应教育本单位全体员工认真执行安全防范规定和支持配合保安员的工作。

4、甲方不得未经乙方同意录用乙方员工。否则，应视为甲方违约，承担违约责任。违约方应支付给对方违约金为合同有效期内全部保安服务费总额的________%。

5、若甲方实际经营权、所有权进行转让、买卖、移交的，应将实际情况提前________个月通知乙方，因甲方未及时通知而造成乙方经济损失的，甲方承担赔偿责任。

6、甲方须按时支付保安服务费。

六、乙方的权利和义务

1、乙方所派出的保安员必须具备政治思想良好(无犯罪前科)、文化素质较高(初中以上)、仪表端庄、身材高大(男1.70米以上，女1.60米以上)工作责任心强等条件。

2、乙方负责保安员的工资、证件、业务培训、组织管理、工伤保险等福利待遇，并按规定发放保安员的工作服装。

3、原则上，甲方不得安排乙方保安员从事护卫范围外或超越保安职权的工作。若违反，甲方负责承担一切法律责任和经济风险。

4、因工作需要，乙方有权调换保安员，有权辞退不合格的保安员，但必须提前知会甲方。

5、在合同签订时，如甲方存在经济纠纷或劳动争议(仲裁)事项，应当在合同签订前将详细情况明确告知乙方。否则，乙方有权随时解除合同，并保留向甲方追究违约责任的权利。

七、违约责任

1、双方在履行本协议过程中，如因任何一方未履行自身义务而造成合同无法继续履行的视为违约。违约方应支付给对方违约金为合同有效期内全部保安服务费总额的________%。

2、合同期内双方均不得擅自中止或解除本合同，确需中止或解除的，须提前________个月通知对方，并向对方支付________个月服务费作为损失赔偿。

3、甲方未依本合同规定按时履行付款义务，并且逾期超过________天的，乙方有权提前解除合同，并保留向甲方追究违约责任的权利。

4、合同履行期间，在保安员工作时间、能力和职责管理范围内发生责任事故，经部门侦查终结并认定确属保安员失职造成的，由乙方承担相应责任。以下情况乙方不承担任何责任或部分责任：

(1)甲方债务民事纠纷、甲方盘点发现的短少、无明显盗窃痕迹的被盗事故、犯罪分子持械公然抢劫、甲方工作人员自盗，或发生被盗事故，被盗物品为现金、古董、有价证券、金银首饰、珠宝、收藏品、私人财物、个人可随身携带的物品、智力成果和知识产权的，乙方不承担赔偿责任。

(2)由不可抗力给甲方造成的经济损失和人身伤害，乙方不承担任何责任。但乙方应配合甲方尽力采取补救措施，避免损失进一步扩大。不可抗力包括但不限于地震、雷击、水灾、泥石流等自然灾害，战争、社会暴乱等意外事件，或国家法律法规和政策的调整等。

(3)甲方财务部门的库存现金额度应当符合国务院《现金管理暂行条例》及相关法律法规的规定。如库存现金数额超过核定的库存现金限额或数额较大时，甲方应另行委派专人值守。

(4)合同履行期间，乙方发现护卫范围内存在人力不足或其它安全隐患，甲方应给予足够重视并及时消除。如乙方已经以书面提出且工作中已尽到勤勉审慎之义务，因甲方未及时消除安全隐患而发生安全责任事故，乙方不承担任何责任。

(5)责任归属未查清之前，双方仍应按本合同规定忠实履行各自义务，任何一方因此擅自变更、中止或解除本合同的均视为违约，违约方应当承担违约责任。因不可抗力造成合同不能继续履行时，双方均可协商变更、中止或解除合同。

(6)在合同履行期间，如发生责任事故乙方需要保险理赔时，甲方应积极协助并于事故发生的________个工作日内出具保险理赔所需的各类证明资料。如因甲方过错而导致理赔不成，该部分损失或风险应由甲方自行承担，乙方仅补偿应赔偿甲方损失中超过保险赔偿的部分。

八、解决争议的办法

双方发生争议，应先协商解决，如协商不成或不愿协商时向甲方所在地人民提请诉讼。

九、其他

1、合同未尽事宜，双方可协商做出补充协议。

甲乙双方根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》等法律及法规规定，在平等自愿，协商一致的原则下，甲方聘用乙方为挖机驾驶员，双方定立合同如下，共同遵守。

一、聘用时间和待遇：

1、聘用时间从 ______年 ______月______日至 ______年 ______月______日止。

2、甲方按 以货币形式支付乙方工资，工资为____________元整( )。工资以___________月为一个结算周期。

3、聘用期间，每天按工作8至10小时为准，超出时间按加班核算工资。

二、乙方工作职责：

1、乙方负责型号为 的挖掘机驾驶工作。

2、聘用期间内，乙方应自觉遵守甲方的各项安全规章制度，服从甲方的安全监督，检查和管理，安全驾驶，文明服务。

3、乙方必须持有挖机操作证。牢固树立安全意识，精通驾驶业务，按时，按质，按量完成任务，并努力做到尽量节约油耗，降低挖机维修保养成本。

4、遵纪守法，按时上班，工作时间不擅自离开工作岗位，保证一天24小时开通通讯工具，如因联络阻碍，导致未能及时上班扣除当日 倍工资。

5、如遇特殊情况，乙方不能按时上班必须征得甲方同意并自行找有挖机驾驶资质的人员到现场代替作业，工资有乙方支付。

6、工作积极主动，服从调度，遵守甲方其他各项规章制度。

7、严格遵守挖机操作规程，文明驾驶。工作时间内如因乙方违反挖机操作规程引起的责任，造成的损失由乙方自行承担。不开带“病”车，不疲劳驾驶，严禁利用挖机或挖机擅自借给他人驾驶或从事违法违纪活动。

8、乙方不得将甲方挖机借给其他驾驶员驾驶，且发生油耗，损坏，丢失和安全事故由乙方承担。乙方应定时保养挖机，如每天工作结束时加注黄油，定时换机油，检查挖机各项性能等，保持挖机容貌整洁。

9、聘用期间，乙方不得擅自离开或为他人开挖机。

三、乙方安全驾驶责任

1、必须树立“安全第一，预防为主”的思想，遵章守纪，积极参加租赁方提供的安全教育学习活动，并积极参加，配合租赁方的安全检查和监督，服从甲方和租赁方的管理。

2、确保挖机作业状况良好，严格遵守驾驶安全操作规程，积极配合甲方做好挖机每天工作前，工作结束后的检查保养工作和安全停放，保证挖机不带病作业，发现事故隐患应及时联系甲方予以解决。

3、保持充沛精力投入工作，不疲劳工作。不将挖机叫给他人驾驶。

4、积极配合甲方和租赁方做好其他各项安全工作。

5、聘用期间，乙方是该挖机安全的第一责任人，挖机如发生大小安全责任事故，其责任和一切经济损失{除保险公司索赔外}，由甲.乙双方协调赔偿。

四、甲方的责任.权利

1、合同期间，甲方为乙方提供吃住。

2、甲方按时发放工资，不得随意拖欠.扣发驾驶员工资，如因乙方的原因造成安全事故需要扣发工资的，应向乙方解释清楚。

3、乙方工作期间如出现下列情况，甲方有权解除合同。

A、乙方不完成工作任务.违反租赁方有关管理制度，经甲方和租赁方认定的;

B、驾驶员因家庭.健康原因不能胜任岗位的;

C、甲方车辆因故决定停用或出售.报废的;甲方应支付满乙方当月的工资;

D、订立协议的客观情况发生重大变化，经当事人协商不能变更协议达成协议的; E、连续旷工时间超过2天或一______年内累计旷工时间超过15天的;连续请假超过31天或请假超过一周达3次以上的;

F、无理取闹.打价斗殴.恐吓威胁甲方领导.严重影响工作秩序和社会秩序的。

六、协议的执行和解除。

聘用协议签订后，甲.乙双方必须全面履行协议规定的义务，任何一方不得擅自变更合同。确需变更的，双方应协商一致，并按原协议程序办理。双方未达成一致意见的，原协议效力不变。

七、协议期限届满，聘用协议终止。早本协议期满前三十日甲方向乙方表明终止或许订意向，经双方协商同意续订聘用协议。

八、本协议一式两份，甲、乙双方各执一份，经双方签字后生效。
