(5)擅自移动、损坏林业标志和林区工程设施;

(6)非法征占用、擅自改变林地用途;

(7)乱埋散坟;

(8)森林防火期内在林区未经批准野外用火;

(9)捕猎野生动物;

(10)盗伐、滥伐林木。

2、对乙方提供的案情，依法律程序，按有关规定进行及时处理。

3、甲方负责对乙方进行考核，对乙方不能履行合同，造成下列后果的，甲方可解除对乙方的聘任。

(1)因玩忽职守，不履行管理职责，造成本责任区森林资源损失的;

(2)对盗伐和滥伐林木行为不制止、不报告，致使森林资源遭受损失的;

(3)擅自同意单位或个人进入林区施工、放牧、埋葬新坟，或不制止、不报告，造成林地破坏的;

(4)对本责任区存在的森林火灾隐患，不报告又不采取措施消除，导致森林火灾发生的;

(5)以权谋私，监守自盗，弄虚作假，致使森林资源遭受损失的;

(6)违反或不履行合同，甲方提出警告仍不改正的;

(7)在履行协议期间，有违法违纪行为的。

(二)乙方职责和权利

1、对毁坏林地、林木进行开垦、采石、采砂、挖土和以营利为目的采搂枯枝落叶破坏土壤覆盖层;在新植未成林地、幼林地、特种用途林内和封山育林区内砍柴、放牧、放蚕;扒剥活树皮、挖掘活树根;进入有林地区采集种子、药材和山货野果;未经批准进入林区以营利为目的采集、收购树枝、树叶和珍贵林木种子;擅自移动、损坏林业标志和林区工程设施;非法征占用、擅自改变林地用途;乱埋散坟;森林防火期内在林区未经批准野外用火;捕猎野生动物;盗伐、滥伐林木等行为要及时制止，并直接向乡(镇)、街道林业站和森林公安机关报告;

2、发现林火要及时组织扑救，并在第一时间内向当地政府及有关部门报告;

3、做好森林病虫害疫情监测，及时向森防部门报告森林病虫害情况;

4、积极配合森林公安机关做好各类林业案件的侦破工作;

5、积极协助林业主管部门做好林业法规的宣传工作;

6、接受、服从甲方等上级机关对护林情况的检查。

甲方依据考核结果，应及时向乙方支付补助费，若未按规定及时支付护林员补助费，乙方有权通过法律程序解决。

四、护林员报酬

甲方根据乙方对管护区域内林地管护情况，依据考核结果，按季付给乙方护林补助费，其中：最后一季度补助费在年终检查后兑付。

按本合同书规定的检查内容，经检查在乙方管护责任区内，若存在下列问题的，按一定比例相应扣减乙方最后一季度补助费：

1、存在毁坏林地、林木进行开垦、采石、采砂、挖土和以营利为目的采搂枯枝落叶破坏土壤覆盖层的，扣减15%补助费;

2、存在在新植未成林地、幼林地、特种用途林内和封山育林区内砍柴、放牧、放蚕的，扣减5%补助费;

3、存在扒剥活树皮、挖掘活树根的，扣减5%补助费;

4、存在进入有林地区采集种子、药材和山货野果的，未经批准进入林区以营利为目的采集、收购树枝、树叶和珍贵林木种子的，扣减5%补助费;

5、存在擅自移动、损坏林业标志和林区工程设施的，扣减5%补助费;

6、存在非法征占用、擅自改变林地用途的，扣减50%补助费;

7、存在新建散坟，没有及时报告的，扣减10%补助费;

8、存在森林防火期内在林区未经批准野外用火的，扣减10%补助费;

9、存在捕猎野生动物的，扣减30%补助费;

10、存在盗伐、滥伐林木的，扣减40%补助费。

五、本合同自双方签字之日起生效。

六、合同自签字之日起满一年，双方便终止合同。

七、本合同一式三份，甲乙双方及林权所有者各持一份。

八、本合同未尽事宜，以及在履行合同中发生的争议问题，双方协商解决，协商不能解决的，按照有关法律、行政法规执行。

根据《中华人民共和国民法通则》、《中华人民共和国合同法》和有关规定，甲乙双方作为平等的民事主体，经协商一致，确立劳务合作关系，自愿就具体劳务内容签订本合同，以便双方共同遵守。

一、合同期限

第一条 双方是建立在地位平等，协商一致的前提下，就劳务事项达成的劳务协议，双方仅仅是劳务合作关系，非雇佣关系。本劳务合同期限为______(大写)年，于______年______月______日至______年______月______日终止。合作期届满，双方不再具有任何法律关系，但乙方享有优先继续合作的权利。

二、工作任务

第二条 乙方负责牌号为 的汽车驾驶工作。

第三条 乙方应爱惜公司的车辆,注意车辆的平时保养,经常检查车辆的主要机件。每周实施定期检查及保养,以维护机件的寿命,确保行车安全。

第四条 乙方应每天清理所驾车辆,以保持车辆的清洁(包括车内、车外和引擎的清洁)。

第五条 出车前,要例行检查车辆的水、电、油、车灯、刹车系统、轮胎及其它部件的性能是否正常;发现不正常时,要立即加补或维修。出车回来,要检查存油量,发现存油不足一格时,应立即加油。

第六条 乙方发现所驾车辆有故障时，要立即检修;不能自行检修的,应立即报告总经理,提出具体的维修意见(包括维修项目和大致需要的经费等)。

第七条 乙方对所驾车辆的各种证件的有效性应经常检查,出车时一定保证证件齐全。

三、工作时间

第八条 因工作性质特殊，乙方需机动作业。经双方协商同意，乙方实行不定时工作制。

四、劳动报酬

第九条 甲方按月以货币形式支付乙方工资，月工资为 元。其中试用期间工资为 元。

第十条 工资发放时间为次月10日，遇节假日顺延或提前。

五、劳动纪律及奖惩

第十一条 不得出车时才临时去加油。

第十二条 未经批准,不许私自将车辆送厂维修。

第十三条 出车在外或出车归来停放车辆,一定要注意选取停放地点和位置,不能在“不准停车的路段”或“危险地段”停车。司机离开车辆时,要锁好保险锁,防止车辆被盗。

第十四条 乙方在晚间要注意休息,不准开疲劳车。严禁酒后驾车。

第十五条 乙方驾车一定要遵守交通规则,文明开车,不准危险驾车(包括超速、爬头、紧跟、争道、赛车等)。

第十六条 乙方因违章或证件不全被罚款的,费用不予报销;如属用车人执意所为,则由司机和用车人共同负担。

因乙方违章导致的赔偿费用超过保险公司理赔金额的部分,由乙方自行承担，因违章造成的其它后果概由乙方自行负责。

第十七条 上班时间内司机未被派出车的,应在公司随时等候出车,不得擅自外出;出车回来,应立即向甲方报到。

第十八条 乙方必须保持电话畅通,随时与甲方保持联络。

第十九条 下班后,应将车辆停放适当地点保管,不准私自用车。

第二十条 乙方未经甲方领导批准,不得将所驾车辆交给他人驾驶或练习驾驶;严禁将车辆交给无证人员驾驶。任何人不得利用公司车辆学开车。

第二十一条 乙方假如患病、因事不能提供服务，必须提前向甲方请假，否则甲方有权向乙方追偿损失。休假期间未能向甲方提供服务的，甲方免于支付相应天数的服务费。

第二十二条 乙方在工作中有突出贡献的，甲方可根据实际情况给予奖励。

第二十三条 乙方全年安全无事故的，甲方可奖励乙方 元。

六、保密协议

第二十四条 乙方负有保守甲方商业秘密的义务。商业秘密是指：甲方未公开的财务数据资料;甲方的所有客户信息;甲方未公开进行中或计划谈判的投资项目信息及资料;甲方相关科研项目信息;甲方技术配方、技术秘密的信息及资料;因乙方劳务范围知悉的能给甲方带来经济利益的信息及资料、甲方所有其他的非为业内同行所知悉的信息及资料等。包括但不仅限于包括客户名单、行销计划、采购资料、定价政策、财务资料、进货渠道、技术方案、工程设计、电路设计、制造方法、配方、工艺流程、技术指标、计算机软件、数据库、研究开发记录、技术报告、检测报告、实验数据、实验结果、图纸、样品、样机、模型、模具、操作手册、技术文档、相关的函电等等。

除了劳务需要或经过甲方书面同意，乙方不得擅自利用、让他人利用或对他人泄露商业秘密，如果使用、发表、泄露有关甲方商业秘密将使甲方的业务及声誉受到损害，乙方在劳务合作期间，应尽其最大努力避免此种情况发生。此种保密要求不受时间限制;只有法庭判定应当公开的信息或甲方已经通过纸质媒体公开该信息。乙方违反保守商业秘密事项，给甲方造成经济损失的，乙方应依法承担经济赔偿责任，甲方保留进一步追究乙方相关法律责任的权利。

七、本合同的变更、解除和终止、续订

第二十五条 本合同经甲、乙双方协商一致可以解除。

第二十六条 有下列情形之一的，甲方可与乙方提前解除本劳动合同：

1、在试用期间，乙方被证明不符合录用条件的;

2、乙方被开除、除名、劳动教养或被依法追究刑事责任的;

3、乙方不履行甲方规定义务的;

4、本劳动合同订立时所依据的客观情况发生重大变化，致使本劳动合同无法履行，经当事人协商不能就变更合同达成协议的;

5、甲方按国家法律规定宣布破产、濒临破产处于法定整顿期间或者生产经营状况发生严重困难，无法安排乙方工作的。

第二十七条 乙方解除本合同，应提前十日以书面形式通知甲方。

第二十八条 本合同期限届满三十日内，甲、乙双方应将终止或续订本合 同的意向以书面形式通知对方。如双方都有续订合同的意向，经双方协商一致， 可以续订劳动合同。

第二十九条 本合同期满，甲、乙双方即终止劳动关系，办理有关手续。当事人愿意续订合同的，经双方协商同意，在本合同期满前办理续订手续。

第三十条 本合同生效后，甲、乙双方必须全面履行本合同约定的义务。当事人擅自解除劳动合同，给对方造成经济损失的，依法承担赔偿责任。

第三十一条 因履行合同发生劳动争议，当事人应当在劳动争议发生之日起六十天内，以书面形式向甲方所在地劳动争议仲裁委员会申请仲裁或依法提起诉讼。

第三十二条 本合同一式两份，甲、乙双方各执一份。

第三十三条 本合同自双方签订之日起生效。

本学期是我们幼儿园成立5年的一个阶段，也是借助这样的一个阶段，我们会更多的去努力做些总结与思考。本学期我们英语组以“提高老师和幼儿英语表达能力”为总目标，有计划有策略性的开展本学期工作，对幼儿英语教育做更多的思考。

本学期我们根据英教部及幼儿园的工作计划，针对阳光园老师及幼儿现有的情况，特制定本学期计划如下：

一 主抓教研，让教研充满活力又行之有效。

根据幼儿年龄阶段特点，我们鼓励大家自主研究的同时，也列出列各个级部教研的重点：

1大班：英语的幼小衔接

A 提高幼儿一日生活用语，老师通过一日生活的各个环节提高幼儿语言的表达和应用能力。

B 以句子的教学为重点研究对象，提高幼儿造句和运用句子的能力。

C 充分利用英语故事表演对幼儿的吸引，提高幼儿英语口语发展水平和幼儿自主表现力。

D 通过参加英语风采我们感觉到大班幼儿更需要的是看图说话的能力。

2中班：

A 进行词汇与句子的积累，为升入大班做充分的准备

B 英语视听环境对幼儿口语的良好渗透作用。

C 利用英语故事，激发幼儿表现表演的兴趣

D 句型教学也将成为中班的教学重点

3小班小小班：

小班小小班的英语尤为重要，因为对于孩子3-6岁是语言学习的关键期，只要方法的当，孩子们不会象我们想象的那样对英语恐惧，反而面对一种新生语言，他们非常的好奇，学会了就非常乐意的表达。所以小班要努力培养幼儿的兴趣，提高幼儿对英语的感知能力。

A 小小班小班中语言(单词与简单的句型)和歌曲、童谣教授得方法。

B 英语视听环境的创造对幼儿英语表达能力的促进。

而顺利完成各年龄段的目标，需要的不仅仅是努力，更是我们有效的方法和正确的引导方式，我们可能都是英语的大学生，又通过了四六级的考试等等，但一方面我们已经捡不起大学的水平，另一方面，我们需要更多的新的方法和技巧来填充我们的英语教育， 所以，我们迫切的需要成长，需要提高，那如何提高呢?
