3. 出现以下情况可免除乙方责任且不影响本合同履行：____________

纵观历史，大凡获得成功的人，都是一些良好行为长期坚持，养成习惯，形成自然。我国近代大文豪鲁迅从小就养成不迟到的习惯，他要求自己抓紧时间，时时刻刻地叮嘱自己凡事都要早做，这样长时间地坚持下去，就成了习惯了。后来，鲁迅在中国以至世界文学史上留下了辉煌的业绩。可见，行为习惯对一个人各方面的素质起了决定性的作用，对我们中学生来讲，尤为重要。就拿与我们密切相关的学习来说吧。我们经常看到这样的现象，有些同学平时不刻苦、不用功，在考试时常常左顾右盼。请同学们想一想，你是这样的吗?我们还看到，有些同学双休日只顾玩，把作业积压到一定程度才地去做，急功近利怎么能把学习搞好呢，也请同学们回忆一下，昨天晚上你有没有忙着赶作业，甚至今天早上来学校交不出作业。其实，这完全是学习习惯和方法的问题。大家都知道，一个好的、科学的学习习惯和方法，能使我们既学得有效率，又学得轻松自在。因此，我们在学习中生活时，要养成一个良好的习惯;良好的习惯会使你终身受益!

出租车承包经营合同书

甲、 乙双方协商就乙方承包甲方出租车___经营出租业务达成以下协议：

(一) 甲方提供出租车___保证证件齐全，正常营运中。

(二) 乙方在营运中要遵守国家相关法律、法规，守法经营，如有违章、停运、罚款等违反规定的行为，由乙方负全部责任并承担相应罚款;如有吊销经营手续，乙方按照市场价赔偿甲方。

(三) 乙方必须在每年1月1日前购买全车保险，如：交强险、商业险(现阶段商业险不能低于30万元，以后根据公司要求递增)甲方每年检查保险购买情况，禁止无保险营运。车辆到期乙方交甲方车时，乙方商业保险退回标准以保险公司退回标准为准，强险不退。如在营运中，造成重大伤亡事故，车勋由乙方负全部责任，如有一方造成伤残，由乙方负全部责任，与甲方无关。

(四) 乙方在营运过程中，发生的一切费用由乙方承担，如：修车、车体保养、年审、季审、气瓶审验、计价器、税收、公司费用等。乙方必须对随车证件按时审验，不能拖审。

(五) 出租车___年租金根据市场价格，每一年浮动一次，以市场中间价为准，具体价格协商确定后，在该协议上签字认可。 年 月 日开始，年租金x万x仟x佰元整，乙方每月一号交甲方x仟x百元整，打入甲方指定账户。

(六) 包车押金x万元整，乙方一次性付给甲方，甲方出具押金条为证。如有国家下发燃油补贴，归甲方所有(包括推迟下发的补贴)，___x年开始，在出租车承包期间燃油补贴按实发金额，甲方三分之一、乙方三分之二。

(七) 双方签订协议起，甲方将___x出租车及随车证件交给乙方保管(证件包括：行驶证、营运证、二级维护卡、道路运输许可证副本、附加费证、计价器证卡、气瓶使用许可证、加气卡)，如有丢失，由乙方负责补办并承担相关费用。

(八) 乙方在包车期间，如果经常出现不利于出租车营运的情况(违反法律法规、交通法规、出现交通事故等)，所产生的结果由乙方承担全部责任，甲方有权立即终止包车协议并收回出租车及全部证件。

(九) 租车时间___x年___x月 日至___x年xx月xx日(本车强制报废时间)需要提前更新车辆时提前四个月结束该协议。在营运中如有变动，甲方提出卖车，乙方主动交出车辆及随车证件，甲方退回押金，终止协议。如乙方违约，提前结束包车协议，甲方不退押金。

(十) 以上条款甲乙双方信守协议，如有违背，甲方有权收回车辆，乙方有权不交租金。其他未尽事宜由甲乙双方协商解决。
