8.2 租赁期内甲方不得收回出租房屋(除非本合同另有规定)，甲方保证乙方可不受干扰的享用该物业。

8.3 在乙方遵守本合同的条款及支付租金的前提下，乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。

九、乙方的责任：

9.2 乙方应爱护使用出租房屋，如因乙方的过失或过错致使房屋设施及屋内用具和饰品受到损坏(正常损耗除外)，乙方应负赔偿责任。

十、违约处理：

十一、适用法律：

第一、认识本位，勤于服务

众所周知，办公室是综合部门，是领导工作和机关工作的参谋部门与服务部门。在整个企业中处于承上启下、服务左右、应酬各方的枢纽地位和中心位置。我认为，办公室是服务部门，应该做好三项服务工作：

一、为领导服务。当然不是狭义上的为领导的个人服务，而是指为领导的工作服务，为领导的思想和决策服务，当好部门主管的助手，当好公司高层领导的参谋。

二、为各部室服务。办公室在传达上级指示，在贯彻领导旨意或在催办、督办时，要从团结科室或班组，共同做好工作的良好愿望出发，要充分尊重每个职务角色的重要性，体现平等的原则。如果遇到困难，要学会换位思考，置身于别人的角度思考问题，共同研究，以达成解决问题的共识。

第二、只求所得，不求所有

有人说，办公室工作可用八个字概括，即："参与政务，管理事务"，形象地说是"上管天文地理、下管鸡毛蒜皮"。具体一点，参与政务是指参加领导对重大问题的讨论和决策;管理事务是指管理环境卫生，组织参加各种社会公益活动等。的确，办公室的工作是苦、是累、是默默无闻!每天埋头于琐碎小事，风光与荣誉总擦身而过。"台下十年功，台上一分钟"，深夜的伏案写作，常常只换取匆匆一瞥。因而，树立正确的义利观对办公室工作很重要。我想，作为办公室的一员应该多牺牲一点个人利益，用孔总的话说，就是"只求所得，不求所有"。"先天下之忧而忧，后天下之乐而乐"是仁人志士的追求，更应该是办公室人员的人生旅程。

第三、精诚合作，追求完美

办公室作为公司的文书部门，要经常起草大量文稿、传达上级指示和本单位意图。无论是起草领导发言稿，还是撰写年度计划或总结，需要办公室群体的通力合作。要充分发挥个人的聪明才智，仅凭个人奋斗是难以生存的，只有自然地融入集体、相互协作，才能无往不胜。为了能更好地为电信的企业文化服务，办公室人员要练就过硬的写作能力、组稿能力和改稿能力，我认为要从三个方面入手：

一、 认真学习方针政策和法律法规

例如要起草一份产品购销合同，办公室主任作为合同起草的第一负责人，就必须熟读《经济合同法》、《产品质量法》和《消费者权益保护法》等相关法律。否则，凭个人的主观臆想，写出来的合同，必有疏漏之处，一旦发生纠纷，必将给企业造成损失。

二、深入实践，掌握第一手材料

毛泽东说"谁没有调查就没有发言权"，罗素也说过"要购买房子，至少要到里面看看"。调查研究，是办公室员工的一项基本职责，也是重要的工作方法。要掌握第一手资料，可采取发征询函、走专访、听汇报、开小组会等形式。只有调查研究，才能透过现象看本质，才能为领导提供真实准确的决策依据。

三、言之有物，写出高质量、高水平文章

俗语道："言之无物，行之不远"。我认为，要写出一篇观点鲜明、内容详实和妙语连珠的公文，必须有丰富的素素材作铺垫，而且要会掌握、应用生动活泼的语言，为公文润色增彩。办公室的员工要能熟练掌握先进的电脑技能和最前卫的文字编排技术，如microsoft word 、wps 、lotus 1-2-3 office pro.等，才能编排出精美别致、赏心悦目、丰富多彩的版式，让读者寓教于乐。为了提高表达能力、分析能力、判断能力和应变能力，我们要不断学习通讯技术、汉语文学、逻辑学、公关和哲学等书籍，以便能将具有电信专业水平、有较高文化品味和逻辑严密的好文章、好作品呈献给公司高层领导和广大干部职工。

第四、开拓进取，永无止境

随着社会文明和人类科技的进步，如何利用网络技术、internet技术和管理信息技术进行信息的采编整理、如何加速信息在企业内部的流转、如何实现企业的信息共享，以及如何加强企业的电子文档管理等等，是值得我们深思的问题。对此，我们应该开拓创新，有所为，有所不为。

一、加快办公自动化进程

电信行业是高科技行业，我们拥有其它行业不可比拟的通讯工具，如电话、传真、手机和现代的语言信箱、internet(国际互联)、intranet(企业内部网)、e-mail(电子邮件)等等，但要说真正利用在日常办公的，恐怕只有电话和传真。这个现象，就好比我们开了一家最先进的光学眼镜店，但我们的店员个个是近视眼，却依然没有配戴眼镜。不难想象，这样的眼镜店又怎能提高工作效率呢?同理，不把最新通讯技术用于现代办公实属企业的遗憾之事，因为公文处理的自动提醒，自动流转，自动归档等可使办公业务无纸化，有序化，使枯燥无味的工作变得轻松愉快。在这一点，万城公司已经作了示范--他们将几个办公室的微机通过hub(网络接线器)互联形成lan(局域网)，实现了4个办公室的打印机和公司电子文档共享。其实，这种局域网的技术是最简单不过了，购买5000~10000元的相关材料将现有的电脑相互联网，便能实现州电信分公司的电子文档与资料共享。那样，我们全州办公室工作效率将会大副度提高，同时秘书的工作将会比目前轻松至少40%。我认为，我们重视的是功劳而非苦劳，办公室工作更应力求效率、效益。

二、倡导企业文化建设

在传统管理过程中，一般比较重视人事管理、财务管理、技术管理、生产管理等职能性管理。但最新的管理理论认为，包括文化管理在内的创新管理、战略管理、知识管理等经营要素的综合性管理，才是现代管理中的重要环节。其中不少重要的学者和企业家认为，世界级著名公司之所以能较长期地保持世界领先地位，最重要原因之一是它们都有一种能吸引人、激励人和留住人的独特的企业文化。

也许有人会问："企业文化是什么?"它什么也不是。一个企业的文化看不见、摸不着，但文化无处不在，你外婆给你讲故事时其中有非常多的做人的道理，这就是文化。从某种意义上来讲，文化是土壤，人才是种子。文化是一个平台，是使有潜力、有才能的人真正发挥作用的平台。

目前，我们公司靠积极的管理创新和制度创新，已经在很大程度上摆脱了传统体制的束缚，它已具备一个现代企业的特征。然而，在机构改革、人员整合发生质的变化之后，如何调动公司员工的积极性、主动性和创造性，以及如何统一职工思想认识、增强凝聚力和战斗力可能领导们最关心的问题。我想，如何在目前的氛围中培育电信独特的企业文化，对电信的未来发展至关重要。

关于建设电信的企业文化，我认为应做到以下两点：

一、办公室应当责无旁贷地承担企业文化建设这一光荣而又艰巨的任务。我们要把信息进行全面改版，在内容和形式上作大的调整，要把它办成是引导电信员工与干部携手前进的一面旗帜，一个灯塔。《电信》应当分为内部、外部两个版本。内部版本要增加对工作有指导意义的"管理与优化"、"it(information & technology竞聘信息技术)评论"等栏目。外部版本要增加"企业管理"、"市场营销"、"通讯技术"、"电信业务"、"行业动态"等栏目。从内容方面讲，要具体而不空泛，真实而不虚假。文章要长人志气，发人深省。从技巧方面讲，可以考虑排版成彩色，力求主旨突出、图文并茂、富于新意。使之在深受读者欢迎的同时，更有收藏价值。总之，我们要把最优秀的一面展现给客户和我们的员工。实现"企业管理报刊化，报刊内容专业化"的现代管理目标。

二、向优秀的企业学习文化管理。众所周知，《华为公司基本法》是中国民营企业的第一个管理大法，而《华侨城集团宪章》是中国国有企业的第一个管理大法(康佳、锦绣中华、民俗文化村、世界之窗、欢乐谷等均属于华侨城集团的下属企业)。我想，我们也应该精心策划，起草一个《电信宪章(或基本法)》之类的企业文化纲要，以进行企业的文化整合，增强理论前瞻的导向力和作用力。

现聘用 同志(以下简称乙方)为聘用教师。

甲乙双方根据《中华人民共和国劳动法》和教育、教学工作需要，双方本着平等自愿、协商同意签定本合同。

期限为一年：自 20xx年X月X日 至 20xx年X月X日

教师职责：

1、负责本班教育和保育工作，结合本班实际，制定班级工作计划、教育教学活动计划，并认真执行，定期向园长做工作汇报;

2、服从园长及教研组长的安排，发扬团队精神，积极主动，与本班教师团结合作，确实做好本园教育、保育及生活护理等工作;

3、对幼儿态度和蔼可亲，做到爱心、耐心、关心、热心、细心;随时维护幼儿在园所内之健康与安全及辅导幼儿之身心发展与个别差异;

4、严格执行幼儿园作息制度，认真安排好幼儿一日生活，做到动静交替，手脑并用，确保幼儿户外活动时间及游戏时间;

5、培养幼儿良好的行为习惯，使幼儿身心健康成长;

6、做好家访工作，保持经常与家长联系，落实与家长双向沟通，了解幼儿与家长的需求，指导家长科学育儿。每周向家长公布本周及下周教育内容，使“优质教育、愉快教学、健康成长”等得到充分体现;

7、坚持正面教育原则，尊重幼儿，积极启发诱导，严禁体罚和变相体罚;

8、作好交接班工作，对家长要求、物品要登记交接;

9、认真学习，努力钻研业务，积极参加教研活动及业务学习，积极创编教材，制作教具，不断写出教育教学论文，提高自身素质和业务水平;

10.园内举办的各型活动之准备与执行等各项工作;

11.其他上级支付之任务。 劳动纪律、奖励与处罚

1、必须遵守国家法律、法规;

2、必须按国家教委有关规定，实施教育教学工作;

3、甲方有权按国家政策制定管理本园的规章制度，并对违反行为进行处罚;

4、乙方应遵守本园的规章制度及工作时间，不得擅自离开工作岗位;

5、甲方对工作中确有成绩或违反纪律者，将按程序予以奖励与处罚(详见《园务制度》)。

聘用合同的解除与终止

1、聘用期间乙方触犯法律经判刑、服刑的本合同将自行终止;

2、聘用期间乙方未经甲方允许，不得擅自受聘其他与本园工作时间有冲突的工作，如违犯者视作违约行为，合同解除;

3、在聘用期内，如果乙方违反国家法律法规、国家教委的有关规定，或严重违反本园的《园务制度》，或在家长中反响不良，或教育质量严重下滑，教学成绩不佳的情况，甲方有权在聘用期内解聘乙方，并需提前一个月通知乙方，按相应规定给予补偿;

4、(因行业特性，教师不得在学期中途提出解除合同)乙方需提出解除合同，应在学期结束前一月提出。

其他

1、合同如有未尽事宜，按幼儿园有关规章制度执行;

2、甲乙双方在执行过程中，意见不能达成一致时，应首先通过协商解决，如无法协商，可请上级主管部门协调解决，或向市劳动争议仲裁委员会申请仲裁，直至诉诸法律;

3、本合同一式二份，甲乙双方各一份，经双方签字后生效，两份合同具有同等效力;

6.3 在每批技术资料发运后24小时内，乙方应将合同号、空运提单号、空运报单日期、资料项目、件数、重量、航班号和预计抵达日期用电报或电传通知甲方。同时将空运提单和技术资料详细清单各一式2份寄给甲方。

6.4 若技术资料在空运中丢失、损坏、短缺，乙方应在收到甲方书面通知后30天内，免费外寄或重寄给甲方。在甲方收到技术资料后60天内，如果没有以书面形式提出资料不全或增补要求，则视为甲方验收。

第七条 考核与验收

7.1 合同产品的第一台样机，由甲、乙双方组成的联合考核小组，按附件七规定的时间和内容进行考核。如果符合附件一规定的技术要求，即可验收，并由双方代表签署合同产品考核验收合格证书一式4份，双方各执两份。

7.2 如果合同产品的技术性能达不到规定的技术标准，双方应友好协商，共同研究，分析原因，采取措施，消除缺陷，进行第二次性能考核。考核合格后，双方签署考核合格证书。

7.3 如果第一次考核不合格是乙方责任，乙方应自费再次派遣技术人员进特第二次考核。

7.4 经过第二次考核仍不能合格验收，若责任在于乙方，刚乙方须赔偿甲方遭受的直接损失。并采取措施艄除缺陷，进行第三次考核。

7.5 经过第三次考核仍不合格，如系乙方责任，则甲方有权终止合同，并接第九条的规定处理。若系甲方责任，则由双方协商合同进一步执行的问题。

第八条 技术改进

8.1 乙方提供的技术资料，如有不适合甲方生产条件的（如设计标准、原材料、外购配件及共他生产设备等一，乙方有责任帮助甲方修改技术资料，闪加以确认。在不影响合同产品性能情况下，应采用中国产的原材料、配套元器件和设备。

8.2 在合同有效期内，双方对合同产品的任何改进和创新，都免费将改进或创新的技术资料提供给对方。

8.3 改进或创新的技术所有权属于改进或创新一方，另一方不得对其申请专利或将其转让给第三者。

第九条 保证和索赔

9.1 乙方保证所提供的技术资料是乙方经过实际使用的最新技术资料，并保证向甲方及时提供任何改进和发明的技术资料。

9.2 乙方保证所提供的技术资料是完整的、正确的、清晰的，并保证按时交付。
