首先，要强化政府行为，充分发挥政府部门的主导作用，通过立法等行政手段，确保《汉语拼音正词法基本规则》及其他有关规定的顺利实施。国家有关部门有必要重申历年来已经公布的各项规定，并批示下属机构尽快纠正不规范的拼音书写。令人鼓舞的是，2000年10月31日，九届全国人大常委会第十八次会议通过了《中华人民共和国通用语言文字法》，这是我国第一部关于语言文字的专项法律，它的诞生标志着我国语言文字规范化、标准化工作正式步入法制轨道，进入一个新的时期。此法重申《汉语拼音方案》是国家通用语言文字拼写和注音的工具，是中国人名和中文文献罗马字母拼写法的统一规范。《通用语言文字法》正文中没有提到汉语拼音正词法，我们建议在以后的实施细则中加入这一部分内容，使汉语拼音书写的规范化得到法律的保障。

其次，要充分发挥学校教育对汉语拼音书写规范化的基础性作用。学校是贯彻实施国家语言文字有关规定的基本阵地，学校教育成功与否，直接关系到整个社会的语言文字使用的规范化程度。针对当前学校教育中的某些不完善之处，我们建议高校语言学教材尤其是现代汉语教材中必须要加入正词法的内容。除此之外，应该在基础教育中加入正词法内容，至于是在小学还是中学讲，讲到什么深度，还要根据学生的接受能力、学习的连贯性等因素进一步研究，在适当的阶段进行正词法教学，使学生树立起“词”意识。养成正确的书写习惯，规范地使用汉语拼音，这是普及正词法的关键一环。

语文规范化建设是我国现代化建设的基础工程之一，如果政府加强管理、学校教育填补空白，使汉语拼音正词法得以普及，就一定能大大提高语文教学水平和中文信息处理水平，有力地推动国家现代化建设的进程。

在一般情况下,向某人颁发聘任书是一件正式的、很严肃和庄重的事。颁发聘任书,意味着对某人的承认和信任。但在山东省临沂市,前不久却发生了一起企业颁发聘任书算不算签订劳动合同的争议。

企业意欲终止聘任书

刘某是某高校20xx年市场营销专业的应届毕业生,20xx年6月22日通过洽谈会应聘到一家公司。

20xx年7月1日,刘某与该公司签订了一份为期两年的聘任书。聘任书约定:聘请刘某为公司营销员,主要从事市场营销工作,月工资1200元,聘任时间自20xx年7月1日起至20xx年6月30日止。聘任书同时还约定了劳动保护、劳动纪律、违约责任等条款,明确了刘某的职责、待遇、工作期限等。聘任书盖有公司公章以及公司负责人与刘某的签字。之后,公司再未与刘某签订劳动合同。

刚毕业就找到工作而且从事所学的专业,的确是一件值得高兴的事情。然而,刘某毕竟刚刚毕业,缺乏市场实践经验,所以一直未能打开所负责地区的产品销路。

在市场竞争日益激烈、产品销路关系到企业生存的情况下,业绩不佳对任何人都不是一个好消息。

3月2日,公司新任经理找刘某谈话,宣布解除与刘某的劳动关系,要求刘某10日内办理交接手续。

员工称公司行为已违约

面对公司“10日内办理交接手续”的要求,刘某认为这是公司单方面解除劳动关系,因而应该支付违约金和经济补偿金等待遇。公司则以聘任书不是劳动合同、与刘某没有签订劳动合同、不存在劳动关系为由,拒绝支付违约金和经济补偿金等待遇。刘某与公司就聘任书是否算劳动合同、是否存在劳动关系及自己是否应该享受相关待遇争执不下。

4月6日,刘某向当地劳动争议仲裁委提出仲裁申请。刘某称,公司虽然未与自己签订劳动合同,但聘任书已经明确规定了自己的工作职责、工资待遇以及违约责任,公司在聘任书未到期的时候无故解除聘用关系,应该支付违约金和经济补偿金。刘某要求公司继续履行聘任书规定的聘用期限,按时支付聘任书中规定的待遇,或者支付单方面提前解除劳动关系违约金和经济补偿金。

该公司则辩称,当初与刘某只是签订了聘任书,并未签订书面劳动合同,双方不存在劳动关系,不需要支付经济补偿金;刘某在实际工作中未能按时完成公司交办的营销任务,直接影响公司的经济效益,应该承担由此带来的损失。因此,公司没有必要支付违约金,不追加刘某的责任已属照顾。

仲裁委受理此案后经审查认为,刘某大学毕业后应聘到公司从事市场营销工作。工作期间,刘某按照公司的安排主要从事产品推销工作。公司未与刘某签订劳动合同,但公司与刘某已经存在事实劳动关系。公司虽未与刘某签订书面劳动合同,但聘任书基本具备了劳动合同的基本内容,公司与刘某形成事实劳动关系。不签订劳动合同的责任在公司,该聘任书应视同为劳动合同。公司单方面无故解除劳动关系,应该按照国家的有关规定支付经济补偿金。刘某工作业绩一般,影响公司的经济效益,但并不是刘某主观造成的,不存在违约的事实,公司应该按照当时的约定支付单方面解聘的违约金。

5月9日,经劳动争议仲裁委调解,双方当事人最终达成调解协议:公司与刘某解除劳动关系,终止执行聘任书;公司向刘某支付违约金6800元、经济补偿金1200元。

聘书与合同有啥区别

本案虽已结束,但该公司以聘任书替代劳动合同,进而逃避法定义务的做法,应引起企业依法从事管理的思考。

聘任书是发给应聘者的文书,是企业录用员工的书面文件。聘任书沒有具体的格式要求,但一般应当写明被聘任者的姓名、聘任的职位或职称、聘任期限等内容。由于聘任书是企业单方面制作的文书,是企业在与劳动者签订劳动合同前颁发的文件,内容非常简单,一般不涉及双方具体的权利和义务,所以,聘任书不能等同于劳动合同。

劳动合同是劳动者与用人单位确立劳动关系、明确双方权利和义务的协议。劳动合同是当事人双方意思表示一致的协议,内容由双方在自愿平等的基础上协商达成的,是一种法律行为,必须由双方签字或盖章方能生效。按照法律规定,建立劳动关系应当签订劳动合同,企业不能因为颁发了聘任书而不与劳动者签订劳动合同。

本案中,聘任书应视为劳动合同,公司提前解除与刘某的劳动关系,应该支付经济补偿金和违约金。因为公司与刘某签订的聘任书中已基本具备了劳动合同的必备条款,且双方对聘任书的内容没有任何异议,一直执行聘任书的约定。这说明,双方当事人对聘任书中明确注明的聘用期限、工作内容、待遇等达成一致并已实际履行。公司未与刘某签订书面劳动合同,责任在单位,双方已经形成了事实劳动关系。公司因更换领导而单方面解除与刘某的劳动关系,应该支付经济补偿金。既然聘任书已经约定了双方的违约责任,公司也应该支付违约金。

今天我竞选的职务是社团部副部长。熟话说：“近水楼台先得月”作为社团部的干事，我有了比别人更加了解社团部工作的优势;再者，我是小学教育(数学)专业，一个理科生，所以做事都会用理性的头脑，理性的看问题;我还有一个优势，你们一看就知道了，没错我是男生，都说“男女搭配，干活不累”，作为一个女生占大多数的师范院校的男生，我拥有了很多相对的优势，比如：坚强，勇敢，富有责任感。

为什么竞选社团部副部长呢?第一，社团部是一个真真正正的大家庭，它包括了7大协会，在社团部工作期间我感受到了，这个大家庭的温馨，尤其是部长和副部长们的平易近人，我们是真正的好朋友，这样一个好的环境，怎能让我不留下来呢?怎么让我不好好去建设它呢?第二，社团部的所有兄弟姐妹们都很关心照顾我，尤其是部长和副部长们对我的看重，我要继他们的脚步把社团部办的更好，更出色!

我高中当过学习委员，把班级管得很好，大学是图书馆助理、社团部干事，锻炼了许多。同时我也组织同学参加排球、篮球、拔河比赛，成绩突出，所以我的组织能力不错。我认为，做任何一件事责任心最重要，责任心驱使我克服种种困难。在社团部工作期间，我发现了一些社团部工作上的不足之处，如：社团部与7大协会的衔接不是很好。要是我当上的社团部副部长，我一定把社团部现在存在的一些问题好好改正，尽量做到完美，也请大家监督。

树牢品牌意识，进一步坚定工作自信心

基层办公室团队是工作勤勉敬业、作风严谨刻苦的优质品牌，我们要像爱护自己的眼睛一样，呵护其声誉、珍惜其形象。办公室工作对每个人的语言表达能力、组织协调能力、文字水平等要求都非常高。办文、办会、办事都必须养成服从大局、团结协作、精益求精的自觉意识，外在体现就是忠诚、服从、执行。忠诚是第一位的，对组织忠诚、对事业忠诚、对领导忠诚;第二是服从，对组织的决策、决议、指示、要求不推不拖，无条件地抓好落实;第三是执行，努力提高执行力，一竿子插到底。做到件件有着落，事事有回音。

基层办公室是一个紧张工作并快乐学习着的部门，尽管工作枯燥清苦，经常加班加点，但近距离地服务于机关工作，服务于广大基层群众。这对于每个在办公室工作过的同志，无论是做人还是处事，都将受益终生。无论在办公室工作，还是以后走出办公室都要时刻铭记自己曾在办公室学习过、工作过，自身形象是基层办公室形象的延伸，任何时候都要恪守办公室的行为规范，保持良好素质和自我形象。

正确认知自我，保持阳光健康心态

正确认知自我是实现自身价值的重要前提，唯有正确认知自我，才能为人生轨迹把好向、定好位。基层办公室是重能力、重潜力、重品行的团队，无论此前从事什么岗位，走进办公室，就需要迅速地融入这个团队，尽快地适应岗位环境，从自身实际出发，找准位置。认真地思考：自己能为办公室做什么?只有明确了努力方向，才能脚踏实地、全身心地投入到工作中来。

要重规范、守规矩，耐得住寂寞和清苦，持之以恒地在工作中锻炼自己，提升自己，实现自身价值。切忌不学真本领，没有真本事，却忽忽悠悠，飘飘然。要干一行、爱一行、精一行，钻研业务求深、求精，做行家里手，做专家大家，增长真学识，主动练胆识。要谦和本分，低调做人，高调做事。基层办公室虽然条件简朴，一些办公设备陈旧，有的桌椅甚至一用几十年，但简朴环境更能磨砺意志，更要守住心神，戒浮戒躁。要有阳光的心态，健康的品行。心态决定品行，一个人如果心态摆不正，品行也很难端正。要自觉克服功利思想，端正价值取向，做到淡定自若，宠辱不惊，豁达阳光，珍惜在基层办公室工作的时光。

坚持用心做事，努力超越自我

用心做事是一种态度，是一种境界，是一个人责任心、综合素养的集中体现。基层办公室作为基层机关运转的“中枢”，不仅要领会贯彻领导意图，还要学深学透上级文件政策，统筹把握本地区实际，为领导决策发挥以文辅政、综合协调、后勤保障等参谋助手作用。

可以说，基层办公室每天都站在一个新起点上，每时每刻都要面对新的压力、新的任务，我们必须要做到心神专注，高标准要求自己，对学习、工作、事业专心致志，研究事周密细致，干工作争创一流。要抗得住干扰，经得住考验，经过反复地磨砺、锤炼，使自己变得睿智、聪明、灵透起来。“爱之深责之切。”难得经常有领导、有良师益友面对面地给予批评、教诲，逐步地使自己走向成熟。要善于思考研究工作，这是办公室人员必备的素质，不要当“材料匠”，而要当思想者。办文的过程是一个思想由低到高、由浅入深、去粗取精，逐步完善的过程。一件事只有想得到，才能写出来;只有梳理出脉络来，做事才会有条理、有章法。要立足各自科室职能，经常思考如何干好本职工作，总结具有思想性、指导性、建设性的经验做法，制定具有针对性、可操作性的办法，形成常态化的制度规范。这既是钻研业务、推进工作的内在需要，也是释放潜能、拓展思维的重要途径。
