第五条 劳保福利待遇：

第六条 劳动纪律：

乙方对外代表公司进行的民事活动，必须经法人代表授权方可，未经公司授权或以乙方个人名义进行的民事活动，其民事责任均由乙自行承担。

第七条 劳动合同的解除：

(一)乙方有下列情况之一甲方可解除劳动合同，不给予乙方任何经济补偿：

1、 员工在试用期内，经考核不符合录用条件的;

2、 严重失职，营私舞弊，给公司利益造成损失数额达伍仟元以上(含)的;

3、 违反《员工手册》，符合其“解除劳动合同”条件的;

4、 员工提供虚假个人学历、职称、工作经历等岗位要求重要证明材料，致使公司与其订立劳动合同后，经公司调查证实，员工不能胜任岗位工作的;

5、 蓄意损害公司财产，造成不良影响的;

6、 打架、斗殴造成不良影响的;

7、 组织职工擅自罢工，有意制造事端的;

8、 办公时间内进行娱乐、赌博活动的;

9、 改、伪造单据、证明材料的;

10、 违反公司保密制度，符合保密制度中“解除劳动合同”条件的;

11、 违反计划生育规定的;

12、 其它触及刑法及行政强制性规定行为的。

(二)乙方有下列情况之一，甲方应提前三十日通知乙方，可解除劳动合同，并按国家劳动法给予经济补偿：

1、乙方工作中年度考核不及格的;

2、乙方不能胜任公司安排的工作，经培训或岗位调整仍不能胜任的; 3、乙方患病或非因工负伤，医疗期满后，不能从事原工作也不能从事甲方另行安排的工作，或者不符合国家和本市从事有关行业、工种岗位规定，公司无法另行安排工作的;

4、订立本合同所依据的客观情况发生重大变化，致使本合同无法履行的，经甲乙双方协商同意，可以变更本合同相关内容。

5、国家劳动法上规定的其他可以由用人单位解除劳动合同的情形。

(三)乙方在合同期限内解除劳动合同应提前三十日通知甲方。

(四)有下列情形之一，乙方可以随时通知甲方解除本合同：

1、在试用期内的;

2、甲方以暴力、威胁、监禁或者非法限制人身自由的手段强迫劳动的;

3、甲方不能按照本合同规定支付劳动报酬或者提供劳动条件的。

(五)乙方有下列情形之一的，甲方不得依据本合同第七条第二款解除劳动合同：

1、患病或者负伤，在规定的医疗期内的;

2、女职工在孕期、产期、哺乳期内的;

3、法律、行政法规规定的其他情形。

(六)解除劳动合同双方均须以书面形式通知对方;劳动合同解除后，乙方不得再以任何理由提出任何要求。

第八条 违约责任：

劳动合同签订后，双方必须全面履行，如一方违约给对方造成损害或经济损失，违约方应承担全部赔偿责任。

第九条 劳动争议处理：

因履行本合同发生的劳动争议，当事人可以向甲方劳动争议调解委员会申请调解;调解不成，当事人一方要求仲裁的，应当自劳动争议发生之日起六十日内向北京市昌平区劳动争议仲裁委员会申请仲裁。当事人一方也可以直接向劳动争议仲裁委员会申请仲裁。对裁决不服的，可以向人民法院提起诉讼。

第十条 双方约定的其他事项：

(一) 乙方劳动人事档案由乙方自行寄存，甲方不负任何责任。双方以本合同作为劳动关系建立的依据。

(二) 甲方根据需要可对乙方进行技术培训，签订培训合同，培训费按培训合同约定内容支付。

(三) 乙方应严格保守甲方的商业和技术秘密，不得对外泄露，如因此给甲方造成损失，乙方应承担全部赔偿责任。乙方在甲方单位任重要岗位职务(所有财务人员、部门经理以上职务等)须与甲方另行签订保密协议。
