三、乙方的义务

1、乙方需向甲方提供有关工程项目的信息，内容包括中标通知书，合同条件，建设单位供应材料等，同时协助甲方对该工程项目进行实地考察。

2、乙方承诺向甲方提供的关于该工程项目的信息真实可靠。乙方在代表甲方与建设单位

进行合同谈判期间，应尽必要的谨慎和诚实义务。

3、乙方根据与建设单位签定的工程承包施工合同约定的建设单位支付工程款的进度，负

责联系建设单位索要工程进度款，并保证工程进度款的及时回笼。

四、业务提成报酬

1、甲、乙双方约定，报酬为一次性支付该工程总款的百分之十，若未及时支付，则每越

一日，由甲方按支付金额的----%向乙方支付违约金。2、

五、合同终止

5.2.4 the second training shall be from the eighth to the nineth month. party a shall

sent 4 technical persons and an interpreter to party b’s factory for training for 160

working days/man  (5 days per week). the training shall cover the designing， the

manufacturing technology，erection and adjustment of the contracted products.

5.2.5 party a shall bear the travelling expenses of its trainees; party b shall

provide party a’s trainees free of charge with boarding， lodging and means of

conveyance for travel- ling between the lodging place and the factory.

accordingto the schedule and contents stipulated in appendix 7 to the contract. lf the

performance of the contracted product is in conformity with the technical specifications

stipulated in ap-pendix 1， such testshall be considersd as qualified and the

representatives of both parties shll sign the inspection and testing certificate for the

proper performance of the contracted product in quadruplicate， 2copies for each party.

7.2 if the verification test demonstrates that the performance of the contracted

prod-uct isnot in conformity with prescribed technical specifications， both parties

shall， throughamicable negotiations，make a joint study of and analyse the cause and

take measures to e-liminate the defects and carry out asecond test. when the second test

demonstuates tha the performance is qualified， both parties shall sign a testing

certificate for the proper perfot- mance

7.3 if party b is responsible for the failure of the first test， party b shall send

at ist own expense technical ersonnel for the second test.

7.4 if the second test fails again and the failure is attributed to party b， party b

shallindemnify party a for any losses sustained and shall take effective measures to

eliminate thedefects and carry out a third test.

7.5 if the third test again fails， and if party b is responsible for the failure，

八、甲方的责任：

8.1 甲方须按时将出租房屋及其家私家具用品与其设施以良好状态交付乙方使用。

party a shall deliver on schedule to party bvacant possession of the leased property including the furniture,furnishing and appliances and the related facilities for party b’s use(furniture,furnishing and appliances to be detailed in appendisl.)

8.2 租赁期内甲方不得收回出租房屋(除非本合同另有规定)，甲方保证乙方可不受干扰的享用该物业。

party a shall not repossess the leased property during the term of party a disturb of interfere with party b’s quiet enjoyment of the leased property.

8.3 在乙方遵守本合同的条款及支付租金的前提下，乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。

proviede that party b pays the rent and performs and observes party b’s terms and conditions in accordavce with this agreement, party b shall be entitled to hold and enjoy the leased property throughout the term of this tenancy without any interruption by party a or any other person.

8.4 租赁期内出租房屋的结构，进出物业的排水、上下管道、电路等处于良好使用状态。

party a agrees to repair and maintain the structure,drains, pipes and cables, etc.leading in to or from the leased property at all times in good and tenable repair during the term of this tenancy.

九、乙方的责任：

party b’s obligations:

9.1 乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。

party b shall promptly pay all rent ,security deposit and other charges payable by it in accordance with the terms of this agreement.

9.2 乙方应爱护使用出租房屋，如因乙方的过失或过错致使房屋设施及屋内用具和饰品受到损坏(正常损耗除外)，乙方应负赔偿责任。

paryt b shall treat the leased property with care. if as a result of party b’s negligence or misconduct, the leased property and the related facilities and accessorties suffer any damage(fair wear and tear excepted ),party b shall be responsible for compensating party a for such damages.

9.3 乙方应按本合同的约定合法使用出租房屋，不得擅自改变使用性质，不应存放中华人民共和国法律下所禁止的危险物品，如因此发生损害，乙方应承担全部责任。

party b shall use the leased property legally as agreed in this agreement and may not change such use on its own…party b shall not store any dangerous items which are prohibited by the laws in the people’s republic of china in the leased property and shall be fully responsible for any admages of losses as result thereof.

9.4 未经甲方事先书面同意，乙方不得将出租房屋转租或租给其他的第三者。

without party a’s prior written consent ,party b may not assign the tenancy or sublet the leased property to a third party.

十、违约处理：

breach of agreement :

10.1 甲、乙任何一方如未按本合同的条款履行，构成违约，应承担相应的违约责任。双方同意违约方应赔偿守约方之直接损失人民币____________元。

if either party a or party b fails to perform its obligations hereunder ,it shall constitute a breach of this agreement and the defaulting party shall be liable for the liabilities resulting from such breach. the parties agree that the party in breach shall pay the other party compensation ____________________for the direct loss and damage suffered by the other party as result of such breach .

10.2 乙方有下列行为之一的，甲方有权终止本合同，收回出租房屋，并且保证金不予返还;

a.未得甲方书面书面同意，将出租房屋擅自转租;

sublets the leased property without party a’s written consent;

b.未得甲方同意将出租房擅自拆改结构或改变用途的：

alters the structure of the leased property or uses the leased property other than for the purpose started herein without party a’s consent;

c.无故拖欠租金超过三天(除双方就本合同存在争议除外)。

fails to pay rent without any reason for more than thirty (30)days after the due date except where there is a dispute in respect of this agreement.

十一、适用法律：

applicable law:

本合同的成立，其有效性、结实、签署和解决与其他有关的一切纠纷均应受中国法律的管辖并依据中国法律解释。

the formation of this agreement ,its validity,interpretation,executiong and settlement of any disputes arising hereunder shall be governed by and construed in accordance with the laws of the people’s republic of china.

十二、争议的解决：

dispute resolution:

凡因执行本合同所产生的或与本合同有关的一切争议，双方应通过友好协商解决;协商不成，应提交中国国际经济贸易仲裁委员会，按其仲裁规则和中华人民共和国仲裁法进行仲裁。仲裁解决是终局的，对双方都有约束力。

十三、其他

13.1 本合同如有未尽事宜，由甲、乙双方洽谈解决。

第二、认真加强专业知识学习，不断充实自己工程审计方面的业务知识。对于我来说，虽然从事工程建设工作接近三年，有一定的工作经验和能力，但政府部门的工程审计是一个崭新的工作。为了能尽快适应环境，更好地开展工作，我努力坚持“向人学、向书本学”的学习型适应思路：一方面，虚心向同科室的老同志请教，通过他们的言行举止、工作程序等来规范自己的工作行为;另一方面，认真学习《中华人民共和国审计法》、《中华人民共和国国家审计准则》、《审计机关审计项目质量控制办法》等书籍杂志，努力掌握有关专业知识。并在20_年12月份参加了市审计局举办的“全市投资审计工作人员培训班”，在20_年4月份参加了市交委举办的“全市交通系统造价专业工作人员培训班”，系统地学习了《工程造价管理基础理论与相关法规》、《工程造价计价与控制 》、《建设工程技术与计量(土建、安装)》、《工程造价案例分析 》知识，为更好地做好本职工作奠定了专业知识基础。

第三、认真加强科学文化学习，不断提高自己的综合素质。我严格按照国家公务员的考试知识结构要求自己，提高自己的综合素质，在工作之余努力丰富自己全面的科学文化知识。参加并顺利通过公务员初任培训，并自学工程项目管理、园林工程技术等专业知识，通过了全国二级注册建造师、国家园林助理工程师等资格考试。

二、认真履行职责，积极开展工作

坚持原则，认真办事，现场与资料结合，做好了“_路第一合同段”工程的投资审计工作。20_年10月份，根据上级的文件精神和局里的统一安排，我参加了“_路第一合同段”工程结算的审计工作。本着求实、严谨、认真负责的工作态度，将测量、抽样数据同有关签证一一核对，将不符合要求的签证剔除，将与现场不符合的资料进行审减，尽职尽责完成审计工作报告，高质量地完成了“_路第一合同段”工程结算投资审计项目。

科长职务之小不言而喻，但其职责之重、地位之要也是显而易见的。因此，当好小科长必须有大胸襟，不能因小失大。我结合自己当秘书科长的工作实践，谈几点体会。

一、低调为人、谨慎处事是前提

要做事先做人，做好人才能做好事。作为秘书科的领导者，要把“文、事、会”等事情办好，首先必须具备良好的品德修养，在做人做事上砥砺公道正派的道德品质、求真务实的工作作风和甘于奉献的思想境界。具体说来，要做到以下几个方面。

一是要找准定位，办事到位不越位。秘书科长要摆正自己的位置，清楚自己的角色。多一步是越位，少一步是缺位，偏一步是错位。要把握好工作分寸，不过、不错、不缺。首先，要处理好参谋与决策的关系。要自觉站在领导的角度和高度，围绕部门的中心工作，深入调查研究，全面收集信息，积极查找问题，出主意、想办法、当高参。不做“应声虫”，不放“马后炮”，有新观点、新思路、新措施，能参在点子上，谋在关键处，提在需要时，力求达到“好雨知时节，当春乃发生;随风潜入夜，润物细无声”的“春雨”境界。其次，要处理好做事和处事的关系。秘书科长是党组决策的具体执行者，对一些具体问题要积极做好工作，果断处理，不要将大小责任都往上推，但对领导已研究决定的事情或是重要和敏感问题，则不能随意改变。如在执行过程中发现领导的决定确有问题需要更改，也要及时反馈由领导本人决定，若非授权，不可替代。再次，要处理好协调和协商的关系。秘书科长和业务科长是同级关系，但因工作原因，有些问题往往需要秘书科长牵头协调处理。这时候就需要秘书科长充分发挥枢纽和桥梁作用，外求支持配合，内求团结协作，沟通情况，交流看法，传达政令，解决问题，同时注意做好协商工作，重视对方的意见，以达成共识，协同推进工作的开展。

二是要务求实效，做事求成不求名。作为秘书科长，在单位里有一定的威信。要建立起秘书科长的威信，除了具备一定的学识、才干外，还要有个人的人格魅力。首先，个人品行要端正。凡事以大局为重，不玩弄权术，不搞小动作;工作中要注意突出领导班子和部门的作用，多做幕后的事情、台下的工作，不抢镜头，不出风头。其次，工作作风要扎实。办事讲实效，工作讲效率，不好大喜功，不夸夸其谈，要有为机关服务的思想，放下架子，淡化等级观念，强化服务意识。具体工作事务要认真安排，甚至要亲力亲为做好每一项工作。再次，面对荣誉要谦让。秘书科长内外协调，迎来送往，必须热情大方，性格开朗，具有较好的交际能力，但在成绩荣誉面前却要保持低调，因为秘书科的工作大多是协助性工作，虽然干了很多事，但说起成绩来，却很难说是秘书科的。因此，秘书科长一定要有甘当无名英雄的思想和胸怀，这样才能心平气和，兢兢业业地做好本职工作。

三是要默默奉献，干事吃苦不叫苦。服务就意味着奉献，没有奉献精神就搞不好服务。秘书科工作最大的规律就是“无规律”、“不由自主”，一年到头都忙忙碌碌，加班加点连轴转，既辛苦又清苦，不显山、不露水。身为秘书科长应正确认识自己的工作和价值，正确处理苦与乐、得与失、局部与全局、家庭与事业、个人与集体的关系，甘当不为名利的“小草”、乐于奉献的“蜜蜂”、恪尽职守的“螺丝钉”。任何时候都招之即来，来之能战。对可预知的工作，早作准备;对临时交办的工作，快速反应，抓紧布置办理;对有时限要求的任务，千方百计按时完成;对没有明确时限的任务，也要尽快落实。

二、悉心筹谋、尽心办事是基础

机关工作无小事。在繁杂的工作任务面前，秘书科长必须保持良好的心态，以正确的处事观落实好各项工作，认真履行服务职责。

一是不以事小而不为。事务本身有大小之分、主次之别。秘书科长面对大量繁杂的事务，立足于抓大事、学会抓大事、善于抓大事是明智的，但小事不抓，日积月累，就会酿成大事，贻误工作。特别是对那些看似小事但抓不好就可能影响工作、影响团结、影响领导情绪的，更不能听之任之。这也是秘书科工作无小事的内涵之所在。对秘书科长来说，不管大事小事，不存在该不该抓的问题，只有抓的角度、力度的区别。

二是不以事杂而乱为。秘书科工作头绪很多，任务琐碎繁杂。秘书科长要清楚哪个该为，哪个不该为，做到一清二楚，不能乱为。不乱为，就要知重知轻，避免重要工作没抓住，次要工作用过了劲，使过了头。不乱为，就要知上知下。吃透了上情，办事才有方向、有主心骨，摸透了下情，办事才有的放矢。不乱为，就要知书知礼。知书，就是要多学习，提高理论水平，通晓方方面面的知识，办事得心应手。知礼，是指工作方法多、讲艺术。不仅办了事，还能使大家心悦诚服，各方面都满意。不乱为，就要知规知矩。没有规矩不成方圆。秘书科是规矩之科。秘书科长更应成为讲规矩的楷模，不管事情再多再杂，采用什么方法解决，都不能忘了办事的规矩。

三是不以事急而盲为。秘书科固定式、程序化的工作多，但意料外、突发性的事情也会随时出现。秘书科长往往是急事和突发性事件的第一知情者，负责事件处置的第一道工序。在这种情况下，秘书科长必须政治敏感、头脑冷静。要泰然处之，切忌慌了手脚。不管事情多么突然、多么紧急，首先要冷静地分析，根据上级要求和平时掌握的情况，及时召集有关部门商讨对策，并依法依规提出解决方案，呈送领导。要沉着应付，切忌慌了神、乱了手脚。其次要边请示边按领导要求协调相关力量、组织相关力量进行处置。再次要有主见，切忌唯唯诺诺。面对急事或突发性事件，不能退缩，要大胆地往前站，做到胸有主见，既不乱表态、乱许愿，又不唯唯诺诺、态度暧昧，避免在解决一种问题时埋下另一种隐患。

四是不以事难而怕为。在处置事务的过程中，不乏一些超出预见、超出职责、难以料理的事情。对这些事，是上推下卸绕着走，还是主动出击、迎难而上，不仅反映秘书科长的工作水平，更主要的是检验秘书科长的职责感和工作态度。一个称职的秘书科长，必须坚持不怕揽矛盾，不怕受委屈，不怕得罪人，不怕找麻烦。

三、科学管理、团结共事是关键

秘书科的工作很多是被动性、临时性的，很多工作仅靠个人的长袖善舞是难以完成的，只有科里全体同仁心往一处想、劲往一处使，才能干好事、干成事，才能实现“1+l>2”的整体效应。因此，培养团队观念和协助精神，对于秘书科长能否充分地履职尽责至关重要。

一要健全相关规章制度，突出规范管理。在制度的制定中，坚持运用“热炉法则”的四个惩处原则：首先是热炉火红，不用手去摸也知道是热的，是会灼伤人的——替告性原则;其次是每当人碰到热炉时，肯定会被火灼伤——现实性原则;再次是当你碰到热炉时，立即就被灼伤——及时性原则;最后是不管谁碰到火炉，都会被灼伤——公平性原则。要建立一种奖罚分明的机制，既不能让“会哭的孩子多吃奶”，更不能形成或陷入“干的不如不干的，不干的不如捣蛋的”怪圈。 二要科学制定工作标准，实行分类管理。对于科室的管理，不仅需要健全的规章制度，还应制定相应的工作标准和规范的运作机制，实施分类管理。日常工作要突出一个“严”字，对外接待要突出一个“细”字，综合文字材料写作要突出一个“精”字，文秘机要工作要突出一个“准”字，后勤服务要突出一个“高”字，从而带动整个机关工作上新水平、新台阶，不断提升服务工作的质量和水平。

三要营造和谐融洽环境，强化人文管理。除了科学规范的规章制度和运行机制外，科室管理中也不能少了人情味。要坚持以人为本，尽力解决大家日常生活中的实际困难，使同志们真正感觉到组织和领导的关怀，从而激发工作的积极性。要把创造良好的工作环境视为重要的工作内容来抓，用良好的环境去影响人、改造人、约束人，营造一种勤奋学习、积极向上、努力开拓、团结协作、乐于奉献的良好环境。要注重培养每位科室工作人员的团队意识，正确处理分工与协作的关系，做到同心不分心，建功不争功，补台不拆台，尽力不惜力，理解不误解，倍加珍视同事的友谊，倍加珍爱集体的团结，倍加珍惜共事的机缘。

(一)甲方实行每日不超过8小时，平均每周不超过44小时的工作制度。并保证每周乙方至少不间断休息24小时。

(二)甲方可以报经劳动行政部门批准实行不定时工作制或综合计算工时工作制。

(三)甲方因生产、工作需要，经与工会和乙方协商同意，可安排乙方加班加点，但每个工作日延长工作时间不得超过3小时，每月累计不得超过36小时。

(四)有下列情形之一的，甲方延长工作时间不受第(三)项规定限制：

1.发生自然灾害、事故或者其他原因，威胁劳动者生命健康和财产安全，需要紧急处理的;

2.生产设备、交通运输线路、公共设施发生故障，影响生产和公共利益，必须及时抢修的;

3.在法定节日和公休假日内工作不能间断，必须连续生产、运输或者营业的;

4.必须利用法定节日和公休假日的停产期间进行设备检修、保养的;

5.为完成国防紧急任务的;

6.为完成国家下达的其他紧急生产任务的。

四、休假乙方在合同期内享受国家规定的节日、公休假日以及年休假，探亲、婚丧、计划生育、女职工劳动保护等假期的待遇。

1、本合同自签订之日起对其构成有约束力的义务。

2、乙方向各方陈述和保证如下：

(1)其保证所提供的个人资料内容的真实性;

(2) 其具有签订本合同的行为能力和履行合同义务的资格和能力，并且其与甲方签订本合同的行为不会导致甲方因此承担任何对第三方的责任;

(3)本合同自签订之日起对其构成有约束力的义务。

第十一条 合同的变更、终止和解除

1、岗位聘任合同签订后，甲、乙双方必须全面履行合同规定的义务，任何一方不得擅自变更合同。确需变更的，双方应协商一致，并按原签订程序办理。双方未达成一致意见的，原合同效力不变。

2、有下列情况之一的，聘任合同自行终止：

(1)聘任合同期满，或聘任合同约定终止聘任合同的条件出现;

(2)甲方撤消或解散。

3、有下列情况之一的，甲方可以随时解除聘任合同：

(1)乙方在试用期内不胜任岗位要求;

(2)乙方严重失职、渎职，给甲方造成严重损失;

(3)乙方年度考核不合格;

(4)乙方连续旷工时间超过15天，或1年内累计旷工时间超过30天;

(5)乙方因私出境逾期不归;

(6)乙方不履行聘任合同;

甲方依据上述条款解除乙方聘任合同，乙方应在30日内办妥终止聘任关系手续。

4、乙方在聘期内被劳动教养或被依法追究刑事责任，聘任合同自行解除。
