根据 县委、县府针对农村配网升级改造的方针、政策，就乙方向供电公司申请，甲方受供电公司的委托，对乙方所辖社电力线路进行配网升级改造这一惠农工程。为了保证此项工程能够安全，顺利的实施，也为了能够早日完成国家实施这项工程的宏愿：尽快的让边远山区的村民用上光明电、优质电、廉价电、放心电，让众多的村民们能够感受和亲身体验到现代电气化产品带给人类的巨大优越性。因此，甲方在接受供电公司严格的资质审查与委托后，到乙方所在地进行了多次实地踏勘，现状以及当地风土人情的了解，再经过与当地镇政府分管此项工程的领导，当地供电所领导，农网办项目负责人，乙方负责该项工作的村干部等多次协商后，结合本工程的特殊性，同时结合县委、县府成立的农村电网改造领导小组的指导思想以及农网办的相关规定和制度，特订立本协议，甲方将抬杆打洞的电杆的二次转运、电杆组立、金具安装，线路架设、材料上下车、转运、拆旧等相关工作的辅助用工承揽给乙方，为明确相互责任，经甲乙双方协商一致，达成以下安全责任协议：

一、甲方责任

1、甲方施工人员必须严格按照设计图纸进行复测、分坑。原则上，不得随意变更原图纸设计与方案。按图施工也是供电公司农网办、生技部、验收组，审计部的硬性规定。

2、甲方负责宣传农网改造工程中有关安全上的常识、规定等，告知乙方劳务人员安全常识常规，日常用电知识，并为乙方劳务人员提供安全帽，教导其正确佩戴方式，记他们充分了解安全的重要性。

3、甲方按照图纸，明确告知乙方抬杆打洞的准确位置，摆放方向和电杆，拉线坑洞的规定深度。

4、电杆组立时，甲方现场施工负责人必须在现场，统一指挥和安排，以降低安全风险系数。

5、甲方现场施工负责人每日应将第二天要做的具体工作以及确需劳务人员的数量，乙方专门负责此事的人员主动函接，明确告知。

二、乙方责任

1、乙方必须告知其组织的劳务人员，应按照主告知的安全事项和措施开展劳务活动。并严格按照甲方教导的方式正确佩戴安全帽，保管安全帽。

2、乙方抬杆、立杆时必须用18周岁以上、55周岁以下的无残疾精壮劳动力，必须听从甲方现场施工人员的安排、指挥。

3、乙方在工程实施之前，应招集村民大会，将此次电网改造工程的宗旨，相关精神，要求及注意事项告知广大村民，特别是不能强迫施工队伍现场施工人员按照他们的意思去任意变换电杆或者拉线点位，更不得私自移动电杆和拉线位置。

4、根据现行电力线路的架设与安装标准和要求，也为了日后，所架设的电力线路能够安全，稳定的运行，所以，在电力线路其通道的砍伐上，应按照标准，保证线路边项与林木间的最低距离为 米。

5、乙方在施工过程中若出现安全事故，应对伤者及时全力救护和事故现场善后处理工作，同时第一时间(24小时内)报告甲方事故情况。

三、事故责任及事故处理

1、鉴于甲方就本工程已向保险公司投保，就事故费用处理达成以下协议：

1.1伤残事故的处理，乙方在施工时发生伤、残事故，需住院治疗者，甲方负责支付伤才在县级人民医院治疗的治疗费用。乙方负责伤者护理、生活、误工费及后续补偿费。

1.2死亡事故的处理，乙方在施工时发生死亡事故，甲方负责将保险公司赔付的死亡赔偿金一次性支付给乙方(以保险公司赔偿金额为准)，其他所用费用由乙方负责赔偿。

2、乙方负责事故人员入、出院手续和安抚工作。

四、协议价款

1、电杆坑洞，拉线坑洞以及地锚洞，按均价 元/个的标准，以实际竣工数量为准，据实结算，所有坑洞的深度必须达到供电公司各部门的验收标准。

2、电杆包括包立，不分长短，按均价 元/根的标准，以实际竣工数量为准，据实结算(8米居多，10米有小部分)。

3、电杆确需车辆进行二次转运的，由甲方现场确认。甲方负责车辆转运的运费，乙方负责电杆的上下劳务费。车辆运费视现场情况而定。

4、其实各项诸如材料上下车，材料转运，金具安装，线路架设，拆旧等各个工序上所要用的辅助工，按均价 元/个的标准，以实际用工数量据实结算。

五、款项支付

1、本协议载明，由甲方支付乙方的费用，按甲方与供电公司农网办约定的工程进度款支付办法和比例同步进行。

2、甲方与供电公司在工程进度款拨付之前，对供电公司要求的相关手续，证明等。乙方应本着理解与配合的角度出发，无偿提供给甲方。

当然，甲方也务必信守承诺， 待供电公司拨付的施工进度款一到账，就立即按约定支付给乙方。

六、违约责任

甲方双方任何一方的违约，都由违约方按照本协议总价款的比例赔付另一方。

I was astonished and grievous to hear of the calamitous earthquake happening on May, 12th. It’s really a national disaster, causing tremendous loss to our whole nation physically and mentally. By now, the terrible earthquake has claimed over 60 thousand lives, injured far more people, and led 5 million homeless.

Seeing the related movies and photos, I could not help crying. I’m especially moved by those high-minded people in front of the catastrophe! I’m proud of you, tough people!

Despite the calamity, I hope that you, our brothers and sisters in the earthquake-striken area, will believe in us, in our government, and in the power of love. 经甲乙双方协商，本着公平公正、诚实守信原则，根据《中华人民共和国合同法》以及《中华人民共和国侵权责任法》之相关规定，现就乙方购买、运送甲方生产的余料及锯木灰事项做如下规定：

1. 合同基本内容

1.1 单价：中纤板余料及锯木灰价格为人民币200元~300元吨。具体价格以交易时市场价格为标准具体商定。

1.2保证金：乙方需交付保证金人民币10000元(大写：人民币壹万元整)，须在合同签订时交给甲方旗下各个系列负责人。该保证金在合同期限届满，乙方无任何过错及违约的情形下退还(无息)。

1.3计量方式：由乙方将中纤板余料及锯木灰运送到甲方指定地点进行过磅称重。甲乙双方必须同时对过磅情况进行监督，并签字认可。若乙方不通过甲方私自过磅，实际重量则按票据上所载数量之三倍计算。

1.4 结算日期及方式：乙方必须于每月24日结清本结算月的所有价款，延迟一天则需向甲方缴纳迎接价款总额的5‰天向甲方支付滞纳金。支付方式：收款人：

2.1 甲方有权按约定每月24日收取货款。

2.2 甲方有权在合同到期时，由于乙方未遵守合同而扣留其保证

2.3 甲方有义务负责将每日需运送出售的中纤板余料及锯木灰运送到指定地点。

2.4 在合同履行期内，甲方不得将中纤板余料及锯木灰专销权授予第三方，否则将承担违约责任，支付乙方人民币10000元(大写：人民币壹万圆)。

2.5若出现由于乙方过错所导致的安全事故，乙方应自觉主动承担责任，不得与第三人恶意串通损害甲方的合法权益、干扰甲方正常营运，否则将赔付甲方人民币50000元(大写：人民币伍万元整)的违约金。

2.6甲方为督促乙方尽到其对员工的安全保障义务，共同维护乙方员工人身、财产安全，甲方一旦发现乙方未为其员工进行安全培训及安装安全防护设备，甲方有权扣除或没收该保证金。

3. 乙方的权利和义务

3.1 乙方工作人员进入甲方厂区必须遵守其《保卫制度》、《消防安全制度》等相关规定，否则因此造成的损失由乙方承担。

3.2 乙方所雇佣的工人应具备与劳动强度相符合的身体素质，乙方在其上岗作业前应对其员工做相应的安全培训工作。

3.3 乙方提供的运输车辆应符合作业标准，且需在车上安装相应的保护措施，以免使其员工受到不必要的伤害。

3.4乙方在接到甲方装车通知后第二天需到甲方处将中纤板余料及锯木灰全部装车，若出现未经甲方同意而停运或延期、因未装完余料及锯木灰而导致消防隐患的，乙方须支付人民币500元次(每月结账时支付)的违约金。

3.5因乙方员工自身原因或乙方未尽到上述安全保障义务导致乙方员工在作业过程中遭受人身、财产损害的，乙方自行负责，不得将责任推卸至无过错的甲方。

3.6 乙方应自行为其员工购买相应的保险，以期更好的保护其员工的权益。

3.7 乙方若擅自解除合同中止合作，需付甲方违约金人民币10000元(大写：人民币壹万元整)。

4.本合同期限为签订之日起一年。

5.本协议内容系双方当事人真实意思之表示，不存在重大误解 、显失公平等情形。
