第一条车辆状况

第二条租赁期限及租金

第四条承租方的权利和义务

1、租赁期间拥有所租车辆的使用权。

2、租赁期间应严格遵守国家各项法律法规，并承担由于违章、肇事、违法等行为所产生的全部责任及经济损失。

3、不得把所租车辆转借给任何第三者使用，不得用租赁车辆进行盈利性经营，以及参加竞赛、测试、实验、教练等活动。

4、承担车辆租赁期间的油料费用。

在租赁期间应对水箱水位、制动液、冷却液负有每日检查的责任，在车辆正常使用中出现故障或异常，承租方应立即通知出租方或将车辆开至出租方指定维修厂，承租方不得自行折卸、更换愿车设备及零件;因非正常使用造成的事故责任及损失费用均由承租方承担。

5、按期如数交纳租金、租金。

6、应按时归还车辆，归还时的车况与《租车车辆交接单》中的车况登记相一致，并经出租方指定的专业人员验收。

验收时发现车辆有所就的划痕、刮伤、碰撞、损坏、设备折损、证件丢失等现象承租方应按实际损失交纳车损费及其他相应的费用。

7、如许续租车辆，须提前24小时到出租方办理续租手续。

8、必须承担因承租方的行为而带来的其他经济损失。

第五条租期的计算

租赁期间以车辆发车时为始，以车辆收车时为止，每日以24小时计算，超过6小时(含6小时)按全日计算，6小时以内按半日或小时计算。

第六条车辆行驶里程限制

承租方多租车辆每日行驶里程为_________公里，超出部分按每公里1元计算，租期在三日以上(含三日)免去里程限制。

第七条租车押金

1、承租方在本合同签定时一次性向出租方交付足额押金。

2、在本合同期满或双方协议解除合同时，如承租方无违约行为，出租方将押金归还给承租方。

3、承租方还车时须交纳交通违章保证金_________元人民币，在十五个工作日后，经确定在租赁期间无违章记录即退还。

第八条车辆保险

1、出租方为租赁车辆办理了车辆损失险，盗抢险、自燃险、第三责任险。

承租方可自愿购买其他险种，费用由承担方自理。

2、车辆在租赁期间内如发生保险事故，承租方应立即通知交通管理部门的出租方，出租方届时应协助承租方向保险公司报案，承租方必须协助出租方办理此事故的相关事宜，并支付因此产生的一切费用。

如属于保险赔付范围的费用有保险公司承担;属于保险责任免赔或其他原因导致保险公司拒赔的损失由承租方承担。

第九条违约责任

1、出租方未能按合同多约定的交车时间向承租方提供所租车辆，需向承租方赔偿该日租金的1.5倍做为违约赔偿金。

2、承租方未经出租方同意逾期返还车辆的，逾期租金以原租金标准的1.5倍计收。

3、承租方在租赁期间发生操作不当或其他外部原因引起的车辆损伤，如可办理保险索赔的，承租方应向出租方支付总维修费用(以保证公司评估为准)30%的加速折旧费和停驶损失;如属于保险责任免除范围的，由承租方承担全部的维修费用和停驶损失。

第十条担保条款

担保方：_____________________(个人签字、单位盖章)愿为承租方提供担保，如承租方发生违约行为，担保方愿承担连带责任。

第十一条合同解除

1、因车辆状况原因导致车辆无法正常行驶时，承租方有权解除合同。

2、未经出租方许可承租方拖欠租金超过3日，出租方有权随时随地收回车辆并解除合同。

3、在下述任何一种情况发生时，出租方有权解除合同收回车辆，并不返还租金和押金，由此造成的一切法律责任和经济损失由承租方承担：

(1)、承租方利用所租车辆从事违法犯罪活动。

(2)、承租方将所租车辆转让、转租、出售、抵押、质押。

(3)、承租方擅自将车辆开出海南省区域。

(4)、从事其他有损出租方车辆合法权益的活动。

第十二条合同的效力

本合同自出租方、承租方签字(盖章)后生效。

本合同一式两份，由出租方、承租方各执一份，具有同等法律效力。

第十三条争议的解决

有关合同的一切争议，双方经协商解决未能达到一致的，任何一方可向出租方所在地的法院提出起诉。

实践报告：这个暑假，可以说过的太快了，感觉还没休息了就又来学校了。本来放假的时候要和室友一块去南方打工，可是几经周折没能去成，只好无奈的回家。到家之后，找了份暑假补习班的工作，另外有找了份家教的工作。都是教初中的英语。

刚开始补习班开始上课前，白天在街里忙着给人家招生，晚上去给一个初三的小孩补初二的英语，前几天每天都是忙到晚上快十点才一个人骑着车子回家，吃晚饭都快十点半了。后来补习班开始上课，我就开始了两遍跑的生活。白天去给补习班那上课，晚上去家教那，不过还好，步入正轨后，每天晚上八点就能回家了。前几天快要透支了，后来习惯了也没觉得那么苦。在补课期间，我的嗓子哑了一个多月。真的觉得干什么都不容易，去厂里上班和干别的都需要自己的坚持。在过去的一年里，我感觉每次放假都是对我毅力的一种挑战。大一的寒假和暑假让我明白了很多。在这个暑假里，最令我感动的是家教的那个小孩，说实话，他的英语很不好，记忆力也很不好，也许只是在英语方面，但是，在我给他补课的一个月里，他一直很认真的在努力，即使单词他背不会，但是他一直在努力地背。我问他为什么现在想起来补英语了，他说只想给自己一个机会，以前没努力，现在给自己一次机会，想证明自己到底行不行。真的很喜欢这样坚持的人，我感觉自己曾经也是这样的人，后来没有了目标，就忘记了坚持。为什么自己不能给自己一次机会。面对这么严峻的就业形势，我醒悟到必须给自己一个机会，一个继续前进的机会。

2、店铺销售额甲方、乙方按照70%：30%的比例分成。销售额按照店铺当月的实际销售额计算，以1个月为结算周期。分成金额，甲方可以通过支付宝，或者银行转账的形式支付给乙方。

第六条 双方的权利义务

1、 乙方应当按本协议约定的事项，履行商品设计与微博推广的义务，共同促进店铺的经营发展。乙方未按约定履行义务的，甲方有权提前单方面终止合作协议，并追究乙方违约责任。

2、 未经甲方书面同意，乙方不得将本协议中的全部或者部分权利、义务转让或委托给第三方。

3、甲方将投入5万至10万用于店铺的经营管理。自淘宝店铺经营之日起半年内，如果店铺无法盈利，即甲方在半年内的分成金额，未能超过甲方的实际投入金额，甲方有权单方面提前终止本协议书，并不承担违约责任。

4、甲方应按本协议书的约定及时支付乙方分成金额。

5、 双方合作终止后，乙方应当在其微博中发布信息，说明乙方与店铺终止合作。

6、在本协议书有效期内，除本协议书约定的情形外，未经双方协商一致，任何一方不得单方面终止合作或者退出合作，否则，应当承担违约责任。

第七条违约责任

任何一方违反本协议约定的义务的，守约方有权单方面提前解除本协议书。

违约方应当支付守约方违约金________元。

第八条其他

1、本协议一式两份，自双方签字盖章之日起生效，甲乙双方各执一份。

2、本协议未尽事宜，由双方友好协商解决，协商不成由甲方所在人民法院诉讼管辖。

1.多听、多看、多想、多做、少说

要知道自己是否能胜任这份工作，关键在于你自己对待工作的态度。态度对了，即使自己以前没有学过的专业知识，也是可以在工作中逐渐掌握的。态度不好，就算自己有基础也不可能吧工作做好的。比如我刚到一些岗位工作，根本不清楚该做些什么，并且这和我在学校读的专业并没有太大的联系，刚开始我觉得很头疼，可是经过工作中不断的学习，多看别人怎么做，多听别人怎么说，多想自己又该怎么去做，然后自己亲自动手实践。终于在短短几天对工作有了系统的认知，慢慢的自己也可以完成相关的工作了，这光靠嘴巴说是不行的。所以我今后干什么都要端正自己的态度，才能把事请干到最好。

2.少埋怨

在条件艰苦的地方实习，也许有的人会觉得这里不好、哪里不好的，同事的相处工作也不如愿，经常埋怨，这样只会影响自己的工作情绪。不但做不好工作，还增加自己的压力。所以，我们应该少埋怨，要看到好的一面，对存在的问题应该想办法去解决而不是去埋怨，这样才能保持工作的激情
