第一条车辆状况

第五条租期的计算

第六条车辆行驶里程限制

第七条租车押金

如属于保险赔付范围的费用有保险公司承担;属于保险责任免赔或其他原因导致保险公司拒赔的损失由承租方承担。

第九条违约责任

1、出租方未能按合同多约定的交车时间向承租方提供所租车辆，需向承租方赔偿该日租金的1.5倍做为违约赔偿金。

2、承租方未经出租方同意逾期返还车辆的，逾期租金以原租金标准的1.5倍计收。

3、承租方在租赁期间发生操作不当或其他外部原因引起的车辆损伤，如可办理保险索赔的，承租方应向出租方支付总维修费用(以保证公司评估为准)30%的加速折旧费和停驶损失;如属于保险责任免除范围的，由承租方承担全部的维修费用和停驶损失。

第十条担保条款

第十一条合同解除

1、因车辆状况原因导致车辆无法正常行驶时，承租方有权解除合同。

第六条 双方的权利义务

1、 乙方应当按本协议约定的事项，履行商品设计与微博推广的义务，共同促进店铺的经营发展。乙方未按约定履行义务的，甲方有权提前单方面终止合作协议，并追究乙方违约责任。

2、 未经甲方书面同意，乙方不得将本协议中的全部或者部分权利、义务转让或委托给第三方。

3、甲方将投入5万至10万用于店铺的经营管理。自淘宝店铺经营之日起半年内，如果店铺无法盈利，即甲方在半年内的分成金额，未能超过甲方的实际投入金额，甲方有权单方面提前终止本协议书，并不承担违约责任。

4、甲方应按本协议书的约定及时支付乙方分成金额。

5、 双方合作终止后，乙方应当在其微博中发布信息，说明乙方与店铺终止合作。

6、在本协议书有效期内，除本协议书约定的情形外，未经双方协商一致，任何一方不得单方面终止合作或者退出合作，否则，应当承担违约责任。

6、被依法追究刑事责任的；

8、协议订立时依据的客观情况发生重大变化，致使协议无法履行，经当事人协商不能就变更协议达成新的协议的。

（三）有下列情形之一，乙方可以通知甲方解除协议：

1、甲方以侵害乙方合法人身权利手段强迫劳动的；

2、甲方不能按照本协议规定支付劳动报酬或者提供劳动条件的；

甲乙双方就绍兴县进出口公司杭州继续承包运营及双方的责任和利益分配等事项达成如下协议：

第一条：

1.甲方继续支持已在杭州组建的绍兴县进出口公司杭州，?由乙方承包。在甲方的支持，指导和监督下，乙方从事甲方法定登记范围内的各项经营活动，_____操作进出口业务，并承担全额业务风险。如因甲方责任造成乙方的业务风险，应由甲方承担相应损失。

3.甲方凭乙方出口结汇水单和相应的出口产品完税发票，在3个工作日内给付乙方或乙方指定的收款单位对应的人民币款项；?由于非人力不可抗拒原因拖迟付款而造成乙方或乙方吸纳的委托代理方的经济损失应由甲方负责。
