我在班上的学习虽然谈不上数一数二，却是小有名气，我的人缘也很好，班上有一大半的同学都是我的好朋友，其中还有我的“知心朋友”。我不仅朋友多，而且兴趣爱好也多的不得了，有：“画画、玩电脑、游泳、弹钢琴、看书……。我最喜欢看书了。我很小的时候，爸爸就給我买了许多的识字手册，还经常给我读一些故事书，可以说，我的童年就是在书海中度过的。随着我年龄的增长，我家的书也越来越多，现在我家就象一座小图书馆，到处都是书，我自己的书更是多得数不胜数，整整放了两个柜子。虽然我平时一向很节约，但是对买书却毫不吝啬，只要是我喜欢实用的书，而且不是很贵，我一定会马上买下来。有时候我遇到一本好书，又因为价格太贵而不能买，我一定会翻来覆去地看好几遍才甘心，所以每次我一进书店，都要看上大半天。高尔基曾经说过：“书是人类进步的阶梯”。而我也坚信：好书能伴我一生。我常常因为看书而误了其他的事情，因此爸爸、妈妈经常开导我说：“看书要学会适而可止”。为此有时我也很伤脑筋，想来想去，我下定决心，以后一定要学会克制、克制再克制！

根据有关法律法规规定，甲乙双方本着平等自愿、协商一致、合法公平、诚实信用的原则，签订劳动合同，并承诺共同遵守：

第一条：合同类型和期限甲、乙双方选择以下形式确定本合同期限：

(一)固定期限，自_____年_____月_____日起至_____年_____月_____日止，共_____个月。

(二)其中试用期自年月日起至_____年_____月_____日止，共______个月。

(三)乙方应在______年___月___日前到岗。规定到岗时间的理由在于：规定劳动关系的建立日为用工之日(一般情况以到岗为准)，劳动者签订合同后一直不到岗，企业不能随便解除合同，法律风险和成本很高，应约定到岗时间，以便后面约定本同的自动失效。

第二条：工作内容和工作地点

(一)根据甲方工作需要，乙方同意从事岗位工作，根据甲方的工作需要，经甲乙双方协商同意，可以变更工作地点。

(二)乙方应按甲方的要求，按时完成规定的工作数量，达到规定的质量标准。

第三条：工作时间和休息休假

(一)乙方实行以下第种工时制。

1、实行固定工作制的，平均每日工作时间不得超过8小时，平均每周工作时间不得超过60小时。

2、实行不定时工作制的，工作时间和休息休假甲乙双方协商安排。

(二)甲方因工作需要安排延长乙方工作时间的，应依法安排乙方同等时间补休或支付加班加点工资。

(三)乙方依法享受国家规定的节假日和本单位规定休假制度。

第四条：劳动保护和劳动条件

(一)甲方根据生产岗位的需要，按照国家有关劳动安全、卫生的规定为乙方配备必要安全防护措施，发放必要的劳动保护用品。

(二)甲方根据国家有关法律、法规，建立安全生产制度;乙方应当严格遵守甲方的劳动安全制度，严禁违章作业，防止劳动过程中的事故，减少职业危害。

(三)甲方应当建立、健全职业病防治责任制度，加强对职业病防治的管理，提高职业病防治水平。

第五条：劳动报酬

(一)乙方试用期的基本(固定)工资标准为______元/月，乙方在试用期期间的工资为______元，绩效工资根据乙方的业绩考核情况核定。

(二)乙方试用期满后，甲方应根据本单位的工资制度，确定乙方实行以下第种工资形式：

1、计时工资。乙方的工资由基本(固定)工资和绩效工资组成。基本(固定)工资为______元/月，绩效工资根据乙方的业绩考核情况核定。如甲方的工资制度发生变化或乙方的工作岗位变动，按新的工资标准确定。

2、计件工资。甲方应制定科学合理的劳动定额标准，计件单价按甲方的有关制度为准。

3、其他工资形式。具体约定如下：________________________________________________________。

(三)甲方(或甲方指定的单位)应以货币形式按月支付乙方工资，发薪日为每月________日。若乙方提供了正常劳动，甲方支付给乙方的工资报酬不得低于当地政府规定的最低工资标准。

(四)合同期内，甲方应视乙方的工作表现情况，给予乙方提高工资待遇的机会。

第六条：社会保险和福利待遇

(一)甲、乙双方必须依法参加当地政府规定的法定社会保险，并按照国家有关规定按时向劳动保障部门所属社会保险机构缴纳社会保险费，其中乙方应缴纳部分由甲方从乙方工资中代扣代缴。

(二)乙方因工负伤(死亡)和患职业病，依法享有获得医疗救治、经济补偿的权利。

(三)乙方在劳动合同期内患病、非因工负伤，依法享有国家规定的医疗期。

(四)乙方的福利待遇按国家及甲方的规定执行。

第七条：劳动合同的变更、解除、终止、续订

(一)有下列情形之一的，甲、乙双方可以变更本合同：

1.在不损害国家、集体和他人利益的情况下，双方协商一致的

2.劳动合同订立时所依据的客观情况发生了重大变化，经与乙方协商一致的

3.由于不可抗力的因素致使劳动合同无法完全履行的

4.劳动合同订立时所依据的法律、法规已修改的

5.法律、法规规定的其他情形。

(二)乙方有下列情形之一的，甲方可以解除本合同：

1.在试用期间，被证明不符合录用条件的。

2.严重违反劳动纪律及甲方规章制度的。

3.严重失职，营私舞弊，给甲方利益造成重大损害的。

4.同时与其他用人单位建立劳动关系，对完成甲方工作任务造成严重影响，或者经甲方提出，拒不改正的。

5.以欺诈、胁迫的手段或者乘人之危，使甲方在违背真实意思的情况下订立或者变更劳动合同的。

6.被依法追究刑事责任的。

(三)有下列情形之一的，甲方可以解除本合同，但是应当提前三十日以书面形式通知乙方：

1.乙方患病或者非因工负伤，医疗期满后，不能从事原工作也不能从事由甲方另行安排的工作的

2.乙方不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作的

3.劳动合同订立时所依据的客观情况发生重大变化，致使原劳动合同无法履行，经甲、乙双方协商不能就变更劳动合同达成协议的。

(四)有下列情形之一的，乙方可以解除此合同：

1.甲方不能按时按量提供乙方合理报酬的

2.甲方未能按时按量提供乙方保险福利的

3.甲方不能提供乙方合理岗位和培训机会的

4.甲方不能为乙方提供更好发展机会的

八、其他约定条款

(1)凡由甲方出资培训乙方，双方另行签订《培训/教育协议》，因乙方原因而提前解除劳动合同，乙方应赔偿甲方的培训等费用，具体赔偿标准执行《培训/教育协议》的约定。

(2)乙方在签订劳动合同之前，甲方有权了解乙方与劳动合同直接相关的基本情况，包括但不限于劳动者的学历、履历、资格或任职证书(明)以及以前劳动关系是否解除或终止等。

劳动者应当如实说明，并应书面承诺其真实性。

若因故意漏报、隐瞒前述基本情况，骗取甲方签订劳动合同的，经甲方查出或被原单位追诉的，视为乙方的欺诈行为并导致甲方的严重误解，甲方有权依法申请认定本合同自始无效，由此给甲方造成的损失，应由乙方全额承担。

(3)乙方未按照本合同第一条规定的到岗日到岗的，本合同自到岗日满后自动失效，但甲方认可的除外。

由此给甲方造成的损失，应由乙方全额承担。

(4)本合同的附件与本合同具有同等效力。

但如果本合同的条款与附件内容有任何冲突或不一致之处，则以附件中的内容为准。

(5)本合同履行过程中，若甲方变更名称、法定代表人或者主要负责人、投资人等事项，不影响本合同履行;若甲方发生合并或分立等情况，本合同继续有效，由承继单位继续履行。

(6)乙方在合同期内，属其岗位职务行为或主要利用甲方的物质技术条件所产生的所有专利、版权和其他知识产权归甲方所有，乙方无权进行商业性开发。

(7)双方签订本合同后，乙方不得在合同期内再受聘其他任何单位从事与甲方相同或类似或有竞争冲突的业务。

(8)乙方对在合同期间得到的有关甲方及其关联公司的情报、信息等商业秘密进行保密，不得将其泄露给任何第三者(亦包括无工作上需要的甲方雇员)。乙方违反保密义务则被视为严重违反本合同，并认为有足够的理由被辞退。此种保密义务在本合同终止或期满后的任何时间对乙方仍有约束力。

十、本合同未尽事宜，法律法规有规定的，按法律法规规定执行;法律法规没有规定的，由双方协商解决;双方协商一致，可以变更本合同。若双方协商不成或者发生劳动争议，应当依法向调解机构申请调解，或者依法申请劳动争议仲裁、向人民法院起诉。

十一、本合同一式________份，自双方签字盖章之日起生效;双方至少各执一份。甲方应按规定建立职工名册备查，并向劳动部门办理备案手续。
