2016年12月市商务局政务公开工作总结

xx年，市商务局按照《市政务公开工作要点》的要求，以全面落实“三进驻”为重点，以贯彻落实《行政许可法》和《湖南省行政程序规定》为契机，不断规范行政行为，努力提高政务公开水平，全面提升了全局依法行政水平，较好地推进和保障了商务工作的深入开展。

一、坚持“四公开”，全方位接受社会监督

按照市委、市政府的要求，逐步实行信息公开、办事公开、职权公开，并就所有办事内容、方式、程序向社会公开承诺，全方位接受社会监督。一是实行办事公开。按照市政府[]19号文件要求，将外资行政审批、外贸经营权行政备案、投资代理、外贸企业资金申报等职能项目交由局驻政务中心窗口全权办理，确定首席代表全权履职，派出6名同志专职进入政务中心，做到项目、人员、职权三到位。二是实行信息公开。切实加强电子政务建设，通过市政府门户网站、市商务局网站和省、市新闻媒体等多种途径，及时公开和刷新公众最关心的信息。对商务部门涉及管理的肉品酒类安全、拍卖典当企业、定点屠宰以及外资外贸企业设立审批和年检等共94项职权的每一项职权项目名称、类别、实施依据、实施条件、程序、办结期限以及收费标准等内容，都在政务大厅和各科室张榜公布。对本局职能、职责和局机关处级领导干部和科室工作人员的职责与要求，通过“政务公开栏”对外公布。三是实行职权公开。按照市纪委的要求，对本局所有行政职权进行了清理，在此基础上，编制了《市商务局行政职权目录》，绘制了“行政职权流程图”，系统地修订了机关规章制度，将按照市委、市政府的统一安排，于明年初以网络的形式面向社会公开。四是进行公开承诺。由单位“一把手”向社会公开承诺，做到“实行首问责任制，依法审批审核许可，推行办事限时制，规范收费行为，严格执罚，规范执法检查，开展优质服务，进行违诺责任追究”。

二、切实规范行政行为，机关工作效率逐步提高

一是坚持依法行政。利用机关学习时间，组织全体工作人员认真学习《中华人民共和国行政许可法》、《行政程序法》及局机关相关法规如《生猪定点屠宰管理条例》、《成品油管理办法》、《酒类流通管理办法》等，提高大家的依法行政意识；与市法制办衔接，组织机关全体人员分期分批进行培训，领取执法证，确保亮征执法，严防各种损害群众利益的行为发生；按照行政处罚裁量权基准的要求，制定印发了《市商务局行政处罚裁量权基准（试行）》。在生猪屠宰管理、酒类管理、成品油市场管理三项工作中，严格规定了处罚依据、违法行为情形和处罚基准，并要求全体工作人员遵照执行。

二是规范从政行为。局机关办公室进行广泛调研，对原来的机关制度进行了修改完善，形成了十七项机关制度。同时，针对大额资金的运用，局党组专门研究制定了《招商引资资金管理办法》，对资金的审批和运用进行了规范。在此基础上，局机关推行开门办公，实行工作考勤，全面推行岗位责任制、服务承诺制、办事公开制、首问负责制、限时办结制、挂牌上岗制等制度，建立健全考勤考绩和责任追究制度，实现以制度管人管事，使制度建设贯穿于机关效能建设的各个方面和各个环节，增强针对性和可操作性。与此同时，加强对制度建设和执行情况的监督检查，着力解决工作中的“四难”现象，努力消除办事拖拉、工作推诿、纪律涣散、政令不畅等问题，确保各项制度真正落到实处，进一步形成心齐、气顺、劲足、实干的良好氛围。

三是加大审批项目的清理力度。今年来，根据【】1号、2号市长令和永证办发【】6号、永证办函【】56号的规定，将我局的行政审批项目缩减到2项，清理了其他服务事项41项，并按照要求上报了网上政务服务和电子监察系统政务服务事项。

为进一步强化服务意识，提高服务水平和办事效率，转变工作作风，密切党同人民群众的联系，理解人民群众监督，我社区党支部现公开郑重承诺：

一、不断加强组织建设。进取利用远教、创先争优、党员座谈、冬春训等形式逐步提高党员素质和本事，提高党员干部服务水平，建设群众满意服务窗口;加强党风廉政建设，定期召开党员生活会，使全体党员自尊自律、廉洁奉公。

二、狠抓水利建设。扎实做好农田水利建设，争取硬化六口骨干塘;对集镇屋后排水沟进行全面改造。

三、加强集镇建设。对集镇进行全面改造，拆除违章建筑，统一规划集镇招牌和广告牌;争取规划拆迁集镇三角坪，彻底解决集镇交通拥堵情景;建设和维护集镇路灯和绿化。

四、全面加强基础设施建设。完善公路建设，硬化曾家场组、团结组公路;争取对社区主干道进行全面绿化;争取将路灯延伸至江家园组。

五、农村环境整治常抓不懈。狠抓社区环境卫生，继续推行现有的环境管理模式，建立垃圾收集处置长效机制，重点治理群体聚餐后环境卫生清理工作;做好森林防火工作，遏制乱砍乱伐，保护森林资源。

六、全面落实群工站工作。切实贯彻“一推行四公开”制度，充分发挥群众工作站密切联系群众的桥梁作用，为群众化解矛盾和纠纷，解决困难和问题。

七、群众文化工作全面推进。广场舞队坚持每日锻炼，腰鼓队、舞龙舞狮队定期开展活动，争取举行1—2次规模较大、群众参与面广的群众文化活动。

八、食品安全从严监管。继续落实农村聚餐上报制度。做好副食品从业人员和餐饮从业人员、流动厨师的培训工作。

九、妇女计生工作全面落实。继续做好妇女工作，继续落实各项计生政策和奖励措施，发挥计生协会作用，控制大月份流产，杜绝违法生育，争创计生模范社区。

故而，双方经友好协商对剩余款项的支付事宜达成如下补充协议：

1.        同意免除自20__年1月1日起至20__年12月31日的授权使用费81,666美金；减免之后，Camsing应付的款项为163,334美金（计算方式：245,000 -81,666=163,334）。同意，按本协议约定支付减免后的授权使用费163,334美金后，不再向主张任何费用，包括但不限于授权使用费、违约金等。

4.       应严格按照分期付款计划执行，如有一期逾期支付则视为违约，届时剩余应付款项的支付期限立即到期，并且原先减免的20__年度81,666美金的授权使用费不再减免，将一同并入应付款项由立即一次性全额支付，同时，还应按未付款项总金额每日万分之五的标准向支付逾期付款违约金。

5.        法律适用及争议解决：本协议适用中国法律。凡因本协议引起的或与本协议有关的任何争议，均应提交至深圳国际仲裁院（SCIA）按照其仲裁规则进行仲裁，届时败诉方应承担对方为解决本争议而产生的一切合理费用，包括但不限于仲裁费、律师费、差旅费、评估费、调查费、鉴定费等相关费用。

Applicable Law and Dispute Resolution: This Agreement shall be governed by the laws of China. Any dispute arising from or in connection with this Agreement shall be submitted to Shenzhen Court of International Arbitration (SCIA) for arbitration according to SCIA’s Arbitration Rules, and the losing party shall bear all reasonable ges of the other party concerning dispute resolution, including but not limited to arbitration fees, lawyer’s fees, business trips costs, evaluatioges, investigation fees, appraisal costs, etc.);

6.        本协议生效后，即成为原协议不可分割的组成部分，与原协议具有同等法律效力。除本协议对于剩余应付款项的约定外，原协议的其余部分应完全继续有效。如本协议与原协议发生冲突时，以本协议为准。

This Agreement, after its entry into force, becomes an integral part of the Initial Agreement and has the same legal effect. Except for the provisions about the remaining unpaid payment stipulated herein, other provisions of the original agreement shall remain in full effect. In case of any discrepancy, this agreement shall prevail.

This Agreement is written in Chinese and English. In case of any discrepancy, the Chinese version shall prevail.

8. 本协议一式贰份，经双方盖章及代表人签字后生效，双方各执壹份，具有同等法律效力。
