第八条 保密和知识产权

8.1 对本协议内容以及在本协议签订执行过程中获悉的对方所有相关信息(包括但不限于原件、译件以及其他任何形式的信息)，甲乙双方均应承担保密义务;未得到对方事先的书面许可，不得向第三方公开或泄露。

8.2 乙方应按甲方要求，将载有甲方信息的介质(包括但不限于书面资料、电子文件、媒体以及复制品和其它资料)区分管理，以确保信息文件的安全和完整;当甲方提出归还或销毁要求时，应按要求归还或销毁。

8.3 甲乙双方均应受本保密条款约束;在本协议终止后，本保密条款在三年内持续有效。

8.4 如果甲乙双方另行签订《保密协议》的，本条款未尽之保密事宜或本条款约定内容与双方达成的《保密协议》内容不符时，以《保密协议》约定为准。

第九条 违约责任

9.1 由于甲方原因推迟向乙方提供原件或相关支持文件，甲方应承担相关损失。

9.2 因甲方提供的原件存在问题，导致的翻译错误由甲方承担。

9.3 在甲方如期提供原件的情况下，如乙方未按约定日期按约定要求完成翻译服务，甲方有权解除协议并视为乙方违约，乙方应向甲方支付协议总额 %的违约金作为赔偿。

9.4 因乙方自身翻译失误所带来的经济损失由乙方承担。任何情况下，乙方承担的直接和间接的经济损失最多不得超过本合同涉及项目金额的 1 倍。

9.5 在乙方无违约的状况下，甲方应按协议约定及时付款。如甲方没有及时向乙方付款，每逾期一日，甲方应向乙方支付协议总金额的%作为违约金，直至付清所有费用为止。

9.6 甲方在约定的交付日期前取消所委托部分或全部的翻译内容，甲方应向乙方支付乙方实际已经完成部分的费用，乙方应向甲方交付已经完成的译件。

第十条 不可抗力

10.1 在协议履行过程中，由于不可抗力(例如战争、严重火灾、水灾、台风、地震等不可遇见、不可避免且不可克服的事件)导致协议不能履行或延期履行，协议双方互不承担违约责任。但受不可抗力影响的一方应在不可抗力发生后 24 小时内通知另一方不可抗力发生情况，且在不可抗力发生之后工作日 日内出具书面证明。

10.2 遭遇不可抗力影响的一方仍然有义务采取相应的措施减少损失。如果不可抗力的影响导致协议最终无法履行，双方另行协商善后事宜。

本协议适用中华人民共和国相关法律法规。

第十二条 争议的解决

I am a third year master major in automation at Shanghai Jiao Tong University, P. R. Ch ina. The scheduling was designed for the rubber-making process that covered not only discrete but also continuous circumstances. To make a balance point between optimization quality and time cost, I proposed a Dynamic Layered Scheduling method based on hybrid Petri Nets. The practical application showed that the average makespan was shortened by a large scale. I also publicized two papers in core journals with this idea. Recently, I am doing research in the Composite Predict of the Electrical Power system assisted with the technology of Data Mining for Bao Steel. I try to combine the Decision Tree with Receding Optimization to provide a new solution for the Composite Predictive Problem. This project is now under construction.

4. 为确保乙方翻译服务能够达到甲方要求，在本合同签订时，乙方可应甲方书面要求进行试译，供双方核定并确认质量标准。如果甲方在收到试译稿后3日内未向乙方提出书面意见或建议，则该试译稿的质量标准将作为乙方今后的质量标准。

5. 译文中不应出现技术性错误，不能与原文意思相悖，专业词语表述应准确一致;文字表述符合相关专业的表达习惯与要求，目标语言与源语言在行文风格上一致;符号、量和单位、公式和等式需按照译文的通常惯例或国家有关规定进行翻译或表达，译者的注释使用恰当;

6. 对于笔译项目，乙方在向甲方交付工作成果后，若存在以下三类错误，乙方应对工作成果进行必要修改，并不得另行收费：____________

(1) 语法与单词拼写错误;

(2) 同一或同批稿件中前后用词或表达法不统一;

(3) 由于专业或背景知识不足发生的错误。

第三条 为保证乙方有效进行翻译服务工作，甲方应当向乙方提供下列工作条件和协作事项：____________

3. 为保证翻译质量，甲方应尽可能协助乙方，包括但不限于向乙方提供翻译项目所需的参考资料，专业的固有、惯用译法，解答相关技术问题，必要时提供相关背景知识培训。

(3) 本合同服务费用按以上单价标准，以甲方订单要求的服务工作量计算。如翻译项目有特殊情况需要调整价格的，经甲乙双方一致后在订单中明确。

(4) 乙方因履行本合同而产生的加急费、特殊排版费、差旅费、交通费、食宿费等费用经甲乙双方一致后在订单中明确。

2. 翻译服务费由甲方选择以下 B 方式支付乙方。(根据确定的交易方式)

方式A.在双方签订本合同及订单后二个工作日内，甲方应当支付乙方费用总额的50%作为预付款，余款在乙方完成翻译服务后五个工作日内支付。支付可采用现金、支票或银行转账等方式。

暑期日语翻译实习总结

首先我很庆幸自己能有机会在电视台实习，虽然实习期短而仓促，期间也遇到了很多困难，但是不得不说从这次实习中我学到了很多。

在经历大学四年的日语学习之后，没有给自己太多的进入社会去检验日语水平的机会，就直接进入到研究生阶段的学习了，我不知道自己的日语到底怎么样，总之还是太缺乏日语方面的实践，而这次的实习恰好提供了这样的机会，所以我非常珍惜也非常投入。

这次主要的工作内容是对视频的翻译，视频的内容主要是围绕中日历史方面的问题，所以里面会出现很多历史事件的名称和特定人物。因此，要做好这个视频翻译，前期工作必不可少。首先，我必须得了解整个历史事件的来龙去脉同时还要熟悉其中的历史人物。在这方面，我觉得可以称之为专业领域了吧，即使日语水平再好，如果不做好前期工作的话，后期的翻译工作也是很难进行的。其次，视频翻译不同于笔译，笔译直接对着相关的文本翻译就好，而视频翻译，必须得先听，然后再翻译，也就是说，首先要听懂才能翻译成文字。这个过程其实是很痛苦的，特别是碰到说话人没有说清楚或是说的很快抑或是自己不熟悉的点的时候，真的很棘手。最后，在听懂的基础上，要能将自己听懂的内容很好的转化为文字，所以翻译其实与自己的母语水平是息息相关的。转化为文字的过程中要充分考虑中文的表达习惯，才不至于翻出来的文字不伦不类。

通过这次翻译，真的学到了很多，也明白了很多。

翻译不是一件易事。在整个的翻译过程中，我真的有很多次想过要放弃。因为视频的时间很长，而听每一分钟都得集中所有精力努力去听，去查。没做这之前，我从来不知道人一分钟可以说这么多话，所以一个小时的视频翻译花了我将近一个礼拜的时间，而这一个礼拜除了上课就是翻译，真的，翻译是一件不仅要脑力还要体力的事。

翻译需要技巧。我记得刚开始的时候，我是在听视频的时候听一句写一句，然后再成段的翻译，这样翻译虽然准确，然后却相当耗时。后来，我开始听一大句话，先听明白，将大概的中文意思写下来，然后边听边进行补充，这样一来，节约了很多时间。事实上因为视频里也主要是说的，除了一些专有名词之外其他部分都是口语，所以没有什么大问题，也不需要逐句写下来。所以，翻译是需要技巧的。

坚持才是王道。整个的翻译过程很辛苦，有的时候听不出来也很抓狂。但是每一分钟每一分钟去听，总会有听完的时候。当我完成的时候，虽有有些部分还是没有很好的听出来，但我真的觉得很欣慰。至少，我努力了，我尽力了，这样就很好了。不断这样去锻炼自己，我相信自己的实践能力也会随之提高。

最后我只想吐槽一句，为什么不发工资！
