3.房屋租金承担：酒吧使用房屋房租由甲方承担，但本合同前3个月的房租每月8000元，共人民币2.4万由乙方承担。

4.酒吧费用承担：乙方接管后，酒吧经营产生的所有费用由乙方承担，包括但不限于水费、电费、电话费、电视收视费、供暖费、燃气费、物业管理费、卫生费、上网费、车位费、室内设施维修费、垃圾费等。

六、酒吧设施维护与维修

地址：(本合同履行过程中所有文件及通知以特快专递或挂号信箱寄至上述地址即视为送达，收件人拒收或未签收导致退回的，仍视为送达。)合同双方经过友好协商，本着互惠互利的原则，平等协商，达成如下协议：

一、租赁双方出租及承租长沙市 天心区劳动西路245号凯瑞大厦1908、1909 物业 (下称房屋)，建筑面积约为： 168 平方米，购房合同号码20_02931908、20_02931909 ，承租该房地产仅限于作办公用途。

出租人保证如实陈述该房产权属状况、坐落、装修等情况，承租人已对上述具体情况做 了充分了解，双方在此基础上自愿签订本合同。

二、租期自 20_ 年 5 月 16 日起至 20_ 年 6 月 9 日止。出租方 应于 20_ 年 5 月 16日前将该房屋交付给承租方使用，自交付之日起 25 日内为免租期，用于承租方进行装修，期间不计租金。

三、租金、押金及其他费用

(一)、在租赁期内，租金为每月人民币 壹万肆仟壹佰壹拾贰 元(小写：￥ 14112 元)整。季租金额为 肆万贰仟叁佰叁拾陆元整 (小写 ￥42336元)整。

(二)、租金按 季度 结算，承租方应于每次租金到期前 壹拾伍 天支付租金给出租方。 支付方式为[ × ]现金支付/[ √]转账支付(承租方将租金存入出租方指定的以下银行账户，视为出租方收款有效。开户银行： 长沙雨花农村合作银行 户名： 鲁艺账户： )。

(三)、上述租金【×】包含/【√】不包含租赁税费。

(四)、租赁期间，每月的物业管理费、电话费、煤气费、电视收视费、水电费、卫生 费等杂费，均由承租方支付。(20_年度的物业管理费已交)

四、出租方义务

(一)、出租方应按照本合同约定的期限交房，并办理相关移交手续。如出租方延期交房，则承租方无需支付迟延期间的租金，每逾期一日，出租方需赔偿拖欠部分1%的滞纳金给承租方。

(二)、在租赁期间，如系正常使用或自然老化所造成的房屋及有关设施损毁，出租方应在接到承租方通知后及时组织维修，履行维修义务，所需费用由出租方承担。

(三)、出租方在租赁期间，不得出售或转租该房产。如果不得已的情况需要出售，需 提前三个月通知承租方，承租方在同等条件下，享有优先购买权。

(四)、出租方保证在租赁期间保持该房屋始终符合约定的用途，该房屋及有关设施处于良好的可正常使用状态。承租方的正常使用不受第三方的非法干扰和破坏。

(五)、若因出租方原因，导致承租方无法按合同约定用途正常使用该房地产的，则承租方有权单方解除合同，并向出租方进一步追究责任。

五、承租方义务

(一)、承租方应妥善使用该房屋及有关设施，如故意或过失损毁，应负责修缮和回复

原状或向出租方赔偿经济损失，所需费用自行承担。

(二)承租方使用该房屋时，不得储存任何违禁品，不得从事任何违法活动，未经出租方书面同意不得改变房屋结构和用途。承租方有前述行为之一的，出租方有权立即单方解除合同，没收押金并向承租方进一步追究责任。

(三)、承租方应及时足额交纳租金、物业管理费等杂费，每逾期一日，出租方有权加 收拖欠部分1%的滞纳金。如若欠租金超过 7天，出租方有权立即单位解除合同，没收押金并有权向承租方进一步追究责任。

(四)、承租方如不按时支付租金，出租房有权单方解除合同。合同签订之日起房屋所产生的费用，包括装修期水电，物业等费用及纠纷有承租方负责。出租方有权立即单方面解除合同，没收押金并向承租方进一步追究责任。

六、转租、分租按下列第 a 种方式约定

a：租赁期内，承租方无权将该房屋转租、分租给他人，否则按违约处理。

b：租赁期内，承租方有权将该房屋转租、分租给他人。

c：租赁期内，承租方在征得甲方同意前提下，可以将该房屋转租、分租给他人。

七、提前终止合同

(一)、租赁期内，出租方若因非承租方的原因提出提前终止合同，需提前 2 个月通知承租方，承租方有权要求出租方退回多缴纳的租金并赔偿因出租方提前终止合同给承租

方造成的损失。

(二)、租赁期内，承租方若因非出租方的原因提出提前终止合同，需提前 2 个月通知出租方，出租方有权没收租金，并赔偿对出租方造成的经济损失，承租方需承担赔偿责任。

(三)因征地拆迁等不可抗力原因导致合同不能继续履行的，租赁合同自行终止，双方 互补承担责任。

(四)、违反第六条关于转租、分租约定的条款。出租方有权没收押金，并赔偿对出租 方造成的经济损失。

八、物业及设施的交回

(一)、租赁期满，如需续租，承租方应在租赁期届满前 2 个月向出租方提出书面 申请，在同等条件下，承租方享有优先承租权。

(二)、如因承租方违约而导致出租方单方面解除合同，或合同租赁期满而又不续租，承租方应在接待出租方接触合同通知之日或合同期限届满之日起三日内无条件搬出该房屋，同时结清费用。

(三)、承租方拒不交回物业钥匙或拒不搬离物品的，出租方有权进入该房屋内，将承租方物品清点处理，用于抵偿拖欠的租金和杂费，承租方无法联络的，出租方有权自行相互

之间。承租方保证自愿接受出租方的上述处理措施，绝不会提出任何异议或赔偿要求。

(四)、承租方在租赁期间对该房屋的装修，在交回该房地产给出租方时，可以搬走搬 移不会损坏室内结构及装修部分，其它部分秉持来装去留的原则处理。

九、代表人/代理人承诺并声明：在签署本合同时，已获得委托人的委托授权(包括书面委托和口头委托)，否则自愿承担因委托人违约所造成的法律及经济赔偿责任。

十、本合同一式肆份，内容必须一致，任何私自修改部分均视为无效，自双方代表人签 字或盖章之日起生效。

十一、备注(备注条款内容与前述条款签署内容不一致的，以备注条款为准)第一、如承租方需开具租赁发票，租赁税费由承租方承担第二、承租方在装修和使用过程中如果毁坏消防设施，由此所造成的一切后果由承租方承担。

第三、双方签订合同之后，乙方支付甲方一个月租金即人民币：壹万肆仟壹佰壹拾贰元整(￥14112元整)，免租期结束后，乙方装修完毕之后，再付给甲方两个月租金即人民币：贰万捌仟贰佰贰拾肆元整(￥28224元整)，作为第一季度的使用租金。从第二季度开始按合同条款三执行。
