重大疾病定期保险条款
保险合同构成
第一条 本保险合同（以下简称本合同）由保险单及其所载条款、声明、批注，以及和本合同有关的投保单、复效申请书、健康声明书、体检报告书及其他约定书共同构成。
保险责任的开始及缴付保险费
第二条 中保人*保险有限公司（以下简称本公司）对本合同应负的责任，自投保人缴付第一期保险费且本公司同意承保而签发保险单时开始。除另有约定外，保险单签发日即为本合同的生效日，生效日每年的对应日为生效对应日。
本公司同意承保且收取第一期保险费时，应签发保险单作为承保的凭证。
合同撤销权
第三条 投保人于收到保险单之日起十日内可亲自或以邮寄方式书面连同保险单向本公司申请撤销本合同。合同撤销的效力，自投保人寄出邮戳次日零时起或亲自送达时起生效。合同撤销后发生的保险事故，本公司不负保险责任；但合同撤销前若发生保险事故，则本公司仍依本合同的规定负保险责任，但合同不得撤销。

保险费的垫交
第五条 第二期及第二期以后的分期保险费超过宽限期间仍未缴付，而本保险单当时的现金价值足以垫交保险费及利息时，除投保人事前另以书面作反对声明外，本公司自动垫交其应缴保险费及利息，使合同继续有效。如发生保险事故，本公司应从给付保险金中扣除本公司垫交的保险费及利息。
本保险单当时的现金价值不足以垫交一期保险费及利息时，本公司退还现金价值，本合同效力即行中止。
合同效力的恢复
第六条 本合同效力中止后，投保人可在效力中止日起两年内，填妥复效申请书及被保险人健康声明书申请复效
前项复效申请，经本公司同意并投保人缴清欠缴的保险费及利息后，自次日起，本合同效力恢复。
保险责任
第七条 在本合同有效期内，被保险人于本合同生效或复效之日起一百八十日以后初次发生、并经本公司指定或认可的医疗机构确诊患重大疾病时，本公司按保险单所载保险金额给付重大疾病保险金，本合同效力即行终止。
第八条 在本合同有效期内，被保险人（一）因意外伤害而身故，或（二）于本合同生效或复效之日起一百八十日以后因疾病而身故时，本公司按保险单所载保险金额给付身故保险金，本合同效力即行终止。
第九条 在本合同有效期内，被保险人（一）因意外伤害而致身体高度残疾，或（二）于本合同生效或复效之日起一百八十日以后因疾病而致身体高度残疾时，本公司按保险单所载保险金额给付身体高度残疾保险金，本合同效力即行终止。
第十条 在本合同有效期内，被保险人生存至七十周岁的生效对应日，本公司按所交付的保险费（不计利息）给付满期保险金，本合同效力即行终止。
责任免除
第十一条 被保险人因下列情事之一而患重大疾病，身故或身体高度残疾时，本公司不负保险责任：
一、投保人的故意行为；
二、受益人的故意行为；
三、在合同订立或复效之日起二年内自杀或故意自伤身体；
四、故意犯罪、吸毒、殴斗、酒醉；
五、战争、军事行动或动乱；
六、罹患获得性免疫缺陷综合症（艾滋病）、性病、先天性疾病或遗传性疾病；
七、核爆炸、核辐射或核污染；
八、无驾驶执照、酒后驾驶；
九、被保险人于本合同生效或复效之日起一百八十日以内患重大疾病。
发生第一款情形时，本公司向其他享有权利的受益人退还保险单现金价值；发生第九款情事时，本公司向投保人退还保险费；发生其他各款情形时，本公司向投保人退还保险单现金价值。
本公司退还保险单现金价值或保险费后，本合同效力即行终止。
身体高度残疾鉴定
第十二条 被保险人因意外伤害或疾病而致身体高度残疾，应在治疗结束后，由本公司指定或认可的医疗机构进行鉴定。如果自被保险人遭受意外伤害或罹患疾病之日起一百八十日内治疗仍未结束，按第一百八十日的身体情况进行鉴定。
保险事故的通知与保险金的申请时间]
第十三条 在本合同有效期内，投保人、被保险人或受益人应于知悉被保险人身故或发生其他保险事故之日起七日内以书面通知本公司，并应于被保险人发生保险事故后三十日内向本公司申请给付保险金，否则投保人、被保险人或受益人应负担由于通知迟缓致使本公司增加的查勘、调查费用。
保险金的申请与给付手续
第十四条 被保险人申请领取重大疾病保险金时，应出具下列文件：
一、保险单及保险金申请书；
二、最近一次保险费的缴费凭证；
三、被保险人的户籍证明与身份证件；
四、附有本公司指定或认可的医疗机构出具的病理显微镜检查、血液检验及其他科学方法检验报告的疾病诊断证明书。
第十五条 受益人申请领取身故保险金时，应出具下列文件：
一、公安部门或县级以上（含县级）医院出具的被保险人死亡证明书；
二、保险单及保险金申请书；
三、最近一次保险费的缴费凭证；
四、被保险人的户籍注销证明；
五、受益人的户籍证明与身份证件。
第十六条 被保险人申请领取身体高度残疾保险金时，应出具下列文件：

凡因本合同引起的或与本合同有关的任何争议应协商解决。若协商不成，应提交中国国际经济贸易仲裁委员会深圳分会，按照申请时该会当时施行的仲裁规则进行仲裁。仲裁裁决是终局的，对双方均有约束力。
any dispute arising from or in connection with the contract shall be settled through friendly negotiation. in case no settlement is reached， the dispute shall be submitted to china international economic and trade arbitration commission (cietac)，shenzhen commission， for arbitration in accordance with its rules in effect at the time of applying for arbitration. the arbitral award is final and binding upon both parties.
23. 通知(notices)：
所有通知用____文写成，并按照如下地址用传真/电子邮件/快件送达给各方。如果地址有变更，一方应在变更后__日内书面通知另一方。
all notice shall be written in _____ and served to both parties by fax/courier according to the following addresses. if any changes of the addresses occur， one party shall inform the other party of the change of address within ____days after the change.
24.本合同使用的fob、cfr、cif术语系根据国际商会《XX年国际贸易术语解释通则》。
the terms fob、cfr、cif in the contract are based on incoterms of the international chamber of commerce.
25. 附加条款 (additional clause)：
本合同上述条款与本附加条款抵触时，以本附加条款为准。
conflicts between contract clause hereabove and this additional clause， if any， it is subject to this additional clause.
26. 本合同用中英文两种文字写成，两种文字具有同等效力。本合同共__份，自双方代表签字(盖章)之日起生效。
