出国留学合同

(具有法人资格的)单位(简称甲方)的法定代表人(姓名)委托本单位(姓名)为代理人与(单位、姓名、性别、出生年月、住址) (简称乙方)，就甲方派遣乙方出国留学事宜，签订如下协议：

第一条 甲方根据人才培养和事业发展的需要，派遣乙方出国留学，乙方按受甲方的派遣。

第七条 甲方在乙方回国后，负责安排乙方的工作，并积极创造必要的工作和生活条件，发挥乙方的作用。

第八条 乙方保证按本协议书第二条、第三条的规定，在国外努力完成学业，并按期回国服务。留学期间每 个月向甲方报告一次学习情况。

第九条 乙方抵达留学所在国后，一个月内中国驻该国使、领馆报到。乙方在国外期间，保证遵守中国法律和中国对出国留学人员的规定，遵守所在国的法律。

第十条 乙方无论因何种理由中止、延长留学期限或改变留学内容，均应至少提前三个月通过中国驻留学所在国使、领馆向甲方提出书面申请，未经甲方批准，不得改变。

第十一条 乙方留学期满回国后，应在一个月内向甲方报到，按甲方规定办理有关手续。乙方根据本协议书第三条的规定，向甲方提交书面的留学总结、学术报告(或科研论文、科研成果报告)。

第十二 条 乙方有责任回国后至少在甲方工作 年。缩短工作年限，由甲方决定。

第十三条 甲方在认为必要时，有权决定将本协议书的副本经由我驻外使、领馆提交乙方留学所在国的有关部门或个人。

第十四条 甲方违反本协议书时，乙方有权向甲方的上级主管部门提出申诉，要求甲方的上级主管部门责成甲方执行本协议书，赔偿损失等。必要时，乙方可向中国的司法机关起诉，追究甲方的法律责任。

乙方违反本协议书时，甲方将根据乙方违约情况，对乙方批评教育，或给予行政处分，或停止公费待遇，或停薪留职，或要求乙方赔偿损失;必要时，甲方可将乙方违约的事实通知乙方留学所在国的有关部门或个人，或向司法机关起诉，追究乙方的法律责任。

第十五条 经甲方同意，由(姓名、性别、出生年月、工作单位、职务)

为乙方出国留学的国内保证人、保证乙方执行本协议书。保证人须与乙方经常保持联系，每半年向甲方介绍乙方执行协议书的情况;如乙方违约，保证人须认真协助甲方追究乙方的责任。在乙方违约而保证人又未履行自己职责的情况下，保证人须承担本人经济收入能承受条件下的经济责任。

甲方与保证人因保证事项而发生纠纷时，经双方同意，可由甲方的上级主管部门裁决。

第十六条 本协议书自公证之日起生效，签字各方保证遵照执行。有效期限至本协议书第十二条规定的工作年限期满时止。

必要时，经甲方、乙方、保证人三方协商一致后，可对本协议书进行修改或补

充。

为加强铁路集装箱运输管理，发展铁路集装箱门到门运输，加速铁路集装箱周转，保证铁路集装箱货物运输安全，经甲方与乙方充分协商达成协议如下。

一、双方职责

1.甲方应提供状态良好的铁路集装箱空箱供乙方使用，乙方在使用前必须检查箱体状态，发现箱体状态不良时，甲方应予以更换。

对到达的铁路集装箱甲方应及时发出催领通知，并在货票(丁联)内记明通知方法和时间，必要时应再次催领。

2.乙方应由专人负责铁路集装箱门到门运输业务，并配备固定的能够保证集装箱运输安全的专用车辆。

3.乙方受托运人（收货人）委托办理铁路集装箱门到门运输业务时，必须与托运人（收货人）签订委托书，承担托运人（收货人）相应责任，未签订委托书的不得办理门到门运输业务，委托书在办理托运（领取）时向车站提交。

4.乙方应确保门到门运输集装箱在门到门运输途中的安全，做到爱箱爱货。

5.乙方对门到门运输的发送集装箱内所装货物真实性负责，甲方对乙方门到门运输的集装箱货物品名有疑问时，有权要求乙方开箱检查，乙方应主动开箱配合检查。

6.甲乙双方应加强对集装箱的交接检查，责任划分为交接前由交方负责，交接后由接方负责。

7.发送的集装箱应于甲方指定的进站日期当日进站完毕。到达集装箱应于甲方发出催领通知的次日起算，2日内领取集装箱货物，并于领取的当日内将箱内货物掏完或将集装箱搬出。

重去空回或空去重回的铁路集装箱，应于领取的次日送回；重去重回的铁路集装箱应于领取的3日内送回。

二、保证金管理

1.乙方在本协议签订后，铁路集装箱门到门运输前，将保证金人民币________万元汇入甲方指定的帐户，专用于支付由于乙方责任造成的铁路集装箱损坏、丢失的赔偿。保证金按预付款管理。

2.保证金因发生赔偿而不足时，乙方应于结算之日起两日内补足差额。双方互不清算利息，终止协议后保证金退还乙方。

三、违约处罚

1.集装箱货物（含空自备箱）在车站存放超过免费暂存期限，甲方按规定核收货物暂存费。铁路箱超过免费使用期限，自超过之日起核收集装箱延期使用费。

2.利用到达集装箱装运发送货物，未经甲方批准擅自装箱进站的，返回的集装箱按空箱接收，由此产生的经济损失由乙方负责。

3.甲方发现乙方有集装箱超重、夹带违禁品、危险品、匿报品名、装载状态不良危及集装箱箱体及运输安全等情况时，除按有关规定处理外，并处以_______元/箱的罚款。

4.由于乙方原因造成集装箱破损或丢失，应按有关规定进行赔偿，赔偿费在保证金中扣除。

四、协议的终止

1.乙方发生下列行为时，甲方有权终止协议：

①伪造具备门到门运输条件的；

②未按规定支付保证金的；

③发生集装箱匿报品名装运货物的；

④发生路风事件和社会投诉较多的；

⑤发生集装箱超载情节严重的；

⑥恶意修改箱号及相关标志标记的；

⑦门到门运输业务转包给其他单位（公司、个人）；

⑧发生铁路箱责任被盗、丢失的；

⑨其它危及铁路运输安全的。

五、甲乙双方必须共同遵守本协议有关规定，如违反上述协议，双方终止协议。本协议一式两份，甲、乙双方各执一份，自签订之日起生效。

第一条 工程概况和造价

1. 甲方需加盖的住房系合法拥有，且加盖手续合法。甲方承诺有权对该住房进行改建，由此而产生的一切后果由甲方承担责任。

2. 三楼上，前面扩建面积38.00平方米，后面整改瓦面35.00平方米，一至三楼的铁楼梯。前房屋最高处3.00米，低处2.60米，后房屋瓦面整理。

3. 承包方式：以乙方承包施工的方式承包。

4. 工程总价款(人工费)为四千六百元整. ￥:4600.00。

第二条 工程价款及结算：

第三条 施工配合

1. 甲方工作：

(1) 在装饰施工前，向施工所在地的物业管理企业申报登记。

(2) 甲方应在开工前三日向乙方提供施工所需的水、电等必备条件。

(3) 做好施工中因临时占用公用部位操作而影响邻里关系等协调工作。

(4) 工程开工前，甲方应将房屋分户钥匙交乙方保管。

(5) 甲方应告知施工所在地的物业管理企业有关物业管理的规定，以便乙方遵守执行。

2. 乙方工作：

(1) 在开工前检查水、电、燃气、管道、楼(地)面、墙面，发现问题应及时通知甲方，由甲方负责解决和协调。

(2) 早上七时前及晚上七时后不得进行有噪音的施工作业。

(3) 乙方负责清运施工中产生的垃圾，并按照物业管理企业指定的地点堆放。

(4) 乙方在施工过程中，负责自身施工安全，若因乙方不慎出现安全事故，甲方概不负责。

3.由于甲方原因造成在施工中大量增加施工项目、变更施工内容、装饰材料及设备的，甲方应及时和乙方协商相应顺延工期。

第四条 合同的变更和解除

1、合同经双方签字生效后，双方必须严格遵守。任何一方需变更合同内容，应经协商一致后，重新签订补充协议。合同签订后施工前，一方如要终止合同，应以书面形式提出，并按合同总价款 %支付违约金，办理终止合同手续。

2、施工过程中任何一方提出终止合同，须向另一方以书面形式提出，经双方同意办理清算手续，订立终止合同协议，并由责任方按合同总价款 %赔偿，解除本合同。

第五条 附则

1. 本合同由甲乙双方签字、盖章后生效。

2. 本合同签订后，工程不得转包。

一、加大常规管理工作力度，促进校园平安建设

本学年学生科加强日常管理工作力度，力求在严、细、实上下工夫。充分发挥了学生干部的作用，对早读、晚自习、英语寝室和上课纪律进行常规管理及检查考核，特别是第二学期成立了“英语寝室检查部”，对各宿舍英语寝室开展情况实行日检查、周评比的考核办法，保证了我系英语寝室学习活动的正常开展。

1、管理工作落到实处，考核评比责任到人。

(1)坚持做好学生日常行为规范教育及习惯养成教育。如学生科每天安排值班人员，分别对早操、早读、晚自习的迟到和早退现象进行检查、通报;为严格课堂教学秩序，我系安排各班长和任课教师分别对学生的上课情况进行检查，一周汇总后分别交学生科和教务科，学生科、教务科各自汇总后，把结果报系领导进行及时处理，该办法的实行有效解决了课堂不考勤和考勤结果不实的问题，也便于系领导对各班级的上课情况进行掌握，通过该措施学生的课堂出勤率有了明显提高。为使班主任及时了解学生情况，每周班级例会时间学生科将上周学生“宿舍卫生、违纪、考勤情况”进行通报，提高了班主任工作的针对性。

本学年学生科加强与班主任的沟通联系，积极协助他们解决班级存在的问题，通过召开班主任座谈会探讨学生管理方面的成功经验和做法。每周日下午班会前召开班主任会议，传达班会内容、指导班主任开好班会，同时听取班主任意见，统一思想认识。在工作中，以量化考核促工作成效，建立并实施完善的班主任评价体系，发挥评价体系的激励作用，不断加强班主任队伍建设。

Since the last few years, I had aspired to become a doctor.The idea of "scalpels," "opened chests" and "sutures" had always intrigued me.And then it happened!The recent unprecedented events in my country wiped off the dust of disillusionment from my eyes;I lost my will to become a doctor.However,the turmoil in the country led me towards newspapers and news channels,and hence Politics.

As I involved myself into politics,I realized that it is all-embracive-wielding its way over social and economic life-it is the omnipotent of Pakistan.It can mobilize public opinion,gear up propaganda machinery,make or repeal laws and what not.Backed up by public opinion,supported by the majority of the legislators,armed with the means to keep the people in a state of ignorance,political power crosses the limits of dictatorial powers.Political power,like the most powerful intoxicant,makes the persons in power to forget social ethics,political morality and obligations.

Most of the learned youth in this country consider Politics to be "a refuge for the scoundrels" and this derogatory remark may be true if we look at the deceptive and degenerated type of politicians indulging in a dirty game.All these political parties are votaries of democracy,but the way they conduct themselves inside their own parties is nothing but senseless authoritarianism.Therefore a very few students choose to pursue Politics as a profession,but what they dont realize is that if we dont take a stand the system can never be changed.Thus,I want to study Politics so I can come back to my country and contribute what little I can do for my homeland and its people.If I can inspire even a single person,it would be worth it.The world today is growing global.We are now not only to think of our own nation but as and when we think of it,we have to keep the international perception in mind;consequently,I chose Politics with International Relations as one of my courses.

第二条 操作

第五条 担保措施

1、 乙方同意，在其未能依本协议第二条，第三条规定支付甲方有关费用时，甲方有权留置其所占有的乙方本协议项下的标的货物。

2、 乙方应于不少于两个月的期限内履行支付义务。该期限从甲方采取留置措施时开始计算。乙方逾期不履行的，甲方得以将留置物拍卖，变卖或与乙方协议折价，以其价款优先偿付甲方费用。留置物折价，拍卖，变卖后，其价款仍不足以偿付的，不足部分由甲方清偿。

3、 乙方同意，在乙方结清相关费用后，甲方方将报关单证或退税核销单或提单等交给乙方，由此造成的任何损失乙方承担。

第六条 违约责任

1、乙方未依本协议向甲方支付费用，或支付费用不完整的，乙方必须从支付期满日起，按应付款向甲方每日支付 违约金。

2、乙方无正当理由 天不履行某一个月的全部费用或所欠费用超过全部应付费用的 时，甲方可以解除协议并按上款要求违约金。

3、 甲乙双方违反本协议造成对方损失的，按违约时的实际损失赔偿对方。

第七条 争议解决

1、 本协议不尽之处，由双方协商解决或作补充商议。

2、 双方协商不成的，一方可以向人民法院起诉。

第八条 协议的变更和解除

By studying Drama, we can become a variety of people, trapped within one single mind, all trying to be freed and each with their own personality and poison. Humanity has helped Drama so much to produce narrative of such calibre, and characters of such depth and poise – characters, which can be as sweet and innocent, or can take the more disgusting side of what being a human is, being as evil as what thought possible

Performance Art explores the whole range of human emotion and can produce tremendous performances and visual experiences and with Drama, in particular, we can go further than flesh and blood and express ourselves as somebody else and take on this ‘mask’. The most profound thing I have found when studying Drama is that we can become any person in the entire world, and still be us

I have always had a love for the performing arts since I can remember; for there has never really been anything else I have ever wanted to do apart from act. But acting is not just a subject to study people, narratives or social issues – we can discover so many things about ourselves, why we perform a character this way: is it because this person is so much like us? There have been numerous qualities I have discovered about myself while participating in drama. In teaching, I have learn how to really connect with people and help them to explorer what their feelings produce and more notably, how we learn about others, about a single person just by the way they say a monologue

Teaching has been a great experience for me because it has given me the time to evaluate my own performance and teaching skill, learning to become that character just a little but more. This has also been enhanced by the performances I have taken part in, learning to work together in teams to realise the dream of the narration and the vision of the director (for nothing really exists without the vision or image)

While experiencing other aspects of the Performing Arts, I have found that is has increased my performance skill on whole and expended my knowledge on the performance world greatly, Dance, Art and English all focusing on similar issues such as the Commedia dell’arte, Henrik Ibsen, Physical Theatre and Movements and philosophies. These subjects have greatly complemented my time in Drama, and increased my confidence and ability in being a performer. Being involved in 5 consecutive school productions, 2 amateur productions, teaching experience and a student has really influence me concerning the determination I will put into a career in Drama and Acting, and just working with these people and directors have really bettered me in the way I act, see myself and carry on with my life. The Performing Arts is such a brilliant profession to work in, because there is so much opportunity to explore the world

I know that I can offer the performing arts the time, the expense and the spark that it deserves. There is nothing else in world that I would devote more time to than being on the stage or acting in the street, and with the passion and determination to succeed behind me, I will give that spark and flavour that acting and the performing arts is all about. I know I can offer so much, because it is the only profession where, maybe just for one night, I can become someone else and do a damn good job of being that person – and I can easily say that I can offer the world, because performance and acting is my whole world. As well as enjoying Drama, I have also taken a shine to Philosophy and finding the reason for irrationality, and I feel particularly moved in amazement by the work of Bob Fosse and George Orwell for their use of horror, sorrow and murder. And a great interest to the History of Art, because so much of the story of us is portrayed in Art and more so these days it is so unique how Art and Drama work together to produce movement, beauty and conception.##

2.受托人指导或为委托人办理缴纳报名费、学杂费等有关费用的手续。

3受托人应当及时向委托人报告办理入学申请的进展、结果。

第七条  办理签证

1.受托人指导委托人进行签证申请准备，协助委托人办理签证或入境批准文件。

第八条  其他

1.如受托人为委托人办理申请入学、签证服务等，其收取的费用应在本合同第三条中介服务费中标明。

2.如受托人代委托人向国外院校缴纳报名费、学杂费等费用，受托人应向委托人提供收费方的符合法律要求的证明文件。

三、委托人义务

第九条  委托人应符合中国公民自费出国留学的条件，遵守国家关于公民自费出国留学的规定。

1.按乙方的要求提供留学所需齐备的材料；

2.配合乙方进行各项准备工作；

Realizing the counterpart didn’t completely implement their contract duty, I gave reasons as follows: First, the counterpart company didn’t mention bearing issue, which caused that the delivered machines couldn’t be put into the plant because of the disqualification of workshop. Thus overhaul was necessary, which delayed production and resulted loss. Based on these reasons, the counterpart didn’t completely carry out its duty, so our party did not pay the balance on time. During this time, I found out the evidence and pictures that attested counterpart did not give reasonable suggestion and service, and made a statement in the court. Finally, the arbitration turned out that counterpart compensated our loss, in which the arbiters invoked the reasons that I stated. They had a panel made up of 3 lawyers and 5 company representatives as agents while we just had 3 persons—two lawyers and me. Under such condition, I was able to cooperate with them and clearly stated my opinions without any nervousness, which got their respect. This matter greatly inspired my enthusiasm on study.

In addition, I took part in the contact draft in several companies. In the process, when I met a lot of problems, I often turned to my teachers for help, which made good impression on them. As I cherished each practice, I studied my specialty and English hard. With effective study method and diligence, I did well both in English and law, which helped me a lot to get scholarship every year. On the other hand, my practice inspired me to study. In practice, I exercised my legal knowledge. I also realize the big gap between theory and its application—sometimes I have master the rules but I didn’t know how to use it in actual case. 一、服务项目及费用

二、受托人义务

第五条 提供信息

1.受托人承诺向委托人提供的出国留学信息、宣传介绍材料、广告等，内容真实。

2.受托人应当向委托人介绍前往国家的教育制度、留学政策、留学签证政策和申请留学院校的性质、办学资质、入学要求、入学申请程序等基本情况。

4.受托人应当告知委托人申请留学院校的收费项目、收费标准和缴纳费用的办法。

第六条 申请入学

1.受托人代为委托人办理入学申请手续。

2.受托人指导或为委托人办理缴纳报名费、学杂费等有关费用的手续。

3受托人应当及时向委托人报告办理入学申请的进展、结果。

第七条 办理签证

1.受托人指导委托人进行签证申请准备，协助委托人办理签证或入境批准文件。

第八条 其他

1.如受托人为委托人办理申请入学、签证服务等，其收取的费用应在本合同第三条中介服务费中标明。

2.如受托人代委托人向国外院校缴纳报名费、学杂费等费用，受托人应向委托人提供收费方的符合法律要求的证明文件。

3.受托人对委托人提供的所有材料，均负有保密义务。除为委托人入学申请、签证申请的目的之外，不得向无关的第三方透露。

三、委托人义务

第九条 委托人应符合中国公民自费出国留学的条件，遵守国家关于公民自费出国留学的规定。

第十条 委托人向受托人送交的所有文件、材料和陈述的内容应合法、真实、有效。

第十一条 在留学申请办理过程中，如前往国家的留学政策、签证政策或申请留学院校的入学要求发生变化，委托人应根据新的要求，及时提供补充材料。

四、违约责任

第十二条 受托人和委托人应履行合同中全部条款，违约方应承担相应的违约责任。

第十三条 受托人违反合同条款造成合同无法履行，受托人不应向委托人收取中介服务费，并协助追回委托人向申请留学院校缴纳的学费、杂费等。

第十四条 受托人未能为委托人申请到拟留学院校的录取通知书，委托人有权解除合同，但应及时通知受托人。

第十五条 委托人为达成本合同目的而向受托人提供虚假文件材料，致使合同无法履行，受托人可以解除合同。

第十六条 由于委托人的违法行为，导致本合同无法履行，受托人可以解除合同。

第十七条 受托人因自身原因，可以随时要求解除合同,委托人已向受托人提供入学申请材料，受托人可以自行销毁。

五、不可抗力条款

第十八条 因不可抗力不能履行合同的，根据不可抗力的影响，部分或者全部免除责任，但法律另有规定的除外。当事人迟延履行后发生不可抗力的，不能免除责任。

本合同所称不可抗力，是指不能预见、不能避免并不能克服的客观情况，如重大自然灾害、瘟疫、战争、骚乱等。

第十九条 当事人一方因不可抗力不能履行合同的，应当立即通知对方，说明不可抗力的发生日期、事件性质，预计持续的时间及对该方履行本合同的影响，并应当自不可抗力发生之日起_____日内提供证明。

第二十条 对不可抗力所造成的影响，双方应及时协商解决办法和补救措施。因不可抗力不能履行合同的一方，应尽力采取合理措施减轻可能给对方造成的损失，否则应对由此而扩大的损失承担赔偿责任。

三、协议条例

四、协议终止

1.协议期满，本协议自然终止;

2.乙方因长期大幅度亏损的想放弃经营权，且经甲方核实其亏损属实，乙方有权申请终止协议。

3.本协议终止或期满时，双方应履行下列事项;
