侵犯商标答辩状

二、答辩人所被诉请的涉案手机销售有合法来源，答辩人没有侵权故意，无需承担侵权责任。

答辩人被起诉的涉案手机有合法来源，答辩人是通过正规合法的途径从__________太平电子城购进，对此事实，有被答辩人提交的东莞市工商行政管理局【东工商长处字(20__)第9__________号】行政处罚决定书予以反证。

根据商标法第五十六条规定“……销售不知道是侵犯注册商标专用权的商品，能证明该商品是自己合法取得的并说明提供者的，不承担赔偿责任。”因此可知，答辩人没有侵犯被答辩人商标专用权的故意，无需承担任何侵权责任。

至于被答辩人提交的东莞市工商行政管理局行政处罚决定书，其并不能当然作为认定答辩人商标侵权故意的依据。

行政处罚是不以当事人的主观故意取向如何而作出，而民事商标侵权则需要有当事人的主观故意为前提。

因答辩人的涉案手机有合法来源，答辩人没有商标侵权故意，因此无需承担商标侵权责任。

三、被答辩人诉请答辩人赔偿人民币50000元损失没有任何依据，依法不应得到法院的支持。

一方面，根据《最高人民法院关于民事诉讼证据的若干规定》第二条规定：_________________“当事人对自己提出的诉讼请求所依据的事实……有责任提供证据加以证明。

没有证据或者证据不足以证明当事人的事实主张的，由负有举证责任的当事人承担不利后果。”第七十六条规定“当事人对自己的主张，只有本人陈述而不能提出其他相关证据的，其主张不予支持。”。

被答辩人开口即要求答辩人赔偿50000元侵权损失费用，但并未提供任何依据说明其损失赔偿额是如何计算而来，因此，其应当对自己的主张承担举证不能的不利后果，50000元的损失赔偿费用因没有任何依据而不应得到法院的支持。

另一方面，根据《商标法》第五十六条规定，被答辩人不能证明其自称的因答辩人商标侵权所遭受到的损失，那么，商标侵权赔偿数额就应带按照被答辩人所认为的因答辩人侵权所得利益进行赔偿。

根据被答辩人提交的东莞市工商行政行政处罚决定书显示的内容可知，涉案21台手机进货价均为450元/台，而售价仅为520元/台，售出的涉案手机仅为三台，销售收入只有1560元，利润也仅有210元。

因此，即使答辩人真若构成被答辩人认为的销售侵犯其商标专用权的手机，答辩人的侵权所得利益只有210元，根据商标法的规定，答辩人的侵权赔偿数额也只有210元。

但被答辩人却信口开河，没有任何根据的漫天要价50000元的侵权赔偿额完全是借诉讼之手段谋取暴利之目的。

被答辩人为达到谋取暴利的目的，甚至通过不正当关系，将一年前的自称是东莞市工商行政管理局的行政处罚资料复印出来当作起诉商标侵权的证据材料，并在珠三角及其它地区大范围地起诉手机零售商，非常明显，被答辩人所谓维权只是幌子，伙同他人恶意维权，借以谋取高额暴利才是其真正目的。

所以，请求法院依法驳回被答辩人的无理要求。

四、被答辩人要求答辩人在《东莞日报》和《南方都市报》上刊登所谓的包含承诺不会再次侵权的道歉声明于法无据。

如上所述，答辩人根本未对被答辩人的商标构成侵权，故无需承担任何侵权责任。

假若构成侵权，侵权情节也非常轻微，未对被答辩人的声誉构成任何影响，赔礼道歉属人身侵权的范围，而本案根本没有构成人身损失。

答辩人无需在《东莞日报》和《南方都市报》上刊登所谓的包含承诺不会再次侵权的道歉声明。

综上所述，被答辩人的诉讼请求也是没有任何依据。

答辩人只是一个小个体工商户，现在生意已非常惨淡，几乎面临关闭状态，整个店铺价值甚至也不过区区几万元，根本就再经不起任何轻微的经济冲击。
