（3）the first training shall be from the third to the fourth month after thecontract comes into effect. there shall be 4 technical persons and an interpreterto besent to party b for training for 16o working days/man (5 days week). the training shallcover the design of the contracted products and manufacturing technology.

（4）the second training shall be from the eighth to the nineth month. party a shallsent 4 technical persons and an interpreter to party bs factory for training for 160working days/man (5 days per week). the training shall cover the designing， themanufacturing technology，erection and adjustment of the contracted products.

作为中人教育图书旗舰店电商的美工，主要负责的工作任务是的店铺的美化、宝贝上传、更新宝贝、宝贝主图和详情页的设计及更新，还接触了自己之前没有接触过的新技能——万里牛宝贝同步!!客服!!等等。。。

首先自己先来吐糟下让领导们都很头疼又对我们很无语的店铺美化及宝贝描述方面的吧，至于设计水平就不多说啦哈，很一般!在这方面遇到的问题就是文案和代码方面太菜鸟了，领导不给文案，大脑一片空白，领导不给设计方案，大脑依然是一片空白，就这样一直都是跟着领导的思想走，每天都按部就班的做领导给布置的任务(就像学生时代老师给布置作业一样的赶脚，好被动喔!)本来以为这样就完事了，但最终的结果是，自己的脑子彻彻底底真的空白啦。自己从未认真思考过，这样做的风格适合吗?做美工的我怎么能没有自己的想法呢?但是有自己的想法也不一定能够得到大家的肯定。

曾试着按自己的想法来做，但最终修改来修改去，还是被打回原形，问题的最终原因是对产品的不了解?缺少市场经验?不知道客户最想要的是什么?更愚昧的是作为美工的我们却不知道原因，很惭愧!!!在方面一直做到的不好，希望以后能长点心吧~~~所以，领导决定让我们做客服! 那么来吐槽下客服吧，最开始心理还有点好奇(当客服好啊，好轻松，不费脑子，要比设计好玩多了~~如果这样想那就真的错了~)，说到客服，那么一大波的问题来了!!

做了一天的客服，把整个人都折腾成了神经病态的样子，脑子完全成了浆糊，不知道怎么引导客户，对产品的不了解，对考试时间的不了解，对报考条件的不了解等等等等一系列的问题，自己都不了解，怎么回答客户?太惭愧啦!当客服也真的不容易!在这里，向客服同事们致敬! 但是，做客服对我们美工的回报是对客户有那么的一点了解，对客户的需求也知道了那么一点儿啦。

对产品貌似也多了点儿了解，知道自己在以后做详情的过程中能添加一些客户所需要的东西(但是还不完全知道啊)。一天客服下来，哇喔好充实，瞬间一身正能量!! 虽然半年时间这么快的过去了，感谢领导们让我们学到了很多东西，但惭愧的是自己没有做好本职工作!让你们失望了!在之前的工作中找到了自己的不足，希望自己在以后的工作中认真努力的把工作做好!!为了明年我们大家的500万，拼啦~~~~~

在民事诉讼理论中，证明责任与提出证据责任是两个不同的概念，这两个名词之间既存在联系又有不同之处。证明责任，又称举证责任，是指当事人对自己提出的事实主张有责任提供证据进行证明，当作为裁判基础的法律要件事实在诉讼中处于真伪不明状态时，负有举证证明义务的当事人应承担败诉的风险。提出证明责任，是指当事人在诉讼过程中，为避免败诉危险而向法院提供证据的必要性。

两者之间的联系在于：(1)对负担证明责任的当事人来说，承担提出证据的责任是为了避免证明责任在诉讼终结时实际发生;(2)在案件事实发生争议时，负担证明责任的一方当事人在诉讼中负担首先提出证据的责任;(3)两者都是因为有争议的事实发生而存在。也就是说，提出证据责任贯穿整个诉讼过程，当负有证明责任义务的当事人为了避免败诉，必须承担提出证据责任，在存在证明责任分配时，必然同时存在当事人的提出证据责任。

而两者之间的有存在大大的不同：(1)两者发生的原因不同。证明责任的所需要证明的争议事实是处于“真伪不明”的前提下，即原告方提出有说服力的主张，被告方提出实质性的反主张，对争议的事实主张有证明需要，用尽所有程序上许可和可能的证明手段，法官仍不能获得心证，且口头辩论已结束，上述情况仍无法改变。而提出证据责任则是在诉讼过程中只要有争议事实需要证明，当事人就有义务承担此项责任。 (2)能否预先在双方当事人之间分担不同。证明责任可以根据预先设定的标准在双方当事人之间进行合理的分配，我国民事诉讼中证明责任分配的一般原则应是: 主张权利义务关系成立的当事人，应就权利义务关系成立的各要件事实负证明责任; 对妨碍权利义务关系发生的事实不负证明责任， 而由对方当事人承担; 主张权利义务关系变更或消灭的当事人应就权利义务关系变更或消灭的各要件事实负证明责任， 对于妨碍权利义务关系变更或消灭的事实不负证明责任， 而由对方当事人负证明责任。而提出证据责任由于其并非发生在“特殊”阶段，只是一种普通的诉讼行为，所以既没有必要预先分配，也没有可能离开诉讼的具体情形来预先分配。

(3)责任转移与否不同。证明责任按照实体法的规定或分配证明责任的标准确定归某一方当事人承担后，始终固定于该当事人，不会随着证据的提出转移于对方当事人后者则会在举证过程中发生转移。提出证据责任的转移与败诉危险的暂时转换具有对应关系，由于提出证据责任是当事人为了避免败诉而向法院提供证据，原告和被告在争议事实不利于自己的情况下，努力寻求证据提出证据力求胜诉，所以它随着败诉危险的转移而转移。

(4)能否由双方当事人负担不同。证明责任只能由一方当事人负担，当案件处于真伪不明的情况时，法官需要按实体法或者分配原则将证明责任分配给当事人一方，因为如果让双方当事人对同一案件事实负担证明责任，法官仍然不能获得心证，对案件事实仍然无法查清，证明责任将失去其存在的作用，提出证据责任则有可能由双方当事人负担，即一方负担提供本证的责任，另一方负担提供反证的责任。

证明责任与提出证据责任两者之间的联系与区别大体如上所述，同时关于两者的制度在我国立法上都存在不足之处，有待完善。
