一、现行刑事诉讼中精神损害赔偿的现状及质疑     精神损害，又称非财产上损害，是与物质损害相对应的概念，这是一个有特定法律意义的概念，它不同于医学上的精神损害，也有别于在日常生活中人们所说的一般精神方面的不愉快。刑事诉讼中的精神损害，是指犯罪人对自然人生命、健康、人身自由、名誉等人身权利进行不法侵害而造成的非财产性的损害。而精神损害赔偿，则是指对自然人生命、健康、人身自由、名誉等人身权利进行不法侵害所造成的非财产性的损害，且后果严重，因此而由被告人承担通过财产赔偿等方式进行救济和保护的一种法律制度，这是针对精神损害的后果所应承担的财产责任。在刑事诉讼中，精神损害是否应得到赔偿，是各国立法时颇感棘手的问题，对此，各国做法不一。德国、瑞士对精神损害赔偿的范围采取一定的限制原则，而同为大陆法系的日本、法国则立法较为宽松，只要是存在精神损害的事实，被害人即可提起此项诉讼。英美法则对此没有明确规定赔偿范围，司法实践中也没有特别的限定。 我国现行1996年的《刑事诉讼法》第七十七条规定，“被害人由于被告人的犯罪行为而遭受物质损失的，在刑事诉讼中，有权提起附带民事诉讼”，这表明在刑事诉讼中只允许被害人就被告人犯罪行为而遭受的物质损失提起附带民事诉讼，而不存在精神损害赔偿问题。最高院于XX年12月4日《关于刑事附带民事诉讼范围问题的规定》第一条第二款中规定“对于被害人因犯罪行为遭受精神损失而提起附带民事诉讼的，人民法院不予受理。”这项规定将刑诉法法律条款过于笼统的规定更进一步明确了，更具操作性。但笔者认为，现行法律对刑事附带民事诉讼中精神损害赔偿的全盘否定的态度，在是否能有效保护被害人利益，与其他法律能否协调以及被害人对诉权处分可能引起混乱等方面不能有效解决问题，具体提出下列质疑意见：     1、刑诉法的规定与民事法律规定存在冲突。     我国1986年《民法通则》第一百二十条规定侵犯公民的姓名权、肖像权、名誉权、荣誉权和法人的名誉权、荣誉权的，有权要求赔偿损失。XX年2月26日《最高人民法院关于确定民事侵权精神损害赔偿责任若干问题的解释》除上述规定，更进一步将精神损害的范围扩展到生命权、健康权、身体权、人格尊严权、人身自由权、隐私权等。总之，我国民事法律的规定是承认精神损害赔偿的。 刑事附带民事诉讼在法律原理上应适用民事法律规定，而刑诉法第七十七条仅限于“由于被告人的犯罪行为而遭受的物质损失的”，由此被害人遭受的精神损害则不在刑事附带民事诉讼的赔偿范围之内，此时，刑事附带民事诉讼被排斥在民事诉讼之外，陷于尴尬的境地。这样出现了刑诉法的规定与我国民事立法所确立的精神损害赔偿原则相抵触的情形。     2、对不同程度的精神损害是否赔偿适用法律出现混乱。     刑、民之间相互矛盾的规定形成了在刑事附带民事诉讼中情节严重的不能请求赔偿，而情节轻微的则可以通过民事诉讼请求赔偿的不正常现象，造成了立法上的不统一。依《最高人民法院关于确定民事侵权精神损害赔偿责任若干问题的解释》规定：“精神损害赔偿必须适用于因侵权致人精神损害，造成严重后果的，对于未造成严重后果的，可通过根据不同情形判令侵权人停止侵害恢复名誉、消除影响、赔礼道歉”，这种可请求赔偿的民事侵权中的严重后果往往表现在侵权人会触犯有关法律，直至是刑法。而刑事犯罪行为通常是情节严重的人格侵权行为，这就形成了精神损害程度较轻的不可以适用损害赔偿，而后果严重到触犯刑律时同样法律规定不得赔偿。同时，这也会造成如被告人行为不以犯罪论处的，被害人所获赔偿反而较多的情形可能出现的不正常现象。     3、可能会造成被害人对诉权的不同处分会有不同的结果出现。       最高院《关于执行〈中华人民共和国刑事诉讼法〉若干问题的解释》第八十九条规定：“附带民事诉讼应当在刑事案件立案以后第一审判决宣告以后提起，有权提起附带民事诉讼的人在第一审判决宣告以前没有提起的，不得再提起附带民事诉讼。但可以在刑事判决生效后另行提起民事诉讼。”这里同意了被害人对犯罪人可以单独提起民事诉讼。如果精神损害不纳入附带民事赔偿范围，有的被害人为维护其合法权益会放弃附带民事诉讼，在刑事案件审结后再另行提起民事诉讼，由于案件性质不是刑事附带民事诉讼案件，而是一般的民事案件，就不适用刑诉法和最高院《关于刑事附带民事诉讼范围问题的规定》，这样，以获得民事法律的全面保护。被害人这种变通寻求民事法律的全面保护的方法不仅增加诉讼成本和当事人讼累，还会因附带民事诉讼和民事诉讼的结果不一而影响国家司法的统一性和严肃性。     4、对被告人承担刑事责任是对被害人最大的精神安慰的说法的质疑。     不少人认为犯罪人承担刑事责任就是对被害人最大的精神安慰，在刑事附带民事案件中，被告人被罪量刑，受到了制裁，这本身就是保护了被害人的合法权益，国家力量在此时已最大限度保障了被害人的利益，因此，在一般情况下，也就是抚慰了被害人在精神上的损害，不需要用精神赔偿再次制裁犯罪者以补偿被害人的精神损害。此观点得到了刑诉法和最高审判机关的认同，并予以采纳。但对此笔者有不同看法，虽然，我国法律体系受原苏联影响，认为自然人的人格尊严是不能用金钱来衡量的，也是不可以用金钱来赔偿的，但是一旦人的人格尊严、生命、健康等被犯罪行为侵犯后，对被告人科处刑罚，并不能全面消除被害人精神上的损害，也不一定就是对被害人最为有效的救济方式，而一定数额的金钱赔偿也许是我们迄今为止的法律智慧所能找到的最重要的救济方法。     5、对向犯罪人以外的人提起精神损害赔偿会造成事实上的不公平。 在刑事附带民事诉讼中，有赔偿义务的人不仅限于犯罪人时，法律未禁止向犯罪人以外的被告提起精神损害赔偿。被告人可向犯罪人以外的人提起精神损害赔偿，其一造成了对同一事实需要适用不同的法律规范、法律程序才能解决问题，其二，对同一事实

出现不同的处理结果，其三，在适用不同法律规范时可能会因法律之间的相互冲突而面临对冲突规范的选择，其四，使同类型案件中同样因犯罪行为遭受损失的被害人因适用不同的法律规范而得到不同的保护结果，被害人之间处于事实上不公平的地位。 二、在刑事附带民事诉讼中确立精神损害赔偿制度的必要性     笔者认为，在刑事附带民事诉讼中，立法上对精神损害应当予以认可，并应逐步确立精神损害赔偿制度，其理由如下：     1、确立附带民事诉讼中的精神损害赔偿制度符合刑法规定，对刑罚的功能起补充作用。     刑法第三十六条规定“由于犯罪行为而使被害人遭受经济损失的，对犯罪分子除依法给予刑事处罚外，并应根据情况判处赔偿经济损失 ”，其规定的精神就是“又打又罚”，此条明确在论罪判刑的同时可以判令被告人赔偿被害人的经济损失。这里的“经济损失”，刑法并未将其局限为物质损失，笔者认为应包括因精神损害而造成的经济损失。刑法这一规定与刑诉法第七十七条规定不一致，但刑法修改在后，按后法优于先法的原则，就适用刑法规定。此外，刑事附带民事诉讼中被告人所给予被害人的经济赔偿尽管属于民事责任，但实际上是一种经济制裁，而且是带有强制性的。因为在某种情况下，金钱赔偿具有惩罚功能，因为责令被告人支付被害人一定数额的精神损害赔偿金，能使加害人发生有所失之感，并得以赎其加予被害人之痛苦。且从作用来看，无论从别预防，还是从一般预防的刑罚目的出发，附带民事赔偿的威慑力并不小于判处刑罚的威慑力，由被告人承担对被害人及其近亲属所造成的精神损害赔偿对被告人而言，其惩戒效力不低于刑罚处罚。     2、将精神损害列入附带民事赔偿范围是有法律依据的。     《最高人民法院关于执行〈中华人民共和国刑事诉讼法〉若干问题的解释》第一百条规定“人民法院审判附带民事诉讼案件，除适用刑法、刑事诉讼法外，还应当适用民法通则、民事诉讼法有关规定。”民法通则第一百二十条明确了民事赔偿的范围包括精神损失，这当然也适用于附带民事诉讼。     3、确立附带民事诉讼中的精神损害赔偿制度有利于维护被害人的合法权益。     被告人的犯罪行为由于侵犯了自然人的生命权、健康权、人身自由权、名誉权等人身权利，具有相当的社会危害性，且违反刑法规定，因而依法应予以刑罚处罚。但被告人的犯罪行为往往又同时使被害人人格尊严受损、名誉降低、或迎接未来生活的信心受挫，或丧失面对未来挑战的勇气，从而精神上遭受极度痛苦，乃至影响未来的正常的学习、工作和生活，根据刑法对被告人的犯罪行为定罪量刑，甚至根据案情判决赔偿被害人的有关物质损失，这些尚不足以抚慰被害人。因为，刑事案件被害人因犯罪行为遭受的精神损害一般都比单纯的民事侵权行为造成的损害程度深，有的犯罪如杀人、等均会给被害人及其亲属造成造成巨大精神损害，与之相比，物质损失可能微不足道。但是，民事被害人尚可要求精神损害赔偿，刑事被害人更应享有此项权利。某些侵害生命、健康等人身权的行为给被害人及其亲属所造成的精神痛苦及创伤很深，也难以消除，其精神痛苦是长期且巨大，在精神损害方面给予被害人一定的金钱赔偿，具有使被害人获得某种满足之功能，因为金钱赔偿所具有购买力等功能，可以使被害人有所满足而冲销痛苦。法院也应从切实保护公民人身权之立法宗旨出发，给予被害人最大限度的法律保障。所以，应确立刑事附带民事诉讼中的精神损害赔偿制度，以实现法律真实意义上的正义和公平，切实保护被害人的权益。     4、确立附带民事诉讼中的精神损害赔偿制度有利于体现公权对私权的特殊保护，符合历史发展潮流。     刑事诉讼中一直强调公权优于私权，被害人首先要服从于国家追究犯罪的需要，但是在保护被害人利益方面，公权所保护的社会利益并非总与被害人的利益一致，公权对社会利益的倾向完全可能导致对被害人利益的忽视。而民法上精神损害赔偿制度的产生，反映了人们对自身价值和人格尊严的重视，是人类发展高度文明的产物，符合历史发展趋势。当今国际潮流，对私权的关注逐渐加大，在刑事附带民事诉讼中确立精神损害赔偿恰恰符合这一历史潮流。公权的功用应越来越有利于对私权的保护，使被害人利益得到最大程度的保障，而不是与私权相互冲突。在刑事诉讼不断趋于对被告～利保护的今天，在附带民事诉讼上则应加强对被害人利益的保护，这符合社会利益、被告人利益、被害人利益三者利益冲突的平衡。此时应允许私权的适度自由，因为犯罪行为毕竟侵害了被害人独立于社会利益的个体利益，在刑事附带民事诉讼中对被害人的个体利益应予以最大限度的保障。实践中，许多国家在刑事附带民事诉讼中也确立了精神损害赔偿制度，德国刑事诉讼法第三条关于一切就追究对象的犯罪事实所造成的损失而提起的诉讼，包括物质的、身体的和精神的损害均应受理的规定值得我国借鉴。确立附带民事诉讼中的精神损害赔偿制度符合国际上刑事法律的发展趋势，符合对被害人的特殊保护。       5、确立附带民事诉讼中的精神损害赔偿制度符合刑事诉讼法等法律的立法原意。     首先，从法律角度讲，生命权和健康权是人身权中一个重要的权利，而健康的含义通常又包括生物属性的健康即生理健康和精神属性的健康即心理健康。精神损害赔偿实质上是对公民心理健康权受到不法侵害时而给予的补偿。其二，犯罪行为除了造成可以用金钱计算的损失外，还可以使被害人受到不能用金钱计算的损害，这种损害甚至还可以引起更大的利益损失，对被害人的损失不底论其是否可以金钱表示而给予赔偿，符合法律的公平原则。其三，对精神损害进行民事赔偿，不是将人格、名誉视为商品，而是对被害人精神上受到的痛苦损害以物质赔偿的形式进行心理上的安慰、补偿，是对犯罪人的一种制裁。它不是降低人格，而是对人格尊严予以重视，并从而提高人身价值。其四，在附带民事诉讼中，被害人的物质损失和精神损害是由被告人的犯罪行为所导致的，所以在这里民事案件与
