根据《中华人民共和国民法典》、《上海市房屋租赁管理条例》(以下简称《条例》)的规定，甲、乙双方在平等、自愿、公平和诚实信用的基础上，经协商一致，就乙方承租甲方可依法出租的房屋事宜，订立本合同。

一、出租房屋情况：

1-2、甲方作为该房屋的房地产权利人代管人法律规定的其它权利人与乙方建立租赁关系。

签定本合同前甲方告之该房屋已未设定抵押。

1-3、该房屋的公用或合用部位的适用范围、条件和要求;现有装潢、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜，由甲、乙双方分别在本合同的附件中加以列明，并以此用为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋时的验收依据。

二、租赁用途：

2-1、乙方向甲方承诺，租赁该房屋作为_____________使用，并遵守国家和本市有关房屋使用和物业管理的规定。

2-2、乙方保证，在租赁期内未征得甲方同意以及按规定需经有关部门审批而未批准前，不得擅自改变上述约定的使用用途

三、交付日期和租赁期限

四、租金、支付方式和期限

五、保证金和其它费用

六、房屋使用要求和维修贵任

6-1、租赁期间，乙方发现该房屋及其附属设施有损坏或故障时，应及时通知甲方修复;甲方应在接到乙方通知后的3日内进行维修，逾期不维修的，乙方可代为维修，费用由甲方承担。

6-2、租赁期间，乙方应合理使用并爱护该房屋及其附属设施，因乙方使用不当或不合理使用，致使该房屋及其附属设施损坏或发生故障的，乙方应负责维修。乙方拒不维修的，甲方可代为维修，费用由乙方承担。

6-3、租赁期间，甲方保证该房屋及其附属设施处于正常的可使用和安全的状态、甲方对该房屋进行检查、养护、应提前_______日通知乙方，检查养护时，乙方应予以配合。甲方应减少对乙方使用该房屋的的影响。

6-4、除本合同附件约定外，乙方另需装修或者增设附属设施和设备的，应事先征得甲方的书面同意，按规定须向有关部门审批的，则还应由甲方甲方委托乙方申请有关部门批准后方可进行。乙方增设的附属设施和设备归属及维护由乙方负责。

七、房屋返还时的`状态

7-1、除甲方同意乙方续租外，乙方应在本合同的租期届满后的________日内返还该房屋，未经甲方同意逾期返还房屋的每逾期一日，乙方应按_________元天(人民币)向甲方支付该房屋占用期间的使用费。

7-2、乙方返还该房屋应当符合正常使用后的状态，返还时，应经甲方验收认可，并相互结清各自应当承担的费用。

八、解除本合同的条件

8-1、甲、乙双方同意在租赁期内，由有下列情形之一的，本合同终止，双方互不承担责任：

(一)该房屋占用范围的土地使用权依法提前收回的;

(二)该房屋因社会公共利益或城市建设需要被依法征用的;

(三)该房屋毁损、灭失或者被鉴定为危险房屋的;

(四)甲方告知乙方该房屋出租前已设定抵押，现被处分的;

8-2、甲乙双方同意，有下列情形之一的，一方可书面通知另一方解除本合同，违反合同的一方，应向另一方按月租金的_______倍支付违约金;给对方造成损失的，支付的违约金不足抵付一方损失的，还应赔偿造成的损失与违约金差额部分;

(一)甲方未按时交付该房屋，经乙方催后____________日内仍未交付的;

(二)甲方交付的该房屋不符合本合同的约定，致使不能实现租赁目的;或甲方交付的房屋存在缺陷，危及乙方安全的;

(三)乙方未征得甲方书面同意改变房屋用途的;

(四)乙方擅自转租该房屋、转让该房屋承租权的

(五)因乙方原因造成房屋主体结构损坏的;

(六)乙方逾期不支付租金累计超过___________________日的

九.违约责任

9-1、该房屋交付时存在缺陷的，甲方应自交付之日起的3日内进行修复，逾期不修复的，甲方同意减少租金并变更有关租金条款。

9-2、因甲方未在本合同中告知乙方，该房屋出租前已抵押或产权转移已受到限制，造成乙方损失，甲方应负责赔偿

9-3、租赁期间甲方不及时履行本合同约定的维修，养护责任，致使房屋损坏，造成乙方损失或人身伤害的，甲方应承担赔偿责任。

9-4、租赁期间，非本合同规定的情况内甲方擅自解除本合同，提前收回该房屋的，甲方应按月租金的壹倍向乙方支付违约金。若支付的违约金不足于抵付乙方损失的，甲方还应负责赔偿。

9-5、乙方未征得甲方书面同意或者超出了甲方书面同意的范围和要求装修房屋或者增设附属设施的，甲方可以要求乙方恢复房屋原状赔偿损失。

9-6、租赁期间，非本合同规定的情况，乙方中途擅自退房、甲方可没收乙方的保证金，保证金不足于支付甲方损失的，乙方还应负责赔偿。

十、其它条款

10-1、租赁期间，甲方需抵押该房屋，应当书面通知乙方，并向乙方承诺该房屋抵押后当事人协议以折价、变卖方式处分该房屋前15日书面征询乙方购买该房屋的意见，同意条件下乙方有优先购买权。

10-2、本合同未尽事宜由甲乙双方协商，协商一致可订立补充条款。本合同补充条款及附件均为本合同不可分割的一部分。

10-3、甲乙双方在签署本合同时，对各自的权利、义务责任清楚明白，并愿意按本合同规定严格执行，如一方违反本合同，另一方有权按本合同规定索赔。

10-4、甲乙双方就履行本合同发生纠纷，可通过中介方协商解决，中介方协商解决不成的，可依法申请有关部门仲裁或直接向人民法院起诉。

10-5、本合同一式叁份，甲乙双方及中介方各执一份，甲乙双方约定，本合同自双方签约后即生效。每份具有同等效力。

大家好!

很高兴能与来自五湖四海的朋友们相聚在麦积山。我是本次旅行的导游小潘，希望我们一行游览快乐。

麦积山地处甘肃天水东南约50公里处，是我国秦岭山脉小陇山中的一座孤峰。景区总面积215平方公里，包括麦积山、仙人崖、石门、曲溪四大景区和街亭古镇。麦积山石窟属全国重点文物保护单位，也是闻名世界的艺术宝库。在悬崖峭壁上开凿成百上千的洞窟和佛像，难度之大，智慧之高，这在我国的石窟中是非常罕见的。下来，咱们就去看一看吧。

进了景区，大家现在看麦积山像什么呢?对，像一个麦垛。麦积山是典型的丹霞地貌，高80米，这里荟萃着后秦、西秦、北魏、西魏、北周、隋唐、五代、宋、元、明、清等十多个朝代的塑像7200余尊，壁画1300多平方米，分布在194个洞窟里，与敦煌莫高窟、大同云岗石窟、洛阳龙门石窟被誉为我国四大石窟。如果就艺术特色来分，敦煌侧重于绚丽的壁画，云岗、龙门著名于壮丽的石刻，而麦积山则以精美的塑像闻名于世。正如我国雕塑家刘开渠所赞美的：麦积山是“我国历代的一个大雕塑馆。”

大家步入栈道一定注意安全，不要拥挤。现在大家看到的是凭崖而凿的一组雕刻造像。中间一座佛，高达15米，左右两尊菩萨侍立，喜笑颜开，迎送来往游客。这也是麦积山最大的佛像。现在大家看到的是最壮丽的4号窟上七佛阁。7间佛龛里有42尊菩萨塑像，神态庄严可亲，华美而不俗。

现在大家来到西崖石窟，这里以133号和127号石窟为最大。133号碑洞，是麦积山最特殊的一个洞窟。洞中不仅有许多泥塑作品，而且有18块石碑，有几块碑面密列贤动千佛小佛像，因此又称“万佛堂”。其中10号、11号、16号为众碑之精华。127号窟更为精彩，这座雕像，不要说在麦积山，就是在世界佛教艺术中，都是稀有珍品。

阁的后面的就是一个观音殿，上面张挂着绣有“南海宝筏飞渡沉香大士”的欢门和四条风幡。正面一个大佛龛，龛前一张明式楠木大供桌，明黄色瓷五供具，恰到好处地陈列在供桌上，二尺高的缕空香炉内，飘出缕缕檀香味。佛龛两侧有铜制伽蓝神和两童子像。佛完内供的就是沉香观音。这尊沉香观音，又名如意观音。观音呈坐像，原高三尺，是用特别名贵的沉香木雕就，故而得名。屈右足于坐上，右肘倚于右膝上，左手支撑于座上，头微右侧，作凝思状，花冠缨络，庄严慈祥。传说，据《隋书》记载，隋大业四年(608)，隋炀帝派大臣常骏出使南方国家，赐赠中国工艺品等礼品，赤土国回赠沉香观音一尊，常骏回到长安，正值隋炀帝巡游扬州，常骏等从淮河乘船赶往扬州，途上遇风翻船，沉音观音沉落淮河。直至明代潘允端发现后，奉回上海，建阁供于此处。据说原来每逢雨天，沉音芳馥四溢。可惜“革命”之中不知去向。

现在的沉香观音，是由沉香阁住持观性法师1990年专程去泰国，从泰国募集到一段极其珍贵的真正的沉香木，价值一万多美元。运回上海，配以上等檀香木，照原样放大重雕而成，其神态和工艺水平，不逊于原像。阁的楼下为慈云堂，里面装修、布置简洁古雅，正中北壁一长几、一八仙桌、两张靠椅，两侧各四张靠椅，居上空地一张园拼桌，四个鼓形园凳。全部明式红木所制，无桌围椅披，高雅而有气度;所有摆设，不过是左右各一座黄梨木独幅屏风，红木长几上一大理石插屏和一对花瓶而已。正面壁上一幅彩描观音中堂和两副对联，分别由赵朴初居士和真禅法师所撰书：

花海沉思洞明自性;

旃檀香风恒可众心。

真禅法师所撰为：

无我无人观自在;

非色非空见如来。

慈云堂西面是贵宾接待室。东面是方丈室，现沉香阁住持为观性法师。观性法师，现已85岁高龄，现任中国佛教协会常务理事，上海市佛教协会副会长，曾任南市区人民代表、区政协委员，又兼慈修居住持。由她带领这两个比丘尼道场的六七十比丘尼和二十多位佛学院尼众班学尼熏休修持。沉香阁东北部重建了一幢明式建筑的小楼，现为“应慈法师纪念堂”，堂额为赵朴初居士所题。底层是一个小法堂，二、三楼陈列着反映应慈法师生前弘法利生事业的珍贵照片、著作、手迹和遗物。

各位游客朋友：

上午好，今天很高兴带大家到龙华寺来进香。龙华寺位于龙华景区，在没有到达之前，我把龙华景区的概况给大家做个介绍。

龙华景区位于上海市中心的西南方向。主要景点有龙华寺、龙华塔、龙华旅游城和龙华烈士陵园。它周边的景点也非常丰富，南边有上海植物园，黄道婆墓、邹容墓。西边和北边有徐家汇商城、八万人体育场、徐家汇天主堂和锦江乐园。

龙华景区因为有一座千年古刹龙华寺而得名。这座寺院主要是供奉弥勒佛的。弥勒佛是佛教的未来佛，他现在还在天上兜率天修行，要修行四千年，天上一天，人间四百年，天上4020__年，人间56亿7000万年。然后在华林园龙华树下接班成佛。所以这个寺院叫做龙华寺。这个景区叫做龙华景区。

龙华景区的特色用一句话来概括：文化的综合性和旅游的多样性。表现在三个方面：

第一个方面就是佛教文化和佛教旅游。龙华寺不仅历史悠久，而且规模宏整。沿着中轴线有山门，弥勒殿，天王殿、大雄宝殿、三圣宝殿，华林丈室和藏经楼。左右有钟鼓楼，西边有观音殿和罗汉堂。龙华寺寺院布局，充分体现了中国古建筑的壮丽恢弘美。龙华寺的每一处殿堂佛像众多，妙相庄严，充分表现了佛教文化的魅力。每一处殿堂都有匾额楹联，不仅点明了每一处殿堂的主题，还充分显示了佛门的大智慧。龙华寺的每一件文物，每一样法器，无不折射中华佛教文化的光辉，它是我们进行佛教旅游的一个生动的载体。

龙华烈士陵园也在这个景区，有“雨花台第二”之称，这就为龙华景区突出了革命传统文化和革命传统教育活动。烈士陵园的园门是__同志提的。里面的纪念碑“丹心碧血为人民”是__同志提的。像金字塔型的烈士纪念馆是陈云同志提的。东面的烈士碑林抒写了革命先烈的一些事迹，还有一处龙华烈士就义地，是1920__年和1937年国民党反动派枪杀革命烈士的刑场，许多党的高级领导人就在那儿牺牲了。每到节庆假日，特别是清明时节，成千上万的人民群众到这里来凭吊，是进行革命传统教育的最生动的课堂，

龙华景区的民俗风情在上海大概只有豫园能和它相媲美了。每到年底的时候，12月31日龙华景区要举办一个盛大的热闹的旅游活动，这就是“迎新年，撞龙华晚钟”。这一天，成千上万的人来到这里，子夜时分，108响钟声响起，成为旅游节庆的一个亮点。同时钟声又延长到新的一年，又是新年一条亮丽的风景线。还有每一年的3、4月举办龙华庙会，有400多年历史，现在一年要举办两次。看民间文艺，尝地方风味，购地方特产。所以龙华景区文化的综合性和旅游的多样性在上海的旅游景点当中是相当突出的。

好了，我们的旅游巴士已经到达龙华景区，下面请各位跟我一起参观游览。

园内中部大观楼群组，建筑气势宏伟，是为元妃省亲所造，东是缀锦楼，西为含芳阁。大门内西侧为贾宝玉住的怡红院，是一座两路三进的院落。林黛玉住的潇湘馆在东侧的翠竹丛中。体仁沐德一组建筑是元妃省亲时更衣休息处。薛宝钗住的衡芜院是由藤萝山石和小楼组成的院落。此外，还有田园风光的稻香村、妙玉修行的拢翠庵等建筑群组。

大观园是一个大型仿古建筑群和现代园林。位于淀山湖的东岸，分东、西两大景区。东部以上海民族文化村、梅花园、桂花园为主要景观。西部则是根据中国古典名著《红楼梦》作者曹雪芹的笔意，运用中国传统园林艺术手法建成的大型的仿古建筑群体。东部景区面积9公顷，古典建筑近800...

0平米，有大观楼、怡红院、潇湘馆、蘅芜苑等20多个建筑群。室内陈设华丽雅致，园内古树名木与朱柱粉墙相互衬托，兼有皇家林苑气派和江南园林秀丽风格，是国家AAAA级旅游区。大观园东部栽树木100公顷共34万株，另有“梅坞春浓”、“柳堤春晓”、“金雪飘香”、“群芳争艳”等景点。其中“梅坞春浓”是上海地区赏梅的最佳处。

枫泾为典型的江南水乡古镇。古镇周围水网遍布，镇区内河道纵横，桥梁有52座之多，现存最古的为元代致和桥，据今有近720_年历史。镇区规模宏大，全镇有29处街、坊，84条巷、弄。至今仍完好保存的有和平街、生产街、北大街、友好街四处古建筑物，总面积达48750平方米(不包括其他街区保存的古建筑物)。是上海地区现存规模较大保存完好的水乡古镇。

枫泾镇成市于宋，建镇于元，是一个已有一千五百多年历史的文明古镇，地跨吴越两界。枫泾镇为典型的江南水乡集镇，周围水网遍布，区内河道纵横，素有“三步两座桥，一望十条港”之称，镇区多小圩，形似荷叶;境内林木荫翳，庐舍鳞次，清流急湍，且遍植荷花，清雅秀美，故又称“清风泾”，“枫溪”，别号“芙蓉镇”。

枫泾文化发达，是蜚声中外的金山农民画的发源地。枫泾人民热爱生活，蓝印花布、家具雕刻、灶壁画、花灯、剪纸、绣花、编织等民间艺术源远流长。浓郁的民间文化艺术，孕育了金山农民画。以枫泾农民画家为主的金山农民创作出了乡土气息浓郁、艺术风格独特的金山农民画，在海内外产生了广泛的影响。镇内的画馆金额名画家祖居也多。和平街上程十发祖居已经修复开放。北大街的丁聪漫画陈列馆设在二层中西式建筑内，楼前一棵古银杏，一丛大芭。馆内陈列了丁聪生平和一百多幅漫画，幽默地画画常让人驻足留连。南大街圣堂弄的金山农民画展示中心就在清代状元蔡以台的读书楼内，尽得清雅，一副副画面却透露出浓郁的乡土气息。农民画与丁聪的漫画、程十发的国画和顾水如的围棋，这些在国内外都具有相当地影响的“三画一棋”，集中于枫泾一镇，是国内罕见的一种地域文化现象。

在镇政府对面西栅河沿河，有一片长达600米的古建大宅院，建筑面积1.2万平方米。古戏台往西，位于和平街92号的大清邮局旧址，灰墙黑瓦，结构坚实，两边的门框都是石头柱子，高高的门洞上方“邮电局”几个大字赫然在目，这是上海地区现存不多的一处大清邮局旧址。由于文化发达，经济繁荣，枫泾又是江南少有的道教、佛教、天主教、_齐全的古镇。早在南朝梁天监元年(520_年)，枫泾南栅已建有道院，明清时，佛教盛行，街、巷、里、坊遍置寺庙，全镇共有3处寺院庙宇。清末，天主教、_也开始传入枫化资源中不可缺少的一部分。前往性觉禅寺、施王庙、郁家祠堂等人文景观，可以寻觅到枫泾镇古代南北分治，半属吴地半属越境的历史陈迹。

前不久，我和妈妈一起去上海的野生动物园玩。

走进野生动物园，随处可见活泼可爱的动物，有活泼可爱的小熊猫，憨态可掬的笨狗熊，美丽端庄的梅花鹿……其中最让我难忘的是乘坐“投喂巴士”和看“跑狗场”表演。

下面首先向大家介绍我乘坐“投喂巴士”的囧事吧!不过你们看了可别笑话我哟!刚坐上“投喂巴士”时，我心里真是激动万分，心想：嘿嘿!以前总是在电视中和老虎“见面”，现在我终于能与猛百兽之王来个近距离接触啦!随着车子慢慢驶入猛兽区，我的心也开始了“砰砰”直跳。忽然，两只老虎懒洋洋地走了过来，大家都异常兴奋。车上的工作人员把几只活鸡扔了出去，两只老虎立刻抖擞精神开始了拼抢，瞧它俩，虎目圆瞪，你不让我，我不让你。不好，也许鸡也是慌不择路，有一只竟然一下飞到了“投喂巴士”的玻璃旁，那只威猛的大老虎见了，连忙一个“饿虎扑食”，竟朝我们扑了过来，吓得我连忙闭上眼睛，直呼救命，惹得车上的乘客们哈哈大笑。

接着，我们一起去“跑狗场”去看看吧!瞧!“跑狗场”上，首先出场的是双峰骆驼，你可别它们表面的“文质彬彬”假象所迷惑，可一比起赛来，他们可聪明啦!这些骆驼还会使用一些战术呢。看!一开始它们是忽快忽慢，哼!一定是用来保持体力，一会儿到来终点，它们立刻像一阵风似的，向终点全力冲刺……

这就是我在上海野生动物园度过了难忘的一天，哈哈!有趣吗?

第十四条：合同期内，乙方如欲将租赁的商铺转租给第三方时，必须事先征得甲方同意，并由三方书面确认，取得使用权的第三方成为本合同的当然乙方，继续履行本合同。

六，违约及处理

(二)租赁期内，甲乙双方应共同保障该房屋及附属物品、设备设施处于适用和安全的状态;

1、对于该房屋及其附属物品、设备设施因自然属性或合理适用而导致的损耗，乙方应及时通知甲方修复。甲方应在接到乙方通知三日内进行维修。逾期不维修的，乙方可代为维修，费用由甲方承担。因维修房屋影响乙方使用的，应相应减少租金或延长租赁期间。

2、因乙方保管不当或不合理使用，导致该房屋及其附属物品、设备设施发生损坏或故障的，乙方应负责维修或承担赔偿责任。

第八条 转租

除甲乙双方另有约定以外，乙方需事先征得甲方书面同意，方可在租赁期内将房屋部分或全部转租给他人，并就转租人的行为向甲方承担责任。

第九条 合同解除

(一)经甲乙双方协商一致，可以解除本合同。

(二)甲方有下列情形之一时，乙方有权要求甲方按照第十条约定支付违约金并单方解除合同。

1、迟延交付房屋抵达十日的;2、交付的房屋不符合合同约定或影响乙方安全、健康的;3、不承担约定的维修义务，致使乙方无法正常使用房屋的。

(三)乙方有下列情形之一的，甲方有权要求乙方按第十条约定支付违约金并单方解除合同，收回房屋：

1、不按照约定日期支付租金达十日的;2、欠缴各项费用达伍佰元的;3、擅自改变房屋用途的;4、擅自拆该变动或损坏房屋主体结构的;5、保管不当或不合理使用导致附属物品、设备设施损坏并拒不赔偿的;6、转租未经同意的;7、利用房屋从事违法活动、损害公共利益或者妨碍他人正常工作、生活的。

第十条 违约责任

(一)甲方有第九条第二款约定情形之一的，按月租金的贰倍向乙方支付违约金;乙方有第九条第三款约定情形之一的，按月租金的贰倍向甲方支付违约金，甲方有权要求乙方回复原状;守约方并可要求违约方赔偿损失。

(二)租赁期内，甲方需提前收回该房屋的，或乙方需提前退租的，应提前三十日通知对方，并按月租金的违约金，甲方还应退还剩余租期相应的租金。

(三)因甲方未按约定履行维修义务造成乙方人身、财产损失的，甲方应承担赔偿责任。

(四)甲方未按约定时间交付该房屋或者乙方不按约定支付租金但未达到解除合同条件的，以及乙方未按约定时间返还房屋的，应按每日房屋月租金百分之五的标准向守约方支付违约金，超过十日仍未履行的，对方可以单方解除本合同并按照本条约定要求违约方承担违约责任。

第十一条 合同争议的解决办法

本合同若发生争议，由三方当事人协商解决;协商不成时，依法向房地产所在地的人民法院起诉。

(三)该房屋在租赁期间因不可抗力导致毁损、灭失的;

②甲、乙双方同意，有下列情形之一的.，一方可书面通知另一方解除本合同。违反合同的一方，应向另一方按月租金的两倍支付违约金;给另一方造成损失，支付的违约金不足抵付损失的，还应赔偿造成的损失与违约金的差额部分：

(一)甲方交付的该房屋不符合本合同的约定，致使不能实现租赁目的的;或甲方交付的房屋存在缺陷、危及乙方安全的。

(二)乙方未征得甲方同意改变房屋居住用途，致使房屋损坏的;

(三)因乙方原因造成房屋主体结构损坏的;

(四)乙方擅自转租该房屋、转让该房屋承租权或与他人交换各自承租的房屋的;

(五)乙方擅自增加承租同住人，且人均承租建筑面积或使用面积低于规定标准的;

③违约责任

(一)该房屋交付时存在缺陷，影响乙方正常使用的，甲方应自交付之日起的15日内进行修复、逾期不修复的，甲乙双方可商议减少租金并变更有关租金条款。

(二)租赁期间，非本合同规定的情况甲方擅自解除本合同，提前收回该房屋的，甲方应按提前收回天数的租金的两倍向乙方支付违约金。若支付的违约金不足抵付乙方损失的，甲方还应负责赔偿。

(三)乙方未征得甲方书面或口头同意或者超出甲方书面同意或口头同意的范围和要求装修房屋或者增设附属设施的，甲方可以要求乙方【赔偿损失】。

Huangpu Park is facing the famous Huangpu River at home and abroad. "Theyellow water in Huanglongpu on the moon" vividly depicts the color of HuangpuRiver. Jiangpu river is the mother river of Shanghai. It originates from TaihuLake in Wuxi. It is the longest, widest and deepest river in Shanghai, with atotal length of 114 km, an average width of 400 m and a depth of 7-9 M. Itsoriginal name is Dongjiang, also known as chunshenjiang and huangxiejiang. It issaid that more than 20__ years ago, Shanghai belonged to the state of Chu. Atthat time, there was a great general named Huang Xie in the state of Chu. He wasvery talented in governing the country. He was appointed prime minister by theking of Chu and was granted the title of "fengshenjun" to govern the land ofShanghai. Due to the siltation of the upper reaches of Dongjiang River at thattime, he led the people of Shanghai to dredge and modify the waterway, whichgreatly developed Shanghais water transportation and agriculture. In order tocommemorate Huang Xies achievements, later generations changed the name ofDongjiang River to "chunshenjiang" and "huangxiepu", which was not officiallynamed "Huangpu River" until the Southern Song Dynasty.

Huangpu River has two "children", one is Pudong, the other is Puxi. Beforethe birth of new China, their family was oppressed by three mountains. Themother river was full of warships and merchant ships, and the "two children"were also overwhelmed. "Tiaohuangpu" is the catchphrase of Shanghai people. 东方明珠游览区位于上海市浦东新区，她是新上海辉煌成就的代表之一。

90年代初期，党中央、国务院宣布开发开放浦东，随后上海市人民政府成立了上海浦东开发领导小组和市政府浦东开发办公室。93年，建立了中共上海市浦东新区工作委员会、浦东行政管理委员会。短短十几年中，浦东经历了史无前例的变化，展现出了日新月异的面貌。目前世界500家公司中大约有140多家已在新区内落户，并建立起了陆家嘴金融贸易区、张江高科技园区、外高桥保税区、金桥出口加工区和孙桥现代农业开发区这五大功能区。

保险标的范围

第一条 下列财产可在保险标的范围以内：

（一）属于被保险人所有或与他人共有而由被保险人负责的财产；

（二）由被保险人经营管理或替他人保管的财产；

（三）其他具有法律上承认的与被保险人有经济利害关系的财产。

第二条 下列财产非经被保险人与保险人特别约定，并且在保险单上载明，不在保险标的范围以内：

（一）金银、珠宝、钻石、玉器、首饰、古币、古玩、古书、古画、邮票、艺术品、稀有金属等珍贵财物；

（二）堤堰、水闸、铁路、道路、涵洞、桥梁、码头；

（三）矿井、矿坑内的设备和物资。

第三条 下列财产不在保险标的范围以内：

（一）土地、矿藏、矿井、矿坑、森林、水产资源以及未经收割或收割后尚未入库的农作物；

（二）货币、票证、有价证券、文件、账册、图表、技术资料、电脑资料、枪支弹药以及无法鉴定价值的财产；

（三）违章建筑、危险建筑、非法占用的财产；

（四）在运输过程中的物资；

（五）领取执照并正常运行的机动车；

（六）牲畜、禽类和其他饲养动物。

保险责任

第四条 由于下列原因造成保险标的损失，保险人依照本条款约定负责赔偿：

（一）火灾；

（二）雷击；

（三）爆炸；

（四）飞行物体及其他空中运行物体坠落。

第五条 保险标的下列损失，保险人也负责赔偿：

（一）被保险人拥有财产所有权的自用的供电、供水、供气设备因保险事故遭受损坏，引起停电、停水、停气以致造成保险标的直接损失；

（二）在发生保险事故时，为抢救保险标的或防止灾害蔓延，采取合理的必要的措施而造成保险标的损失。

第六条 保险事故发生后，被保险人为防止或者减少保险标的损失所支付的必要的合理的费用，由保险人承担。

责任免除

第七条 由于下列原因造成保险标的损失，保险人不负责赔偿：

（一）战争，敌对行为、军事行动、武装冲突、罢工、暴动；

（二）被保险人及其代表的故意行为或纵容所致；

（三）核反应、核子辐射和放射性污染；

（四）地震、暴雨、洪水、台风、暴风、龙卷风、雪 灾、雹灾、冰凌、泥石流、崖崩、滑坡、水暖管爆裂、抢劫、盗窃。

第八条 保险人对下列损失也不负责赔偿：

（一）保险标的遭受保险事故引起的各种间接损失；

（二）保险标的本身缺陷、保管不善导致的损毁，保险标的的变质、霉烂、受潮、虫咬、自然磨损、自然损耗、自燃、烘焙所造成的损失；

（三）由于行政行为或执法行为所致的损失。

第九条 其他不属于保险责任范围内的损失和费用。

保险金额与保险价值

第十条 固定资产的保险金额由被保险人按照账面原值或原值加成数确定，也可按照当时重置价值或其他方式确定。

固定资产的保险价值是出险时重置价值。

第十一条 流动资产（存货）的保险金额由被保险人按最近12个月任意月份的账面余额确定或由被保险人自行确定。

流动资产的保险价值是出险时账面余额。

第十二条 账外财产和代保管财产可以由被保险人自行估价或按重置价值确定。

账外财产和代保管财产的保险价值是出险时重置价值或账面余额。

赔偿处理

第十三条 保险标的发生保险责任范围内的损失，保险人按照保险金额与保险价值的比例承担赔偿责任，按以下方式计算赔偿金额：

（一）全部损失

保险金额等于或高于保险价值时，其赔偿金额以不超过保险价值为限；保险金额低于保险价值时，按保险金额赔偿。

（二）部分损失

保险金额等于或高于保险价值时，其赔偿金额按实际损失计算；保险金额低于保险价值时，其赔偿金额按保险金额与保险价值比例计算。

（三）若本保险单所载财产不止一项时，应分项按照本条款规定处理。

第十四条 发生保险事故时，被保险人支付的必要、合理的施救费用的赔偿金额在保险标的损失以外另行计算，最高不超过保险金额的数额。若受损保险标的按比例赔偿时，则该项费用也按与财产损失赔款相同的比例赔偿。

第十五条 保险标的遭受损失后的残余部分，协议作价折归被保险人，在赔款中，作价折归被保险人的金额按第十四条所定的比例扣除。

第十六条 被保险人向保险人申请赔偿时，应当提供保险单、财产损失清单、技术鉴定证明、事故报告书、救护费用发票以及必要的账簿、单据和有关部门的证明、各项单证、证明必须真实、可靠、不得有任何欺诈。被保险人欺诈行为给 保险人造成损失的，应当承担赔偿责任。保险人收到单证后应当迅速审定、核实。

第十七条 因第三者对保险标的的损害而造成保险事故的，保险人自向被保险人赔偿保险金之日起，在赔偿金额范围内代位行使被保险人对第三者请求赔偿的权利。

第十八条 保险标的遭受部分损失经保险人赔偿后，其保险金额应相应减少，被保险人需恢复保险金额时，应补交保险费，由保险人出具批单批注。保险当事人均可依法终止合同。

第十九条 若本保险单所保财产存在重复保险时，本保险人仅负按照比例分摊损失的责任。

被保险人义务

第二十条 投保人应当在保险合同生效前按约定交付保险费。

第二十一条 被保险人应当履行如实告知义务，如实回答保险人就保险标的或者被保险人的有关情况提出的询问。

第二十二条 被保险人应当遵照国家有关部门制定的保护财产安全的各项规定，对安全检查中发现的各种灾害事故隐患，在接到安全主管部门或保险人提出的整改通知书后，必须认真付诸实施。

第二十三条 在保险合同有效期内，如有被保险人名称变更、保险标的占用性质改变、保险标的地址变动、保险标的危险程度增加、保险标的权利转让等情况，被保险人应当事前书面通知保险人，并根据保险人的有关规定办理批改手续。

第二十四条 保险标的遭受损失时，被保险人应当积极抢救，使损失减少至最低程度，同时保护现场，并立即通知保险人，协助查勘。

第二十五条 被保险人如果不履行第二十条至第二十四条约定的各项义务，保险人有权拒绝赔偿，或从解约通知书送达15日后终止保险合同。

其他事项

音乐旱喷泉 位于人民大道以南，圆形喷水池面积1000余平方米，其中心有水的部分为320多平方米，这是一种国内首创的大型旱喷泉，造型为三层九级下沉式，池中央凸现着上海的版图，驻足池边，黄浦江、崇明岛等历历在目，上海的的地理位置一目了然。水池内有外、中、内、三个圈层的水管，随着音乐的高地起伏，它们向水池中心喷出高度分别为5米、10米和20米的数百根水柱。音乐旱喷泉的四角是4个传统造型花钵，花钵的顶部可种植花草，稍下是灯光和音响，具有声柱、灯柱、花钵三位一体的功能，巧妙地解决了广场不设灯塔却能取得良好照明和音响效果的问题，成为广场内四座优美、典雅的装饰物。旱喷泉的另一个大的优点是喷水时，小孩可在水柱间穿梭;喷泉关闭后，游人可进入旱池游览、散步;避免了常见的水池喷泉占有大片面积以及池水脏臭、吸附垃圾等弊端，喷泉的配电房和管理房全部进入地下，保证了广场的整洁、美观，充分发挥了广场的游览、观光、休憩功能。顺便说句，每月的14和15两日是看不到喷泉的，这两天管理人员要对喷泉进行清洗和保养。
