第七条 甲方在乙方回国后，负责安排乙方的工作，并积极创造必要的工作和生活条件，发挥乙方的作用。

第八条 乙方保证按本协议书第二条、第三条的规定，在国外努力完成学业，并按期回国服务。留学期间每

个月向甲方报告一次学习情况。

第九条 乙方抵达留学所在国后，一个月内中国驻该国使、领馆报到。乙方在国外期间，保证遵守中国法律和中国对出国留学人员的规定，遵守所在国的法律。

第十条 乙方无论因何种理由中止、延长留学期限或改变留学内容，均应至少提前三个月通过中国驻留学所在国使、领馆向甲方提出书面申请，未经甲方批准，不得改变。

第十一条 乙方留学期满回国后，应在一个月内向甲方报到，按甲方规定办理有关手续。乙方根据本协议书第三条的规定，向甲方提交书面的留学总结、学术报告（或科研论文、科研成果报告）。

第十二条 乙方有责任回国后至少在甲方工作

年。缩短工作年限，由甲方决定。

第十三条 甲方在认为必要时，有权决定将本协议书的副本经由我驻外使、领馆提交乙方留学所在国的有关部门或个人。

第十四条 甲方违反本协议书时，乙方有权向甲方的上级主管部门提出申诉，要求甲方的上级主管部门责成甲方执行本协议书，赔偿损失等。必要时，乙方可向中国的司法机关起诉，追究甲方的法律责任。

乙方违反本协议书时，甲方将根据乙方违约情况，对乙方批评教育，或给予行政处分，或停止公费待遇，或停薪留职，或要求乙方赔偿损失；必要时，甲方可将乙方违约的事实通知乙方留学所在国的有关部门或个人，或向司法机关起诉，追究乙方的法律责任。

第十五条 经甲方同意，由（姓名、性别、出生年月、工作单位、职务）

为乙方出国留学的国内保证人、保证乙方执行本协议书。保证人须与乙方经常保持联系，每半年向甲方介绍乙方执行协议书的情况；如乙方违约，保证人须认真协助甲方追究乙方的责任。在乙方违约而保证人又未履行自己职责的情况下，保证人须承担本人经济收入能承受条件下的经济责任。

甲方与保证人因保证事项而发生纠纷时，经双方同意，可由甲方的上级主管部门裁决。

第十六条 本协议书自公证之日起生效，签字各方保证遵照执行。有效期限至本协议书第十二条规定的工作年限期满时止。

必要时，经甲方、乙方、保证人三方协商一致后，可对本协议书进行修改或补

充。

本协议书正本一式四份，甲方持两份，乙方和乙方的保证人各持一份。

为了维护合同当事人的合法权益，委托人与受托人双方本着自愿、平等、协商一致的原则，就受托人接受委托人的委托提供自费出国留学中介服务事宜，达成如下协议：

一、服务项目及费用

第一条 委托人申请赴新 院校外文名称， （院校中文名称）留学.

二、受托人义务

第五条 提供信息

1.受托人承诺向委托人提供的出国留学信息、宣传介绍材料、广告等，内容真实。

2.受托人应当向委托人介绍前往国家的教育制度、留学政策、留学签证政策和申请留学院校的性质、办学资质、入学要求、入学申请程序等基本情况。

4.受托人应当告知委托人申请留学院校的收费项目、收费标准和缴纳费用的办法。

第六条 申请入学

1.受托人代为委托人办理入学申请手续。

2.受托人指导或为委托人办理缴纳报名费、学杂费等有关费用的手续。

3受托人应当及时向委托人报告办理入学申请的进展、结果。

第七条 办理签证

1.受托人指导委托人进行签证申请准备，协助委托人办理签证或入境批准文件。

第八条 其他

1.如受托人为委托人办理申请入学、签证服务等，其收取的费用应在本合同第三条中介服务费中标明。

2.如受托人代委托人向国外院校缴纳报名费、学杂费等费用，受托人应向委托人提供收费方的符合法律要求的证明文件。

3.受托人对委托人提供的所有材料，均负有保密义务。除为委托人入学申请、签证申请的目的之外，不得向无关的第三方透露。

三、委托人义务

第九条 委托人应符合中国公民自费出国留学的条件，遵守国家关于公民自费出国留学的规定。

第十条 委托人向受托人送交的所有文件、材料和陈述的内容应合法、真实、有效。

第十一条 在留学申请办理过程中，如前往国家的留学政策、签证政策或申请留学院校的入学要求发生变化，委托人应根据新的要求，及时提供补充材料。

四、违约责任

第十二条 受托人和委托人应履行合同中全部条款，违约方应承担相应的违约责任。

第十三条 受托人违反合同条款造成合同无法履行，受托人不应向委托人收取中介服务费，并协助追回委托人向申请留学院校缴纳的学费、杂费等。

第十四条 受托人未能为委托人申请到拟留学院校的录取通知书，委托人有权解除合同，但应及时通知受托人。

第十五条 委托人为达成本合同目的而向受托人提供虚假文件材料，致使合同无法履行，受托人可以解除合同。

第十六条 由于委托人的违法行为，导致本合同无法履行，受托人可以解除合同。

第十七条 受托人因自身原因，可以随时要求解除合同,委托人已向受托人提供入学申请材料，受托人可以自行销毁。

五、不可抗力条款

第十八条 因不可抗力不能履行合同的，根据不可抗力的影响，部分或者全部免除责任，但法律另有规定的除外。当事人迟延履行后发生不可抗力的，不能免除责任。

本合同所称不可抗力，是指不能预见、不能避免并不能克服的客观情况，如重大自然灾害、瘟疫、战争、骚乱等。

第十九条 当事人一方因不可抗力不能履行合同的，应当立即通知对方，说明不可抗力的发生日期、事件性质，预计持续的时间及对该方履行本合同的影响，并应当自不可抗力发生之日起_____日内提供证明。

第二十条 对不可抗力所造成的影响，双方应及时协商解决办法和补救措施。因不可抗力不能履行合同的一方，应尽力采取合理措施减轻可能给对方造成的损失，否则应对由此而扩大的损失承担赔偿责任。

八、 生效及终止条款

第二十一条 本合同由委托人及受托人签署，自签字、盖章之日起生效。

一、服务内容

6、甲方指导乙方办理公证和办理护照(不包括异地户籍)。

7、甲方告知乙方办理入学申请的结果。

8、甲方向乙方介绍留学前往国家或地区的留学政策和签证政策，指导乙方进行申请签证准备，协助乙方办理签证或入境批准文件。

9、甲方在乙方获取签证或入境批准文件时，指导乙方进行出国留学的前期准备工作。

二、甲方责任

1、向乙方告知甲方的从业资格情况。

2、按照中华人民共和国法律、法规和本合同约定，为乙方提供自费出国留学中介服务。

3、如实介绍乙方前往国家或地区的留学政策、签证政策和申请留学院校的基本情况，入学要求等留学相关信息，同时应揭示这些信息的阶段性和有限性，并承诺不作虚假陈述。

4、对乙方提供的所有材料，包括个人隐私，均负有保密义务。除为了乙方入学申请、签证申请的目的之外，不得向无关的第三方透露。

5、拟定乙方委托的留学申请在___ ___年_____月_____日前取得申请留学院校的申请结果。如到期不能完成(包括校方签发的录取通知书内容与乙方申请的院系或专业或专业方向有异)，本合同即告终止，甲方向乙方全额退还已缴付的中介服务费。甲方发生的成本费用，由甲方承担。同时，提请乙方重新确认是否继续申请，如继续申请，须重新签订《上海市自费出国留学中介服务合同》。

6、根据各国使(领)馆的要求，可以由甲方负责送签证申请材料的，甲方收到乙方符合签证要求的全部签证申请材料后，在十个工作日内向相关使(领)馆递交签证申请材料。如乙方前往国家或地区的使(领)馆关于递交签证申请材料有特别要求，按特别要求办理。

7、按照本合同约定，按时完成所应提供的中介服务内容。

8、对乙方交付的中介服务费，根据本合同《特别告知》第六条第4项规定，开具相应的收据或发票。

9、在符合申请留学院校退费规定的前提下，甲方应协助乙方向申请留学院校办理退费手续。

三、乙方责任

1、 确认本合同委托事项，并按本合同约定按时向甲方缴付中介服务费。

2、 配合甲方工作，切实遵从甲方的工作进程安排。

乙方应在本合同签订后________天内把入学申请所需材料交给甲方，并遵守本合同《特别告知》中第六条第3项规定。如乙方不能如期提供入学申请所需材料，因此而造成的损失由乙方承担。

3、在留学申请办理过程中，如前往国家或地区的留学政策、签证政策或申请留学院校的入学要求发生变化，乙方应根据新的要求，及时提供补充材料。

4、在留学申请办理过程中，乙方应在甲方的指导下，自行将申请留学院校报名费、学费、杂费等费用按时足额汇往院校指定的银行帐号。

5、在留学申请办理的过程中，如乙方前往国家或地区使(领)馆要求乙方进行面试，乙方应按使(领)馆要求，按时到使(领)馆面试。

6、乙方如未能获得留学前往国家或地区签证或入境批准文件，或者已获签证或入境批准文件而放弃前往该国已申请留学院校学习，均由乙方自行负责向该院校提出退费申请，要求该院校按规定退还学费、杂费等费用。

四、缴费规定

4、乙方必须自行承担在留学申请办理过程中发生的其他费用(如院校报名费、护照工本费、公证费、翻译费、体检费、签证费、银行手续费及汇费、机票款、保险费、院校学费、杂费、接机费、住宿费等)。上述费用由乙方自行向有关机构缴付，缴费标准和缴费方式以相关收费机构对乙方的要求为准。

五、退费规定

1. 如发生以下情形之一，甲方向乙方全额退还已缴付的中介服务费，本合同终止：

(1)甲方未能为乙方申请获得前往国家或地区留学申请院校的录取通知书;

(2)乙方已履行本合同中约定的责任，由于甲方未履行本合同中约定的责任，致使乙方的出国留学目的无法实现。

2、如发生以下情形之一，则乙方已缴付的中介服务费扣除人民币(大写)__________元，余额退还，本合同终止：

(1)乙方被前往国家使(领)馆拒签(本合同第五条第4项第(3)__(5)点所述的三种情况除外);

(2)在本合同有效期内，因我国或前往国家或地区留学政策或签证政策的改变，导致本合同无法履行。

3、如乙方因自身原因，在本合同签署后，单方面要求解除本合同，则根据本合同实际履行的阶段，乙方已缴付的中介服务费按以下办法处理：

(1)在乙方尚未得到申请留学院校的申请结果前，乙方单方面要求解除本合同，则入学申请中介服务费不予退还，签证申请中介服务费全额退还，本合同终止;

(2)申请留学院校已向乙方签发了录取通知书(包括校方根据申请人的自身条件，签发有条件的录取通知书)，乙方尚未向甲方提供办理签证申请所需材料，乙方单方面要求解除本合同，则入学申请中介服务费不予退还，签证申请中介服务费扣除6%，余额退还，本合同终止;

(3)乙方已向甲方提供签证申请所需材料，甲方尚未向使(领)馆递交乙方的签证申请材料，乙方单方面要求解除本合同，则入学申请中介服务费不予退还，签证申请中介服务费扣除8%，余额退还，本合同终止;

(4)已向使(领)馆递交了乙方的签证申请材料，在签证审理过程中，乙方单方面要求解除本合同，则全部中介服务费不予退还，本合同终止。

4、 如发生以下情形之一，则乙方已缴付的中介服务费一律不予退还，本合同终止：

(1)乙方无正当理由拒付本合同约定的任何一笔款项;

(2)乙方由于自身的违法行为，导致本合同无法履行;

(3)乙方未按前往国家或地区使(领)签证要求办妥签证申请所需文件及手续，并书面(正本)要求坚持送签而被拒签;

(4)乙方因提供虚假材料或隐瞒相关实情而被拒签;

(5)乙方被前往国家或地区使(领)馆查实有非法移民、犯罪前科等不良记录而被拒签;

(6)乙方前往国家或地区使(领)馆已发出乙方申请的签证(预签)或入境批准文件后，乙方拒绝领取签证或入境批准文件或拒绝入学或提出要求转学、不向留学院校缴付学费、杂费等费用的;

(7)本合同第七条第2项的情况。

5、甲方应按上述退费规定，在乙方办妥退费手续后将应退款退还乙方，乙方将相关收费凭证退还甲方，本合同终止。

6、乙方申请留学院校的报名费和学费、杂费以及在留学申请办理过程中发生的其他费用(除甲方收取的中介服务费)的退费事宜，由申请留学院校和相关收费机构负责处理。

六、违约责任

1、甲、乙双方应严格履行本合同中全部条款，任何一方违约应承担相应的违约责任。

2、在任何情况下，甲方为达成本合同之目的而为乙方制作虚假文件材料的，应承担违约责任，除全额退还已收取的中介服务费以外，还应按中介服务费的______%作为违约金偿还乙方。

3、本合同终止后，合同违约方仍应向守约方承担赔偿责任和违约责任。

七、终止条款

1、乙方前往国家或地区使(领)馆发出乙方申请的签证或入境批文件后，即视为甲方已完成为乙方提供自费出国留学中介服务事宜，本合同即告终止。

2、在本合同的履行过程中，经甲方挂号信或特快专递催告后，在九十天之内，乙方仍无继续履行本合同或终止本合同的书面意思表示，本合同即告终止。

3、出现本合同其他条款规定的合同终止条件，本合同即告终止。

八、适用的法律及争议解决方法

1、 本合同的履行、解释及争议解决均适用中华人民共和国有关法律。

2、甲、乙双方在履行本合同中如发生争议，应由双方协商解决。如协商不成，双方同意按以下第 ____________ 种方式解决：

九、本合同的补充、变更、修改

十、特别条款

十一、生效条款

第十五条 经甲方同意，由（姓名、性别、出生年月、工作单位、职务） 为乙方出国留学的国内保证人、保证乙方执行本协议书。保证人须与乙方经常保持联系，每半年向甲方介绍乙方执行协议书的情况；如乙方违约，保证人须认真协助甲方追究乙方的责任。在乙方违约而保证人又未履行自己职责的情况下，保证人须承担本人经济收入能承受条件下的经济责任。 甲方与保证人因保证事项而发生纠纷时，经双方同意，可由甲方的上级主管部门裁决。

第十六条 本协议书自公证之日起生效，签字各方保证遵照执行。有效期限至本协议书

Since the last few years, I had aspired to become a doctor.The idea of "scalpels," "opened chests" and "sutures" had always intrigued me.And then it happened!The recent unprecedented events in my country wiped off the dust of disillusionment from my eyes;I lost my will to become a doctor.However,the turmoil in the country led me towards newspapers and news channels,and hence Politics.

As I involved myself into politics,I realized that it is all-embracive-wielding its way over social and economic life-it is the omnipotent of Pakistan.It can mobilize public opinion,gear up propaganda machinery,make or repeal laws and what not.Backed up by public opinion,supported by the majority of the legislators,armed with the means to keep the people in a state of ignorance,political power crosses the limits of dictatorial powers.Political power,like the most powerful intoxicant,makes the persons in power to forget social ethics,political morality and obligations.

Most of the learned youth in this country consider Politics to be "a refuge for the scoundrels" and this derogatory remark may be true if we look at the deceptive and degenerated type of politicians indulging in a dirty game.All these political parties are votaries of democracy,but the way they conduct themselves inside their own parties is nothing but senseless authoritarianism.Therefore a very few students choose to pursue Politics as a profession,but what they dont realize is that if we dont take a stand the system can never be changed.Thus,I want to study Politics so I can come back to my country and contribute what little I can do for my homeland and its people.If I can inspire even a single person,it would be worth it.The world today is growing global.We are now not only to think of our own nation but as and when we think of it,we have to keep the international perception in mind;consequently,I chose Politics with International Relations as one of my courses.

Studying in UK will breed a sense of individuality and self reliance.I would be able to interact with people from everywhere and get to know about their culture.This would not only open new horizons for me,but would also clear some preconceived notions one has about the other.I have always been an active participant of debates.I have participated in 3 Model UN conferences out of which I was awarded with the Best Delegate award in two. Could I put myself in the life-threatening working environment? Could I sacrifice my life for the benefits of others? Some people may laugh at my crazy question. To me, that is a serious question I have come a long way to find my answer. “I am not sure whether it is worth to answer”; “What is the true meaning of that question?”

When I was a young child, I watched a soap opera that was about court. I was deeply impressed by the judge’s calmness and the lawyer’s eloquence and resource that were showed in this opera. From then on, I hoped to study law some day. Fortunately, I performed well in entrance examination and got enrolled into __ University. Then I chose law as my major without hesitation. At university, I studied hard and got GPA 3.4. What’s more, I broadly read all kinds of books, including philosophy, history etc. My teachers’ instruction strengthened my understanding of law and makes me understand the significance of law to a country. From my studies, I had a lot of fun and got more interested in law. Moreover, I actively participated in practice in holidays from common company to law firm and tried to apply the theory I had learned into practice.

This summer, I had my internship in counselor department in __ Group Co Ltd which was involved in a business contract dispute, which was submitted to China International Economic and Trade Arbitration Commission for arbitration. As a representative of the requested applicant, I took part in the evidence collection in the early arbitration stage and clearly explained why the 5% balance of goods was not paid on time. After knowing the whole case, I visited my teacher, an Arbitration Law professor, and listened to her opinions. Realizing the counterpart didn’t completely implement their contract duty, I gave reasons as follows: First, the counterpart company didn’t mention bearing issue, which caused that the delivered machines couldn’t be put into the plant because of the disqualification of workshop. Thus overhaul was necessary, which delayed production and resulted loss. Based on these reasons, the counterpart didn’t completely carry out its duty, so our party did not pay the balance on time. During this time, I found out the evidence and pictures that attested counterpart did not give reasonable suggestion and service, and made a statement in the court. Finally, the arbitration turned out that counterpart compensated our loss, in which the arbiters invoked the reasons that I stated. They had a panel made up of 3 lawyers and 5 company representatives as agents while we just had 3 persons—two lawyers and me. Under such condition, I was able to cooperate with them and clearly stated my opinions without any nervousness, which got their respect. This matter greatly inspired my enthusiasm on study.

In addition, I took part in the contact draft in several companies. In the process, when I met a lot of problems, I often turned to my teachers for help, which made good impression on them. As I cherished each practice, I studied my specialty and English hard. With effective study method and diligence, I did well both in English and law, which helped me a lot to get scholarship every year. On the other hand, my practice inspired me to study. In practice, I exercised my legal knowledge. I also realize the big gap between theory and its application—sometimes I have master the rules but I didn’t know how to use it in actual case. My practice experiences have not only strengthened what I learned but have supplied new knowledge for me, which is good for my future study and career.

In my study and practice, I admired outstanding lawyers’ eloquence and jumping thinking more and more. However, in China, most of lawyers come from theory study and those who can perform well in practice are insufficient. Moreover, after the China’s entrance to WTO, there are a lot of problems with Chinese law. I think, my internship experience is not enough. In practice, I could combine substantive law with procedural law to analyze case, but I still feel my theoretical foundation is not solid enough. What’s more, comparably speaking, the chances that I have to initiatively study and practice are not a lot. Thereby, I am eager to study further abroad to know more about foreign law, thoughts and lawyer career so that I am able to stand out in fierce competition.

As a child I often accompanied my father to his small coin shop and spenthours watching him work. When I was older, I sometimes set up displays, waitedon customers, and even balanced the books. This experience instilled in me thedesire to own and manage my own business someday, yet I understand that thebusiness world today is more complex. This complexity requires more education,and with that in mind, I am applying to the Master’s of Business Administrationprogram at Indiana University Bloomington (IUB).

乙方违反本协议书时，甲方将根据乙方违约情况，对乙方批评教育，或给予行政处分，或停止公费待遇，或停薪留职，或要求乙方赔偿损失；必要时，甲方可将乙方违约的事实通知乙方留学所在国的有关部门或个人，或向司法机关起诉，追究乙方的法律责任。

十四、经甲方同意，由________（姓名、性别、出生年月、工作单位、职务）为乙方出国留学的国内保证人，保证乙方执行本协议书。保证人须与乙方经常保持联系，每半年向甲方介绍乙方执行协议书的情况；如乙方违约，保证人须认真协助甲方追究乙方的责任。在乙方违约而保证人又未履行自己职责的情况下，保证人须承担本人经济收入能承受条件下的经济责任。甲方与保证人因保证事项而发生纠纷时，经双方同意，可由甲方的上级主管部门裁决。

十五、本协议书自公证之日起生效，签字各方保证遵照执行。有效期限至本协议书第十二条规定的工作年限期满时止。

十六、必要时，经甲方、乙方、保证人三方协商一致后，可对本协议书进行修改或补充。

为了维护合同当事人的合法权益，依据《中华人民共和国合同法》及相关法律法规，本着自愿、平等、协商一致的原则，就双方加入阳光留学服务体系，在全国阳光留学综合服务办公室的指导监督下，开展阳光留学中介服务(以下简称“阳光留学”)，达成如下协议：

一、服务项目及费用

委托人(自费出国留学申请人)：

第一条 委托人申请赴 (国家) (院校外文名称，以外文为准) (院校中文名称)留学，就读 专业，留学类别属 (学历或非学历教育)。

第二条 阳光留学向委托人提供留学前往国家的咨询、代办入学申请手续等中介服务。

二、阳光留学义务

第四条 提供信息

1.阳光留学承诺向委托人提供的出国留学信息、宣传介绍材料、广告等，内容真实。

2.阳光留学应当向委托人介绍前往国家的教育制度、留学政策、留学签证政策和申请留学院校的性质、办学资质、入学要求、入学申请程序等基本情况。

3.阳光留学应当向委托人介绍留学层次 (属于就读所在国的高中、预科、专科、学士学位、硕士学位等)及就读专业的详细情况。

4.阳光留学应当告知委托人申请留学院校的收费项目、收费标准和缴纳费用的办法。

第五条 申请入学

1.阳光留学协助和指导委托人准备入学申请的相关材料。

2.阳光留学代为委托人办理入学申请手续。

3.阳光留学指导或为委托人办理缴纳报名费、学杂费等有关费用的手续。

4.阳光留学对委托人委托的留学申请，应当在 年 月前取得委托人申请留学院校的录取通知书。如到期不能完成(包括校方签发的录取通知书与委托人原申请的学校、院系及专业等不一致)，阳光留学应当在 年 月前，向委托人退回中介服务费人民币(大写) 元。

5.阳光留学应当及时向委托人报告办理入学申请的进展、结果。

第六条 办理签证

1.阳光留学指导委托人进行签证申请准备，协助委托人办理签证或入境批准文件。

2.阳光留学收到委托人按委托人前往国驻华使(领)馆要求准备的全部申请签证材料后，应当在 工作日内向委托人前往国驻华使(领)馆递交签证申请材料。如该使(领)馆在递交签证申请材料、送签时间有特别要求的，应按其要求办理;需要进行面试的，阳光留学可协助安排预约时间等。

第七条 其他

1.如阳光留学为委托人办理申请入学、签证服务等，其收取的费用应在本合同第三条中介服务费中标明。

2.阳光留学收取委托人的中介服务费，应当为委托人开具有效发票。

3.阳光留学收取的中介服务费以外的其它费用，应为委托人出具有效发票或盖有企业财务专用章的收据，并在本合同终止前，将收据换为有效发票。

4.如阳光留学代委托人向国外院校缴纳报名费、学杂费等费用，阳光留学应向委托人提供收费方的符合法律要求的证明文件。

5.阳光留学对委托人提供的所有材料，均负有保密义务。除为委托人入学申请、签证申请的目的之外，不得向无关的第三方透露。

6. 阳光留学在委托人需要的情况下提供留学职业生涯规划。

三、委托人义务

第八条 委托人应符合中国公民自费出国留学的条件，遵守国家关于公民自费出国留学的规定。

第九条 委托人向阳光留学送交的所有文件、材料和陈述的内容应合法、真实、有效。

第十条 委托人应当自本合同签订之日起 日内，按阳光留学要求，把入学申请所需全部材料交与阳光留学。

第十一条 在留学申请办理过程中，如前往国家的留学政策、签证政策或申请留学院校的入学要求发生变化，委托人应根据新的要求，及时提供补充材料。

第十二条 在留学申请办理过程中，如委托人前往国家驻华使(领)馆要求委托人进行面试，委托人应按要求参加面试。

四、违约责任

第十三条 阳光留学和委托人应履行合同中全部条款，违约方应承担相应的违约责任。

第十四条 阳光留学违反合同条款造成合同无法履行，阳光留学应向委托人退还中介服务费人民币(大写) 元，并在 年 月前，负责追回(或先行给付)委托人向申请留学院校缴纳的学费、杂费等。

第十五条 阳光留学为达成本合同目的而向委托人提供虚假文件材料，除全额退还中介服务费外，还应按中介服务费的 %的人民币，作为违约金支付给委托人。

第十六条 阳光留学未能在约定的时间内为委托人申请到拟留学院校的录取通知书，委托人有权解除合同，但应及时通知阳光留学，阳光留学应按本合同第十四条的规定承担违约责任。如委托人要求继续履行，阳光留学应负责在 年 月前为委托人申请到拟留学院校的录取通知书，并向委托人支付迟延履行违约金人民币(大写) ―元。

第十七条 委托人为达成本合同目的而向阳光留学提供虚假文件材料，致使合同无法履行，阳光留学不退还委托人缴付的中介服务费。

第十八条 由于委托人的违法行为，导致本合同无法履行，阳光留学不退还委托人缴付的中介服务费。

第十九条 委托人因自身原因，要求解除合同，按以下办法处理：

1.委托人已向阳光留学提供入学申请材料，阳光留学尚未向外方送交该材料， 委托人要求解除合同， 阳光留学扣除中介服务费人民币(大写) 元。

2.阳光留学已向外方送交了委托人入学申请材料，委托人尚未得到申请留学院校的录取通知书，委托人要求解除合同，阳光留学扣除中介服务费人民币(大写) 元，并协助委托人追回委托人已向申请留学院校缴纳的学费、杂费等。

3.委托人获得入学录取通知书后，要求解除合同，阳光留学扣除中介服务费人民币(大写) 元，并协助委托人追回委托人已向申请留学院校缴纳的学费、杂费等。

4.阳光留学尚未向拟留学国驻华使(领)馆递交委托人签证申请材料，委托人要求解除合同，阳光留学应当扣除中介服务费人民币(大写) 元，并协助委托人追回委托人已向申请留学院校缴纳的学费、杂费等。

5.阳光留学已向拟留学国驻华使(领)馆递交了委托人申请签证材料，委托人要求解除合同，阳光留学应当扣除中介服务费人民币(大写) 元，并协助委托人追回委托人已向申请留学院校缴纳的学费、杂费等。

五、不可抗力条款

第二十条 因不可抗力不能履行合同的，根据不可抗力的影响，部分或者全部免除责任，但法律另有规定的除外。当事人迟延履行后发生不可抗力的，不能免除责任。

本合同所称不可抗力，是指不能预见、不能避免并不能克服的客观情况，如重大自然灾害、瘟疫、战争、骚乱等。

第二十一条 当事人一方因不可抗力不能履行合同的，应当立即通知对方，说明不可抗力的发生日期、事件性质，预计持续的时间及对该方履行本合同的影响，并应当自不可抗力发生之日起_____日内提供证明。

第二十二条 对不可抗力所造成的影响，双方应及时协商解决办法和补救措施。因不可抗力不能履行合同的一方，应尽力采取合理措施减轻可能给对方造成的损失，否则应对由此而扩大的损失承担赔偿责任。

六、适用的法律及争议解决方法

第二十三条 本合同的履行、解释及争议解决均适用中华人民共和国有关法律。

第二十四条 双方在履行本合同中如发生争议，应先由双方协商解决。如协商不成，同意按以下第 种方式解决。

第一种：提交 仲裁委员会仲裁。

第二种：依法向人民法院提起诉讼。

七、合同的补充、变更、修改

第二十五条 如委托人未委托阳光留学进行签证服务，本合同第六条对当事人双方无效。

第二十六条 对本合同的任何补充、变更、修改应采用书面补充合同形式。补充合同在双方签署后与本合同具有同等法律效力。

八、 生效及终止条款

第二十七条 本合同由委托人及其代理人、阳光留学、受托人法定代表人签署，自签字、盖章之日起生效。

第二十八条 本合同正本一式两份，具有同等效力，委托人与受托人各执一份。

第二十九条 双方履行本合同的权利和义务后，合同终止。
