我叫ccc，男，1954年10月出生，中共党员，现任鹿邑县国税局城区分局党支部书记、兼任鹿邑县财税监督稽查中心副主任兼稽查室主任至今。

我于1976年参加税收工作，在此期间，自1984年至1995年任税务所长。1995年至XX年任中心税务所长(分局长)XX年河南国税局王连清任局长，进行改革，对科、所长实行40岁职务一刀切，48岁离岗。当时我超过了40岁，中心所长(分局长)的职务被一刀切了下来，但是不到离岗的年龄，没有离岗。我被调到国税局公安室工作。XX年李陵君任河南省国税局局长，对干部的使用实行三不唯的政策，即：年龄、文凭和资历。我又被任命为王皮溜中心税务所所长。XX年9月国家税务总局副局长钱冠林和省、市、局长等有关领导来我县考察工作，要求听取最基层的工作汇报，我代表最基层的中心所长以 “税风正、人心齐”为题，作了工作汇报，各级领导非常满意。除汇报工作之外，我向领导提出了三个问题：一是全国的税务系统最基层的单位都是分局，分局长都是享受副科级待遇。唯独河南省是税务所，所长享受的是科员级待遇。这样很不平衡，并且不利于工作，一个税务所管辖几个乡镇的税收征管工作，名不正、言不顺。二是：我们的工资可能全国倒数第一。三是没有配备交通工具(征收车辆)，不利于税收的征管工作。不料领导非常重视，这三个问题很快解决了两个，一是税务所改为了分局，分局长享受了副科级待遇。全省可能唯独我因为年龄的限制(副科级限制到45岁)本应该转为分局局长的我又被切下来了!因为可能是本人工作成绩突出，1999年被省局作为突出贡献者给我记三等功一次。在此期间又被选为两届县人大代表、一届党代表。我的中心所长的职务被第二次切了以后，XX年又被城区分局选举为党支部书记至今。XX年鹿邑县委、县政府成立财税监督稽查中心，(正科级单位)我又被推选为财税监督稽查中心的副主任兼任稽查室主任。但是我做的工作都是副科级职务的岗位和工作，可是，我的工资待遇却没有享受副科级待遇，真是让人难以理解啊!

现在我有几个问题需要请教领导，盼望领导给予指示：

一：向我现在的工作情况和岗位情况是否应该享受副科级待遇?

二：我们的分局长在党里的职务是副书记，能够享受副科级待遇，为什么党支部书记不能享受副科级待遇?

三：我省国税系统凡是XX年离岗的人员现在又上岗，不论以前有没有担任过职务，都能享受副科级待遇，难道说副科级待遇是靠离岗离出来的吗?在领导岗位反而不如不在领导岗位的待遇，天下那有这个道理呢?我们的公平、正义又在哪里呢?“税风正、人心齐”又体现哪里呢?难道说我真的交了“华丐”之运吗?就此问题我于XX年已经向上逐级反映，直至反映到国家税务总局工资处，处领导让我写个材料寄去，我在XX年11月23日写了情况反映，寄到国家税务总局工资处，以及县、市、省局的局长各寄去一份，至今石沉大海，杳无音信!为此，为了找到公平、公正的包青天解决问题，本人再次书面申请，逐级反映直到问题解决为止!如果问题不能解决，只要领导能给一个圆满的答复和解释，使人们心服口服也算解决了问题。如果没有一个圆满的答复和解释，不能使人们心服口服，那么决心直至反映到总局为止。昔日的张桂英女流之辈尚能进京告状，找到包青天!何况我们区区五尺男子汉乎?

原告于20__年4月经黔西县政府招商引资投资设立，从事蔬菜种植及销售，种植基地位于黔西县谷里镇前华村内。我公司因自身员工人手不足，每当蔬菜成熟时便雇佣当地村民进行采摘、装运。根据蔬菜产量的情况，雇佣人数及天数不经相同。原告通过向村民发出雇佣通知，雇员根据自身的时间任意选择做工或不做工。本案中，原告雇佣被告从事采摘、装车主要集中在20__年4月至同年7月，按100元每日计算报酬。平均每月从事雇佣活动天数不超过12天，被告根据自身情况自愿选择从事雇佣活动，原告未不要求其必须参加劳动、接受制度管理。原被告之间形成的是雇佣关系而非劳动关系。

二、劳动仲裁委员会依据《工伤认定决定书》认定原、被告为劳动关系，被告所受的伤为因工受伤错误。

被告在受伤后向黔西县人力资源与社会保障局申请工伤认定，并作出黔人社决【20__】71号《工伤认定决定书》。劳动仲裁委员会依据该决定书认定本案事实，并作出错误裁决。原告至开庭前从未得知被告申请工伤认定，人社局未向原告了解情况，未向原告送达《工伤认定决定书》。根据《工伤认定办法》第二十二条第二款的规定：_________________”《认定工伤决定书》和《不予认定工伤决定书》的送达参照民事法律有关送达的规定执行。”第一、被告需对证明劳动关系存在及系因工受伤的《工伤认定决定书》已生效承担证明责任。第二、人社局未按规定向原告依法送达，未送达的对原告不发生效力。因此，劳动仲裁委员会依据未生效的证据认定原被告系劳动关系明显错误，错误裁决原告需承担被告各项损失。

x乡落实农村“三老”人员政治生活待遇情况报告

近两年来，x乡在紧紧抓住经济建设这一中心任务不动摇，加快经济和各项社会事业全面发展进步，同时积极认真落实好自治区党委对农村“三老”人员发放生活补贴的各项政策规定。通过政策的有效落实，进一步改善了农村“三老”人员的生活条件，稳定了基层党员干部队伍，不断增强了我乡基层党组织的凝聚力和战斗力，现将具体情况报告如下：

一、我乡农村“三老”人员概况

1、截止2004年12月31日，我乡“三老”人员总数为182人，可实际享受财政生活补贴人数为142人，其中老党员为100人，老干部为42人，劳动模范为2人。1995年核定享受财政补贴人数为139人，截止2004年12月，享受财政补贴“三老”人员比1995年增加3人。

2、在执行《暂行办法》期间，没有终止享受生活补贴和照顾的“三老”人员。

3、没有《暂行办法》（第六条）规定享受自治区财政生活补贴以外的“三老”人员。

二、农村“三老”人员的管理情况

1、根据乡、村两级财政情况，我乡2003年制定了《x乡“三老”人员管理办法》（以下简称《办法》），《办法》规定了每个村可根据本村实际情况为“三老”人员划拨2亩耕地。通过落实制度，确保我乡“三老”人员的政治生活待遇得到有效落实。

2、《x乡“三老”人员管理办法》明确规定了先由村党支部申报，然后经乡党委审核、批准，备案。主要负责部门为乡党建办公室,由乡党委书记负责。

3、近两年来，乡党委每个季度组织人员对落实农村“三老”人员政治生活待遇问题进行专项检查。全乡各村建立了重大事项邀请“三老”人员进行讨论，听取他们的意见和建议。年终时发放民意调查表，向他们征求本村经济社会发展方面意见，整理好后，列入本村下一年村“两委”班子整改项目。每逢春节、古尔邦节、肉孜节，乡领导、村干部都要到全乡的“三老”人员家中进行慰问，了解社情民意，解决他们生活中遇到的问题。

4、“三老”人员去世后，全部举行丧葬仪式，开追悼会能够达到90%以上。并根据现有财政情况一次性给予丧葬费500元/人。

5、对于那些生活仍处于贫困状态的“三老”人员，乡党委积极组织人员加大对“三老”人员生产技术指导，做好产前、产中、产后服务工作，为“三老”人员提供优质服务，帮助了一部分“三老”人员实现了脱贫致富。对丧失劳动能力和无依无靠的“三老”人员，由各村党员成立帮扶小组，在生活上给予帮助与照顾，解决了生活困难。

6、全乡18个村推行村级在职干部建立社会养老保险制度，具体办法是在职村干部一次性交纳5000元养老保险金，60岁后，每月可从保险公司领取80元的养老金。现在全乡有5名“三老”人员已经可以每月按期领到养老金。存在的问题是让村级干部一次性交纳5000元养老保险金对许多村干部来说比较困难，许多干部不能够理解，所以应加大对他们进行养老保险制度的宣传教育。

三、发挥“三老”人员作用的情况

1、定期组织“三老”人员举行我乡发展情况通报会，征求他们的意见和建议形成了制度，保证了决策的科学民主。

2、定期组织“三老”人员参加政治理论学习，法律知识学习，全乡老党员参加党的组织生活不间断，提高了党的吸引力，增强了党组织的凝聚力和战斗力。

3、近两年来，因个别党员发挥党员先锋模范带头作用突出，被县委、乡党委表彰鼓励的有2人。

4、发挥“三老”人员作用好、中、差的比例为3∶5.5∶1.5，作用发挥不好的“三老”人员主要由于年纪较大不愿更多地参加我乡的公益事业，影响了作用的充分发挥。

5、应继续坚持在涉及全乡、各村经济发展、精神文明创建、村级组织规范化管理方面广泛听取“三老”人员意见和好的建议，为加快我乡发展增添新力量。

四、农村“三老”人员财政补贴的使用和管理情况

1、根据乡、村实际情况，对每村无偿划拨给“三老”人员耕地进行了落实，2003年共落实耕地199亩，折合人民币2.6万余元。

2、我乡对“三老”人员生活补贴采取年终一次性发放。

3、建议：

（1）应明确县、乡、村三级责任分工，严格发放程序，加强监督检查。应有组织干事与乡财务人员同时到组织部领取，发放时“三老”人员凭生活补贴发放证领取，由主管党务的副书记或其他乡领导在场监督。

（2）应加强对乡党委组织干事的严格合理监督。并坚持每年集中对组织干事进行业务知识和党性、党规知识培训，提高组织干事的党纪法规意识。

（3）在发放生活补贴的同时，向“三老”人员宣传自治区党委关于发放生活补贴的政策，发放的时间。根据发挥作用的具体情况对现有“三老”人员进行动态管理。

My undergraduate study focused on economics and I achieved remarkablescholastic performance in this field. My GPA is 3.44 (my GRE score is 20__ andTOEFL---- ). For four consecutive years of my undergraduate study, I receivedscholarships for my distinguished academic performance. Due to my equallyprominent performance in extracurricular activities I was conferred on theOutstanding Student in Campus Activities. However, honestly speaking, my realinterest lies not in economics, but in education. Ever since I was a primaryschool student, I had cherished a strong desire for a teaching careerexemplified by my teachers. In the actual teaching career that I embarked onupon my graduating from university, I have become increasingly aware that theexisting educational conditions in China are far from satisfactory. The backwardteaching methodology and the prevailing pedagogical ideology have renderedChinese education out of place with the modern international development ineducation. On the macro level, the current education theory and practice inChina lag significantly behind advanced countries in the West. For instance,though education via the internet has achieved considerable development in pasttwo years, in practical operation such education has more often than notdeteriorated into an extended form of the conventional examination-orientededucation instead of a really interactive process. In my personal experience,despite the fact that some of the problems that I have encountered in myteaching career can be solved by consulting relevant technical literature, Ihave found that the more serious flaws inherent in Chinas current educationalsystem cannot be worked out easily. Under such circumstances, an advancedprogram in education becomes necessary.

In this age of information, traditional education, both in its ideology andmethodology, has met unprecedented challenge like many other aspects of humanexistence. Meanwhile, the pursuit for higher levels of educational developmentand of the quality of life has largely transformed the educational valueorientation of the general public. The educational model that is centered aroundthe cognitive and intellectual instruction has been seriously questioned.Greater attention has been devoted to the cultivation of well-developedpersonality and to the ontological status of the individual in education. Suchissues as the internal studies of education science, scientific decision-makingin education, and meta-education have also been increasingly emphasized upon.There have also been innovations in educational research methodology. Thetendency has been to combine modern technology with humanistic researchcategories and with naturalistic research categories, and to organicallyintegrate qualitative descriptions with quantitative descriptions. It is alsoimportant to carry out educational experimentations in which educationalpredictions are complemented by educational feedbacks. Both the complexity ofeducation and the complexity of human individuals have made the comprehensiveapplication of diverse educational approaches necessary. Those new horizons arewhat fascinate me.

In view of the following qualifications that I have acquired, I believethat I will acquit myself satisfactorily in the prospective Ph.D. program ineducation that I am currently endeavoring to apply for. First and foremost, asis often claimed, ones interest is ones best director. I believe that I willdo well what I am really interested in doing. Secondly, though I majored ineconomics as an undergraduate, my trainings during that stage helped developeffective modes of thinking and research approaches. In Educational Psychology, I will concentrate on appliedcognition and development, gifted and creative education, genetics and childrendevelopment, personality structure and individual differences and other relatedsubjects.

For me, to shift from economics to education and to pursue an advanceddegree in the United States is not so much a challenge as an opportunity. 为了维护合同当事人的合法权益，依据《中华人民共和国民法典》及相关法律法规，委托人与受托人双方本着自愿、平等、协商一致的原则，就受托人接受委托人的委托提供自费出国留学中介服务事宜，达成如下协议：

一、服务项目及费用

第一条 委托人申请赴 (国家)留学;留学层级属 (初中/高中/本科/研究生/预科)。

第二条 委托人的服务费分两次支付给受托人，分别为一次服务费和二次服务费。本协议签订时，委托人需向受托人支付一次服务费。受托人在收到一次服务费、申请院校所需资料后，为委托人办理学校申请手续。受托人获得所申请的院校录取通知书时，委托人需向受托人支付二次服务费。受托人收到该款项及签证所需资料后，为委托人办理签证申请手续。委托人申请院校的数量及相应的服务费分别如下：(勾出并填写大小写金额)

□A类：受托人为委托人申请一所院校。服务费共计 元人民币。一次服务费 元人民币;二次服务费 元人民币。

□B类：受托人为委托人申请两所院校。服务费共计 元人民币。一次服务费 元人民币;二次服务费 元人民币。

第三条 其他费用(以下费用委托人可以自行交纳，也可以委托受托人转交)：

a. 校方要求交纳的相关费用(院校申请费、留位保证金、学费、医疗保险费、住宿费、监护人费、接机费等)：由委托人按申请院校的要求交纳;

b.使(领)馆签证费：由委托人按递交签证时前往国使(领)馆具体要求交纳;

c.体检费：由委托人按前往国使(领)馆指定医院的要求交纳。

d.委托人如委托受托人代办公证，公证费由委托人按公证处的要求交纳;

e.以及交纳以上费用可能发生的银行手续费。

f.委托人如果委托受托人申请多于3所院校的录取通知书，每增加一所，委托人需另外支付受托人中介服务费，此费用无论学校录取与否，都不退还。具体参见《补充协议》。

二、受托人义务

第四条 提供信息

1. 受托人为委托人提供自费留学咨询服务，介绍拟留学国家教育制度和申请院校的入学要求、入学申请程序等基本情况。

2.结合委托人条件帮助委托人选择前往国的学校和课程。委托人选择的拟留学国家的院校名称如下：

委托人获得其中任一所院校的录取通知书，即视为申请成功。若委托人需要延期录取通知书，双方协商一致后，受托人可为委托人按照拟留学国家院校及使馆规定办理延期手续，受托人不另收服务费。

第五条 申请入学

1.受托人帮助和指导委托人填写各类申请表格;协助和指导委托人准备入学申请的相关材料。

2.受托人应当及时向委托人报告办理入学申请的进展、结果。

第六条 办理签证

1.受托人指导委托人进行签证申请准备，协助委托人办理签证有关手续。

2.受托人收到委托人按委托人前往国驻华使(领)馆要求准备的全部申请签证材料后，应当在30个工作日内向委托人前往国驻华使(领)馆递交签证申请材料。如该使(领)馆在递交签证申请材料、送签时间有特别要求的，应按其要求办理;需要进行面试的，受托人可协助安排预约时间等。

3.若委托人签证申请被拒签，委托人需要再次办理签证有关手续，双方协商达成一致后，受托人可协助委托人再次申请赴拟留学国家留学签证的有关手续，受托人不另收服务费。

第七条 其他

1.受托人代表委托人与其所申请的学校及拟留学国家使(领)馆或移民局联系所有相关事务，拟留学国家使(领)馆或移民局指定需与委托人本人联系的情况除外;

2.若委托人需要受托人为委托人安排住宿，接机等服务，受托人可免费为委托人联系。

3.如委托人为18岁以下学生，应委托人及其代理人要求，双方协商一致后，委托人为受托人代为联系在拟留学国家的监护人服务;

4.受托人对委托人提供的所有材料，均负有保密义务。除为委托人入学申请、签证申请的目的之外，不得向无关的第三方透露。

三、委托人义务

第八条 委托人应符合中国公民自费出国留学的条件，遵守国家关于公民自费出国留学的规定。

第九条 委托人向受托人送交的所有文件、材料和陈述的内容应合法、真实、有效。

第十条 委托人应当自本合同签订之日起 15 日内，按受托人要求，把入学申请所需全部材料交与受托人;若委托人无法在规定日期内提交，应与受托人协商，确定提交日期。

第十一条 委托人一经选择了相关的专业或学校，不应随意改动;如果委托人坚持更换已选定的专业或学校，由此引起的费用及损失由委托人负担;

第十二条 在留学申请办理过程中，如委托人和委托人担保人或家庭成员的地址、单位、收入等发生变化, 须立即通知受托人，以便受托人通知拟留学国家驻华使(领)馆或移民局;

第十三条 在留学申请办理过程中，如拟留学国家的留学政策、签证政策或申请留学院校的入学要求发生变化，委托人应根据新的要求，及时提供补充材料。

第十四条 在留学申请办理过程中，如委托人拟留学国家驻华使(领)馆要求委托人进行面试，委托人应按要求参加面试。

四、违约责任

第十五条 委托人履行了合同、协议全部义务而未被所申请院校录取，委托人可凭校方书面通知向受托人主张退费。受托人根据委托人在本协议第二条所选择的类别，退还委托人一次服务费。

第十六条 委托人履行了合同、协议的全部义务却被拟留学国家驻华使(领)馆拒签的，委托人可凭使(领)馆书面通知向受托人主张退费。受托人根据委托人在本协议第二条所选择的类别分别退费：(勾出并填写大小写金额)

□A类：退还服务费共计 元人民币;

□B类：退还服务费共计 元人民币;

□C类：退还服务费共计 元人民币;

第十七条 委托人为达成本合同目的而向受托人提供虚假文件材料，致使合同无法履行，受托人不退还委托人缴付的中介服务费。

第十八条 委托人在合同、协议签订后因自身原因，要求解除合同、协议，则应承担全部违约责任，无权要求受托人退还服务费。由于委托人的违法行为，导致本合同无法履行，受托人不退还委托人缴付的中介服务费。

第十九条 受托人在协助委托人获得拟留学国家院校的录取通知书后，委托人无权要求受托人退还一次服务费;受托人在协助委托人获得拟留学国家驻华使(领)馆签证后，视为合同、协议履行完毕，委托人无权要求受托人退费。

第二十条 委托人通过受托人申请院校、办理签证过程中向所申请院校、驻华使(领)馆或政府部门交纳的费用，由委托人按照相关主体的退费规定向相关主体主张退费。受托人可以协助委托人进行有关的退费追索，但不负任何责任。

第二十一条 受托人在收到委托人退款所需资料(具体包括本合同和交纳服务费单据原件、校方或拟留学国家驻华使(领)馆的拒绝证明、委托人退费申请书)后，7 个工作日内按本合同相关规定退费。委托人可以亲自办理退费手续，也可出具有委托人正式签字的委托书委托其他人代为办理退款，委托人必需在委托书中详细注明受委托人的姓名、性别、年龄、职业、与委托人的关系以及授予他(她)的权利等。受托人将通过银行汇款或以现金方式向委托人退款，并解除合同。所需银行汇款手续费由委托人负担。如委托人未在本合同有效期内提出退款要求，即视为委托人放弃。

五、不可抗力条款

第二十二条 在留学申请办理过程中，如遇任何不可抗力(如战争、外交纠纷、签证政策变化等)的影响，导致申请学校及办理签证延误或停止，受托人将不承担相关责任。但受托人可为委托人顺延办理。

本合同所称不可抗力，是指不能预见、不能避免并不能克服的客观情况，如重大自然灾害、瘟疫、战争、骚乱、签证政策变化等。

第二十三条 对不可抗力所造成的影响，双方应及时协商解决办法和补救措施。本合同对不可抗力事件，以及委托人及受托人双方影响范围之外的情况不负责，如由中国政府、中国大学、拟前往国大使馆、拟前往国政府、拟前往国院校等机构决定的事项。

六、适用的法律及争议解决方法

第二十四条 本合同的履行、解释及争议解决均适用中华人民共和国有关法律。

第二十五条 双方在履行本合同中如发生争议，应先由双方协商解决。协商不成，双方均可依法向相关人民法院提起诉讼。

七、合同的补充、变更、修改

第二十六条 对本合同的任何补充、变更、修改应采用书面补充合同形式。补充合同在双方签署后与本合同具有同等法律效力。

第二十七条 委托人所签订的表明委托人欲申请的院校、专业等意愿的书面意见，经受托人书面确认后，视为本协议的一部分，与本协议具有同等法律效力。一方未经对方书面同意，不得单方变更。

第二十八条 本协议所称“合同”是《自费出国留学中介服务委托合同》、“协议”是双方补充协议。

八、 其他

第二十九条 若委托人在合同、协议签订之日未满18周岁，则不具备完全民事行为能力，须由法定代理人或监护人在合同、协议上签字认可后生效。

第三十条 本合同由委托人及其代理人、受托人、受托人法定代表人签署，自签字、盖章之日起方可生效。

第三十一条 申请出国留学属委托人自愿，委托人在申请过程中发生的本合同没有提及的任何费用，如在此期间发生的生活费及由此产生的误工费、误学费等费用，在任何情况下都应由委托人自行负担，与受托人无关;若属于退款情况，则执行上述退款条例，委托人不再提出任何索赔要求。

第三十二条 本合同正本一式两份，具有同等效力，委托人与受托人各执一份。

第三十三条 双方履行本合同的权利和义务后，合同终止。

甲、乙双方在平等、自愿、协商一致的基础上，就乙方出国留学中介服务纠纷相关事宜，达成如下协议，以资共同遵守：

第一条  甲方一次性支付乙方人民币共计3，350 元整（大写：叁仟叁佰伍拾元），此费用包括公证费1，900元、雅思报名费1，450元。

第二条  甲方同意于本协议生效次日起三个工作日内向乙方一次性付清本协议第一条规定的款项，同时乙方向甲方出具收据。

第三条  乙方代理人曹系乙方刘母亲，其承诺具备全权处理本协议约定事宜的权利。

第四条  在甲方依本协议约定付清全部款项后，甲、乙双方之间就乙方自费出国留学中介服务相关事宜产生的所有纠纷即告终结，双方再无其他纠纷。乙方不得再以任何理由和任何方式向甲方主张权利，否则乙方应无条件返还甲方已支付的全部款项。乙方不得以本协议作为其主张权利的依据。（或作如下表述）
