2. 2、约定取消一方子女探视权的条款是否有效针对“背叛婚姻方不得探望子女、不得做孩子的父母”的保证条款，法律的态度很明确，此类约定概属无效。因为涉及到子女的探望权及子女与离异父母的关系属身份关系，当事人不能约定予以排除相关当事人的权利。

（二）若一方当事人违反了婚姻保证书中约定的内容，另一方当事人向法院起诉离婚，该婚姻保证书可否作为双方感情破裂的依据，法院可否据此判决解除双方的婚姻关系实践中，除非当事人双方一致同意离婚，否则，法院判决当事人离婚必须以此为准据。婚姻当事人签署的婚姻保证书多是夫妻双方婚姻忠贞及夫妻义务与责任的书面宣誓，涉及道德或精神层面的居多，在当前婚姻案件的审理下，其充其量只能作为双方感情不合的一个参考。在具体审理中，法官应当结合当事人提供的证据综合予以认定夫妻感情是否破裂，对符合法定离婚条件的，应准予离婚。
