12.工作期限及顺延

13.工作质量

14.再分包或转包

15.有关资料查阅权、知情权

16.工作安排、检查与安全防护

16.1乙方应遵守工程建设安全生产有关的管理规定，按安全标准及规程进行工作，随时接受行业安全检查人员依法实施的监督检查，采取必要的安全防护措施，消除事故隐患。

16.2乙方应对其在工作场地的工作人员进行安全教育，并对他们的安全负责。由于乙方安全措施不力造成人员伤亡和财产损失的，责任由乙方承担。

16.3 乙方在动力设备、输电线路、地下管道、密封防震车间、易燃易爆地段以及临街交通要道附近工作时，工作开始前应向甲方提出安全防护措施，经甲方认可后实施。

16.4 甲方不得要求乙方违反安全管理的规定进行工作，因甲方原因导致的安全事故，由甲方承担相应责任及发生的费用。

17、环境保护和职业健康

17.1、乙方应遵守当地政府有关环境保护的条例和规定(噪声污染防治、市容和环境卫生管理办法、污水排放及废弃物处理、大气污染防治、生态环境建设等)以及甲方环境、职业健康管理程序，注意对施工过程中噪音排放、粉尘排放、有毒有害固体废弃物废弃和运输遗洒等重要环境因素进行有效控制，尽可能的减少施工过程对环境的污染，杜绝重大环境事故的发生。

18.三方责任

18.1甲方责任：

一、供货产品品种数量及价格

备注：

1. 数量以甲方实际收货数量为准。

二、产品质量

四、交货

五、验收

1、甲方在收到乙方产品的当天，对乙方所供货物的数量、品种、外包装、外表质量进行确定验收并索取《产品检疫证》《运输工具消毒证》《产品合格证》，在相关的单据上签字说明，并将情况及时告知乙方。产品的内在质量如：产品重量不足、发生质变、腐臭等，由甲方在生产使用此批次产品时，甲方质检部门出具质检报告通知乙方。

2、甲方在验收时，按以上程序对乙方产品进行验收，如乙方产品运抵甲方十五天内未以书面的形式提出产品质量的异议，则视同该产品合格。

3、甲方在抽检过程中如发现乙方所供产品有质量问题或发货部位不对等，必须即时通知乙方协商解决，决不能将其产品继续使用，否则视同该产品合格。

4、甲方有权将此批次产品送由具有国家认可资质的第三方检测机构检测，因此所产生的一切费用由乙方承担。

Hi, my name’s Harry, H-a-r-r-y, Harry. It’s such a pleasure for me to introduce myself to you.

I’ll soon graduate from Guangzhou University with a bachelor’s degree in Economics. 4.技术要求和标准

4.1.1第二条、混凝土技术要求

1、混凝土材料应符合以下要求：

(1)砂石需有进厂检验报告及出厂合格证;

(2)水泥须有生产许可证、出厂合格证、复试报告;

(3)外加剂需要有相应的合格证和检测报告;

6.2货款支付

6.2.1首次付款方式：筏板砼浇筑完成后，双方核对无误后乙方在15日内付筏板总砼货款的50%。

6.2.2筏板浇筑完成以后其他部分浇筑混凝土的付款方式为：乙方应在3个月内支付剩余的50%混凝土货款。如买方不能按上述约定足额支付商品混凝土货款，买方应支付违约补偿金(按商业银行同期的利息两倍计算利息)。卖方账户必须是合同约定账户，如卖方随意改变账户，买方将拒付货款，由此引起的延期付款责任及相关的损失全由卖方承担。

6.3银行费用

在买方银行发生的费用由买方负担，在卖方银行发生的费用由卖方负担。

7计划与供货

7.1计划

7.1.1在要求到货前，买方一般应提前具体要求到货时间以提前小时的通知(可为电话通知)为准。如有计划有变化，也应于计划到货时间前5小时通知卖方。大量(超过1000立方米)使用货物，需提前两天预约。

7.1.2卖方应按买方向卖方发出供货通知的供货时间、数量、规格、技术要求等提供货物。

7.2运输

卖方应使用搅拌车将货物运至买方指定的工程地点，运杂费已包含在合同单价中。卖方负责办理装、卸及泵送的一切手续，承担运输及泵送的全部工作和责任并负担实施运输及泵送所产生的全部费用。

8.保险

1卖方根据货物的特点，考虑对货物在生产、购置、运输、存放和交付过程中的丢失或损坏以及对工作人员和第三方责任进行保险，费用由卖方负责。

9.索赔与赔偿

9.1不足量索赔

9.1.1由卖方供应到工地现场的货物，经抽检，如被抽检的本车货物实际数量少于卖方出具的相应送货单，超过允许误差范围2%，本批货物数量将按此抽检结果计算和核定。

9.1.2卖方供应的货物，数量虽然在允许误差范围之内，但经抽检，出现多次负偏差(超过%时)的现象，买方可能认为卖方有故意欺骗的行为，并有权对卖方提出警告、要求赔偿、甚至解除合同。

9.1.3对于可清楚计量的部位，现场验工计量也作为实际到货数量的一个参考依据，应与双方签收的相应单据数量基本一致，如有较大差异的(超过2%时)，双方友好协商解决，查找原因，如经证实为卖方的原因，买方将追究卖方的责任，并向卖方提出索赔。

9.2质量索赔

9.2.1如在“合同条款”第7、9条所述之检验和验收过程中，发现货物的质量不能达到“技术要求”的有关要求，买方应事先以传真或电话，向卖方提出索赔，并附上有关检验单位出具的检验证明。

9.2.2卖方须在收到买方的索赔文件(包括传真件)后，两个工作日内做出答复，认可是否接受买方的索赔要求。如卖方在收到索赔文件两天内不作答复，则应视为该索赔要求已被卖方接受。

9.3延迟到货及付款索赔

9.3.1除非合同双方书面同意延迟到货外，若商品混凝土未能按约定的时间运至交货地点则卖方应按本批未按时到货的货款5%向买方支付罚金，本项罚金开累不超过合同总价的2%，如超过合同总价的2%，则买方有权终止合同。如延迟到货(含因货物质量问题影响的到货)，已对工程的质量造成影响或停工，买方将追究因此而造成的相关损失。同时，为保证工程的质量和进度，买方有权按12.4(B)的规定另行采购货物。

9.4“合同条款”第12.2条对货物提出的索赔，若卖方根据“合同条款”第12.4(A)条的方式未能及时更换货物或出现多次质量问题对工程造成影响，则买方有权决定按“合同条款”第12.4(B)的方式处理。

(A)更换

卖方应及时更换有缺陷的货物，费用自理。除买方特别许可外，货物的更换应当场完成。经替换的货物在通过规定的检验合格后，买方应予以接受。

(B)另行采购

如卖方未能及时更换货物或延误到货时间影响了工程的进展或出现质量事故对工程造成潜在危险，买方可以认定卖方不具备供应能力，为保证工程进度及质量，买方在通知卖方后有权单方面终止、解除合同，从其它公司采购替换的货物。但卖方必须赔偿买方因另外购买货物而产生的一切费用及额外支出。

10.买方保留的权利

10.1除买方事先书面同意外，卖方不得部分转让或全部转让其应履行的合同义务。

10.1.1如卖方供货不及时或货物质量(含外观质量，如坍落度、和易性等)问题或无法满足工程的需要，买方有权执行12.4(B)条款的权利。

10.1.2如本工程其它标段的供应商供货不及时或货物质量(含外观质量，如坍落度、和易性等)问题或无法满足工程的需要时，买方有权要求卖方作为此标段的补充供货商或取替供应，卖方不应拒绝。

10.2为更好保证货物的质量，买方(或代理单位)保留向卖方供应外加剂和水泥的权利，卖方不应拒绝，双方以合同的形式明确。

11.争端的`解决

11.1本合同执行过程中如果发生争议，双方应及时协商解决;协商不成时，依法向人民法院提起诉讼。

12.双方合同义务履行完成终止合同

12.1当合同双方完成了合同中规定的责任和义务，合同终止。

13.双方同意终止合同

13.1双方同意终止合同时，合同双方则将无例外的免去对方合同规定尚未履行的责任和义务，但已履行部分应当清算并继续履行完毕。

14.违约终止合同

14.1因卖方违约终止合同

14.1.1如果买方发现卖方以下违约情形之一后，可向卖方发出书面违约通知书，提出终止部分或全部合同：

(1)如果卖方在合同约定的期限或买方同意延长的期限内，未能提供符合合同规定的部分或全部货物;

(2)如果卖方未能履行合同约定的其他任何义务;

(3)如果买方认为卖方在本合同的竞争和实施过程中有腐败和欺诈行为。为此目的，定义下述条件：

(i)“腐败行为”是指提供、给予、接受或索取任何有价值的东西，来影响有关人员在采购过程或合同实施过程中的行为;

(ii)“欺诈行为”是指为了影响采购过程或合同实施过程而谎报事实，损害买方的利益，包括投标人之间串通投标(递交投标书之前和之后)，人为地使各投标价丧失竞争性，剥夺买方从自由公开竞争所获得的权益。欺诈行为还包括卖方擅自更改货物的配合比进行生产，改变重要原材料产地，使用非买方指定的水泥品种等。

14.1.2如果买方根据“合同条款”第19.1.1条的规定，发出违约通知书后，买方有权依其认为适当的条件和方法购买与未交货物类似的货物，或买方有权采取其认为最合适的措施来完成被终止了的工程，卖方应对购买类似货物所超出的那部分费用或为了执行完成被终止了的该部分而买方实际发生的直接费用负责。但是，卖方应继续执行合同中未终止的部分。

14.2因买方违约终止合同

14.2.1如果买方严重违背了合同规定的责任义务，而且这种违约没有任何条款允许时，则卖方有权终止合同的一部分或全部，但前提条件是卖方应在终止合同前二个月内书面通知买方，而买方未能在这个期限内采取合理的措施以弥补其违约。

14.2.2在“合同条款”第19.2.1条的情况下，卖方有权要求买方补偿其因违约而造成的任何直接损失。但是，卖方应继续执行合同中未终止的部分。

15.因破产而终止合同

15.1如果卖方破产或无清偿能力，买方可在任何时候以书面形式通知卖方，提出终止合同而不给卖方补偿。该终止合同将不损害或影响买方已经采取或将要采取的任何行动或补救措施的权利。

15.2卖方有责任而且必须支付买方超过合同金额的合理的必须的费用。该费用是买方为了执行完成被终止了的该部分而实际发生的直接费用，包括搬运费及所需的额外资料费。

乙方：

根据《中华人民共和国合同法》及其他有关法律、法规的规定，甲、乙双方经友好协商，在平等、自愿、公平、诚信、守法的原则下签订本合同，以资共同遵守。

一、主体资格

乙方在本合同签订时，应当提供营业执照、税务登记证、卫生许可证等合法缔约主体资格的证明。

二、合同标的

(一)供应的商品种类、品名、品牌、规格、生产厂厂名及厂址、等级、质量标准、包装要求、计量单位、有效期及单价等，详见本合同附件一《购销商品确认单》。在合同期内，调整商品及价格时，以双方确认的《购销商品确认单》为准。

(二)乙方应当按《购销商品确认单》提交相关商品生产、代理、批发、进口、专项经营等许可或证明文件以及相关质量检验证明。有专利、注册商标标识的，还应提供国家颁发的有关证明。

三、商品价格

(一)除属于国家定价的商品外，乙方对所供货商品自行定价，乙方报给甲方的价格，应公平合理。乙方应以书面送达方式向甲方报价。

(二)经甲方书面确认之乙方《购销商品确认单》将作为本协议之附件。双方约定：报价单中商品的价格作为商品到达甲方指定收货地点并交付给甲方的实际成交价格，包装、运输、装卸等费用及风险由乙方承担。

(三)乙方变更商品单价时，必须提前三天将该类商品的新报价以书面形式通知甲方，经甲方书面确认后方可变价。

(四)甲方订单不另标明交易价格，以保障双方交易价格之机密性，双方成交价格应以本条第(二)项所述之报价单为准。

四、商品质量

(一)乙方供应的商品必须符合以下要求：

A、具有符合国家和地方规定的产品质量检验合格证。

B、有中文标明的产品名称、产品产地、生产厂名及厂址。

C、有产品说明书(包含对规格、等级、所含成份的名称及数量的说明)。

D、有使用期限说明书(包含：生产日期、安全使用期限、失效期限的说明)。

对于上述资料，如果商品包装物上已有印刷，或者贴在商品上的商标(标志)上已具备的，可以不另行提供。

(二)乙方应在标明的该商品的保质期限及保质条件下对商品的质量全面负责，同时自付费用承担提供商品质量所引起的相关责任。

(三)乙方不得向甲方提供假冒伪劣商品，所提供的商品，其剩余保质期时间必须在原有保质期的2/3以上。

(四)乙方供应的商品质量应当符合中华人民共和国相关法律法规规定的质量标准。

(五)乙方所提供商品的质量应当符合本合同或订单约定的质量标准;质量要求不明确的，执行国家标准、行业标准;无国家标准、行业标准的，执行通常标准或者符合合同目的的特定标准。

(六)因商品的售后服务所产生的费用，经乙方确认后，甲方先行垫付的，甲方可在乙方货款中直接抵扣或由乙方直接给付。另有约定的，从其约定。

(七)为保障消费者权益，贯彻国家食品等安全方面的有关规定，甲方可对乙方提供的商品每年度进行4次的定期抽检，由此产生的检验费由乙方承担。甲方也可进行不定期抽检，抽检商品质量合格的，检验费由甲方承担，不合格的则由乙方承担，甲方应出具检验报告单。

商品在销售过程中由政府专门机构依有关规定进行的质量检验，如检验部分收取费用的，抽检商品质量合格的，检验费由双方共担，不合格的检验费则由乙方承担。

由消费者投诉而送检的商品，检验后不合格的，检验费用由乙方承担。

上述检验应由乙方承担的费用，甲方需提供政府专门检验机构合法收费凭证，并以凭证金额向乙方结算。

五、交货及验收

(一)交货实行送货制，即：乙方应按订单所规定的时间(以开出日起四天内)将商品运至甲方所指定的交货地点交予甲方。

(二)乙方交货时，货到现场时商品从卸货到进入甲方仓库中所发生的搬运工作一律由乙方负责，货到现场时甲方收货人员仅点收箱数量或件数，以后甲方开箱时如发现商品数量、质量等不符合本合同的约定，则由乙方负责。

(三)乙方应按订单一次性交完商品，不可多交或少交、分批交货。遇到特殊情况，可同甲方相关人员协商。

(四)乙方交货时，应提供甲方订单复印件或传真件，乙方根据甲方订单复印件或传真件开具送货单，包括产品名称、规格、数量、单价、金额。甲方根据订单和送货单验收，点收完毕后，双方交接人员签字。

六、退、换货

(一)乙方货品进入甲方超市，如出现质量上问题或滞销，乙方应对供应的货品实行二包：包退、包换。但在退换滞销货品时该货品的剩余保质期时间应不少于原有保质期1/3，单件外观无破损且未使用。

(二)对出现滞销或问题商品，乙方应尽快安排退换货。甲方以书面形式通知乙方退换货类别，如五天内乙方仍未安排货品的退换，所涉及到需退换货品的保质期的全部责任由乙方负责，甲方按退货通知确定数量直接从应付货款中扣减。

(三)甲方收货后在实际销售时开箱发现商品有残损或短缺，乙方应组织退换或补货。

(四)甲方收货后发现乙方所提供的商品存在隐蔽瑕疵或其他质量问题，乙方应无条件组织退换。

七、质量保证金

乙方货物进入甲方场地销售前应向甲方缴纳 为质量保证金，在质量保证期届满或验收交接日一年后，无质量问题无息返还质量保证金。

八、对帐

(一)甲乙双方确认的对帐周期为：每月一次，对帐日期为每月3日至10日，对帐期限为8天。

(二)甲方更改订单在合理的时间内以书面形式来实现。如乙方在收到该更改订单的书面通知后二日内未提出书面异议，则视为乙方同意按该更改订单交易，且交易单价不变。

(三)如乙方在收到甲方更改订单的书面通知后二日内提出书面异议，则甲方的更改无效。如果乙方要求有条件地更改订单的，则乙方应同甲方相关人员在平等互利、协商一致的基础上予以处理。

(四)乙方应在收取货款时，向甲方开具合法有效的增值税专用发票并附送货单结算联。

九、结算

十、合同的终止

(一)乙方不能按订单规定的交货期限履行交货义务的，甲方有权终止合同，并追究乙方的违约责任。

(三)双方经协商一致后可修改、终止合同。

(五)出现本合同其他条款中有关允许一方终止合同的情况时，也可以终止合同。

十一、违约责任

(一)乙方因产品质量问题给甲方造成损失或违反本合同“商品质量”条款的，甲方从乙方交纳的质量保证金里扣除损失的10倍作为违约金并终止合同。

(二)乙方供给甲方的商品价格如高于乙方供给其它同类客户的价格，甲方有权终止合同并要求乙方按该订单商品金额的5倍支付违约金。

(三)乙方配送率累计3次达不到95%，甲方有权终止合同。

(四)乙方不能按照本合同的规定履行交货义务且逾期2天以上，则按未交货物的价款的20%向甲方支付违约金。

(五)乙方违反本合同其他条款的，须赔偿甲方的全部损失并支付甲方违约金伍万元。

十二、合同期限

(一)本合同期自 年 月 日起至 年 月 日。

(二)合同期满前个月，如双方同意继续合作，应重新签订新的合同;如未签订新的合同，甲方仍然下达订单且乙方接受的，视为按原合同继续履行。

十三、争议解决

本合同项下发生的争议，双方应当协商解决，也可向有关行政机关投诉处理;协商不成的，向合肥仲裁委员会申请仲裁。

十四、其它

(一)在履行本合同过程中，双方明确授权代理人和具体执行交易过程中各环节代理人以及代理行为的法律效力，从而确保合同的顺利履行。

(二)本合同涉及的通知，应当以双方约定的形式送达。

(三)一方向另一方收取货款或者费用的，应向对方开具发票或收据。

根据《中华人民共和国合同法》有关规定，甲方委托乙方代理__线铁路施工用石碴货物的运输业务及相关服务事宜，经双方协商一致，达成以下条款共同遵守：

一、合同的有效期

本合同的有效期自20__年1月1日至20__年12月31日止。

二、代理费用及结算方式

甲方按2元/吨的服务费用支付给乙方，数量以铁路运输票据为准，每月结算一次，次月的10日内甲方通过银行转帐给乙方，乙方开具相应的金额的服务发票给甲方。

三、双方的权利义务

1、甲方

(1)甲方应于每批货物代理前1日内向乙方或乙方聘用的货运人员交付代理运输的货物和真实、完整的运输资料，国家规定应办理运输许可的货物，还需提交准运批文;

(2)与乙方或乙方聘用的货运人员共同验货;

(3)要求乙方按照合同的规定将货物安全交承运人，由承运人送至订单指定的交货地点;

2、乙方的责任

(1)按合同规定的内容及时办理货物运输计划的提报或运输变更手续，组织、监督装、卸车(船)，负责将货物安全交承运人，由承运人送至交货地点;

(2)代为保价(保险),代理领票、送票;

(3)提供运输咨询及技术指导，提供货损货差索赔咨询;

(4)根据甲方的另行委托，代理货物出险理赔手续(有关费用另计);

四、违约责任

1、甲方违反合同规定导致合同不能履行，或者擅自解除合同、擅自中止合同的履行，应按代理费总额的千分之三向乙方偿付违约金，并赔偿乙方因此受到的损失。

2、由于甲方的责任或者甲方违反有关规定，在代理运输的货物中夹带危险品、爆炸品等违禁物品，导致乙方未能将所代理货物送达指定地点，或者导致其他货物和运输工具、机械设备污染腐蚀、损坏、造成人身伤亡的，甲方应承担赔偿责任。

3、甲方未按合同规定预付运杂费及支付代理服务费，应从结算时间起，按未支付部分每日万分之五的比率，向乙方支付违约金。

4、乙方未按合同规定的要求，使货物错运到货地点，乙方应承担无偿运至合同规定地点，并承担因货物逾期到达所造成的损失。

5、合同履行期间，货物发生短少、丢失、变质、污染、损坏，属乙方责任的，比照运输企业的有关规定或者按照保险合同的约定进行赔偿。

五、免责条款

由于下列原因造成货物丢失、短少、变质、污染、损坏的，乙方不承担违约责任：

1、不可抗力;

2、货物本身的自然属性;

3、货物的合理损耗;

4、甲方或收货人的本身过错。

六、争议的解决方式

本合同发生争议，由双方协商解决，协商不成时，可依级别管辖的规定，应当向__铁路局两级法院提起诉讼。

the manufacturers shall， before delivery， make a precise and comprehensive inspection of the goods with regard to its quality， specifications， performance and quantity/weight， and issue inspection certificates certifying the technical data and conclusion of the inspection. after arrival of the goods at the port of destination， the buyer shall apply to china commodity inspection bureau (hereinafter referred to as ccib) for a further inspection as to the specifications and quantity/weight of the goods. if damages of the goods are found， or the specifications and/or quantity are not in conformity with the stipulations in this contract， except when the responsibilities lies with insurance company or shipping company， the buyer shall， within _____ days after arrival of the goods at the port of destination， claim against the seller， or reject the goods according to the inspection certificate issued by ccib. in case of damage of the goods incurred due to the design or manufacture defects and/or in case the quality and performance are not in conformity with the contract， the buyer shall， during the guarantee period， request ccib to make a survey.

19. 索赔(claim)：

买方凭其委托的检验机构出具的检验证明书向卖方提出索赔(包括换货)，由此引起的全部费用应由卖方负担。若卖方收到上述索赔后______天未予答复，则认为卖方已接受买方索赔。

除合同第21条不可抗力原因外，如卖方不能按合同规定的时间交货，买方应同意在卖方支付罚款的条件下延期交货。罚款可由议付银行在议付货款时扣除，罚款率按每__天收__%，不足__天时以__天计算。但罚款不得超过迟交 货物总价的____ %.如卖方延期交货超过合同规定__天时，买方有权撤销合同，此时，卖方仍应不迟延地按上述规定向买方支付罚款。

21. 不可抗力(force majeure)：

凡在制造或装船运输过程中，因不可抗力致使卖方不能或推迟交货时，卖方不负责任。在发生上述情况时，卖方应立即通知买方，并在__天内，给买方特快专递一份由当地民间商会签发的事故证明书。在此情况下，卖方仍有责任采取一切必要措施加快交货。如事故延续__天以上，买方有权撤销合同。

22. 争议的解决 (arbitration)：

23. 通知(notices)：

The year end is coming, before we move on to the new year, it’s high time for all of us to do a review for the year. To me, doing this annual review is like getting a report card. It’s no different with my annual review – except these results aren’t for my studies – they’re bigger. They’re for my life.

时间转瞬到年底，在我们步入新的一年之前，我们所有人都应该对这一年做个回顾总结。对于我来说，年终总结就像是拿成绩单。年终总结和成绩单一样，只不过收获的并不是学习成绩，它们更重要，是关于我的人生。

What have you experienced this year? What have you learned from them? With every experience we face, there are important things to learn. We can either let these incidences paus by, or we can stop to understand, internalize them, and draw lessons from them. Life is your school, and the lessons are dressed up as your everyday incidences. You don’t want to be living year after year without learning from your experiences. That’s just sleepwalking your life away.

这一年，你经历了些什么?从中你又学到了些什么?我们面对的每一次经历，都有一些重要的东西值得学习，我们可能会让发生的这些事情就从我们的生命中匆匆而过，或者我们也可以选择停下来，理解并消化这些经历，从中学到经验教训。生活就是你的学校，这些经验教训会假扮成每天的琐事。你也不想年复一年只是过生活，却从不从经历中学到些什么吧，那样的话，你只是在梦游度日。

There are a lot of lessons which I learn every year. Looking back at my review for , one of the biggest lessons I learned is that our reactions to life’s situations is a choice, and it’s up to how we make out of situations we encounter. This realization came after a highly intense period at my job. At that time I was already a positive person, but the situation was so out of control that it really made me negative. It was after a short period of feeling miserable that I realized that the reality was such and it was up to me to make the best out of it. I could either sit and bi-tc-h about it which would do absolutely nothing to change the situation, or I could take action and make the best out of it. This small shift in my mindset created a big shift in my reality – it made me a lot more proactive and solution-oriented. It made me realize that many of us generate unnecessary baggage with negative situations in life, and it’s all about taking action to create the lives that we want. Happineis truly a choice.

每年我都能学到很多。现在回头看看我xx年的总结，我学到的最重要的一课是“我们对生活环境的反应是一种选择”，取决于我们如何解决遇到的情况。这种感悟是在我的工作经历了一段高度紧张的阶段之后得出的。其实那时候我是个很积极向上的人，但是当时的情况完全不在我的掌控下，让我也变得消极了。有那么一小段时间，我觉得很痛苦，然后我就意识到，生活就是这样，如何做到最好取决于我自己，我可以选择干坐在那里抱怨牢骚，但这根本对改变现状一点帮助都不起;我也可以选择采取行动做到最好。

这样简单的心态转变使我的生活出现了很大的改变：我变得更加主动，积极选择解决问题的方法。这也让我意识到，我们许多人在遇到不利状况时，总是背负了太多不必要的包袱，只要采取行动，我们就能创造想要的生活。幸福快乐其实只是个选择。

Because I would write down lessons I learned each time (in my life handbook), I could then build upon my learnings. Rather than deja vuing through life situations, every time I would think about how I could apply what I had learned earlier and how I could do something different. As a result, I kept moving forward in my growth.

因为我每次都会记下学到的经验教训(在我的生活手册里)，所以我从所学中慢慢成长。每次总结后我都会想，下次遇到我会如何利用之前学到的改正错误，而不是一次次的重复犯错栽跟头。就这样，我在成长的路上一步步前进。

2. Wrap up what you’ve done this year

Many things can happen in a year and this is the perfect time to wrap them up. Were there any ups and downs? Did you get a promotion? Did you recently quit your job and joined a new workplace? Did you just start up a business? Did you move to a new place? Did you just end an unhappy relationship? Did you move on from a bad partnership? Any major events took place? Or perhaps there are nothing significant that happened?

每年都会发生许许多多的事情，现在就是你把之前的事情打包的最佳时机。生活中有一些起起落落?你升职了?最近刚辞职进入新的工作环境?刚开始创业?搬到新地方?刚结束一段不快乐的感情?走出了一段很糟的伙伴关系?发生了很多大事?也或许没什么重要的事情发生?

This is the time to wrap up the year. It’s time to let go of past baggage, tie up the loose ends, tidy up your feelings, and get ready for what’s ahead.

现在是该打包这一年的事了，也是时候放下这些过去的包袱，做一些收尾让工作有始有终，收拾起情绪，准备迎接即将到来的新一年。

3. Regain focus

重新找到重点

After working for a few years, you’d find that the years sort of just start to blend into each other. Soon it’s hard to tell one year apart from the next. Subsequently, it’s so easy to fall into a routine without being conscious of it. Sometimes I hear people commenting that they’re not sure what exactly they’ve been doing with the past few years of their lives, because everything just seems like the same.

工作了几年后你会发现，每年似乎开始有些混在一起的感觉，很难把它们区分开来。然后不知不觉，工作就很容易变成例行公事的老套路。有时候我会听到人们在说，不知道过去的几年具体都干了些什么，因为一切看起来都一样。

It’s just like driving. When you’re driving in a car, it can be hard to see where you are and where you’re heading to. On the other hand, pausing for a short moment to look at the map can be amazingly helpful. Where are you right now? How far have you traveled? Where do you want to go to? Doing so helps you to regain focus.

这就像开车一样。当你开车的时候，很难看出来你开到哪和要去哪。而另一方面，如果你停下来看看地图，你会发现超级有帮助。你现在正在哪儿?你走了有多远了?你想去哪儿?年终总结会帮你重新找到重点。

Like I mentioned above, doing my annual review is like getting the report card for my life. How do I grade myself for this year? Do I give myself an A+? A? B? C? D? or even F? This assessment reminds me if I have lived this year the way I had wanted to.

4. Start the next year on a high note

以高起点开始下一年

Last but not least, your annual review will help you to start the next year on a high note. As I’m going to share later in the post, doing your review includes setting your goals for the next year. For this year , my one single biggest goal was to build this blog. So this year, while other people were figuring out what to make out of their year, I was a person on a mission. By mid-year I had already exceeded some of my goals, and now that it’s the end of the year, I’ve accomplished what I had set out to do at the beginning, and more.
