一、甲方的责任和义务

三、经济条款

四、退费原则

1.如甲方未能成功帮助乙方获得入学录取通知书，则留学办理押金于两周内凭收据退还乙方;

2.若甲方未能成功帮助乙方获得学生签证，则留学办理押金和入学保证押金金凭收据于两周内退还乙方;

3.甲方帮助乙方获得学生签证后，无论何种原因，不能如期入学者，甲方不予退费。

五、违约责任

1.除申请录取通知书失败或签证失败以外的任何原因，乙方不得中途终止协议。如乙方执意要终止协议，乙方将无权要求甲方退回留学办理押金;

2.如乙方违约，甲方有权停止继续履行本协议，并扣留乙方所交之款项;

3.甲方对乙方的赔偿，以退回所收乙方的所有费用为最大限额。

我这次到国外考察，是有很大收获的。特别是对我们彻底粉碎“崇洋媚外”的思想是大有教育意义的!在这方面我最有深刻体会的是：洋鬼子都很傻，都没有我们中国人聪明!下面我就举几个这方面的例子。

比如说：法国人自称很有文化，可取个名也是怪怪的，偏要倒着来!明明是泥巴，他们取个巴黎，明明是赛马，他们偏偏叫马赛!这不是存心跟人闹别扭吗?

再比如我到澳大利亚考察期间，正值他们国家发生森林火灾。救火这本来是消防队员的事吧!可偏偏有许多人专门请假或是利用休假从老远赶来救火!这些人图个啥呢?我问了一下，什么都不图!你看这些人多傻呀!就说不要奖金、工资，总该蹭顿饭吃吧!可那些人救完了火还自己上餐馆，这不是倒贴钱吗?

第一天：上午到达66325部队，下午进行训练；

第四天：上午去体大参观，下午到了科技馆，晚上拉歌；

优点：行程安排充实，时间安排比较妥当，食宿不错，业余时间活动丰富。

缺点：学生太吵，每到一个景点参观时间较短。

Ishould manage not only the finance in the shop but also the employees in my shopeven made some strategies to enlarge the business in my shop to hold on the runthe shop. By December， 20__， I had finally determined to take business managementas my career instead of IT. To accumulate more relevant knowledge， I strived togain more practical work experience in some big companies.

第一章 服务通则

第一条 本合同条款根据《中华人民共和国民法典》等有关法律、法规、规章制定。

第二条 双方本着自愿、平等、诚信的原则，就委托方接受受托方提供有关出国留学咨询服务事宜,经协商，达成本合同协议，以共同遵守。

第三条 两方共同签订本合同，合同内容均为双方真实意思表示，并明确表示对合同所载明之条款内容完全理解，并无歧义。

第四条 本合同签约之前当事人应当仔细阅读本合同内容，并对本合同及其附加文件内容已仔细阅读，并同意合同的条款与附加文件内容与细节。双方共同遵守履行。

第五条 本合同文本中涉及到的选择、填写内容以手写项为优先。若有对本合同的附加或者修订条款，须在双方确定后，在本合同补充协议处双方同时签字盖章确认，与本合同一同生效。对本合同文本中空格部位填写双方应当协商确定。若有附加条款需作为本合同附件由双方确认后生效。

第六条 本合同的签订双方均对本合同的所有内容、条款、期限、金额及其附加表格、涉及合同双方的机密信息、各方情报、商业机密、数据统计信息、内部报告与分析资料信息、合同过程中所涉及的文件和数据，负有保密责任，泄露未经授权的机密信息应承担相应法律责任。

第二章服务内容

第一条 服务范围及方式：受托方的经营范围为国际教育咨询服务;服务方式为诊断评估、方案规划、培训指导、代理服务、心理辅导与后续跟踪;

第二条 服务内容：

受托方为委托方提供的国际教育咨询服务包含但不仅限于以下基本服务项目：语言考试规划，学校及专业的选择，竞争力强化(科研及实习的联络)，文书制作，递交申请，套词面试辅导，签证培训，行前指导。

第三条 服务目标委托方赴美国、加拿大入学时间为 _______年 季，目标学位为 ，就读专业为 (中文)。以下为受托方为委托方提供咨询服务的目标学校名单，确定的学校名单如下：

(院校外文名称，以外文为准，所申请的专业和学校名单应在签订合同后，由委托方在申请前最终确定)。委托方最终定校名单如下：

第三章服务时间

第一条 申请服务期：本合同签订后，受托方为委托方提供的咨询服务自动进入申请服务期。申请服务期在委托方寄出所有学校申请文件材料或委托方向受托方递交《申请服务期确认表》后结束。

第二条 服务后期：双方在申请服务期结束后，自动进入服务后期，服务后期直至委托方获得可以接受的学校录取，并签订《留学申请服务结果确认表》为止。本合同包含签证服务步骤，服务后期在委托方获得签证并顺利入学后自动结束。

第四章委托方权利与义务

一、委托方权利

第一条 委托方有权利了解受托方服务进度，并有权利要求受托方按照合同规定完成服务进度并确保服务质量;

第二条 在不涉及受托方商业机密的前提下，委托方有权利要求受托方提供留学咨询服务过程中涉及的文件、规划方案或相关资料;

第三条 如果委托方由于个人原因，决定终止本合同服务，委托方有权利向受托方正式提出申请，并按照本合同退款要求申请退款;

第四条 委托方对申请目标学校、申请创作文件、最终就读学校有最终决定权;

第五条 如果委托方对受托方提供的咨询服务及其相关的策划方案、具体申请服务细节有意见或者建议，可要求受托方进行修改;

第六条 委托方对受托方的咨询服务工作有建议权和申诉权。

二、委托方义务

第七条 委托方需向受托方提供完整真实的个人信息，并提供有效的证明文件;

第八条 委托方需配合受托方的信息沟通，保证受托方人员能顺利的与委托方及时联系;

第九条 委托方有义务对受托方的服务流程、服务数据、相关涉及文件、资料、报告及其受托方服务人员的个人信息进行保密。如果委托方有泄露受托方以上信息的实际行为，受托方有权利提前终止本服务合同，本合同退款条款自动失效;

第十条 委托方需按照受托方的要求积极配合工作。委托方对服务重要的阶段性确认文件、表格，如无异议，应及时予以签字确认;

第十一条 委托方需自行承担在申请过程中发生的由第三方收取的费用，如学校申请费，考试报名费、申请材料邮寄费、标准考试(TOEFL,IELTS,GRE,GMAT,SAT, LSAT等)成绩寄送费、成绩单评估费(评估机构一般为WES，ECE等)，签证费用、学校要求的押金等;

第十二条 委托方需按时向受托方支付咨询服务费用;

第十三条 委托方前往国家驻华使(领)馆，或者申请学校要求委托方进行面试，委托方应按要求参加面试。

第五章受托方权利与义务

一、受托方权利

第一条 受托方有权利将委托方的申请信息用于非公开性的内部研究体系。

第二条 受托方有权利在对外发布的分析报告中包含经过隐私处理的委托方申请的数据信息。

第三条 受托方有权利要求委托方及时准确的提供申请学校的名单及其最终申请结果以确认受托方服务的进度。

第四条 受托方有权利对委托方的备考情况、个人专业水平、英文水平进行测试，以了解和保证相关咨询服务进度和计划的准确。

第五条 受托方有权利在委托方提交《服务终止及退款申请表》之后，审核委托方的护照，或要求委托方提供完整真实的学校录取状态证明文件和申请过程涉及申请资料副本，以确保退款审核的顺利进行。

第六条 受托方服务协调与质量监管部门有权利在服务过程中，对委托方进行电话或邮件调查，了解具体服务细节与委托方意见。

第七条 受托方有权利拒绝支付本合同退款条款外的其他委托方留学申请过程实际发生费用或任何委托方的精神或物质损失。

二、受托方义务

第八条 受托方需按照合同约定，为委托方提供留学咨询服务。

第九条 受托方需根据委托方情况，为委托方设计合理有效的咨询服务方案并保障委托方的正确理解与有效执行。

第十条 受托方应根据委托方申请目标为委托方组建合适的咨询师团队及其相关支持服务团队，为委托方提供高质量的留学咨询服务。

第十一条 受托方应按照《留学咨询服务项目及时间规划》安排进行咨询工作的时间和进度。不得擅自更改或者减少服务内容或者拖延服务周期。

第十二条 受托方应及时处理委托方的申请目标的变更，当需要更改、补充修订《留学咨询服务项目及时间规划》时，受托方应征得委托方的同意。

第十三条 受托方应保持良好的工作态度和服务质量，受托方对委托方的留学申请的各重要环节有指导权和建议权。

第十四条 受托方应如实向委托方介绍委托方所要前往国家或地区的考试要求、申请难度、签证政策，学校状况并提供有效的文件供委托方参考，不作任何虚假陈述。

第十五条 受托方应及时向委托方推荐其他服务体系(公证、ETS等)以保证委托方留学申请的顺利进行。相关费用由委托方承担。

第十六条 受托方须对委托方的体系文件、有效资料和个人背景信息保密，用完的个人资料原件须立即归还，严守委托方机密。 不得擅自在服务期间及服务结束之后的任何时间，在没有获得委托方书面允许的情况下，向第三方透露委托方的任何个人及其申请服务信息。若受托方有任何泄露委托方机密信息的行为，委托方有权利提前终止合同并要求全额退费。

第十七条 受托方在符合本合同关于退费规定的前提下，在收到委托方正式的退款申请文件时，受托方应及时协助委托方确认退款流程并按时处理退款。

第六章服务费用

第一条 委托方应向受托方支付咨询服务费总计人民币小___万元整(￥___元)。

第二条 委托方应在本合同签订之日起，三日内通过现金、刷卡向受托方支付咨询服务费用。汇款相关账户由受托方指定。

第三条 受托方需在委托方付款生效后向委托方提供收款凭证。

第四条 委托方自行承担在申请办理过程中发生的第三方费用(如院校报名费、邮寄费、签证费等)。

第七章 服务退款

第一条 如果委托方最终获得了本合同第二章中目标学校和专业的录取并通过签证顺利入学，且委托方没有本合同本章条款中所提及的退费情况发生，则视受托方服务成功;

第二条 如果受托方为委托方提供咨询服务的目标学校名单中的学校和专业均申请失败，或者申请成功，但最终签证失败，受托方将在十五日内执行全额退款;

第三条 在服务过程中由于受托方原因而导致合同无法履行，受托方将在十五日内执行全额退款;

第四条 其他特殊情况的退款或由于不可预知的因素导致的委托方的退款要求，受托方和委托方需友好协商并确定退款额度与退款时间。

第八章合同结束

第一条 待双方按本合同要求履行完各自的权力和义务后，本合同自行终止。

第二条 若委托方未在服务后期与受托方确认《申请服务完结确认表》，也未在退款申请期提交正式退款文件。在退款申请期过期之后，本合同自动结束。

第三条 双方在本合同退款条例下正常签订《退款确认协议》，在退款正常执行后，本合同自动终止。

第四条 如在本合同生效后，若由于本合同未约定的特殊情况，任何一方欲终止执行本合同时，须提前一个月与另一方协商，待双方以书面形式就有关终止事宜达成共识并正式认可签章后，本合同的终止方为有效。

第九章合同延长

第一条若委托方在收到学校录取结果后，并决定在当年不接受此录取结果，而继续申请下年度的录取、或保留录取结果至下年度，受托方需继续提供下年度服务，本合同自动延续至下年度申请。服务延续委托方无需向受托方支付额外的咨询服务费。

第二条若委托方在服务过程中由于任何原因放弃本年度申请，但有计划申请下年度申请，委托方可在签订《服务延续申请表》确认后，自动终止本年度服务内容，自动进入下年度申请服务阶段。服务延续委托方无需向受托方支付额外的咨询服务费。

第十章适用的法律及争议解决方法

第一条 本合同的履行、解释及争议解决均适用中华人民共和国有关法律。

第二条 本合同在履行过程中发生任何争议的，由双方协商解决。协商不成，由______仲裁委员会进行仲裁或向受托人住所地人民法院提起诉讼。

第十一章补充协议、合同的变更、修改

第一条 补充协议、或者合同的修改、变更均应采用书面形式形成补充合同。补充合同在双方签署后生效，并与本合同具有同等法律效力。直接在本合同正文上的修改无效。

第十二章生效条款

第一条 本合同自受托方代表签字、盖章(行政章或合同专用章)及委托方(委托方未满18周岁的，由委托方法定代理人签署)签署，并在受托方收到委托方按本合同约定的时间缴付咨询服务费之日起生效。

第二条 本合同正本一式两份，具有同等法律效力，双方各执一份。

第十三章补充协议

本补充协议内容为合同正文补充部分，与本合同一同生效。对合同的变更及其补充协议内容，双方须共同协商确定。若补充协议与本合同正文部分有冲突条款，以本补充协议为准。

补充协议条款如下：

第一条 本协议包括的受托方为委托方申请的专业数量、院校数量均不做限制，由委托方确定。

身体平衡训练是针对孩子的另一个重要的环节，身体平衡包含了身体协调，所以想在运动训练中有一个更好的提升，平衡训练是必备的训练之一，平衡训练课程是搭配在篮球训练课程当中的课程。是让孩子可以感受乐趣的环节。我们会利用一些小器械来辅助完成，让孩子们可以感觉到乐趣。 小器械训练

身体体能训练

一个好的体能是篮球本身的基础。新星篮球俱乐部的体能训练特色是由专人进行体能训练课程，通过大肌肉群的综合训练使孩子们在体能训练时不会觉得枯燥，同时可以很好的参与其中。体能是所有运动的基础，是孩子身体发育最重要的一个环节，所以我们也是最重视的一块。

篮球训练一直倡导的是全面提升孩子身体素质与发育的理念去进行。所以会在基本的篮球训练当中穿插很多身体训练项目，小器械训练就是其中一个。

心里素质训练

目的就是发展孩子们的心里素质，让孩子在飞跃巅峰篮球训练当中不仅仅是来这里运动玩。而是真正的身心灵的训练。人们都说性格决定命运。也是一样打造的是一个全面的篮球训练营。训练方式是限定时间投篮，上篮，分组对抗的方式进行训练。让孩子可以在不知不觉间去体会。

分组对抗训练

分组对抗训练是篮球训练中常见的训练方式，分组对抗目的就是培养孩子的竞争意识和培养团队意识，训练营经常会把篮球训练分成若干组进行比拼，让我们的孩子参与当中不仅仅是过来训练，可以培养更多的心里素质。

身体矫正训练

现在孩子的体姿体态问题困扰着家长。没有一个好的学习习惯跟体姿体态也是有非常大的关系。由于孩子长的过快，或者平常学习习惯导致的驼背问题，脊柱测完问题都会得到非常大的改善。那训练营特别推出这样的课程来帮助孩子们可以在篮球训练的同时，把自己的身体姿态做一个调整。一套篮球训练下来孩子会有非常大的改变。

2016年夏令营讲话稿

各位营员，各位远道而来的青年朋友：

此时此刻，我代表哲学学院的全体师生欢迎你们。也祝贺你们做了一个正确的选择，在夏令营的活动中你们选择了xx大学哲学学院。

xx大学哲学学院的前身教育哲学系，于1922年成立。在1949年以前，现代中国哲学史上很多著名的哲学家都曾经在这里任过教，有的甚至做过系主任。其中耳熟能详的有熊等人。新中国成立后，武大哲学系被合并到北京大学哲学系，后来，一些著名的教员就留在了北京，如洪谦先生。1956年，在老校长李达的亲自领导下，恢复重建哲学系。武大哲学系是当时中国高等院校院系大合并后第一个恢复重建的哲学系。李达先生当时请来、选用的一些青年教师，如陈等人，后来就成为改革开放后xx大学哲学系的中坚力量，并逐渐形成了今天武大哲学学院的基本学科格局——中、西、马、美学的骨干学科。20世纪末21世纪初，在时任人文学院院长郭xx教授的带领下，武大人文学院哲学系又率先实施本科教学改革，先后创立中西比较哲学试验班、国学试验班、宗教学试验班。在本科教学改革的推动下，武大哲学学院又形成了新的优势学科——比较哲学、宗教学、国学。而国学目前发展得最好，已经成立了国学学院，从本科到硕士、到博士，有比较完整的课程与人才培养体系，是全国数一数二的最好的国学院之一。

今天xx大学哲学学院下设三个系——哲学、宗教学、心理学，有一个挂靠的学院，国学院，哲学学科八个二级学科比较齐全，心理学有两个二级学科，国学按照中国传统学问的四部分类——经、史、子、集分科培养，再将宗教学独立出来，共有五个学科。因此，xx大学哲学学院的一大特色是学科门类相对比较齐全，为研究生的学习与研究能提供比较广阔的知识视野与思想的视野。

1956年重建以后的哲学系，很多教员都来自北京大学哲学系，或在北京大学哲学系进修过。在老一辈学者的带领下，xx大学哲学院的学风与北京大学哲学系有非常相似之处，即非常重视哲学史与哲学基本思维的训练，重视哲学经典的教学与研究，表现出比较扎实与比较朴实的学术研究风格。陈修斋、杨祖陶先生开创的西方哲学史研究，在唯理论与经验论、莱布尼兹研究、德国古典哲学——康德、黑格尔的翻译与研究方面，做出了突出的贡献，构成了我们这里西方哲学研究的特色。在此基础上延伸出的西方宗教哲学的研究，又形成了新的优势。段德智教授率领自己的研究团队，长期致力于中世纪基督宗教哲学的翻译与研究，将托玛斯•阿奎那的《神学大全》译成汉文，这对于推动汉语学界的阿奎那研究将产生持久的学术影响。江天骥先生开创的现代西方哲学研究，特别是对美国哲学的研究，曾经在学术界独步一时，培养了一批研究西方现代哲学的专家。以萧萐父为代表的中国哲学团队，在明清哲学与王夫之哲学研究、现代新儒家研究、出土文献中的中国哲学研究诸领域，都取得了国内国际同行的认可，特别是萧先生重新界定了“明清早期启蒙说”的内涵及其具体内容，以及对王夫之哲学的深入研究，在20世纪80、90年代的国内、国际学术界，产生了很大的影响。陈荣捷先生主编的英文版《中国哲学资料汇编》里，在收录的少数当代中国哲学家名录里，就有萧萐父先生；而罗马尼亚学者lucian boia编纂的《国际史学家辞典》里收录了王夫之词条，该词条就是由萧萐父先生撰写的。目前，郭xx教授、李维武教授、田文军教授所形成的xx大学现代新儒家研究阵营，是国内现代新儒家研究最强的团队之一。

马克思主义哲学研究一直是xx大学哲学学院的主力，李达老校长所开创的中国化的马克思主义哲学研究及其成果，已经成为20世纪中国哲学的一个有机的组成部分，并在中国的社会主义实践中产生了积极的作用。陶德麟先生是当代中国著名的马克思主义学者之一，曾经当过哲学系主任、xx大学校长。在20世纪80年代的真理标准问题大讨论中，发表过重要理论文章，对当代中国的马克思主义哲学的发展做出过重要贡献。从公职上卸任以后，陶先生一头扎进科学研究之中，长期笔耕不辍，近十几年来，在马克思主义中国化的研究方面，推出了系列极有份量的学术作品，而且还带领一个团队从事这一重大的理论问题，也是现实问题的研究，其学生汪信砚教授已经是这方面的佼佼者与领军人物。

另外，xx大学哲学学院的国外马克思主义哲学研究也成绩斐然，以何xx教授为代表的罗莎•卢森堡研究，以及她的团队里青年才俊李佃来教授的西方马克思主义政治哲学研究，也已经在国内崭露头角。

根据培训地所在国的生活标准，甲方给予乙方国外生活津贴美元/月，每月由甲方支付生活津贴的50%作为其日常开销，余下50%在本协议第九条规定的服务期满后一次性支付给乙方。

4.甲方根据实际需要为乙方在国外购买必要的保险。

5.培训期间不安排回国探亲或家属出国探亲。培训期间如身患重病或慢性病复发，应及时回国就医。伤、亡、病故等按国家有关规定办理。

五、乙方在国外期间，保证遵守中国法律和中国对出国人员规定，遵守所在国法律，违者后果由乙方自负；乙方应自觉遵守培训单位的各项规定与要求，凡因违规违纪而受到培训单位处罚的，甲方将追加惩处，视同在本公司内的违纪。

六、乙方在培训期间，必须每月向甲方书面报告一次培训情况。

七、经甲方同意，由第三方作为乙方出国培训的国内保证人，保证乙方执行本协议。如乙方违约，保证人须赔偿甲方为乙方出国培训所支付的一切费用及由于乙方违约造成损失的各项费用。如乙方违约逾期不归，从逾期之日起，保证人须向甲方支付元（人民币）的担保费。

八、培训期满后乙方将由甲方根据企业运作的实际需要安排适当的岗位；乙方若不同意甲方安排，甲方有权单方面解除劳动合同，乙方除必须向甲方赔偿培训总费用的2倍外，还必须支付给甲方一万元违约金。

九、培训结束后，乙方必须为甲方连续工作5年。如一年内辞职应向应甲方交纳公司负担培训费用的2倍，并支付违约金一万元；如二年内辞职应向应甲方交纳公司负担培训费用1.5倍并支付违约金一万元；如三年内辞职应向应甲方交纳公司负担培训费用1倍并支付违约金一万元；如四年内辞职应向应甲方交纳公司负担培训费用50%并支付违约金一万元；如第五年内辞职应向甲方缴纳公司负担培训费用的25%并支付违约金一万元。因违纪被公司辞退的员工亦照此办理。

十、本协议自公证之日起生效，签字各方保证遵守执行，有效期至本协议第九条规定的工作年限期满为止。

Having a flair for Economics and accounting I have decided that I want adegree in Accounting and Finance or Management. The many brilliantrepresentatives of the management community around the world have strengthenedthat resolve.

When I worked in my school as a tutor of English as a Second Language forstudents from a community school in Muscat, I realized the importance of astrong leader who could organize, command respect, and be able to work well withothers. 第二条 委托人的权利与义务

1.参考受托人提供的信息和咨询、建议，决定申请留学的国家、院校中英文名称、留学层次、就读专业或专业方向，确定留学方案并签署本合同附件《院校及专业确认表》;

2.有权选择自行缴纳院校申请注册费、材料寄送费、签证等第三方收取的费用;

3.填写受托人制定的《自费出国留学申请人信息表》，并向受托人提供留学申请所需的全部文件、材料，材料应于合同签署后 日内提供，并保证所提供的信息、文件、材料真实、有效;

4.配合受托人及时完成申请准备及向申请学留学院校提交申请、寄送资料等工作，如遇前往国家留学政策、签证政策、入学标准发生变化，应根据新的要求及时提供补充材料;

5.按照留学院校要求,如期缴纳学费等有关费用;

6.按期办理护照及签证;

7.按照本合同约定向受托人支付中介服务费;

第三条 受托人的权利与义务

1.要求委托人及时提供办理委托服务所需信息、文件、资料及履行本合同约定的其他义务;

2.按本合同约定收取中介服务费;

3.按照法律法规规定及留学服务行业规范要求提供本合同约定的中介服务;

4.向委托人提供的留学信息，应真实、准确，如遇前往国家留学政策、签证政策、入学标准发生变化，应及时通知委托人补充相应材料;

5.及时完成本合同约定的留学服务事项并向委托人通报工作进展情况;

第四条 中介服务费用

1.双方协商确定，委托人申请的留学院校在本合同附件一《院校及专业确认表》范围以内，中介服务费为人民币(大写) 元整(￥ );委托人申请的留学院校超出《院校及专业确认表》范围，每增加一所学校，委托人须另缴纳中介服务费人民币(大写) 元整(￥ )。

2.中介服务费支付期限

□ 分期付款方式：

2.在双方未出现违约的情况下，委托人留学申请成功，但因委托人原因造成签证申请被拒签的，受托人不退还任何费用。因非委托人原因造成签证申请被拒签的，根据拒签原因，双方协商一致受托人须将中介服务费中所含办理申请签证服务的费用全部或部分共计人民币(大写)__________ 元整(￥ )退还给委托人。

3.在出现本条第2项约定情形时，如委托人已向留学院校缴纳费用，受托人协助委托人按留学院校退款政策索还委托人支付给校方的费用。

4.本合同签署后，在双方未出现违约的情况下，委托人单方面要求解除本合同，则根据本合同实际履行的阶段，委托人已支付的全部中介服务费按以下办法处理：

(1) 在本合同签订后 日内，委托人尚未提供任何入学申请材料的，受托人扣除已支付服务费总额_______%后，余额退还委托人，本合同终止;

(2) 在本合同签订后，委托人已经提供入学申请材料，但受托人尚未向拟申请留学院校或有关外方提交入学申请或送交委托人材料的，受托人扣除已支付服务费总额_____%后，余额退还委托人，本合同终止;

(3)受托人已经向拟申请留学院校或有关外方提交入学申请或送交委托人材料，但留学申请尚未成功的，受托人扣除已支付服务费总额______%后，余额退还委托人，本合同终止;

(4)留学申请成功，但受托人尚未提供办理签证申请服务的，受托人扣除已支付服务费总额_____%后，余额退还委托人，本合同终止。

5.出现本条所约定退费情形，委托人可书面通知受托人进行退费，受托人于收到委托人书面通知后十五个工作日内按本合同约定予以退还。本合同约定受托人退费范围仅限于受托人已收取的中介服务费，不包含受托人受委托人委托向第三方代缴的费用。

第六条 违约责任

1.双方均应严格履行合同中全部条款。因双方中任一方违约导致本合同无法继续履行的，另一方有权解除本合同。本合同解除后，受托人按照本合同第五条退费条款中的第4项约定退费，同时违约方须承担相应的违约责任。

2.委托人违反本合同约定，按照下列不同违约情形，承担相应违约责任。

(1)迟延向受托人支付中介服务费或未及时向受托人支付由受托人代为向第三方支付的费用，每迟延一日应向受托人支付逾期付款总额万分之_ ____的违约金。迟延支付中介服务费超过____日的，受托人有权解除本合同;

(2)迟延提供材料或向受托人提供虚假材料，从而导致留学院校申请失败或被拒签，委托人应自行承担由此产生的后果。受托人没有过错的，不承担违约责任。

3.受托人违反本合同约定，按照下列不同违约情形，承担相应违约责任。

(1)为达成本合同目的而向委托人提供虚假文件材料，除全额退还中介服务费外，还应按中介服务费的 %的人民币，作为违约金支付给委托人，并在 年 月前，协助委托人按留学院校退款政策索还委托人支付给校方的费用;

(2)未能在约定的时间内为委托人申请到拟留学院校的录取通知书，委托人有权解除合同，但应及时通知受托人。受托人除全额退还中介服务费外，还应按中介服务费的 %的人民币，作为违约金支付给委托人，并在 年 月前，协助委托人按留学院校退款政策索还委托人支付给校方的费用。如委托人要求继续履行，受托人应负责在 年 月前为委托人申请到拟留学院校的录取通知书，并向受托人支付迟延履行违约金人民币(大写) 元整(￥ );

(3)导致委托人留学院校申请失败或被拒签，受托人全额退还中介服务费，并按中介服务费的 %的人民币，作为违约金支付给委托人。

第七条 不可抗力

由于政治原因或地震、台风、水灾、火灾、战争以及其他不能预见并且对其发生和后果不能防止或避免的不可抗力，致使直接影响本合同的履行或者不能按约定的条件履行时，遇有上述不可抗力的一方，应及时通知对方，并应在十五日内，提供不可抗力详情及本合同不能履行、或者部分不能履行、或者需要延期履行的理由的有效证明文件，此项证明文件应由不可抗力发生地区的公证机构出具，按其对本合同的影响程度由双方协商决定是否解除合同、免除或者部分免除履行合同的责任，或者延期履行合同。

第八条 争议解决方式

1.本合同的履行、解释及争议解决均适用中华人民共和国有关法律。

2.凡因履行本合同所发生的一切争议，双方应通过友好协商方式解决。协商不成时，双方一致同意选择以下一种解决方式：

第九条 生效及期限

本合同自委托人(如委托人未满18周岁建议由委托代理人签署)及受托人签字、盖章之日起生效，至本合同约定的委托事项完成之日止。

第十条 通知

除特别书面声明外，委托人所填写的《自费出国留学申请人信息》中载明的住址即为受托人寄送书面文书的通讯地址。受托人在提供中介服务过程中，如按照委托人提供的其他联络方式无法取得联系时，受托人向该通讯地址发送的书面文书，即视为受托人履行了通知义务。委托人如更改通讯地址，应及时以书面形式通知受托人。

第十一条 其他

1.本合同的组成：本合同由合同本身及附件《院校及专业确认表》组成，本合同和其附件具有同等法律效力。

2.本合同一式三份，委托人执一份，受托人执两份，具有同等法律效力。
