第二条 房屋权属

该房屋为甲方的家庭共同财产。甲方保证其全部家庭成员同意甲方出卖该房屋给乙方，且房屋没有产权纠纷，不存在房屋抵押，债权债务，以及其他权利瑕疵。自本协议生效之日起，如发生上诉未清事项，概由甲方负责清理，并承担相应法律责任，由此给乙方造成的损失，由甲方负责赔偿。

第三条 房屋面积和价格：

房屋面积为80.98平方米，按3470元/每平方米计价，共计人民币281000元整(大写：贰拾捌万壹仟元整)。

第四条 付款时间与方式：

本合同签署后乙方应将购房款贰拾伍万壹千元整(￥251000元)交付给甲方，该款在签订合同当日支付。余款叁万元在办理产权过户手续后三日内付清。甲方的银行帐户：开户行建行，户名： ，账号 。乙方可现金支付给甲方也可将购房款存入甲方上述的帐户。

第五条 房屋交付：

1、本合同签订后当日，甲方应将所持有的《安置协议书》原件(编号： )、交款票据原件等一切与该安置房有关的文件及凭证交由乙方保管;

2、甲方应在签订本合同后三日内，将该房屋及其钥匙全部交付给乙方，由乙方所有。

第六条 关于产权登记及过户的约定：

对本房屋以后需要办理房屋产权证，土地证等其它手续，经甲乙双方协商，按以下约定进行。

1、买卖房屋办理到甲方名下所有权证、土地使用权证及其他手续所需缴纳的税收和费用均由甲方承担。办理到甲方名下后，甲方应自领取之日起三日内，将领到的产权证书交由乙方。

2、在已办理到甲方名下房屋产权证，土地证等其它手续之后，甲方应告知乙方，并自甲方办理房屋产权证到自己名下后的3日内甲方须无条件协助乙方办理房屋产权证、土地证及其过户手续，所须相关费用(包含双方交易费、营业税等)全部由乙方承担。甲方应该提供一切与之有关的手续及资料(原房屋产权人的产权证及国土证，原房屋产权人结婚证及复印件，原房屋产权人夫妻双方身份证复印件，其他房屋共有人同意出售的书面意见等)，不得用任何方式拒绝阻挠。

第七条 补偿费和建筑差价的享有和承担

1、根据甲方和晋江市土地储备中心签订的安置补偿协议，指挥部应给付给甲方的临时安置补助费，每平方米每个月10元，由乙方享有，并从首付款中预先扣除一年的安置补助费(9720元)，超过一年的安置补助费由甲方再补给乙方，不足一年乙方应返还差价给甲方。

第八条 违约责任条款：

1、乙方没有按照约定的期限内将房款交付给甲方，逾期达到一个月的，甲方有权解除本合同，乙方并承担逾期付款的购房款日万分之五的违约金;

2、甲方在交房后未按约定将房屋及其附带的钥匙全部交付给乙方的，视为甲方违约，甲方应支付违约金人民币叁拾万元整给乙方。

3、甲方在接到办理房屋产权通知后逾期10日不去相应机构办理产权证和土地证的，视为甲方对乙方的违约，甲方应支付违约金人民币叁拾万元整给乙方。

4、甲方不得擅自解除合同或再次将该房屋出售给他人，否则，乙方有权要求甲方继续履行合同或要求甲方退还乙方已付房款，并有权要求甲方按照同期银行贷款利率支付利息款，同时有权要求甲方支付违约金人民币叁拾万元整给乙方。

5、甲方不根据本合同的约定将房屋和产权证书交付给乙方，视为甲方违约，乙方有权要求甲方交付房屋和产权证书，并有权要求甲方支付违约金人民币叁拾万元整。

6、甲方根据本合同的约定在出证后超过30天不协助乙方办理房产过户手续的，视为甲方违约，乙方有权要求甲方履行合同或要求甲方退还已付房款，并有权要求甲方支付违约金人民币叁拾万元。

第九条、合同无效的特别约定：

若本合同无效，甲方特别声明在本合同确认无效的十日内赔偿乙方经济损失叁拾万元整。

第十条、本合同发生争议的解决方式：

双方本着友好协商，公平合理的原则签定本合同，签定本合同后，双方应严格遵守执行，不得以任何理由反悔。在履约过程中发生的争议，双方可通过协商解决。协商不成的，双方一致同意向本合同的签署地泉州市福华商厦所辖地方法院----丰泽区人民法院提起诉讼。

第十一条、本合同未尽事宜，甲乙双方可另行约定，其补充约定由甲方、乙方共同协商解决，与本合同具有同等法律效力。

本合同在双方签字之时生效。本合同中空格部分填写的文字与印刷文字具有同等法律效力。本合同一式叁份，甲方产权人共持一份，乙方一份，另一份留存备查。

微风习习，随风摇摆的树枝被皎洁的月光映出几分婆娑的倒影，晃动间，煞是美丽。明亮的灯光照在路上，烘托出静谧的气氛。而在宿舍楼某层的某个宿舍，我们正忙得不亦乐乎。

“呼，”我长出了一口气，“终于换完了，和浦，你搞定了没？”“没有。”“那我帮你吧。”“好啊，谢谢。”“没事。”

在这个不算很大的宿舍里，我和张和浦开始了“艰难”的换床单工程。张和浦先把床单铺平，他在床头，我在床尾，吾二人一前一后，岂不“快”哉！我们飞快的把床单上的褶皱压平，随后把褥子从床板上抄起，再把床单和褥子贴合上，最后把褥子一压，“蓬”，床单带着褥子，落在床板上，发出一声轻响，似乎在庆祝着我们的小成功。我又沿着床边，把垂下来的床单都一一塞到褥子底下，最后双手将褥子压平，并把褶皱的床单向两旁一扽，大功告成！

我们一击掌，和浦脸上露出一丝笑容，我也笑了一下。看到李公仔的床单还在床上散乱的扔着，我对和浦说：“和浦，咱们帮公仔把他的床单也铺了吧。”“好啊。”和浦不假思索的答道。随后，我们又以迅雷不及掩耳之势铺好了公仔的床单。这时，公仔披着浴巾，推门走了进来。目光扫了一眼床上，“呵，这是谁帮我铺的床单啊。”“远在天边，近在眼前。”我和和浦异口同声的道。我们三人相视一笑，公仔感激地说道：“谢谢两位大帅哥！”

窗外，依旧微风习习，不时间传来的一声声虫鸣，似乎在奏着一首首交响曲，为这静谧的夜，又添几分温馨。宿舍楼的某一扇窗户里，高兴的笑声不时传来，那月亮，似乎也露出甜甜的笑脸。“呵呵……”
