7.乙方提前交货的，甲方接到货物后，仍可按合同约定的付款时间付款;合同约定自提的，甲方可拒绝提货。

乙方逾期交货的，乙方应在发货前与甲方协商，甲方仍需要货物的，乙方应按数补发，并承担逾期交货责任;甲方不再需要货物的，应在接到乙方通知后______日内通知乙方，办理解除合同手续，逾期不答复的，视为同意乙方发货。

第十条不可抗力与约定免责

不可抗力是指不能预见、不能避免并不能克服的客观情况。

具体包括：

一是自然原因如洪水、暴风、地震、干旱、暴风雪等人类无法控制的自然原因所引起的灾害事故;

二是社会原因，如战争、罢工、骚乱、政府禁止令、征收征用等引起的;

三是突发重大事件。

任何一方由于不可抗力原因不能履行合同时，应在不可抗力事件结束后______日内向双方通报，以减轻可能给对方造成的损失，在取得有关机构的不可抗力证明后，允许延期履行部分履行或者不履行合同，并根据情况可部分或全部免予承担违约责任。

第十三条约定事项
