TIMBER SALE CONTRACT - SAMPLE

1. (d) During the life of this contract and on the area covered, care shall be exercised by the Purchaser and his employees against the starting and spread of fire, and they shall do all in their power to prevent and control fires.

(e) Any liability for damage, destruction, or restoration of private or public improvements or personal damages occasioned by or in the exercise of this contract shall be the sole responsibility of the Purchaser, and the Purchaser shall save harmless the Seller on account of such damages.

2、乙方必须严格遵守医疗卫生操作规范，认真落实各项医护管理制度，提高医疗护理质量，确保医疗、护理安全。

3、乙方必须遵守医院的各项规章制度，服从医院的管理，维护和塑造医院的良好形象。

4、乙方科室对外进行宣传广告活动，必须报甲方医院批准，严禁未经批准，擅自对外发布广告。

三、利润分配

第五条 乙方每月最低映出长片 场，短片 场。场租：首轮艺术片(复轮艺术片、纪录片)35毫米： 元/场;16毫米： 元/场;8.75毫米： 元/场。

第六条 甲乙双方票房收入分账率为：甲方 %，乙方 %。

第七条 乙方映出的影片，只限于规定的乙方场地映出，不得转租或转借给任何单位和个人。

第八条 乙方放映的影片，不得拖长映期延误规定的时间或拦截周转中的影片，否则按实际影响的场次，以满场总收入的 %赔偿甲方。延误甲方规定的发寄时间，如系不可抗力或其他不可归责于乙方的原因引起的，不适用本条。

第九条 排定的影片，如甲方未能将影片按期供应乙方，致使乙方停映，甲方应根据乙方实际停映的场所，每场按满场总收入扣除片租应得后赔偿乙方。如遇有临时任务必须更改，影片内容修改或停止发行、拷贝损坏无法上映等，责任确实不在甲方者，甲方不负赔偿责任，但甲方有责任及时供应乙方更换的节目。

第十条 排定影片及特殊性影片之票价及优待方法，分账双方不得任意变更。

第十一条 乙方在排定影片后，不得占用排映电影时间改作其他活动，如必须改作其他活动，须于每日拍片提前计划。影片排定后乙方少映或停映电影，在上映3天前提出时，乙方应向甲方缴纳变更手续费 元，在上映前2天或排映期内提出时，则按乙方实际影响场次以本地区平均场租 元，每场的 %赔偿甲方。已出库的影片，借故不出映者，收取片租的 %

第十二条 乙方对甲方供应的影片，应按有关规定予以保护，如有遗失、损坏或经甲方检查有超额损伤时，乙方应予以赔偿，否则停止供片。

第十三条 甲方可随时派机检员凭证至放映设备和放映人员处，如发现乙方放映设备、放映人员不符合要求时，为保护影片安全，甲方有权通知乙方迅速维修改进，如情节严重，甲方可及时停止供给影片至修复后经甲方检查认可时止。

第十四条 乙方按规定的时间提报报表和缴付片款，对不按期缴片租者，超过 日起，每日按片租总额缴 %滞纳金。超过 月以上时，除缴纳滞纳金外并暂停供片，直至缴纳齐片租时再予以恢复供片。

第十五条 甲方派出的稽查员有权利到乙方稽核票务及查阅有关账册，乙方应予以配合;如发现乙方有少报、偷漏片租的行为，除按规定补交片租外，根据情节严重，按片租总额处于 倍以下的赔偿。

第十六条 本合同自签字之日起生效。一方要求延长合同应在第一条规定的时间结束前 3 月通知对方，双方商定并续订合同。
