when a sophomore, i joined the association of ai enthusiast and began to narrow down my interest for my future research. in 1997, i participated in simulation tool development for the scheduling system in prof. wang’s lab. with the tool of opengl and matlab, i designed a simulation program for transportation scheduling system. it is now widely used by different research groups in nust. in 1998, i assumed and fulfilled a sewage analysis & dispose project for nanjing sewage treatment plant. this was my first practice to convert a laboratory idea to a commercial product.

in 1999, i joined the distinguished professor yu-geng xis research group aiming at network flow problem solving and heuristic algorithm research. soon i was engaged in the fudan gene database design. my duty was to pick up the useful information among different kinds of gene matching format. through the comparison and analysis for many heuristic algorithms, i introduced an improved evolutionary algorithm -- multi-population genetic algorithm. by dividing a whole population into several sub-populations, this improved algorithm can effectively prevent ga from local convergence and promote various evolutionary orientations. it proved more efficiently than sga in experiments, too. in the second semester, i joined the workshop-scheduling research in shanghai heavy duty tyre plant. the scheduling was designed for the rubber-making process that covered not only discrete but also continuous circumstances. to make a balance point between optimization quality and time cost, i proposed a dynamic layered scheduling method based on hybrid petri nets. the practical application showed that the average makespan was shortened by a large scale. i also publicized two papers in core journals with this idea. recently, i am doing research in the composite predict of the electrical power system assisted with the technology of data mining for bao steel. i try to combine the decision tree with receding optimization to provide a new solution for the composite predictive problem. this project is now under construction.

根据《_____》、《中华人民共和国著作权法》及其他相关法律法规，双方就甲方委托乙方设计___________作品事项，在真实、充分表达各自意愿的基础上，经过平等协商，达成如下协议（简称本合同），由双方共同恪守。

第一条合同标的 1.本合同委托作品的要求： （1）设计作品的内容； （2）设计作品的用途及使用范围； （3）设计作品的交付时间； （4）甲方对乙方主要设计工作人员的要求。 2.在本合同履行过程中，如甲方提出新的设计要求，双方可就设计费的调整、设计成果的交付时间等相关事宜另行签订协议。 3.乙方保证所交付的设计作品具有独创性、不存在任何权利瑕疵，包括但不限于知识产权瑕疵，否则因此引起的任何法律责任由乙方负责；乙方为完成本合同委托事项而需要使用他人作品的，应保证得到该作品著作权人的有效授权。

第二条基础资料 1.甲方应向乙方提供的基础资料及协作事项如下： （1）基础资料清单； （2）提供时间和方式； （3）其他协作事项。 2.甲方保证所提供的基础资料不存在任何权利瑕疵，包括但不限于知识产权瑕疵，否则因此引起的任何法律责任由甲方负责。 3.乙方在收到基础资料后应立即检查签收。如乙方认为基础资料不符合本条要求，应向甲方说明理由，要求甲方尽快重新提供。 4.在设计过程中，如果乙方发现基础资料存在错误或前后不符的情况，应当及时通知甲方。如确属基础资料存在错误或前后不符而产生的延误及损失由甲方负责。 5.无论乙方是否书面通知甲方，告知基础资料存在错误或前后不符的情况，均不免除甲方就其基础资料存在错误或前后不符应承担的责任。

第三条工作计划 1.乙方应在本合同生效后____日内向甲方提交设计工作计划。设计工作计划应包括以下主要内容，乙方应严格按照工作计划开展设计工作： （1）第一阶段：___________________________________________________。 （2）第二阶段：___________________________________________________。 （3）第三阶段：___________________________________________________。 2.本合同履行过程中，乙方应根据甲方的合理要求提交书面工作进度报告，以使甲方及时了解设计工作的阶段性进展。

第五条工作转让 未经甲方同意，乙方不得将本合同委托作品设计的主要工作转让第三人承担，但在紧急情况下乙方为维护甲方的利益需要转委托的除外。

第六条成果转让 乙方不得在向甲方交付委托设计作品之前，自行将委托设计作品转让给第三人。双方另有约定的除外。

第七条交付方式 乙方应当按以下方式向甲方交付委托作品： 1.交付时间：______年___月___日前交付。 2.交付地点为以下第____种： （1）甲方住所地当面交付； （2）乙方住所地当面交付； （3）其他。 3.交付的载体选择以下第__种形式： （1）纸质版本； （2）电子版本； （3）其他形式的载体。

第八条评审验收 1.双方同意将验收委托设计作品的评审标准、评审人员组成、评审程序作为本合同的附件，另行约定。 2.双方同意选择以下第 种方式对乙方完成的委托设计作品进行验收： （1）对任一阶段的设计成果，甲方应在收到后____日内将评审意见提交乙方，如甲方认为不符合要求，应提供书面修改意见。双方另行约定完成修改并交付的时间，届时再次评审。对任一阶段的设计成果，如甲方在收到后____日内未提出评审意见，即视为该阶段的设计成果已通过验收； （2）甲方应在收到任一阶段的设计成果后____日内安排双方召开评审会议，具体时间和地点由甲方安排，由此产生的相应费用由甲方负担，评审意见应由双方代表签字确认。对任一阶段的设计成果，如甲方在收到后____日内未安排评审会议，即视为该阶段的设计成果已通过验收； 如果评审确认设计成果不符合要求，双方另行约定完成修改并交付的时间，届时再次安排评审会议； （3）其他。

第十二条违约责任 任何一方违反本合同，给对方造成损失的，按以下约定承担违约责任： （1）甲方迟于合同约定的期限付款的，每日按应支付价款的万分之 ________（万分之一至万分之五）向乙方支付违约金； （2）乙方迟于合同约定的期限交付委托作品的，每日按未交付作品应收价款的万分之______（万分之一至万分之五）向甲方支付违约金。因乙方迟于合同规定的期限交付委托作品导致合同目的不能实现的，应返还已收取的价款，给甲方造成损失的，还应承担赔偿责任； （3）未经乙方同意，甲方为评审设计成果以外的目的使用本合同项下的设计成果或违反本合同的约定披露乙方设计成果的，应按合同价款的____倍（1—10倍）向乙方支付违约金； （4）未经甲方同意，乙方将本合同项下的设计成果披露给他人或用于本合同以外目的的，应按合同价款的___倍（1—10倍）向甲方支付违约金； （5）如一方违反其义务、承诺和保证，则应赔偿另一方的损失，以及另一方为保护其合法权益而支付的合理费用，包括但不限于_____和诉讼费，另有约定的除外。

甲乙双方就上述作品的出版、发行达成如下协议。

第一条 甲方授予乙方在合同有效期内，在国内外各地区以图书形式出版、发行上述作品的中文简体版、繁体版、外文版、修订版和缩编本的专有使用权。

甲方将本作品的音像制品、电子出版物的专有使用权和网络出版权（以下统称电子版版权）授予乙方，乙方可以出版，也可以转让第三方出版，合同另签。

第二条 甲方交付乙方的作品，不得违反宪法和法律，不得损害公共利益。

第三条 甲方保证拥有第一条授予乙方的权利。因上述权利的行使侵犯他人著作权及名誉权、肖像权、署名权等人身权内容的，甲方承担全部责任并赔偿因此给乙方造成的经济损失，乙方可以终止合同。

第四条 甲方有责任将作品中引用他人拥有著作权的内容以页下注的形式标注清楚。

第五条 在本合同有效期间，未经乙方同意，甲方不得将本书稿的全部或一部分，或将其内容稍加修改后以原名或更换名称授权第三者出版。若违反本规定，甲方应承担全部责任并赔偿因此给乙方造成的经济损失，乙方可以终止合同。

第六条 上述作品的内容、篇幅、体例、图表、附录等应符合乙方《作译审编校须知》的有关要求。

第七条 甲方应于年月日前将上述作品的齐、清、定稿交付乙方（尽可能附软盘）。双方约定版面字数（包括图表）为万字。未经乙方同意，甲方交稿时的字数与双方约定的字数之差不能超过5%，如不符合这一要求，乙方有权拒绝收稿。甲方因故不能按时交稿，应在交稿期满前__________乙方，双方可以另行约定交稿日期。甲方到期仍不能交稿，应按本合同第十二条约定的报酬总额的10%向乙方支付违约金，并赔偿因此给乙方造成的经济损失，乙方可以终止合同。如乙方不终止合同，图书出版后，上述违约金从稿酬中扣除。若乙方终止合同，甲方应按乙方实际投入的费用，向乙方支付赔偿金。

第九条 在合同有效期内，未经双方同意，任何一方不得将第一条约定的权利许可第三方使用。如有违反，另一方有权要求经济赔偿并终止合同。一方经对方同意许可第三方使用上述权利，双方应将所得报酬按六四分成（其中负责联系的一方得60%，另一方得40%）。

第十条 作品的署名方式和著作方式，由甲、乙双方商定。合作作品的署名顺序，以甲方提交并保证其真实性的全体合作作者亲笔签名（个人作者应附身份证复印件）的书面信函为准。乙方如需更动上述作品的名称，对作品进行实质性的修改、删节、增加图表及前言、后记，应征得甲方同意，并经甲方书面认可。
