七、违约责任

1.除不可抗力因素外，任何一方如违反本合同之约定，另一方有权解除合同，并要求对方赔偿造成的实际损失及救济的合理支出费。

2.甲方到期不能支付乙方作品报酬的，甲方应每日按约定报酬的万分之五向乙方支付迟延履行金，直至甲方实际支付该笔报酬为止。

3.如乙方违反本合同第3条的规定，甲方有权要求乙方给予经济赔偿。

4.如乙方违反本合同第4条的规定，甲方有权解除合同，甲方有权要求乙方承担全部责任并赔偿由此给甲方造成的损失。

5.乙方到期仍不能交付作品的，甲方有权解除合同，乙方应赔偿由此给甲方造成的损失。

6.因甲乙双方任何一方违反本合同约定，违约方应承担守约方为保护和实现本合同项下权利和救济所产生的所有合理费用（包括但不限于诉讼费、律师费等）。

八、其他约定

1.由于不可抗力事件，致使一方在履行其在本合同项下的义务过程中遇到障碍或延误，不能按规定的条款全部或部分履行其义务的，不应视为违反本合同。本合同所指不可抗力，实质不能预见、不能避免并不能克服的客观情况。

2.本合同非经甲乙双方书面同意，不得任意修改或变更。如需修改变更，双方应通过协商达成一致后签订补充合同，作为本合同附件。

3.本合同的成立、效力、解释、履行、签署、修订和终止以及争议解决均应适用中华人民共和国法律。

4.双方（各方）就履行中产生的任何争议，都应由双方（各方）通过友好协商解决，协商不成的，任何一方有权向长沙市开福区人民法院提起诉讼。

5.本合同自起生效。原件一式份，双方各执份。

I am Jack. I was born in Shanghai. I graduate from senior high school and major in English. I started learning English since I was 12 years old. My parents have a lot of American friends. That’s why I have no problem communicating with Americans or others by speaking English.

In my spare time, I like to do anything relating to English such as listening to English songs, watching English movies or TV programs, or even attending the activities held by some English clubs or institutes. I used to go abroad for a short- term English study. During that time, I learned a lot of daily life English and saw a lot of different things.

在兴趣爱好方面，作为学计算机的学生，时喜欢打些竞技类游戏。

体育运动方面，喜欢游泳，为了尽可能享受学生的优惠，在临毕业的时候还赶紧办了张游泳卡;也喜欢打乒乓球，之前每天都看到同事下班后在公司的乒乓球室打球，想去呢，但有点不好意思。
