第三条 许可使用的权利内容

前款中的专有使用权是指：乙方在本合同有效期内和在本合同约定的地域范围内，以本合同约定的形式(含作品载体形式和文字形式)出版、发行本合同约定作品的原版、修订版、袖珍版、缩编版的专有权利;在本合同有效期内和在本合同约定的地域范围内，乙方有权排除包括甲方在内的任何人以同种形式和方式使用本合同约定的作品。

以中文以外的其他文字形式使用的作品报酬，由双方另行商定。

第四条 许可使用的期间

甲方许可乙方使用本合同第二条约定作品的期间为_________年，自作品出版之日起计算。

第五条 甲方的保证义务

甲方保证合法享有本合同约定作品的著作权和对该作品的处分权，并保证：至其与乙方订立合同之日为止，不曾有与本合同第三条规定的授权行为相违背的许可行为或者转让行为。

甲方违反前款保证义务的，乙方有权：

1.解除合同;

2.要求甲方赔偿全部损失;

第六条 许可第三人行使同一权利

在本合同有效期内，甲方不得将其在本合同第三条授予乙方的权利再授予任何第三人。未经甲方许可，乙方不得许可任何第三人使用其通过本合同第三条取得的权利。

第七条 作品的内容与质量

甲方交付作品的内容，应当符合双方的约定或者乙方的编写要求。

甲方交付的作品，应当符合下列要求：

1.内容完整、确定(包括扉页、内容提要、编写说明、目录、正文、附录、后记等);

2.体例、格式正确、统一;

3.使用标点符号、数字正确;

4.文字清晰;

5.引文准确无误(引用法律、法规、规章或者司法解释以及行业标准的，必须准确有效)。

如果甲方交付的作品不符合上述要求，乙方应当退还甲方予以修改或者补正，修改或者补正期限不得超过一个月;经修改或者补正仍不合格的，乙方有权解除合同。

第八条 作品的交付时间

甲方应于_________年_________月_________日前向乙方交付本合同约定的作品。因甲方未按时交付作品致乙方不能按时出版、发行上述作品的，甲方应依本合同约定承担违约责任;给乙方造成损失的，甲方并应赔偿乙方的损失(以金钱形式承担违约责任的，可折抵赔偿额);甲方逾期一个月仍未交付本合同所定作品的，乙方有权解除合同，并及时以书面形式通知甲方。

第九条 作品的编辑加工

乙方有权根据出版要求和编辑规范对作品进行编辑加工。但未经甲方许可，不得对作品的内容进行实质性修改和影响其原有完整性的删节，增减和修改甲方提供的前言、后记、插图(表)等，也应征得甲方的同意。

所谓实质性的修改是指：

1.改变作品的观点或结论;

2.改变作品中的事实或者个别情节;

3.改变作品中采用的方法;

4.改变作品中篇、章、节的标题;

5.其他实质性改动。

第十条 排版、校对和审读校样

排版和校对由乙方负责。甲方要求审读校样的，乙方应予同意;但甲方应在乙方规定的合理期限内完成审读，而且不得对作品进行影响版面完整性的修改(如大量增减内容、修改版式等);因甲方的不适当修改增加的版面费用，由甲方承担，但因法律、标准、科学方法或事实的变化而必须进行的改动除外。

第十一条 装帧、封面、印数、定价

作品的装帧、封面、印数、定价，双方有约定的，依照约定。没有约定的，由乙方根据本作品的出版计划和出版行业同类作品的通常标准决定。

第十二条 出版时间

乙方应于_________年_________月_________日前，以本合同约定的方式、标准出版本合同第二条约定的作品。

第十三条 稿酬

作品出版后3个月内，乙方应当依照下列第_________种方式向甲方支付稿酬：_________

第十六条 作品的修订

当作品所涉及的内容发生重大变化时，乙方有权安排甲方修订，甲方有义务实施修订。付酬条件按照实际修订比例，参照本合同第十三条的规定执行。

甲方拒不实施修订的，乙方有权自行安排修订;实际修订人对于其修订的部分享有著作权，甲方无权干涉。但甲方对于原作品的著作权应受尊重。

第十七条 原稿的处理

作品出版后3个月内，对于手抄稿件，乙方应当将原稿退还甲方;甲方声明不要的，乙方有权自行处理。

第十八条 违约责任

甲方违反本合同第五条约定的保证义务，给乙方带来损失的，应当赔偿乙方的全部损失。甲方非因不可抗力原因，未经乙方允许逾期两个月后(含两个月)才交稿的，应按本合同约定稿酬的30%向乙方支付违约金;甲方拒不履行本合同约定的义务，擅自毁约的，应按本合同约定的稿酬标准向乙方支付违约金。

乙方非因不可抗力原因拒不履行出版义务的，应按本合同约定的稿酬标准向甲方支付违约金;乙方因不可抗力原因不能履行出版义务的，应按本合同约定稿酬的30%向甲方支付补偿金。乙方因过错丢失原稿致其不能履行出版义务的，视为违约，应按本合同约定稿酬的30%向甲方支付赔偿金。

第十九条 纠纷的处理

双方因本合同的解释或者履行发生争议时，应当协商解决;协商不成的，依照下列第_________种方式解决：

To make a balance point between optimization quality and time cost, I proposed a Dynamic Layered Scheduling method based on hybrid Petri Nets. The practical application showed that the average makespan was shortened by a large scale. I also publicized two papers in core journals with this idea. Recently, I am doing research in the Composite Predict of the Electrical Power system assisted with the technology of Data Mining for Bao Steel. I am Chen Lin . I was born in GuangDong Province . I graduate from senior high school and major in English. I started learning English since I was 12 years old. My parents have a lot of American friends. That’s why I have no problem communicating with Americans or others by speaking English.

In my spare time, I like to do anything relating to English such as listening to English songs, watching English movies or TV programs, or even attending the activities held by some English clubs or institutes. I used to go abroad for a short- term English study. During that time, I learned a lot of daily life English and saw a lot of different things.I think language is very interesting. I could express one substance by using different sounds. So I wish I could study and read more English literatures and enlarge my knowledge.Thank you!
