5 甲方责任和权利

5.1 要求乙方提交承揽该项目应具备的相关资质复印件备查。

5.2 要求乙方提供承包工作安全措施方案、安全管理网络、安全生产责任制度、相关安全生产规章制度及管理办法、事故应急预案、安全规程、安全管理负责人名单及安全资格证、特种作业人员名单及操作资格证、特种设备检验报告及安全使用许可证、作业人员“三级”安全教育合格档案、职业健康监护档案等资料的复印件备查。

5.3 向乙方提供甲方的各项安全生产规章制度及管理考核办法，按照甲方用工安全教育培训要求，负责组织对功能承包单位用工人员进行安全教育培训。根据各个具体的施工项目，组织对乙方人员进行入场前的安全交底教育，告知乙方施工现场及周围环境的基本情况、存在的危险危害因素及应采取的各项安全措施，提供作业范围地下、上方和相邻关系可能影响施工安全的资料，向乙方提出安全管理要求。

5.4 甲方有权对乙方执行国家有关安全生产∕职业卫生法律法规、国家标准、行业标准和甲方安全生产规章制度的情况进行监督检查，督促乙方依法履行安全生产管理职责。

5.5 对乙方所制定的安全方案和安全技术措施进行备案，便于协助支持乙方执行。对无方案、无措施和措施未落实的有权停止生产作业，限期整改，并根据具体情况进行处罚。

5.6 对乙方安全生产情况进行经常性监督、检查，并对检查发现的隐患、问题向乙方提出指令性整改意见。对不按期完成隐患整改的，按相关安全生产管理规定进行处罚。对违章行为有权制止，并根据具体情况按相关安全生产管理规定进行处罚。

5.7 甲方发现乙方在工作过程中或工作场所存在重大安全隐患，不符合安全生产条件时，有权要求乙方立即停止生产作业，撤离现场作业人员，待隐患整改完毕，符合安全生产条件才能恢复生产。

5.8 甲方按其监管职责配合地方政府、上级部门对乙方在合同约定作业区域内发生的生产安全事故进行调查和处理，督促乙方按调查组要求落实整改工作，未经调查组批准，不得同意乙方恢复生产。

5.9 甲方负责协调乙方与其他承包单位之间的安全生产工作，互助协作关系。

5.10 甲方不得对乙方提出不符合安全生产法律、法规和强制性标准规定的要求，不得要求乙方在不具备安全生产条件下强行生产作业。

5.11 甲方不得明示或者暗示乙方购买、租赁、使用不符合安全施工要求的安全防护用具、机械设备、施工机具及配件、消防设施和器材。

5.12 甲方负责为乙方提供在甲方区域内施工工作中需用的风、水、电、汽等动力能源，并负责指定接点。

5.13 乙方人员在该项目承包工作时发生生产安全事故，甲方负有责任的，按照事故调查处理报告中划分的责任范围，由甲方承担相应责任。

6 乙方责任和权利

6.1 乙方的主要负责人是乙方的安全生产第一责任人，依法履行安全生产主体责任，对乙方安全生产工作全面负责;分管负责人对安全生产工作具体负责;安全生产管理人员在其职责范围内对安全生产工作承担相应责任。

6.2 乙方对承包期内的全部生产经营活动(设计、管理、资金、技术、设备、设施和人员)实行自主管理，对生产现场的安全工作负总责，对生产过程中发生的安全事故承担安全生产管理责任。

6.3 乙方负责将相关安全资质证照复印件交甲方备案，并对其真实性、合法性、有效性负责。并保证从甲方承揽的工程项目在其资质等级许可的范围内。

6.4 严格执行国家有关安全生产∕职业卫生法律法规、国家标准、行业标准和围绕本工程制定的各项安全生产规章制度及安全标准化管理体系标准。

6.5 建立健全安全生产管理体系及安全生产管理机构，设立专职安全生产管理人员，建立健全本单位安全责任制、安全生产规章制度和各工种安全操作规程。

6.6 乙方的主要负责人、分管负责人、安全生产管理人员和特种作业人员必须按照国家有关规定经过培训考核合格后，持证上岗。

6.7 乙方必须依法保证安全生产所必须的资金投入。

6.8 乙方用工必须符合国家劳动法等相关法律法规及地方的有关规定。

6.9 乙方必须依法参加工伤保险，为从业人员足额缴纳工伤保险费。为在高危行业岗位或从事危险作业的人员，办理人身意外伤害保险，支付保险费。

6.10 乙方必须严格执行“三级安全教育”制度，对所属从业人员进行职业卫生、安全生产教育和培训，经考核合格后方能上岗，并建立从业人员三级安全教育档案备查。对所属从业人员经常性进行相关的安全生产法律、法规和规章制度教育，进行必要的安全操作技能培训，并如实告知从业人员本作业区域存在的危险有害因素、防范措施及其在安全生产方面的权利和义务。

6.11 乙方必须为所属从业人员提供符合安全技术标准的劳动工具、劳动防护用品和自救器材，保证作业环境符合安全职业卫生标准。

6.12 乙方必须对从事接触职业病危害作业的所属从业人员，按照国家有关的规定组织上岗前、在岗期间和离岗时的职业健康体检，并将检查结果如实告知从业人员，依法对用工职业危害后果负责。职业健康检查费由乙方承担。

6.13 乙方必须为从业人员建立职业健康监护档案，并按规定的期限妥善保管。

6.14 乙方必须制定事故应急救援预案，建立专职或者兼职应急救援队伍，配备应急救援设施设备和器材，定期开展应急救援演练，将评审发布的应急预案交甲方备案，便于配合救援。

6.15 乙方必须定期不定期的开展安全生产检查，及时消除隐患;发现重特大事故隐患的，应当立即采取防范措施，并向甲方相关部门报告隐患情况及措施落实情况。

6.16 乙方负责对所属区域内的各级危险源点的日常控制和管理。

6.17 乙方采购、租赁的安全防护用具、机械设备、施工机具及配件，应当具有生产(制造)许可证、产品合格证，并在进入生产现场前进行查验，确保符合作业安全要求。

6.18 乙方投入现场所使用的各种特种设备，必须经有相应资质的检验检测机构定期监督检验合格，并将《检验报告》和《安全使用许可证》复印件送甲方备查。

6.19 生产过程中对人的不安全行为，物的不安全状态，作业环境的不安全因素和管理缺陷进行控制和管理，杜绝“三违”行为。

6.20 乙方必须在作业现场入口处、起重机械、用电设施、出入通道口、楼梯口、电梯井口、孔洞口、溜井口、爆破物及有害危险气体和液体存放处等危险部位，设置明显的安全警示标志，并根据作业要求安排相关管理责任人进行管理。安全警示标志必须符合国家标准。

6.21 乙方必须根据具体施工项目、不同生产施工阶段和周围环境及季节、气候的变化，定期对生产现场的危险有害因素进行辨识，制定相应的安全生产和职业卫生防范措施，作为本协议附件报甲方备案。生产现场暂时停止生产作业的，乙方必须做好现场防护，所需费用由乙方承担。

6.22 施工中需要使用到甲方的水、电、汽等动力能源，必须到甲方指定地点搭接，保持规范，不得到指定点以外的其它地点随意私拉乱接，未经甲方同意，不得随意乱动自己所承担项目范围以外的设备、工具及设施。

6.23 乙方指派专门的安全管理人员与甲方协调承包项目的安全生产管理工作。

6.24 乙方必须接受当地政府相关部门和甲方的安全生产监督检查和管理。

6.25乙方在生产过程中一旦发生伤亡事故，应按照有关规定，及时如实地向地方政府安全生产监督管理部门报告，同时，向甲方报告。事故发生后，乙方应根据事故情况决定启动应急预案级别，立即抢救伤员，采取措施防止事故扩大，保护事故现场。按照国家有关规定进行调查、处理，作好事故的善后处理工作。不得隐瞒不报或迟报、谎报。

6.26乙方人员在该项目承包工作时发生生产安全事故，按照事故调查处理报告中划分的责任范围，由乙方承担相应责任。

7 安全工作考核

7.1乙方发生生产安全事故的，按甲方的相关规定进行考核。

7.2 乙方出现“三违”行为的，按甲方的相关规定进行考核。

8 协议效力

8.1 本协议经双方签字盖章后生效，未经双方共同协商同意，任何一方不得私自改动或终止。

8.2 本协议与工程项目承包合同具有同等效力，期限与工程项目承包合同一致。

2 、责任范围：乙方出租的特种设备在安装、拆卸和使用过程的人身安全和设施及环境的安全。

3 、双方义务

3.1认真贯彻落实国家、地方及上级有关安全生产的方针、政策，严格执行安全生产的法律法规、规章和标准规范，建立健全安全生产责任制度和安全教育培训制度，制定设备安全操作规程，保证本单位安全生产所需资金的投入和有效使用。

3.2 设备进场前，双方应共同确定设备的型号、规格和安装平面位置。

4 、乙方权利和义务

4.1 遵守工程建设和特种设备安全生产管理的有关规定，严格执行安全标准规范和操作规程，并随时接受甲方、业主、地方政府、监理等单位依法实施的监督检查。

4.2 出租的特种设备结构件均应在合理的使用年限内，超过正常使用年限或结构腐蚀磨损严重、属淘汰或限制、禁止使用的，不得进入施工现场。设备必须符合有关安全技术标准的要求，应当按照安全施工的要求配备齐全有效的保险、限位等安全设施和装置。应当对设备的安全附件、安全保护装置及有关附属仪器仪表、吊具、索具等进行定期校验、维护和保养，并做好记录。

应当对设备至少每周进行一次自行检查，并作出记录。在对设备进行自行检查和日常维护保养时发现异常情况的，应当及时处理，做到设备始终处于良好的工况，安全装置动作灵敏、可靠。

设备出现故障或者发生异常情况，应当对其进行全面检查，消除事故隐患后，方可重新投入使用。

由于乙方安全措施不力、设备自身原因或违章造成事故的，由乙方承担全部责任，甲方有权就事故造成的损失向乙方索赔。

4.3 负责向甲方及时提供设备基础图纸、合格的预埋件和经拆装单位技术负责人审批签字并加盖公章的安装/拆卸方案和技术措施、应急预案。

4.4 设备进场，应及时如实提供设备相关资料(特种设备制造许可证或安全认可证、出厂合格证、制造监督检验证明、使用说明书、设备备案证明、最近一次的检测报告、自检合格证明)和设备安装相关资料(营业执照、起重设备安装资质证书、安全生产许可证、管理和作业人员资格证书、辅助机械的定期检验证明和起重性能表)的原件及复印件供甲方查验，并对资料的真实性负责。

4.5设备安装、拆卸、顶升和附着等过程发生的生产安全事故，由乙方和安装单位承担全部责任，甲方有权就事故造成的损失，向乙方索赔。

如遇可能影响设备安全技术性能的自然灾害或发生设备事故后，以及停止使用半年以上再次使用前，应由具备相应资质的检验检测机构检测合格。

4.6负责对操作、指挥人员进行经常性的安全教育培训和安全技术交底，及时纠正违章行为;派驻现场的操作、指挥、管理人员必须具备相应的资格。负责为本单位从业人员配备必要的劳动防护用品，并监督正确使用;严格执行设备管理的各项规章制度，做好设备日常的维修、保养工作，并做好相关记录。

严禁安排操作人员带病上岗和连续加班。本单位现场人员在工作中伤亡或患职业病、突发疾病死亡或上下班途中发生交通事故的，由乙方承担其工伤保险待

遇。

4.7 接受甲方的安全监督管理，对检查提出的问题和隐患及时整改，不得以任何理由拒绝整改。对不服从管理导致生产安全事故的，由乙方承担全部责任，甲方有权就事故造成的损失向乙方索赔。

4.8 操作人员有权拒绝违章指挥和强令冒险作业;发现直接危及人身和财产安全的紧急情况，有权停止作业或采取必要的应急措施后撤离，并同时告知甲方和相关方现场人员采取应急措施。

4.9 负责为本单位现场从业人员办理工伤保险和意外伤害保险，并承担保险义务。加强对本单位人员非工作期间的安全管理，并对非工作时间和施工现场以外发生的事故承担全部责任。

负责为本次出租的设备办理保险，并对因不可抗力造成的人员伤亡和财产损失承担全部责任。

4.10 应当制定特种设备事故应急措施和救援预案。发生生产安全事故，应当迅速组织救援、保护好事故现场，并按规定立即如实向甲方和有关单位报告。配合甲方和有关单位按照有关法律法规对事故进行调查处理，负责做好家属的安抚、事故善后处理工作，并承担相应的法律责任。

5、甲方权利和义务

5.1 负责向乙方进行进场前的安全总交底，配合乙方做好设备安装、拆卸及使用过程的安全监督管理。

5.2 有权审查特种设备的相关资料和安装/拆卸单位资质及安装拆卸工、设备操作、指挥人员的资格，并按照规定负责审查和报批安装/拆卸单位编制的安装/拆卸工程施工方案、生产安全事故应急救援预案。

5.3 按照乙方提供的设备地基、基础施工图纸和安装方案，配合乙方做好设备地基、基础和附墙预埋件的施工，并做好设备基础周围的排水及防护。应当向乙方提供拟安装设备位置的基础地质资料、混凝土的强度报告及隐蔽工程验收记录等基础施工资料。

5.4 负责向乙方提供办理设备使用登记所需的工程报建相关资料。

5.5 设备安装、拆卸、顶升和附着等作业过程，协助乙方设置警戒区域。

5.6 负责协调劳务分包企业、其他相关方与乙方在设备使用过程的安全生产管理工作。

5.7 有权对违反安全生产标准和规章制度的行为进行纠正，必要时进行内部经济处罚或要求乙方停止使用。

6 、协议的生效与终止

本协议书作为《设备服务合同》的附件，同《设备服务合同》同时生效、同时终止。
