一、房屋租赁合同的主要内容

根据相关法律的规定，房屋租赁的当事人应当签订书面租赁合同，租赁合同应当具备以下条款：

(一)当事人姓名或者名称及住所;

(二)房屋的坐落、面积、装修及设施状况;

(三)租赁用途;

(四)租赁期限;

(五)租金及交付方式;

(六)房屋修缮责任;

(七)转租的约定;

(八)变更和解除合同的条件;

二、签订房屋租赁合同的注意事项

(一)时限规定

1、租赁期限不得超过二十年。超过二十年的，超过部分无效。租赁期间届满，当事人可以续订租赁合同，但约定的租赁期限自续订之日起不得超过二十年。

2、租赁期限六个月以上的，应当采用书面形式。当事人未采用书面形式的，视为不定期租赁(任意解除权)。

(二)出租人义务

1、出租人应当履行租赁物的维修义务，但当事人另有约定的除外。

2、出租人未履行维修义务的，承租人可以自行维修，维修费用由出租人负担。因维修租赁物影响承租人使用的，应当相应减少租金或者延长租期。

3、因第三人主张权利，致使承租人不能对租赁物使用、收益的，承租人可以要求减少租金或者不支付租金。第三人主张权利如第三人行使抵押权的，承租人应当及时通知出租人。

4、 因不可归责于承租人的事由，致使租赁物部分或者全部毁损、灭失的，承租人可以要求减少租金或者不支付租金;因租赁物部分或者全部毁损、灭失，致使不能实现合同目的的，承租人可以解除合同。

(三)承租人义务

1、应当妥善保管租赁物，因保管不善造成租赁物毁损、灭失的，应当承担损害赔偿责任。

2、承租人经出租人同意，可以对租赁物进行改善或者增设他物。

未经出租人同意，改善或者增设他物的，出租人可要求承恢复原状或者赔偿损失。

3、经出租人同意，可以将租赁物转租给第三人。承租人转租的，承租人与出租人之间的租赁合同继续有效，第三人对租赁物造成损失的，承租人应当赔偿损失。

4、承租人未经出租人同意转租的，出租人可以解除合同。

(四)承租人特别权利

1、正常损耗免责权。如房屋因正常损耗如电线线路老化等，承租人不用予以赔偿;

2、占有、使用、收益权。承租人通过租赁，可以合法地占用及使用方法，也可以通过经营活动获得收益;

3、买卖不破租赁权，即租赁物在租赁期间发生所有权变动的，不影响租赁合同的效力;

4、优先购买权，出租人出卖租赁房屋的，应当在出卖之前的合理期限内(3个月)通知承租人，承租人享有以同等条件优先购买的权利。否则，承租人可以请求法院宣告该房屋买卖无效

5、共同居住人的继续租赁权，即承租人在房屋租赁期间死亡的，与其生前共同居住的人可以按照原租赁合同租赁该房屋。

工商行政管理局、建设和交通委员会共同制定的《家庭居室装饰装修施工合同文本(XX版)》：一般说来，示范文本比装潢公司的格式合同更具体一些。

上海市工商行政管理局、上海市建设和交通委员会共同制定的《上海市家庭居室装饰装修施工合同文本(XX版)》。主要包括以下条款：(一)工程概况和造价;(二)材料供应;(三)工程质量及验收;(四)安全生产和防火;(五)工程价款和结算;(六)施工配合;(七)违约责任;(八)纠纷解决方式;(九)合同的变更和解除;(十)其他约定;(十一)附则;(十二)合同附件

：示范文本的合同号为数码章顺序号，可作为唯一可追溯标识通过行业协会直接查找到装潢公司

在签定合同时，特别需要注意的几点

工程完工后不同的项目有不同的保修期，客户可依具体情况与公司商议，保留原证件或扣留部分工程款作为装修的质量保证金，

上述装修合同有三种形式：即承包人包工包料，部分包料，承包人包工、住户自己包料，在装修中还应注意以下几种情况，装修公司包料的，要向其索要购买的材料明细表、合格证、发票;业主自己包料的，选用的材料必须符合国家标准，有质量检验合格证明、有中文标志的产品名称、规格、型号、生产厂厂名、厂址等，禁止使用国家明令淘汰的装修材料。

i am a third year master major in automation at shanghai jiao tong university, p. r. china. with tremendous interest in industrial engineering, i am writing to apply for acceptance into your ph.d. graduate program. education background

in 1995, i entered the nanjing university of science & technology (nust) -- widely considered one of the china’s best engineering schools. during the following undergraduate study, my academic records kept distinguished among the whole department. i was granted first class prize every semester,in 1999, i got the privilege to enter the graduate program waived of the admission test.

at the period of my graduate study, my overall gpa(3.77/4.0) ranked top 5% in the department. in the second semester, i became teacher assistant that is given to talented and matured students only. this year, i won the acer scholarship as the one and only candidate in my department, which is the ultimate accolade for distinguished students endowed by my university. presently, i am preparing my graduation thesis and trying for

when a sophomore, i joined the association of ai enthusiast and began to narrow down my interest for my future research. with the tool of opengl and matlab, i designed a simulation program for transportation scheduling system. it is now widely used by diffferent research groups in nust. i assumed and fulfilled a sewage analysis & dispose project for nanjing sewage treatment plant. this was my first practice to convert a laboratory idea to a commercial product.

in retrospect, i find myself standing on a solid basis in both theory and experience, which has prepared me for the ph.d. program. my future research interests include: network scheduling problem, heuristic algorithm research (especially in ga and neural network), supply chain network research, hybrid system performance analysis with petri nets and data mining.
