6.抵押物由甲方向中国XX公司分公司投保，以乙方为保险受益人，并将保险单交乙方保管，保险费由甲方承担。投保的抵押物由于不可抗力遭受损失，乙方有权从保险公司的赔偿金中收回抵押人应当偿还的贷款本息。

第四条 违约责任

1.乙方如因本身责任不按合同规定支付贷款，给甲方造成经济上的损失，乙方应负责违约责任。

2.甲方如未按贷款合同规定使用贷款，一经发现，乙方有权提前收回部分或全部贷款，并对挪用贷款部分在原贷款利率的基础上加收%的罚息。

3.甲方如不按期付息还本，或有其它违约行为，乙方有权停止贷款，并要求甲方提前归还已贷的本息。乙方有权从甲方在任何银行开立的帐户内扣收，并从过期之日起，对逾期贷款部分按借款利率加收%的利息。

4.甲方如不按期付息还本，乙方亦可向有管辖权的人民法院申请拍卖抵押物，用于抵偿贷款本息，若有不足抵偿部分，乙方仍有权向甲方追偿。直至甲方还清乙方全部贷款本息为止。

第五条 其它规定

1.发生下列情况之一时，乙方有权停止发放贷款并立即或即期收回已经发放的贷款。

(1)甲方向乙方提供情况、报表和各项资料不真实。

(2)甲方与

第三者发生诉讼，经法院裁决败诉，偿付赔偿金后，无力向乙方偿付贷款本息。

(3)甲方的资产总额不足抵偿其负债总额。

(4)甲方的保证人违反或失去合同书中规定的条件。

2.乙方有权检查、监督贷款的使用情况，甲方应向乙方提供有关报表和资料。

3.甲方或乙方任何一方要求变更合同或本合同中的某一项条款，须在事前以书面形式通知对方，在双方达成协议前，本合同中的各项条款仍然有效。

4.甲方提供的借款申请书、借款凭证、用款和还款计划及与合同有关的其它书面材料，均作为本合同的组成部分，与本合同具有同等法律效力。

第六条 有关本合同的费用承担 有关抵押的估计、登记、证明等一切费用均由甲方负责。

第七条 本合同生效条件 本合同系经X市公证处公证并依法赋予强制执行效力的债权文书，甲、乙双方如任何一方不履行，对方当事人可根据《民事诉讼法》

第一百六十八条规定，直接向有管辖权的人民法院申请执行。自公证书签发之日起生效，公证费由甲方承担。

第八条 争议的解决 本合同在履行中如发生争议，双方应协商解决，协商不成时，双方当事人可选择：

1.向经济合同仲裁机构申请仲裁;
