三、合同工期及其责任

1、本合同总工期从年月日至年月日。工期中已充分考虑各种程度的晴、阴、雨、风、雾、洪水、台风及停电、停水等影响因素，具体工期以项目部下发的月度、季度以及年度施工计划为准。

五、工程数量及合同价款

3、综合劳务单价包括的内容：甲方按本合同书给乙方支付的价款，为乙方承担本合同工程施工的全部价款，除本合同指明由甲方供应(或甲方委托乙方代购、代租)的材料、机具外，其余为完成本合同工程所需的人工费、小型材料费、小型机具费、小型设备费、材料现场卸车费、保管费、倒运费(甲方库房或指定存放点到施工现场)、缺陷修复费、管理费(含社会保险费用)、利润和税金(其中营业税(税率3.41%)由甲方代扣，其他税费由乙方自行缴纳)，以及合同明示或暗示的所有风险费用都含在此单价中;同时此单价中也包含了场内便道、施工生产生活用房、施工场地平整硬化、施工用水、施工用电等全部费用以及附表1《工程量清单》的“备注”中所示的全部工作内容。

4、本工程的合同价款，除设计变更外，均为一次包死，不再作调整。

5、工程量的确认：由甲方主管工程师按月将乙方完成的工程量填报数量表，并经乙方负责人或委托代理人签字确认，在规定时间乙方不予签字确认的视为认可;对乙方未经甲方认可，超出设计图纸范围和因乙方原因造成返工的`工程量，甲方不予计量。

六、计量与支付

1、本工程每月计量一次，提交月计量报表的时间为每月20—22日。甲方在接到报表后3日内组织现场验工计价;计量确认后，在业主拨款到位的情况下于3个工作日内支付该月进度款。在完成全部工作内容，并经业主、监理工程师验收合格后办理竣工决算。

2、甲方对乙方已完合格工程量通过量测核实后，进行计量与支付。构成支付的依据，必须由甲方计划、技术、项目总工和项目经理确认，任何个人单独签认的工程量及其价款都不能认定为支付依据。

3、乙方应派代表参加现场验工计价，并提供计量所需的一切详细资料和必要的人员、设备及有关永久工程的记录与图纸，对无异议的计量结果进行签认。如果乙方对甲方计量核实结果存在异议，应在计量结果公布当日起2天之内向甲方提出申辩，并与甲方共同进行复核签认，否则，视甲方计量结果准确;对于合同外用工，必须使用甲方提供的带有编号的《合同外用工派工单》，并由项目经理认定的人员签认完整，且在一个月内申报;超过一个月，甲方可以认为乙方自动放弃，不再受理。

4、如果乙方既不对计量结果进行签认又不提出异议或不派人参加计量工作，则视甲方所作的计量为正确计量，甲方不再接受乙方申辩。甲乙双方重要事项应以书面形式联系，任何一方接到另一方函件后应签收确认。

5、本工程无预付款。甲方按照乙方当月计量工程价款的90%支付给乙方，同时扣除本月应扣甲方供应材料的价款及其它应扣款项;剩余10%作为质量保证金和民工工资保障金，在业主对工程验收合格且民工工资支付完毕后，一次性退还给乙方。对缺陷期及保修期内未达到规定质量标准的，按实际发生的返修费用在质保金中扣除。

6、如因业主原因未能及时支付，甲方给予乙方的拨款也将顺延，甲方不承担违约责任，但不排除乙方在工程进度、质量、安全等方面的责任，否则构成对甲方的违约。

七、合同变更及解除

1、乙方不得将工程进行转包或分包，否则，甲方有权解除本合同并清退乙方，由此造成的全部损失由乙方承担。

2、如属乙方原因导致施工进度滞后或施工质量达不到甲方要求，甲方有权对乙方承担的工程任务进行调整或收回，由此造成的一切损失由乙方自行承担。

3、如果乙方只完成合同项下的大部分工程，未经甲方允许而撤除其施工机械设备、施工人员的，对于其剩余工程甲方有权另行安排其它队伍施工，其单价可以在合同单价的2倍范围内确定，其费用由乙方承担。

八、材料供应及设备租赁

1、对于工程中所用的主要材料，如钢筋、型钢、水泥、碎石、中砂等由甲方统一供应(供应单价见附表2《供应材料一览表》)，乙方对数量、质量进行监督，不合格材料严禁使用;在甲方同意的条件下，也可以由甲方委托乙方代购部分材料。对于乙方自购材料，要保证达到本工程所要求的质量标准并经业主、监理同意后方可使用，同时乙方要将购买材料的发票交给甲方财务部门进行列销。

2、为了规范合同管理，防止材料不正当流失或损耗过大，本项目所用材料双方约定实行单项工程材料“总价包干”的办法，即由双方约定单项单位工程所消耗的材料数量，甲方只按约定数量和单价供应乙方材料，超出部分由乙方承担，合理节余部分的费用也由乙方享有。

3、机械设备、周转性材料等由乙方代甲方租赁，费用由甲方按乙方所施工的工程量进行测算，实行单项工程机械费“总价包干”，节余部分归乙方所有，超出部分由乙方自行承担。

4、小型材料、小型机具、油材料等由乙方自行采购，所需费用均含在综合劳务单价中。

九、安全施工、文明施工

1、乙方在开工前，必须对全体施工人员进行岗前培训，特殊工种必须持证上岗;

2、乙方必须严格按照国家安全施工的有关规定及操作规程组织施工，教育全体员工认真落实安全措施和要求。

3、在乙方施工过程中，无论何种原因造成的人身、机械及其它事故均由乙方负责处理并承担费用，甲方不承担任何责任。

4、乙方施工期间必须加强对人员驻地、施工现场的安全管理，在施工现场、道路及乙方工作生活的其它场所设置、悬挂各种警示、标牌、围栏，确保行人、车辆、牲畜以及他人财产安全。

5、乙方要文明施工，尊重民俗，尊重业主、监理及甲方管理人员，爱护周遍环境，爱护百姓财产。

十、民工工资

乙方承诺民工工资由甲方代付。每月月底前，乙方将当月(上月26日至本月25日)民工工资表及出勤考核记录报甲方财务部门审核，由甲方财务人员按照审核后工资表上的人员逐一发放，严禁代领、冒领。

十一、保险

乙方在开工前应对自身的机具投保财产险，对从业人员办理人身意外伤害险，以及第三者责任险，其费用已包含在合同单价中，由乙方承担。

十二、双方责任

1、甲方责任

①、及时向乙方提供施工图纸，技术交底和现场交接，并指导乙方施工。

②、视业主拨款情况及时向乙方拨付工程款，组织工程验收和竣工决算。

③、乙方应按相关规定，及时准确地向甲方报送相关统计报表及技术资料，并接受甲方的检查监督。

④、乙方无条件服从甲方的施工组织及现场安排。

⑤、在本合同工程施工中，乙方要遵守国家和地方政府的法律、法规，尊重当地人民的风俗习惯，工地应整洁有序，工完场清，注重环保。

⑥、乙方应保证甲方不承担属于乙方及其雇员引起的诉讼控告、索赔及其它费用的责任和人身或财产损失的责任。

⑦、乙方必须按时支付所用民工工资，如因此引起诉讼、索赔等事件，由乙方负担全部经济责任。

（五）企业环境.顾客知识：在工作过程中.对企业内部环境.对市场情况.对顾客的特点掌握的越全面.就越能为单位提供满意的服务.平时工作时要善于观察.还要学会换位思考.根据企业本身的特点调整自己的服务方式.可以使我们的工作更顺利的完成.平常工作不忙的时候.我都会到各个部门去转转.像销售部、生产部、财会部、售后服务部等等.这样不仅会使我更快的了解公司内部的情况.还可以更快的让我溶入这个环境.毕业实习报告

（六）文化修养：要与公司其他员工进行良好的沟通.我认为文化修养也是应必备的素质.具备广博的知识和良好的精神面貌才有利于交流.

（七）技术性能力：技术性能力是完成某一项具体活动所需要的本领.有些公司往往通过培训.使工作人员掌握一定的操作程序.适应岗位的需要.而对于某些新招聘的人员来说.具备某方面的技术性能力往往是进入某一行业最起码的要求.作为我们专业的学生.我们的优势技能就是对英语的熟练运用.我之所以能够应征到这个公司来做助理.很大程度上也是因为这个优势.

（八）管理能力：我们在工作过程中.需要与别人建立联系.管理别人.激励别人.处理冲突.控制情绪等等.这一切都与管理能力有关.对于大部分学生来说.会认为对这一能力的要求往往是针对决策层或管理层而言的.但是市场导向的管理体制中.企业组织从“金字塔”型组织结构转变为“倒金字塔”型组织结构.服务工作的决策权也从管理部门和职能部门转移到服务工作第一线.所以说.管理能力不再是高层管理人员的“专利”而是我们刚步入社会的大学生要具备的必要的能力.

对外语系实习的就业建议：

经过这次实习.我深切的感受到了平常系领导和老师们所说的我们的专业优势：商务知识和语言的结合.这使得我们在用人单位招聘时有了一些优势.但我同时也感觉我们也应当在一些方面改进一下：

（一）加强对口语的训练：口语是我们在应聘的时候必过的一关.只要招我们这个专业毕业生的用人单位.首先要检验的就是我们的口语.虽然我们系里请来了外教.安排了许多的口语课.但我们开口的机会其实很少.而且其中有些外交也是名不副实的.口语课其实成了花架子.希望系里能够找到更切实有效的方法来解决这个问题.毕竟.一口流利的口语是许多学生所追求的.这也是我们的“门面”.

（二）多增加学会实习的次数.增强学生的实际动手能力：我们学习的知识偏重于理论.实际运用到的技能往往和我们所学的有很大的差距.动手能力差是我们的普遍特点.我刚到实习单位的时候甚至连复印机、传真机都不会用.我们日常所学的课程中.像《外贸函电》这类实用价值非常大.但实际运用起来有些时候与书本也是有差距的.所以.我认为我们应当多开一些实习课.让学生有更多的机会走出去.刚毕业的大学生既然没有什么工作经验.那么就应该在实习经历上为自己加分.

交际能力强，有较好的口才和表达能力，能协调处理好人际关系;注重协作精神，有较强的组织能力和协调能力;对问题能深刻地分析并迅速地做出判断决策。有强烈的上进心，能沉着冷静地面对挑战，战胜困难。
