我来自于湖南省衡阳市，今年22岁，有幸就读于天津大学的国际贸易专业，经过四年的大学生涯锤炼，现在即将毕业!

家庭经济并不富裕我从小就养成了节俭的习惯，因为体验了贫困所带来的不便，所以我一直渴望富裕的生活。但是我知道要想走出贫困靠天靠地都只是徒劳，只有靠自己的努力才能创造出属于自己的一片天空，所以我坚信天道酬勤。

记得小时候老师问我们将来想做什么，有人回答说当老师，有人说当科学家，也有人说要当大老板，而我却说：我要考大学!也就是在那个时候我为自己确定了一个初级目标，正是这个大学梦一直激励我一步一步的向前走。伴随着童年幼稚的结束我以一个较好的成绩步入中学的殿堂，在那里我认识了很多和我一样有着远大理想的同学，我们一起学习，一起成长，一起克服遇到的种种困难，不知不觉中我体会到了如何去正确的融入到团队中，如何与人交往。中学时代让我学到了很多，对于自己的人生，自己的事业，自己的理想有了进一步的明确。也许 时间并不像你所期待的那样，转眼即逝，带着中学的懵懂我们来到了大学。

进入大学，我发现现实中的大学与自己想象中是那么的不一样。当你融入到一新的环境中的时候，你不可能去改变它，唯有适应它，你才能更好的学习和生活。大学中的挑战和机遇无处不在，班级内的竞争，社团之间的竞争都会锻炼一个人，这些能够激励你去勇敢的挑战自己。只有武装自己，才能跟得上这个快速发展的社会。

大学让我学会了如何去面对，遇事的时候再也不会像中学那样盲目和冲动，我学会了如何去一分为二的看问题，每件事情的发生都会有利和弊，只有洞察才能会正确的解决。大学教育了我，也锻炼了我，它让我变得成熟，变的理智，教会了我如何去运筹帷幄。毕业在即，我也开始寻找适合自己的工作，在我看来工作不是为别人，而是为了自己，只有兢兢业业 踏踏实实的干才能充分显示出自己的价值，才能回报社会。出自农村的我不怕吃苦不怕累，因为我相信付出终会有回报。

为明确双方职责，甲乙双方经友好协商，按照《_____》等的有关规定，就劳务合作一事达成一致，同意签订本合同。

一、一般规定

1、本合同为劳务合作合同，乙方为甲方的提供________牌司机服务，并收取劳务费。

2、服务期限从________年________月________日早________时起至________年________月________日________时止（共计________个月），但本合同规定的提前终止协议的情形除外。合同期满后，甲方根据实际需要决定是否重新签订合同。

3、除双方另有约定外，甲乙双方之间任何与本合同相关的信函以及结算，均使用并且只能使用本合同中甲、乙双方指定的地址和银行开户账号。

4、本合同中甲乙任何一方的名称、法定地址、汇款人、收款人、开户银行、账号若有变更，变更一方应至少提前十五天通知对方。该书面通知经加盖公章并经本合同授权代表签字确认方有效，如乙方名称更改，还需提供新的营业执照复印件和企业名称变更核准通知书。

二、双方的权利义务

乙方权利义务

1、乙方服务司机必须是持有中华人民共和国机动车驾驶证（________牌以上）品行端正、身体健康、年龄在25-40岁的司机。

2、乙方服务司机在服务过程中应该态度良好。如乙方司机在服务过程中出现服务问题，应当按照《劳务合作补充协议》承担违约责任。甲方有权要求乙方改正，乙方再不能达到要求的，甲方有权解除本合同，并有权要求乙方赔偿因此给甲方造成的损失。

3、乙方应与所派遣的司机签订正式的聘用协议书，并负责所派遣司机的工资、福利、各项社会_____（含养老、医疗、工伤）人身意外伤害_____、纳税、生活安排（如吃、住、行的安排，各类证件的办理）等事宜，为甲方服务司机的聘用、调换或被解雇所产生的一切经济和法律责任，均由乙方承担。乙方司机在甲方服务期间，不能正常工作的，甲方将退回乙方处理。

4、乙方服务司机如果患病、因事不能提供服务，必须提前向甲方请假，休假期间乙方应提供相应司机代替，不能因此而影响为甲方提供服务，否则甲方有权向乙方追偿损失。休假期间未能向甲方提供服务的，甲方免于支付相应天数的劳务费。

5、乙方服务司机不得将车用于甲方工作之外的任何目的，_____停放地点由甲方决定。

6、乙方服务司机驾驶甲方_____发生交通事故，一切有关事务的处理均由甲乙双方根据国家政府有关部门出示的责任鉴定书、_____及国家相关法律规定协调进行，负责赔偿相关费用。乙方服务司机的违章责任由乙方负责处理。乙方司机在责任交通事故中伤残或死亡的，甲方向_____投保的_____公司理赔后，其它善后补偿均全部由乙方负责办理。重大或特大交通事故中，负主要责任或多次发生一般交通事故的乙方服务司机，甲方有权要求乙方更换。

7、乙方服务司机为甲方提供服务期间，涉及到甲方有关工作内容及其它信息有保密义务，合作期间，服务司机要与甲方签订保密协议。

甲方权利义务

1、甲方应对_____投保第三者责任险（20万元）司乘座位险（10万元/每座）等，且_____期限包含了合同全部服务期限。

2、甲方保证_____技术状况良好、并有相关的有效行驶证、附加费证、_____卡、车船使用税证及国家规定的养路规费单等证件。如果甲方缺少前述证件，乙方有权解除合同。

3、甲方负责_____的维修和保养，并承担相关费用。如果发生汽车故障时，乙方司机应按甲方指定的定点维修厂，随车跟班监督维修。维修申请必须提前报甲方车管科审核，经甲方车管科审核批准后到甲方指定的维修厂家维修，出车在外的临时小额维修，要申报甲方车管科审批。修理期间，司机自行离岗的，甲方免于支付相应天数的劳务费。如果发生乙方司机人为的汽车故障时，乙方应向甲方赔偿损失，甲方有权从劳务费中直接扣除赔偿金额。

4、甲方要按时支付劳务报酬。

三、劳务费及结算方式

1、乙方服务司机每月的劳务费为人民币________元，（甲方每月安排乙方司机休息时间不低于________天，具体休息时间可由双方商定），在本合同履行期间，如因国家工资政策发生重大变化，使双方仍按本合同规定支付劳务费对一方显失公平的，双方应本着公平原则协商调整劳务费金额，按调整后的劳务费支付合同剩余期限的劳务费。合同劳务费包含：

（1）司机正常工作时间的劳务费及超时劳务费。

（2）乙方的管理费。

（3）服务司机的通讯费。

（1）过路、过桥费。

（2）燃油费。

（3）停车费。

（4）洗车费。

（5）汽车的保养、正常的机损维修及年审费用。

（6）_____年度各项税费、杂费。

3、“五一”、“十一”及农历春节所在月份，如果甲方需要乙方服务司机提供服务，劳务费用按实际服务天数支付，劳务费为________元/天。

4、劳务费，乙方应在下月________号前将合格发票开给甲方，甲方应在收到发票之日起________个工作日内支付上月款项。

5、每月劳务费支付到下列乙方指定的账户，并由乙方代扣代缴服务司机因提供本合同规定的服务而发生的一切税金。

四、违约责任

1、甲方未能按时支付劳务费，乙方有权要求甲方及时结清，如甲方延期付款超过________日，乙方有权停止服务，但应提前________日通知甲方；甲方逾期付款一日，每日支付欠款额________%的违约金。如甲方接到乙方通知后________日内仍不履行付款义务，乙方有权解除本合同，并保留追诉合法权益的权利。

2、乙方服务司机，必须遵守交通规则，因违反交通规则、造成的罚款和责任概由乙方负责。

3、在服务期间，如_____在甲方指定的停车场被盗，与乙方无关（司机作案或与司机联合作案除外），如乙方司机私自用车造成_____丢失或被盗，乙方应赔偿甲方_____损失及停车运行的一切损失。

4、在甲方厂区或办公区域，乙方司机应尊重甲方有关规定，不得影响甲方的正常工作秩序，否则甲方有权要求赔偿损失。

五、协议的变更及终止

1、合同期满后，甲方需要乙方继续提供司机服务的，必须提前________天与乙方协商重新签订劳务合作合同，否则乙方自期满之日起不再提供司机服务。

2、乙方提前终止合同，需提前________天向甲方提出。

3、劳务合作期间，由于甲方的原因需要提前终止合同的，需提前________天向乙方提出。

4、甲方如发生关闭、破产或丧失经济能力等情况，乙方有权解除合同。

5、乙方服务司机发生严重的交通事故、严重扰乱甲方的工作秩序或违反国家法律、法规的，甲方有权解除合同，并要求乙方赔偿相应的损失。

6、乙方如发生经营状况恶化、丧失信誉或其他影响其向甲方提供司机服务的事项，包括但不限于未及时向服务司机支付薪金时，甲方有权解除合同。

六、其他

1本合同由双方签字后生效。本合同一式________份，甲乙双方各执________份，具有相同法律效力。

2、凡对本合同进行修改、补充或变更，须作补充协议，与本合同具有同等效力。

3、有关本合同的未尽事宜及因本合同发生的一切争议，应由双方友好协商解决，如协商不能解决时，提交合同履行地_____委员会申请_____，对_____结果不服的，可向合同履行地的人民法院起诉。
