(一)原告抚养孩子不利于其健康成长。

(二)孩子随被告生活更有利于孩子的教育和成长。

1、被告对孩子疼爱有加、百般呵护，并对孩子采取了正确的教育和生活方式。孩子虽小，但谁疼他还是知道的，这个不是谁教给他的，被告及父母对孩子的教育都是正面的，他们希望把家庭的破裂对孩子的影响降到最低，即使家庭破裂了，被告及其父母也希望并尽量让孩子得到父爱和母爱。

2、被告系绍兴本地人，有稳定的工作，每月收入近三千元，且长期与父母共同生活，开销不大，个人能力和经济状况均比原告优越，原告无住房、工资待遇不高，不能为孩子的学习和生活创造良好的条件。

3、双方协议离婚后，孩子一直随被告生活，彼此之间已有稳定牢固的感情基础。反倒是原告即使在未与被告离婚前对孩子也是不管不问，白天工作可以理解，但晚上回来吃完饭也是顾自己玩电脑，很少有增进父子感情的举动，所以孩子自然而然地对其生疏了。

4、被告父母经济基础坚实，父亲年收入7万余元，母亲也有退休金，二老十分舍得给孩子花费。孩子自出生后半个月起，一直与被告父母共同生活，被告父母非常疼爱孩子，孩子的日常支出基本上都是由二老负担，祖孙已经建立起了深厚的感情，外祖父母优渥的家境与对孩子的关爱，都十分有利于孩子的成长。

(三)原告诉求无法律依据。

1、从原被告双方签订离婚协议迄今不足七月，当时双方对孩子跟谁生活经过认真的考虑和充分的协商。短短的时间，客观情况并未发生变化，现在原告就要对原来双方都认可的协议内容变更，频繁的变更抚养，会使孩子没有一个稳定的生活和学习的环境，所以原告的诉讼是不适当的，既不利于孩子的健康成长，也有悖法律要保护合法有效协议的严肃性。

2、根据《最高人民法院关于人民法院审理离婚案件处理子女抚养问题的若干具体意见》第16条，对一方要求变更子女抚养关系的情形作出规定：

(1)与子女共同生活的一方因患严重疾病或因伤残无力继续抚养子女的;

(2)与子女共同生活的一方不尽抚养义务或有虐待子女行为，或其与子女共同生活对子女身心健康确有不利影响的;

(3)八周岁以上未成年子女，愿随另一方生活，该方又有抚养能力的;被告根本就不符合上述三种情形之一，因而，原告的要求没有法律依据。

(三)原告的变更理由不成立。

原告要求变更的理由是：被告限制原告探望、被告无力抚养儿子。事实证明可原告的这一主张无任何事实依据，通过庭审，已经明确被告并未阻止原告探视孩子，而是原告不顾孩子身患哮喘硬要带其出去的这一不近情理事实，该事实进一步表明了原告并非疼爱孩子，试问一个看重孩子健康的父亲怎会忍心让自己的孩子诱发病情。而且原告完全可以在被告家里探望孩子，孩子尚小，不宜外带，将孩子外带出去不是行使探望权的必要条件。被告也向法庭证明了自己具备抚养孩子的能力，加上有疼爱孩子的外祖父母，被告完全有能力为孩子创造良好的成长与教育环境，相反地，原告却无法为孩子创造这些条件，原告要求变更抚养的真实原因是变更后其可以不负担抚养费。被告嫁人不淑，已经把全部的爱都倾注在孩子身上，被告及其父母与孩子关系融洽，感情深厚，他们对孩子的爱护，真是殷殷期望难以笔述。

事实与理由：

原告与第三人因工伤认定纠纷事宜，不服被告于20__年12月28日作出的084820120_______________号《认定工伤决定书》(以下简称“认定书”)，于20__年2月26日向__________市人民政府申请行政复议。__________市人民政府受理后，于20__年4月1日作出_____复决字【20__】__________号行政复议决定书，维持了被告所做出的认定书。原告认为被告作出认定书的事实采信有偏差，法律适用有误，第三人所遭受的交通事故不能被认定为工伤，具体理由如下：

一、本案的事实采信存在以下错误：

1、有关第三人住所地的《证明》，不能作为证据使用。且即便能做证据使用也不能证实第三人在交通事故发生时的住所地为__________办事处__________新村6幢504室

__________市公安局__________派出所对第三人住所地的《证明》，系该机关事后的说明，不是其原有已形成的材料，在证据种类上不属于《行政诉讼法》第五章中上所规定的七类证据中的任何一类。该《证明》只是该机关对第三人曾经的居住情况进行的简单叙述，无承办人员署名，无任何书面证据材料能够佐证。

依照《行政诉讼法》关于证据的规定，法律上所认可的证据仅有7种。而本案被告所采信的《证明》显然不属于书证(因书证是对案件事实的原始记载，而不可能是事后的说明)，亦不属于物证，更不属于证人证言(证人证言的主体仅能是自然人)，当事人陈述，鉴定结论及勘验笔录和现场笔录等证据。因该《证明》不属于法律上所能认可的证据的种类，故不能作为证据使用，进而不能采信该《证明》所载明的事实。

即便该《证明》能作为证据使用，也不能证明第三人在事故发生时的居住地是__________新村。该《证明》载明“20__年4月份，(陈__________)夫妻俩随儿子陈__________居住在__________办事处__________新村6幢504室”，原告认为，该《证明》仅说明第三人于20__年4月份在__________新村居住，至于20__年4月份之后第三人是否在该房屋居住，__________派出所并未说明，亦无其他证据能证实。而本案的发生是在20__年1月5日(并非20__年4月份)，事故发生时第三人是否在__________新村居住，无任何证据能够证明。认定书将第三人现居住地为__________新村缺乏事实依据。

2、《仲裁裁决书》不能证实双方在事发时仍然存在劳动关系

《仲裁裁决书》(【20__】宣劳仲裁字30号)，仅确认了原告与第三人曾经存在劳动关系，并未认定原告与第三人在案件发生时仍存在劳动关系(而第三人的仲裁请求是要求确认第三人与原告截至提起仲裁之日存在劳动关系)。原告认为，被告据该裁决书认定双方在事发时仍存在劳动关系的依据不足。

3、有关被告所做的调查笔录，恰恰证明了第三人是去办理私事才发生的交通事故

被告到原告单位所做的调查笔录，两位证人与原告及第三人均有利害关系，且证人均未证实第三人在事发当日在原告处工作。且证人郭大明陈述第三人家住在五星，一般到儿子饭店里去。原告认为，第三人到儿子饭店去是为办理私事，不是回家。第三人在去儿子饭店的路上所发生的交通事故不应被认定为在回家途中所发生的交通事故。

4、没有证据证明到五星乡或__________办事处__________新村必须经过案发地。

二、本案的法律适用有误

《工伤保险条例》第十四条第六项规定，在上下班途中，受到非本人主要责任的交通事故或者城市轨道交通，客轮渡，火车事故伤害的，可以认定为工伤。依照该条规定，事故的发生应当是在上下班的必经途中。而本案中，无任何证据证明第三人是在从申请人处下班，更没有证据证明第三人是在下班的必经途中发生事故。被告据该款规定作出认定书，显属法律适用错误。

综上，原告认为被告做出的084820120_______________号《认定工伤决定书》事实采信有误，法律适用错误，依法应予撤销。原告特向人民法院提起行政诉讼，请依法撤销该认定书为感。
