d) 甲方有权要求乙方对其服务过程中存在的问题进行整改。甲方如对乙方交付的译件有异议，应在收到译件之日起个工作日内向乙方提出修改意见，若甲方逾期未提出修改意见的，则视为译件质量达到甲方要求;

e) 甲方应按本协议约定向乙方提供原件或参考资料，对乙方的澄清要求做出答复，配合乙方翻译开展服务工作;

f) 甲方应保证所提供的文件资料没有违反中华人民共和国法律法规、国际法，否则应承担全部责任;

g) 甲方应按本协议约定向乙方支付翻译服务费用。

5.2 乙方权利与义务

a) 乙方有权要求甲方提供翻译原件和相关背景资料;

b) 乙方有权对甲方提供的资料提出澄清和咨询要求;

c) 乙方有权按照协议收费标准向甲方收取翻译费用;

第八条 保密和知识产权

8.1对本协议内容以及在本协议签订执行过程中获悉的对方所有相关信息(包括但不限于原件、译件以及其他任何形式的信息)，甲乙双方均应承担保密义务;未得到对方事先的书面许可，不得向第三方公开或泄露。

8.2乙方应按甲方要求，将载有甲方信息的介质(包括但不限于书面资料、电子文件、媒体以及复制品和其它资料)区分管理，以确保信息文件的安全和完整;当甲方提出归还或销毁要求时，应按要求归还或销毁。

8.3 甲乙双方均应受本保密条款约束;在本协议终止后，本保密条款在三年内持续有效。

8.4 如果甲乙双方另行签订《保密协议》的，本条款未尽之保密事宜或本条款约定内容与双方达成的《保密协议》内容不符时，以《保密协议》约定为准。

第九条 违约责任

9.1 由于甲方原因推迟向乙方提供原件或相关支持文件，甲方应承担相关损失。

9.2 因甲方提供的原件存在问题，导致的翻译错误由甲方承担。

9.3 在甲方如期提供原件的情况下，如乙方未按约定日期按约定要求完成翻译服务，甲方有权解除协议并视为乙方违约，乙方应向甲方支付协议总额%的违约金作为赔偿。

9.4 因乙方自身翻译失误所带来的经济损失由乙方承担。任何情况下，乙方承担的直接和间接的经济损失最多不得超过本合同涉及项目金额的 1 倍。

9.5在乙方无违约的状况下，甲方应按协议约定及时付款。如甲方没有及时向乙方付款，每逾期一日，甲方应向乙方支付协议总金额的%作为违约金，直至付清所有费用为止。

9.6 甲方在约定的交付日期前取消所委托部分或全部的翻译内容，甲方应向乙方支付乙方实际已经完成部分的费用，乙方应向甲方交付已经完成的译件。

第十条 不可抗力

10.1在协议履行过程中，由于不可抗力(例如战争、严重火灾、水灾、台风、地震等不可遇见、不可避免且不可克服的事件)导致协议不能履行或延期履行，协议双方互不承担违约责任。但受不可抗力影响的一方应在不可抗力发生后24 小时内通知另一方不可抗力发生情况，且在不可抗力发生之后工作日 日内出具书面证明。

10.2 遭遇不可抗力影响的一方仍然有义务采取相应的措施减少损失。如果不可抗力的影响导致协议最终无法履行，双方另行协商善后事宜。

经过本次毕业设计，我完成了教学楼工程初步设计。在设计过程中，根据设计任务、建筑规划方案和建筑场地岩土工程勘察资料，在遵循“适用、安全、经济、美观”的设计原则和国家有关现行建筑结构设计规范与标准的基础上，进行了教学楼的建筑与结构初步设计，获得了该建筑物初步设计阶段的建筑CAD设计图纸与技术指标。

教学楼建筑占地面积约750平方米，总建筑面积约2750平方米，建筑总高度23.5m，主体结构五层、局部六层。设计确定了结构布置方案与结构计算模型，工程主体结构采用钢筋混凝土横向承重框架结构体系，主要柱网尺寸为9m×9m，地下基础结构为高强预应力管桩基础，建筑物防火等级二级，抗震设防烈度6度。

根据钢筋混凝土结构、框架结构与基础工程设计基本原理，选取该教学楼的轴线一榀框架作为手算对象，并建立了计算模型和进行了结构设计计算，其中恒载和活载的计算采用二次弯矩分配法，风荷载的计算采用D值法，还进行了屋面板、楼面板、次梁、楼梯和基础等的设计计算。经过对教学楼的楼盖结构、轴线一榀框架结构、基础工程结构等部分的手工计算和用结构设计软件进行结构整体分析计算相结合与比较的方法，完成了工程结构布置与构件的配筋设计，获得了教学楼的结构设计计算书，并用结构软件绘制输出了教学楼的结构设计图。

本次设计较全面地研究了工程各种制约因素和使用要求，设计科学合理、贴合国家现行规范要求。

一、课题意义

(一)课题的理论意义

在20世纪60年代，美国企业管理家H.I.安索夫首先将战略运用于企业管理中，针对日益复杂的企业进行统筹规划和协调指导。而如今在这样一个品牌经营时代，品牌竞争空前激烈，大力营造品牌形象，提升品牌知名度，创造独立的、的、固定化的产品品牌已成为企业经营的重中之重，同时，各企业也需要在一个系统有序的品牌战略平台完成各种品牌战术的规划，因此品牌战略应运而生。

改革开放以来，我国取得的成就举世瞩目，民族工业得到了飞速的发展，也涌现了TCL、海尔等一大批知名本国品牌。但是我们相关的政府部门和企业，对于品牌建设的战略意识，还没有形成。以至于我们的大量品牌还难以与国外品牌抗衡。

因此，对品牌战略的研究，成为我国民族企业品牌建设与发展的必经之路。立足于品牌战略的发展，我们借鉴国外成功经验，并与国内实情相结合，谋求一条适应中国国情的品牌战略发展之路。

(二)课题的现实意义

英荷联合利华公司与美国宝洁公司，属于世界名列前茅的日用消费品制造企业。他们相继在1986、1988年进入中国市场。90年代初，便通过发展占据了我国国内日用消费品行业大半壁江山。面对中国这样一个消费大国，两家公司根据企业自身特点，以及对中国市场的不同定位，采取了不同的品牌战略路线，并且获得了成功。两家企业的品牌战略，有利有弊。本课题，针对两者不同的品牌战略，对比分析他们的优劣势，力求为我国企业本土品牌的发展探索出一条品牌战略成功之路，对我国企业提高本土品牌知名度和品牌国际竞争力，具有非常重要的作用和现实意义。

二、文献综述

(一)本课题相关问题在国内(外)的发展现状综述

品牌战略在世界范围内首次被提出，源自20世纪60年代，美国企业管理家H.I.安索夫。他首次将战略运用于企业管理中，针对日益复杂的企业进行统筹规划和协调指导。对品牌战略的建设和发展有着决定性的重要意义。品牌战略，在我国的雏形为“战略”。艾丰，是我国战略最早倡导者之一，他是公认的理论专家。曾经担任中国质量万里行组委会主任和中国第一个组织――驰名商标保护组织主任，92至95年，连续四年组织召开了全国性大会及战略研讨会，在中国第一次鲜明地提出了“战略”这个概念，全面地阐述了它的内涵，并结合中国实际情况分为国家、地方、企业三个层次，提出“国家实施战略建议书”、“地方实施战略建议书”、“企业实施战略建议书”。从理论和实践的结合上大力推进中国事业。品牌战略在我国的继续发展，1996年，国务院颁布《质量振兴纲要》，提出了“实施战略，振兴民族工业，鼓励企业生产优质产品，支持有条件的企业创立产品”，全国大部分省市开展起“质量兴省(市)、质量兴企”活动。到20xx年党的xx大，明确指出要“加快培育我国的跨国公司和国际知名品牌”，一批实力较强的企业已经走出国门、走上了国际舞台。

宝洁公司和联合利华在20xx年《财富》杂志“世界500强”中分别位居68、121位。放眼两者在世界范围取得的巨大成就，以及在中国市场上占有的高市场份额，都离不开企业自身的定位发展以及对目标市场的战略应用。两者成功的关键，在于他们针对目标市场进行细分，采取适合本企业的战略方式。跨国企业，能否在世界范围内立足，不仅与企业本身的实力相关，同时采取的相关战略也十分重要，选对了方式则能为企业的发展提供出一条更为迅捷的道路。联合利华和宝洁公司品牌建设在我国的成绩是大家有目共睹的，因此，在国内也有许多学者针对两者的品牌战略进行了分析，它们在中国市场上获得的成功，是非常值得我国企业学习和借鉴的。我们应该将品牌战略的理论研究成果与我国企业的实际情况相结合，让我国的本土品牌，找到适合自身品牌建设和发展的道路，将我们自己的品牌做大做强，走出国门，走向世界。

鉴于甲方拥有（作者姓名）（下称"作者）的作品（书名）（下称"作品"）第（版次）的著作权，双方达成协议如下：

第一条 甲方授予乙方在保同有效期内，在（国家、地区）以图书形式用（文字）翻译  、出版  册（印数）上述作品译本（下称"译本"的专有使用权。

第二条 甲方保证拥有第一条授予乙方的权利。如因上述权利的行使侵犯他人菱权，甲方 承担全部责任并赔偿因此给乙方造成的损失，乙方可以终止合同。

第三条 为翻译的目的，甲方应免费向乙方在  在内提供上述作品的 本加工副本。

第四条 乙方根据本合同第十七条的规定，为获得出版译本的权利，向甲方支付报酬，支 付方式为：

（一）版税：  （货币单位）[译本定价X %（版税率）X销售数（或印数）]；（例 如文学作品8%，科技作品10%）或

（二）一次性付酬：（货币单位）（例如文学作品每千字20元，科技伤口每千字25元）  如果译本的最后定价高出预计定价，乙方应在译本出版后按%增加向甲方支付的报酬。

乙方在本合同签订后 月内，向甲方预付 %版税，其余版税开出版后第 月结算期分期支付，或在  月内一次付清。

第五条 乙方负责安排有资格和有能力的译者对作品进行准确性确的翻译，译者姓名和其 资格证明应送交甲方，未经甲方事先书面同意，不得删节、增加或以其他方式修改 作.

第六条 有磁译本的质量问题，由甲乙双方商定。

第七条 乙方将作者的姓名标注在译本的封面、护封和扉页的显著位置，并注明："此版 本（书名）系（乙方名称）与（甲方名称）于 年 月协议出版"。

第八条 乙方应于  年 月 日前出版译本。乙方因故未能按时出版，应在出版期  限届满前  日通知甲方，双方另行约定出版日期。乙方支付愈期违约金，比例为  ，乙方在双方另行约定的出版日期仍不能出版，甲方可以终止合同，乙方应向甲方  赔偿损失，并支付违约金，比例为  。

第十五条 甲方有权核查译本的印数。如甲方指定第三方核查，需提供授权委托书。如 乙方隐瞒印数，除向甲方补齐应付报酬外，还应支付违约金并承担核查费用 。如核查结果与乙方提供的印数相符，核查费用由甲方承担。

第十六条 如果乙方违反了本合同的约定，又未能在甲方通知其  月内改正，或甲方已 撤销不能履行的合同，本合同自动终止，授予乙方的翻译权回归甲方，乙方  应向甲方赔偿损失，并支付违约金，比例为 。
