function and application of descriptive translation studies

1 introduction

the intention of this study is to explore possible advantages of descriptive translation studies as in its application in translation practice and translation analysis.

since early 20th century, translation studies gradually broke away from the marginal status within other related disciplines and established itself as an empirical science. from then on, schools of thought have kept coming out and each claims its legitimacy for existence. among these schools is descriptive translation studies (dts).

dts approaches translation from an empirical perspective. translation is viewed to be a social activity having significant importance in the receiving culture and for the target community. therefore, translation is dealt with beyond the linguistic realization and language comparison, and is incorporated in social and cultural context.

my attention was first directed to dts by its peculiar characteristic of observation, description and explanation. the subject is whatever happens in translation practice, from the determination of prospective function of translation to the process of translator’s choice of strategies, brainstorming and the revision, to the final product making appearance in the target community.

the method of dts is basically descriptive. the prescriptive tendency and the problem-solution pattern is abandoned. translation phenomena are noted down. with accumulated data, some underlying truths about translation will come out which will prove to be instructive not only for theoretical probe but also for applied translation practice. i will apply this descriptive method in the case study of this thesis.

a convenient tool has been set up to conduct dts. “norm” is operative at every stage of description and explanation. function, process and product and their relationship as well are skeletal structure of what constitute descriptive studies. translation phenomena are accounted for with the help of norm.

the case taken in this thesis is the chinese classic the dream of red mansions. two english versions translated respectively by yang hsien-yi and david hawks are compared and observations are made in regard to their translation approaches.

in this regard, my observations are limited to several aspects, i hope in-depth observation and explanation will done in light of dts.

15. 装运条款(terms of shipment)：

(1) fob交货方式

卖方应在合同规定的装运日期前30天，以____方式通知买方合同号、品名、数量、金额、包装件、毛重、尺码及装运港可装日期，以便买方安排租船/订舱。装运船只按期到达装运港后，如卖方不能按时装船，发生的空船费或滞期费由卖方负担。在货物越过船弦并脱离吊钩以前一切费用和风险由卖方负担。

(2) cif或cfr交货方式

卖方须按时在装运期限内将货物由装运港装船至目的港。在cfr术语下，卖方应在装船前2天以____方式通知买方合同号、品名、发票价值及开船日期，以便买方安排保险。

16. 装运通知(shipping advice)：

一俟装载完毕，卖方应在__小时内以____方式通知买方合同编号、品名、已发运数量、发票总金额、毛重、船名/车/机号及启程日期等。

17. 质量保证(quality guarantee)：

货物品质规格必须符合本合同及质量保证书之规定，品质保证期为货到目的港__个月内。在保证期限内，因制造厂商在设计制造过程中的缺陷造成的货物损害应由卖方负责赔偿。

the seller shall guarantee that the commodity must be in conformity with the quatity， specifications and quantity specified in this contract and letter of quality guarantee. the guarantee period shall be______months after the arrival of the goods at the port of destination， and during the period the seller shall be responsible for the damage due to the defects in designing and manufacturing of the manufacturer.

18. 检验(inspection)(以下两项任选一项)：

(1)卖方须在装运前__日委托______检验机构对本合同之货物进行检验并出具检验证书，货到目的港后，由买方委托________检验机构进 行检验。

the seller shall have the goods inspected by ______ days before the shipment and have the inspection certificate issued by____. the buyer may have the goods reinspected by ________ after the goods，rrival at the destination.

(2) 发货前，制造厂应对货物的质量、规格、性能和数量/重量作精密全面 的检验，出具检验证明书，并说明检验的技术数据和结论。货到目的港后，买方将申请中国商品检验局(以下简称商检局)对货物的规格和数量/重量进行检验，如发现货物残损或规格、数量与合同规定不符，除保险公司或轮船公司的责任外，买方得在货物到达目的港后__日内凭商检局出具的检验证书向卖方索赔或拒收该货。在保证期内，如货物由于设计或制造上的缺陷而发生损坏或品质和性能与合同规定不符时，买方将委托中国商检局进行检验。

the manufacturers shall， before delivery， make a precise and comprehensive inspection of the goods with regard to its quality， specifications， performance and quantity/weight， and issue inspection certificates certifying the technical data and conclusion of the inspection. after arrival of the goods at the port of destination， the buyer shall apply to china commodity inspection bureau (hereinafter referred to as ccib) for a further inspection as to the specifications and quantity/weight of the goods. if damages of the goods are found， or the specifications and/or quantity are not in conformity with the stipulations in this contract， except when the responsibilities lies with insurance company or shipping company， the buyer shall， within _____ days after arrival of the goods at the port of destination， claim against the seller， or reject the goods according to the inspection certificate issued by ccib. in case of damage of the goods incurred due to the design or manufacture defects and/or in case the quality and performance are not in conformity with the contract， the buyer shall， during the guarantee period， request ccib to make a survey.

19. 索赔(claim)：

买方凭其委托的检验机构出具的检验证明书向卖方提出索赔(包括换货)，由此引起的全部费用应由卖方负担。若卖方收到上述索赔后______天未予答复，则认为卖方已接受买方索赔。

the buyer shall make a claim against the seller (including replacement of the goods) by the further inspection certificate and all the expenses incurred therefrom shall be borne by the seller. the claims mentioned above shall be regarded as being accepted if the seller fail to reply within ______days after the seller received the buyer‘s claim.

20. 迟交货与罚款(late delivery and penalty)：

除合同第21条不可抗力原因外，如卖方不能按合同规定的时间交货，买方应同意在卖方支付罚款的条件下延期交货。罚款可由议付银行在议付货款时扣除，罚款率按每__天收__%，不足__天时以__天计算。但罚款不得超过迟交 货物总价的____ %.如卖方延期交货超过合同规定__天时，买方有权撤销合同，此时，卖方仍应不迟延地按上述规定向买方支付罚款。

买方有权对因此遭受的其它损失向卖方提出索赔。

should the seller fail to make delivery on time as stipulated in the contract， with the exception of force majeure causes specified in clause 21 of this contract， the buyer shall agree to postpone the delivery on the condition that the seller agree to pay a penalty which shall be deducted by the paying bank from the payment under negotiation. the rate of penalty is charged at______% for every ______ days， odd days less than _____days should be counted as ______ days. but the penalty， however， shall not exceed_______% of the total value of the goods involved in the delayed delivery. in case the seller fail to make delivery ______ days later than the time of shipment stipulated in the contract， the buyer shall have the right to cancel the contract and the seller， in spite of the cancellation， shall nevertheless pay the aforesaid penalty to the buyer without delay.

the buyer shall have the right to lodge a claim against the seller for the losses sustained if any.

21. 不可抗力(force majeure)：

凡在制造或装船运输过程中，因不可抗力致使卖方不能或推迟交货时，卖方不负责任。在发生上述情况时，卖方应立即通知买方，并在__天内，给买方特快专递一份由当地民间商会签发的事故证明书。在此情况下，卖方仍有责任采取一切必要措施加快交货。如事故延续__天以上，买方有权撤销合同。

the seller shall not be responsible for the delay of shipment or non-delivery of the goods due to force majeure， which might occur during the process of manufacturing or in the course of loading or transit. the seller shall advise the buyer immediately of the occurrence mentioned above and within_____ days thereafter the seller shall send a notice by courier to the buyer for their acceptance of a certificate of the accident issued by the local chamber of commerce under whose jurisdiction the accident occurs as evidence thereof. under such circumstances the seller， however， are still under the obligation to take all necessary measures to hasten the delivery of the goods. in case the accident lasts for more than _____ days the buyer shall have the right to cancel the contract.

22. 争议的解决 (arbitration)：

凡因本合同引起的或与本合同有关的任何争议应协商解决。若协商不成，应提交中国国际经济贸易仲裁委员会深圳分会，按照申请时该会当时施行的仲裁规则进行仲裁。仲裁裁决是终局的，对双方均有约束力。

any dispute arising from or in connection with the contract shall be settled through friendly negotiation. in case no settlement is reached， the dispute shall be submitted to china international economic and trade arbitration commission (cietac)，shenzhen commission， for arbitration in accordance with its rules in effect at the time of applying for arbitration. the arbitral award is final and binding upon both parties.

23. 通知(notices)：

所有通知用____文写成，并按照如下地址用传真/电子邮件/快件送达给各方。如果地址有变更，一方应在变更后__日内书面通知另一方。

6、x同学的学位论文，将计算机辅助设计技术覆盖产品设计的全过程是当前CAD研究的主要内容。传统意义下的CAD技术着重于辅助产品的详细设计和绘图输出，因而有较大的局限性。本文以图形单元作为产品设计资讯的载体，通过运动分析、功能映射、变型设计、关联设计等手段，将计算机辅助设计技术全面地融入产品概念设计过程，取得了一系列有创造性的研究成果：

a.将零件结构划分为零件、功能结构和基因单元三个层次，以功能结构为单位组织基因单元，有利于实现基于功能的零件概念设计。

d.以图形单元置换、叠代技术为核心，构造了单元化产品信息建模原型系统。在此基础上开发了MCADDS系统，并在冲剪机床设计XJD型转辙机传统系统设计中获得了成功的应用。

e.论文内容丰富、条理清晰、结构完整，特别是在运用CAD技术辅助产品的变型设计以及在设计过程中对设计方案的反复修改方面有重要突破。本文是一篇优秀的博士学位论文，建议提交答辩。

从某种角度来说，研究生学位论文评语既是对研究生学位论文研究工作的评价，也反映了评阅人综合水平。既反映了评阅人的学术水平，也反映了评阅人的写作文风。它属于应用写作中一种专业应用文写作，值得我们研究。

英文补充协议变更的起草

一般来说对于合同的小修改，没有必要重新签订合同，重新签订都是费时费力，也没有必要，所以都用补充协议对原合同进行修改。如果对合同改变重大的话，比如对方想换个姊妹公司来签合同，或者合同条款有多处重大变更，可以说从根本上改变了合同的内容，都可以重新签订合同的。重新签订合同有两种方式。一种是交出所有原合同的原件，然后废除，撕毁都可以，然后再签订新合同；如果对合同原件到底有多少份不清楚的话，保险起见可以先起草一个对原合同的终止协议，然后再签新合同。当然如果为了做到天衣无缝，两个合同之间权责无缝转移的话，我自己使用过这种模式，不用撕毁原合同或者起草终止协议，先在新合同中写终止原合同，一般写新合同生效后原合同立即终止，在新合同未生效前原合同保持有效。然后在新合同上盖上三种章，第一种是原合同的对方的章，第二种是新合同的对方的章，第三种是我方的章，这样操作有个缺点是财务看见合同上有三个章，如果她们不看合同内容的话，有时候容易混淆合同内容。

言归正传，给大家分享一个我起草的比较简单的补充协议。

忘了给大家说了，之前跟一位做国际工程的朋友讨论补充协议和变更怎么翻译，我倾向于合同变更翻译为amendment, 补充协议翻译为addendum.不知道大家什麽意见？不过我自己一般都是不加区分的用amendment的。

翻译版权许可合同

XX年12月，我开始了我的毕业论文工作。时至今日，论文基本完成。从最初的茫然，到慢慢的进入状态，再到对思路逐渐的清晰，整个写作过程难以用语言来表达。历经了长达6个多月的奋战，紧张而又充实的毕业设计终于落下了帷幕。回想这段日子的经历和感受，我感慨万千，在这次毕业设计的过程中，我拥有了无数难忘的回忆和收获。

12月初，在与导师的交流讨论中我的题目定了下来，是：从日本妖怪的变化过程看日本人的心理变化。当选题报告，开题报告定下来的时候，我当时便立刻着手资料的收集工作中，当时面对浩瀚的书海真是有些茫然，不知如何下手。我将这一困难告诉了导师，在导师细心的指导下，终于使我对自己现在的工作方向和方法有了掌握，并且从最初的举棋不定，到确定了明确的方向。

在搜集资料的过程中，我认真准备了一个笔记本。我在学校图书馆，大工图书馆搜集资料，还在网上查找各类相关资料，将这些宝贵的资料全部记在笔记本上，尽量使我的资料完整、精确、数量多，这有利于论文的撰写。然后我将收集到的资料仔细整理分类，及时拿给导师进行沟通。

4月初，资料已经查找完毕了，我开始着手论文的写作。在写作过程中遇到困难我就及时和导师联系，并和同学互相交流，请教专业课老师。在大家的帮助下，困难一个一个解决掉，论文也慢慢成型。

4月底，论文的文字叙述已经完成。5月开始将论文进行整理。为了写出较真实的妖怪文化，我仔细阅读了前人关于妖怪的各种研究，仔细的分析了他们的妖怪学中的差异。在构思初期，由于材料较少，觉得无从下手，空有很多想法，却不知道应该选哪个，经过导师的指导，我的设计渐渐有了头绪，通过查阅资料，逐渐确立系统方案。

当我终于完成了论文终稿和所有的排版后，整个人都很累，但同时看着电脑荧屏上的毕业设计稿件我的心里是甜的，我觉得这一切都值了。这次毕业论文的制作过程是我的一次再学习，再提高的过程。在论文中我充分地运用了大学期间所学到的知识。

我不会忘记这难忘的几个月的时间。毕业论文的制作给了我难忘的回忆。在我徜徉书海查找资料的日子里，面对无数书本的罗列，最难忘的是每次找到资料时的激动和兴奋;亲手设计电路图的时间里，记忆最深的是每一步小小思路实现时那幸福的心情;为了论文我曾赶

此次写作是一个漫长的过程，在这段时间里，我总结出以下经验：

首先，时间节点要把握好。由于我在校外找到了实习工作，因此大部分时间都需要在公司实习。而论文的写作也需要花费相当多的精力和时间，因此，既需要合理得安排好时间，又要顾好两边，使实习和论文两不误。

其次，要充分学习和利用数据库资源。搜集资料时，需要有目的地搜索，大量地翻阅与自己论题有关的文献，认真阅读、做好总结笔记，为论文打下坚实的基础。在大量的阅读之后，还需要针对自己的论题，借鉴一些好的理论，并提出自己的观点。

当然，严谨的态度是最重要的。做任何事情，都需要脚踏实地、一步一个脚印的完成，只有态度端正，才能将事情做好。论文的开头是一个艰难的任务，在导师的帮助下，我逐步地找到了方法，严格按照写作要求，一步一步知道最终定稿。在这过程中，我的论文曾多次被要求修改，只有虚心接受、不断地完善，才能得到老师最终的肯定。

最后，脚踏实地，认真严谨，实事求是的学习态度，不怕困难、坚持不懈、吃苦耐劳的精神是我在这次设计中最大的收益。我想这是一次意志的磨练，是对我实际能力的一次提升，也会对我未来的学习和工作有很大的帮助。

英国女作家多丽丝·莱辛（doris lessing,1919——）是英国当代文坛最著名的女作家之一，被誉为“20世纪最伟大的作家之一”（见putting the question differently, interviews with doris lessing 1964-1994）自1950年出版第一部小说《青草高歌》 (the grass is singing ) 开始步入文坛，先后有数十本小说、剧本、诗集和其他文集问世，莱辛的作品广泛涉及殖民主义、女性主义、种族隔离等社会和政治热点问题。

然而，迄今为止，国内对莱辛的研究较少且多数仅限于翻译引进和介绍国外研究成果颇丰，早在1971年现代语言学会(mia)的年会上已有专题研讨会讨论她的作品，但多从其作品中人物或主人公的心理分析为焦点。

本文跳开多丽丝·莱辛在其自传体散文──《我的父亲》中对父亲各方面的描写，如心理、景物描写，特别是单对主人公思想意识和心理的深层挖掘，继而，从另一个角度进行研究，即在自传体散文客观性严重受挫的情况下，莱辛通过对父亲的描述是如何体现对其自身的探索和追求。

本文主要研究影响自传体及自传性文章客观性的几种主要因素，从而推出，莱辛自传体散文《我的父亲》中所记叙的事情并非全部出自父亲的口叙回忆。作者本人，即莱辛的个人心理状况对它的影响颇多，本篇叙文拟揭示莱辛是如何通过对文章内容及结构的安排来达到其自身追求和探索自我的目的。
