2.乙方不能胜任工作，经过培训，仍不能胜任工作的;

3.符合本合同第十三条规定，双方不能就变更合同达成协议的。

第十六条甲方濒临破产进行法定整顿期间或者生产经营状况发生严重困难，确需裁减人员的，应当提前三十日向中心、驾驶员说明情况，听取管理公司意见，并向劳动行政部门报告后，可以解除本合同。

第十七条乙方解除劳动合同，应当提前三十日以书面形式通知甲方。乙方给甲方造成经济损失尚未处理完毕或因其他问题正在被审查或处理期间，乙方不得依据第一款解除劳动合同。

第十八条有下列情形之一的，乙方可以随时通知甲方解除劳动合同：

1.在试用期内的;

在学校，最大的乐土莫过于实验室，即使基础实验成了理工科学生最为诟病的孱头。虽然无法完全掌控实验，但我力争求变，看到自己的思想被证实或被否定，实在是一件乐事。儿时与土地的亲近和十几年“住院”(live in THE hospital)生活让我对实验操作本身颇有体会。特别是动物实验，被同学叫去在扎满耳孔的兔子耳朵上寻找“立针之地”的往往是我。三年来，十几门实验课，门门都是优秀，每每成为实验同伴偷懒的理由，这也是大学时光里的一个美好的回忆。

闲暇之余，背上帐篷和睡袋，深入济南南部的山山水水中，虽然没有云南风光旖旎，还是能寻找到一份城市中失落已久的难得清静。带上地质锤和放大镜，张夏、山旺，都是好去处。和奥陶纪、寒武纪、第四纪的生灵们打个招呼。虽然还上升不到分子的水平，也算是对进化的小小研究了。

说到进化，2019年的春天，非典疑云笼罩京城之际，我和几个朋友受邀到中央电视台科教频道与南京大学、天津大学的朋友一起参加关于恐龙灭绝的话题的讨论。我们提出的复原恐龙生殖生态模型的观点得到了著名古生物学家董枝明和甄朔南的一致肯定。从北京赶回济南后五天，非典隔离开始。同样因为非典，中央台的节目录制陷入停顿，我们的节目“有幸”被重播四次之多，希望我们的观点能够得到更多人的认可。

不过，比之讨论恐龙灭绝，我更喜欢探讨生命的诞生。在这里，进化不仅仅是一个生物学课题，更是一个哲学命题。我对进化生物学及进化基因组学的认识将在下面的一篇小文中展开，在此就不加赘述了。

最后，三年大学生活行将结束，未来的研究生生活即将展开。对我来说，中科院系统始终是我的唯一选择，我需要的是一个纯粹的研究氛围。昆明动物所正是这样一个地方。不管是我目前主攻的动物发育方向，还是我的兴趣所在--进化生物学方向，昆明所都有国内顶尖的教授和实验条件。如果能有幸成为昆明所的

一员，在如此优秀的研究条件下工作，还有什么可以说的呢。

根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》等法律、法规之规定，甲、乙双方在平等自愿、协商一致的基础上，订立本聘用合同，共同遵守：

一、甲方聘用乙方担任本单位的司机，聘用期限为三个月，自xx年11月25日起，至xx年11月25日止。试用期内，乙方不胜任驾驶员岗位的，甲方提前三日以口头方式通知乙方，可以解除本合同，如被甲方认可，试用期计入正式聘用合同期限，并续签正式聘用合同。

二、乙方应当保证自己所提供的个人信息资料和各类资格证书（驾驶执照等）真实有效。

三、乙方必须严格遵守甲方依法制定的各项内部规章制度，正常工作日内按时上下班，否则，甲方可以依照内部规定进行处罚。

四、驾驶员不得私自出车或私自将车转交他人驾驶，违者视情节予以批评教育和处罚。若发生事故，一切责任（包括个人安全、经济损失、违章罚款）由司机个人承担，若造成直接经济损失在万元以上的，赔偿损失并解除聘用合同。

五、车辆晚上应停放在指定车库内，车钥匙放在指定地点，特殊情况停不到车库时，也应停放在有人看管的停车场内，否则一切责任由司机承担。

六、试用期间的工资报酬和待遇：

甲方每月按时足额支付乙方工资报酬¥800.00元（大写人民币陆佰元整）。

七、乙方有下列情形之一的，甲方可以随时解除本合同：

1、严重违反甲方内部规章管理制度，给甲方利益造成重大损失的；

2、身体条件发生重大变化，不能胜任驾驶员岗位的；

3、违反国家法律、法规，被依法劳动教养、追究刑事责任的。

八、试用合同期满，经双方协商一致，可以续聘；否则，此合同终止。

九、违约责任：

1、甲方违反本合同约定给乙方造成损失的，应按乙方受损情况承担赔偿责任。

2、乙方在聘用期限内无正当理由，未经甲方许可，违反合同约定或擅自自行离职的，甲方可以解除本聘用合同，并根据受损情况，追究乙方的赔偿责任。

3、乙方在工作中因个人原因造成甲方和个人经济损失的，该经济赔偿责任由乙方承担，甲方概不负责。

十、因发生不可抗力或情势变更导致本合同无法履行的，本合同终止，双方均不承担法律责任。

十一、本合同未尽事宜，由甲、乙双方协商解决。根据需要可以签署补充合同，补充合同与本合同具有同等法律效力。

十二、本合同一式两份，甲、乙双方各执一份。自双方签字盖章之日起生效。

没有惊天动地的业绩，有的是安全行车百万公里无事故的记录！

没有振聋发聩的豪言壮语，有的是30多年如一日的真诚奉献！

冯国富，这位长运公司“共产党员车”驾驶员，30多年了，他把青春和汗水都抛洒在窄小闷热的驾驶员室内！30多年了，没见过他说什么，要什么，人们只记得他每天热情招呼旅客，迎着晨曦，踏上一天新的征途，那块“共产党员车”的铜牌在阳光的照射下熠熠生辉！

时代在变幻，老冯的观念却似乎还那么陈旧，在老冯的信念里，共产党员就应该吃苦在前，享受在后，默默奉献这才是生活的全部。

多年来，老冯自己也说不清做过多少次好事，但旅客却都记在心上。老冯的车上不少都是回头客，他们说：“坐老冯的车就象坐在自家人开的车一样，比家里人照顾得还周到，不是亲人胜亲人”，“要坐车，找老冯。”

二、车厢胜似保险箱

旅客们常说：“乘坐冯师傅开的车，有舒适感，有信任感，有安全感。”

多年来，老冯先后多次拾到旅客遗失在车上的提包、钱、物品等价值几万元，他都竭尽全力，千方百计一一查询，物归原主。

乘客是客人，老冯总是以礼相待。有一次，老冯的车上来了一个醉汉，不仅不买票，还用脏话骂老冯。当时车内有好些乘客要打抱不平，老冯连忙劝阻，“他喝醉了酒，不要当回事。”醉汉见老冯保护他，如梦初醒，感动得当众认了错，主动交了车费。老冯就是这样，用爱心和诚心与旅客搭上连心的桥梁。老冯驾驶的客车接待旅客十几万人次，从未与客人红过一次脸，发生过一次乘务纠纷。
