为了维护合同当事人的合法权益，根据相关法律法规规定，双方本着自愿、平等、诚信的原则，就受托人接受委托人的委托提供自费出国留学中介服务事宜，达成如下协议：

第一条 中介服务范围

经双方协商，委托人可在以下范围内选择服务项目，委托受托人提供自费留学中介服务：

□向委托人提供中国国家留学政策咨询、留学前往国家的教育概况、留学政策、院校、院系、专业及收费等信息，并为委托人确定留学方案提供相应的咨询及建议;

□向委托人介绍申请留学院校的入学要求及入学申请程序，指导委托人准备入学申请的相关材料并提供申请文书的准备、修改等服务;

□指导或代理委托人向确定的留学院校提出留学申请并提交、补充相关资料;

□根据委托人的委托，代为与申请留学院校联系、协调，代为办理入学、签证申请等手续;

□为委托人提供申请留学院校组织的面试指导以及申请国家使(领)馆面签指导;

除委托人选择的以上服务项目之外，双方还确定了以下的其他服务项目：

第二条 委托人的权利与义务

1.参考受托人提供的信息和咨询、建议，决定申请留学的国家、院校中英文名称、留学层次、就读专业或专业方向，确定留学方案并签署本合同附件《院校及专业确认表》;

2.有权选择自行缴纳院校申请注册费、材料寄送费、签证等第三方收取的费用;

3.填写受托人制定的《自费出国留学申请人信息表》，并向受托人提供留学申请所需的全部文件、材料，材料应于合同签署后 日内提供，并保证所提供的信息、文件、材料真实、有效;

4.配合受托人及时完成申请准备及向申请学留学院校提交申请、寄送资料等工作，如遇前往国家留学政策、签证政策、入学标准发生变化，应根据新的要求及时提供补充材料;

5.按照留学院校要求,如期缴纳学费等有关费用;

6.按期办理护照及签证;

7.按照本合同约定向受托人支付中介服务费;

8.双方约定的其他权利和义务：

第三条 受托人的权利与义务

1.要求委托人及时提供办理委托服务所需信息、文件、资料及履行本合同约定的其他义务;

2.按本合同约定收取中介服务费;

3.按照法律法规规定及留学服务行业规范要求提供本合同约定的中介服务;

4.向委托人提供的留学信息，应真实、准确，如遇前往国家留学政策、签证政策、入学标准发生变化，应及时通知委托人补充相应材料;

5.及时完成本合同约定的留学服务事项并向委托人通报工作进展情况;

6.对委托人委托的留学申请，应当在 年 月 日前取得委托人申请留学院校的录取通知书;

7.对委托人提供的个人信息及资料，负有妥善保管及保密义务;

8.双方约定的其他权利和义务：

第四条 中介服务费用

1.双方协商确定，委托人申请的留学院校在本合同附件一《院校及专业确认表》范围以内，中介服务费为人民币(大写) 元整(￥ );委托人申请的留学院校超出《院校及专业确认表》范围，每增加一所学校，委托人须另缴纳中介服务费人民币(大写) 元整(￥ )。

2.中介服务费支付期限

□ 一次性付款方式：

委托人在签署本合同 日内，需缴纳受托人中介服务费人民币(大写) 元整(￥ )，受托人在收到此款项开始为委托人提供服务。

□ 分期付款方式：

委托人在签署本合同 日内，向受托人交纳第一笔中介服务费人民币(大写) 元整(￥ )，受托人在收到此款项后开始为委托人提供服务。

委托人在收到符合约定的任何一所院校的录取通知书(包括有条件录取通知书及无条件录取通知书) 日内，向受托人交纳第二笔中介服务费人民币(大写) 元整(￥ )。

3.中介服务费支付方式：

□现金 □信用卡/借记卡 □汇款

□ 其他

采用现金和信用卡/借记卡付费的形式，在受托人公司缴纳;采用汇款方式缴纳可将服务费汇至受托人指定的银行账号： ;账户名称：________________ _开户银行：______ _____________。

第五条 退费条款

1.委托人收到符合约定的任何一所院校的录取通知书(包括有条件录取通知书及无条件录取通知书)即视为留学申请成功。在双方都没有出现违约的情况下，如受托人未能协助委托人在_______年____月____日前获得任一所约定的留学院校之录取通知书或留学院校签发的录取通知书与附件一《院校专业确认表》中所载明的申请类型、院校、专业等不一致的，委托人向受托人提出退款要求，受托人可以扣除已支付服务费总额的 %，用来抵扣其已提供服务的必要费用支出，余款应当在 年 月前以 方式退还给委托人。

2.在双方未出现违约的情况下，委托人留学申请成功，但因委托人原因造成签证申请被拒签的，受托人不退还任何费用。因非委托人原因造成签证申请被拒签的，根据拒签原因，双方协商一致受托人须将中介服务费中所含办理申请签证服务的费用全部或部分共计人民币(大写)__________ 元整(￥ )退还给委托人。

3.在出现本条第2项约定情形时，如委托人已向留学院校缴纳费用，受托人协助委托人按留学院校退款政策索还委托人支付给校方的费用。

4.本合同签署后，在双方未出现违约的情况下，委托人单方面要求解除本合同，则根据本合同实际履行的阶段，委托人已支付的全部中介服务费按以下办法处理：

(1) 在本合同签订后 日内，委托人尚未提供任何入学申请材料的，受托人扣除已支付服务费总额_______%后，余额退还委托人，本合同终止;

(2) 在本合同签订后，委托人已经提供入学申请材料，但受托人尚未向拟申请留学院校或有关外方提交入学申请或送交委托人材料的，受托人扣除已支付服务费总额_____%后，余额退还委托人，本合同终止;

(3)受托人已经向拟申请留学院校或有关外方提交入学申请或送交委托人材料，但留学申请尚未成功的，受托人扣除已支付服务费总额______%后，余额退还委托人，本合同终止;

(4)留学申请成功，但受托人尚未提供办理签证申请服务的，受托人扣除已支付服务费总额_____%后，余额退还委托人，本合同终止。

5.出现本条所约定退费情形，委托人可书面通知受托人进行退费，受托人于收到委托人书面通知后十五个工作日内按本合同约定予以退还。本合同约定受托人退费范围仅限于受托人已收取的中介服务费，不包含受托人受委托人委托向第三方代缴的费用。

第六条 违约责任

1.双方均应严格履行合同中全部条款。因双方中任一方违约导致本合同无法继续履行的，另一方有权解除本合同。本合同解除后，受托人按照本合同第五条退费条款中的第4项约定退费，同时违约方须承担相应的违约责任。

2.委托人违反本合同约定，按照下列不同违约情形，承担相应违约责任。

(1)迟延向受托人支付中介服务费或未及时向受托人支付由受托人代为向第三方支付的费用，每迟延一日应向受托人支付逾期付款总额万分之_ ____的违约金。迟延支付中介服务费超过____日的，受托人有权解除本合同;

(2)迟延提供材料或向受托人提供虚假材料，从而导致留学院校申请失败或被拒签，委托人应自行承担由此产生的后果。受托人没有过错的，不承担违约责任。

3.受托人违反本合同约定，按照下列不同违约情形，承担相应违约责任。

(1)为达成本合同目的而向委托人提供虚假文件材料，除全额退还中介服务费外，还应按中介服务费的 %的人民币，作为违约金支付给委托人，并在 年 月前，协助委托人按留学院校退款政策索还委托人支付给校方的费用;

(2)未能在约定的时间内为委托人申请到拟留学院校的录取通知书，委托人有权解除合同，但应及时通知受托人。受托人除全额退还中介服务费外，还应按中介服务费的 %的人民币，作为违约金支付给委托人，并在 年 月前，协助委托人按留学院校退款政策索还委托人支付给校方的费用。如委托人要求继续履行，受托人应负责在 年 月前为委托人申请到拟留学院校的录取通知书，并向受托人支付迟延履行违约金人民币(大写) 元整(￥ );

(3)导致委托人留学院校申请失败或被拒签，受托人全额退还中介服务费，并按中介服务费的 %的人民币，作为违约金支付给委托人。

第七条 不可抗力

由于政治原因或地震、台风、水灾、火灾、战争以及其他不能预见并且对其发生和后果不能防止或避免的不可抗力，致使直接影响本合同的履行或者不能按约定的条件履行时，遇有上述不可抗力的一方，应及时通知对方，并应在十五日内，提供不可抗力详情及本合同不能履行、或者部分不能履行、或者需要延期履行的理由的有效证明文件，此项证明文件应由不可抗力发生地区的公证机构出具，按其对本合同的影响程度由双方协商决定是否解除合同、免除或者部分免除履行合同的责任，或者延期履行合同。

第八条 争议解决方式

1.本合同的履行、解释及争议解决均适用中华人民共和国有关法律。

2.凡因履行本合同所发生的一切争议，双方应通过友好协商方式解决。协商不成时，双方一致同意选择以下一种解决方式：

第九条 生效及期限

本合同自委托人(如委托人未满18周岁建议由委托代理人签署)及受托人签字、盖章之日起生效，至本合同约定的委托事项完成之日止。

第十条 通知

除特别书面声明外，委托人所填写的《自费出国留学申请人信息》中载明的住址即为受托人寄送书面文书的通讯地址。受托人在提供中介服务过程中，如按照委托人提供的其他联络方式无法取得联系时，受托人向该通讯地址发送的书面文书，即视为受托人履行了通知义务。委托人如更改通讯地址，应及时以书面形式通知受托人。

第十一条 其他

1.本合同的组成：本合同由合同本身及附件《院校及专业确认表》组成，本合同和其附件具有同等法律效力。

2.本合同一式三份，委托人执一份，受托人执两份，具有同等法律效力。

Due to the comprehensiveness of China’s “reform and open” policies，economics plays an increasingly important role in the development of its globalposition. Though more and more companies built， management of companies cannotcatch up with the development of the companies. I enrolled in thedepartment of Computer Science in Zhejiang College of Traditional ChineseMedicine. 第十条 乙方无论因何种理由中止、延长留学期限或改变留学内容，均应至少提前三个月通过中国驻留学所在国使、领馆向甲方提出书面申请，未经甲方批准，不得改变。

第十一条 乙方留学期满回国后，应在一个月内向甲方报到，按甲方规定办理有关手续。乙方根据本协议书第三条的规定，向甲方提交书面的留学总结、学术报告（或科研论文、科研成果报告）。

第十二条 乙方有责任回国后至少在甲方工作

年。缩短工作年限，由甲方决定。

第十三条 甲方在认为必要时，有权决定将本协议书的副本经由我驻外使、领馆提交乙方留学所在国的有关部门或个人。

第十四条 甲方违反本协议书时，乙方有权向甲方的上级主管部门提出申诉，要求甲方的上级主管部门责成甲方执行本协议书，赔偿损失等。必要时，乙方可向中国的司法机关起诉，追究甲方的法律责任。

乙方违反本协议书时，甲方将根据乙方违约情况，对乙方批评教育，或给予行政处分，或停止公费待遇，或停薪留职，或要求乙方赔偿损失；必要时，甲方可将乙方违约的事实通知乙方留学所在国的有关部门或个人，或向司法机关起诉，追究乙方的法律责任。

第十五条 经甲方同意，由（姓名、性别、出生年月、工作单位、职务）

为乙方出国留学的国内保证人、保证乙方执行本协议书。保证人须与乙方经常保持联系，每半年向甲方介绍乙方执行协议书的情况；如乙方违约，保证人须认真协助甲方追究乙方的责任。在乙方违约而保证人又未履行自己职责的情况下，保证人须承担本人经济收入能承受条件下的经济责任。

甲方与保证人因保证事项而发生纠纷时，经双方同意，可由甲方的上级主管部门裁决。

第十六条 本协议书自公证之日起生效，签字各方保证遵照执行。有效期限至本协议书第十二条规定的工作年限期满时止。

必要时，经甲方、乙方、保证人三方协商一致后，可对本协议书进行修改或补

充。

第七条 甲方在乙方回国后，负责安排乙方的工作，并积极创造必要的工作和生活条件，发挥乙方的作用。

第八条 乙方保证按本协议书第二条、第三条的规定，在国外努力完成学业，并按期回国服务。留学期间每 个月向甲方报告一次学习情况。

第九条 乙方抵达留学所在国后，一个月内向中国驻该国使、领馆报到。乙方在国外期间，保证遵守中国法律和中国对出国留学人员的规定，遵守所在国的法律。

第十条 乙方无论因何种理由中止、延长留学期限或改变留学内容，均应至少提前三个月通过中国驻留学所在国使、领馆向甲方提出书面申请，未经甲方批准，不得任意改变。

第十一条 乙方留学期满回国后，应在一个月内向甲方报到，按甲方规定办理有关手续。乙方根据本协议书第三条的规定，向甲方提交书面的留学总结、学术报告(或科研论文、科研成果报告)。

第十二条 乙方有责任回国后至少在甲方工作 年。缩短工作年限，由甲方决定。

第十三条 甲方在认为必要时，有权决定将本协议书的副本经由我驻外使、领馆提交乙方留学所在国的有关部门或个人。

第十四条 甲方违反本协议书时，乙方有权向甲方的上级主管部门提出申诉，要求甲方的上级主管部门责成甲方执行本协议书，赔偿损失等。必要时，乙方可向中国的司法机关起诉，追究甲方的法律责任。

乙方违反本协议书时，甲方将根据乙方违约情况，对乙方批评教育，或给予行政处分，或停止公费待遇，或停薪留职，或要求乙方赔偿损失;必要时，甲方可将乙方违约的事实通知乙方留学所在国的有关部门或个人，或向司法机关起诉，追究乙方的法律责任。

第十五条 经甲方同意，由(姓名、性别、出生年月、工作单位、职务)

为乙方出国留学的国内保证人、保证乙方执行本协议书。保证人须与乙方经常保持联系，每半年向甲方介绍乙方执行协议书的情况;如乙方违约，保证人须认真协助甲方追究乙方的责任。在乙方违约而保证人又未履行自己职责的情况下，保证人须承担本人经济收入能承受条件下的经济责任。

甲方与保证人因保证事项而发生纠纷时，经双方同意，可由甲方的上级主管部门裁决。

第十六条 本协议书自公证之日起生效，签字各方保证遵照执行。有效期限至本协议书第十二条规定的工作年限期满时止。

必要时，经甲方、乙方、保证人三方协商一致后，可对本协议书进行修改或补

为了维护合同当事人的合法权益，依据《中华人民共和国合同法》及相关法律法规，委托人与受托人双方本着自愿、平等、协商一致的原则，就受托人接受委托人的委托提供自费出国留学中介服务事宜，达成如下协议：

一、服务项目及费用

第六条 办理签证

1.受托人指导委托人进行签证申请准备，协助委托人办理签证或入境批准文件。

2.受托人收到委托人按委托人前往国驻华使(领)馆要求准备的全部申请签证材料后，应当在 工作日内向委托人前往国驻华使(领)馆递交签证申请材料。如该使(领)馆在递交签证申请材料、送签时间有特别要求的，应按其要求办理;需要进行面试的，受托人可协助安排预约时间等。

第七条 其他

1.如受托人为委托人办理申请入学、签证服务等，其收取的费用应在本合同第三条中介服务费中标明。

2.受托人收取委托人的中介服务费，应当为委托人开具有效发票。

3.受托人收取的中介服务费以外的其它费用，应为委托人出具有效发票或盖有企业财务专用章的收据，并在本合同终止前，将收据换为有效发票。

4.如受托人代委托人向国外院校缴纳报名费、学杂费等费用，受托人应向委托人提供收费方的符合法律要求的证明文件。

5.受托人对委托人提供的所有材料，均负有保密义务。除为委托人入学申请、签证申请的目的之外，不得向无关的第三方透露。

三、委托人义务

第八条 委托人应符合中国公民自费出国留学的条件，遵守国家关于公民自费出国留学的规定。

第九条 委托人向受托人送交的所有文件、材料和陈述的内容应合法、真实、有效。

第十条 委托人应当自本合同签订之日起 日内，按受托人要求，把入学申请所需全部材料交与受托人。

第十一条 在留学申请办理过程中，如前往国家的留学政策、签证政策或申请留学院校的入学要求发生变化，委托人应根据新的要求，及时提供补充材料。

第十二条 在留学申请办理过程中，如委托人前往国家驻华使(领)馆要求委托人进行面试，委托人应按要求参加面试。

四、违约责任

第十三条 受托人和委托人应履行合同中全部条款，违约方应承担相应的违约责任。

第十四条 受托人违反合同条款造成合同无法履行，受托人应向委托人退还中介服务费人民币(大写) 元，并在 年 月前，负责追回(或先行给付)委托人向申请留学院校缴纳的学费、杂费等。

第十五条 受托人为达成本合同目的而向委托人提供虚假文件材料，除全额退还中介服务费外，还应按中介服务费的 %的人民币，作为违约金支付给委托人。

第十六条 受托人未能在约定的时间内为委托人申请到拟留学院校的录取通知书，委托人有权解除合同，但应及时通知受托人，受托人应按本合同第十四条的规定承担违约责任。如委托人要求继续履行，受托人应负责在 年 月前为委托人申请到拟留学院校的录取通知书，并向委托人支付迟延履行违约金人民币(大写) ―元。

第十七条 委托人为达成本合同目的而向受托人提供虚假文件材料，致使合同无法履行，受托人不退还委托人缴付的中介服务费。

第十八条 由于委托人的违法行为，导致本合同无法履行，受托人不退还委托人缴付的中介服务费。

第十九条 委托人因自身原因，要求解除合同，按以下办法处理：

1.委托人已向受托人提供入学申请材料，受托人尚未向外方送交该材料， 委托人要求解除合同， 受托人扣除中介服务费人民币(大写) 元。

2.受托人已向外方送交了委托人入学申请材料，委托人尚未得到申请留学院校的录取通知书，委托人要求解除合同，受托人扣除中介服务费人民币(大写) 元，并协助委托人追回委托人已向申请留学院校缴纳的学费、杂费等。

3.委托人获得入学录取通知书后，要求解除合同，受托人扣除中介服务费人民币(大写) 元，并协助委托人追回委托人已向申请留学院校缴纳的学费、杂费等。

4.受托人尚未向拟留学国驻华使(领)馆递交委托人签证申请材料，委托人要求解除合同，受托人应当扣除中介服务费人民币(大写) 元，并协助委托人追回委托人已向申请留学院校缴纳的学费、杂费等。

5.受托人已向拟留学国驻华使(领)馆递交了委托人申请签证材料，委托人要求解除合同，受托人应当扣除中介服务费人民币(大写) 元，并协助委托人追回委托人已向申请留学院校缴纳的学费、杂费等。

五、不可抗力条款

第二十条 因不可抗力不能履行合同的，根据不可抗力的影响，部分或者全部免除责任，但法律另有规定的除外。当事人迟延履行后发生不可抗力的，不能免除责任。

本合同所称不可抗力，是指不能预见、不能避免并不能克服的客观情况，如重大自然灾害、瘟疫、战争、骚乱等。

第二十一条 当事人一方因不可抗力不能履行合同的，应当立即通知对方，说明不可抗力的发生日期、事件性质，预计持续的时间及对该方履行本合同的影响，并应当自不可抗力发生之日起_____日内提供证明。

第二十二条 对不可抗力所造成的影响，双方应及时协商解决办法和补救措施。因不可抗力不能履行合同的一方，应尽力采取合理措施减轻可能给对方造成的损失，否则应对由此而扩大的损失承担赔偿责任。

六、适用的法律及争议解决方法

第二十三条 本合同的履行、解释及争议解决均适用中华人民共和国有关法律。

第二十四条 双方在履行本合同中如发生争议，应先由双方协商解决。如协商不成，同意按以下第 种方式解决。

第一种：提交 仲裁委员会仲裁。

第二种：依法向人民法院提起诉讼。

七、合同的补充、变更、修改

第二十五条 如委托人未委托受托人进行签证服务，本合同第六条对当事人双方无效。

第二十六条 对本合同的任何补充、变更、修改应采用书面补充合同形式。补充合同在双方签署后与本合同具有同等法律效力。

八、 生效及终止条款

第二十七条 本合同由委托人及其代理人、受托人、受托人法定代表人签署，自签字、盖章之日起生效。

第二十八条 本合同正本一式两份，具有同等效力，委托人与受托人各执一份。

第二十九条 双方履行本合同的权利和义务后，合同终止。

It is my conviction that the meaning of life does not dwell in the lengthof time that one can live or the material abundance that one can acquire, but inthe richness and the wonderfulness of life itself. With the increase of my age,many things in my life have changed. But one thing remains constant, that is, Iwill consistently insist on doing what I like to do and hope that my endeavorscan be valuable to the life of others. I see this as the only way whereby I canrealize the value of my life.

My undergraduate study focused on economics and I achieved remarkablescholastic performance in this field. My GPA is 3.44 (my GRE score is 20__ andTOEFL---- ). For four consecutive years of my undergraduate study, I receivedscholarships for my distinguished academic performance. Due to my equallyprominent performance in extracurricular activities I was conferred on theOutstanding Student in Campus Activities. However, honestly speaking, my realinterest lies not in economics, but in education. Ever since I was a primaryschool student, I had cherished a strong desire for a teaching careerexemplified by my teachers. In the actual teaching career that I embarked onupon my graduating from university, I have become increasingly aware that theexisting educational conditions in China are far from satisfactory. The backwardteaching methodology and the prevailing pedagogical ideology have renderedChinese education out of place with the modern international development ineducation. On the macro level, the current education theory and practice inChina lag significantly behind advanced countries in the West. For instance,though education via the internet has achieved considerable development in pasttwo years, in practical operation such education has more often than notdeteriorated into an extended form of the conventional examination-orientededucation instead of a really interactive process. In my personal experience,despite the fact that some of the problems that I have encountered in myteaching career can be solved by consulting relevant technical literature, Ihave found that the more serious flaws inherent in Chinas current educationalsystem cannot be worked out easily. Under such circumstances, an advancedprogram in education becomes necessary.

In this age of information, traditional education, both in its ideology andmethodology, has met unprecedented challenge like many other aspects of humanexistence. Meanwhile, the pursuit for higher levels of educational developmentand of the quality of life has largely transformed the educational valueorientation of the general public. The educational model that is centered aroundthe cognitive and intellectual instruction has been seriously questioned.Greater attention has been devoted to the cultivation of well-developedpersonality and to the ontological status of the individual in education. Suchissues as the internal studies of education science, scientific decision-makingin education, and meta-education have also been increasingly emphasized upon.There have also been innovations in educational research methodology. Thetendency has been to combine modern technology with humanistic researchcategories and with naturalistic research categories, and to organicallyintegrate qualitative descriptions with quantitative descriptions. It is alsoimportant to carry out educational experimentations in which educationalpredictions are complemented by educational feedbacks. Both the complexity ofeducation and the complexity of human individuals have made the comprehensiveapplication of diverse educational approaches necessary. Those new horizons arewhat fascinate me.

In view of the following qualifications that I have acquired, I believethat I will acquit myself satisfactorily in the prospective Ph.D. program ineducation that I am currently endeavoring to apply for. First and foremost, asis often claimed, ones interest is ones best director. I believe that I willdo well what I am really interested in doing. Secondly, though I majored ineconomics as an undergraduate, my trainings during that stage helped developeffective modes of thinking and research approaches. Onthe other hand, all the accomplished educators since the 1960s have beenwell-versed in psychology. Almost every important new educational theory isderived psychological findings in one way or another so that educationalpsychology has subsequently developed into a fundamental subject for the scienceof education. The tendency in the 21st century is to emphasize on the microresearch of educational activities and against this backdrop educationalpsychology will be attached greater importance. In Instructional Technology, Iwould like to focus on the following studies: how to improve educationalefficiency by applying research results from natural sciences and engineeringtechnology; how to explore the combination and coordination of pedagogicalcontents and to improve teaching methodology by exploiting the theoreticalfindings from psychology and educational science concerning the process ofteaching and learning. In Educational Psychology, I will concentrate on appliedcognition and development, gifted and creative education, genetics and childrendevelopment, personality structure and individual differences and other relatedsubjects.

For me, to shift from economics to education and to pursue an advanceddegree in the United States is not so much a challenge as an opportunity. Atpresent, major reforms are being introduced into virtually every importantaspect of Chinese society. The field of education especially calls forcomprehensive reforms. The United States occupies an absolutely leading positionin the present-day world in education.
