第一次来到翻译是面试,试译不能查手机,加上对自己的能力不够自信,心里满是紧张忐忑不安的念头。但是还记得应该是李培姐端来一杯水,不但缓解了我远途而来的干渴,更让我充分有了被尊重的感觉,让我觉得这所公司与别的公司不一样,于细节处见人文关怀。在这里,是同伴间的真诚相待、是团队各司其职尽职尽责、也是员工生日时上的汉堡薯条小龙虾串串香,让我觉得自己十分幸运,也认为自己眼光不错,选择了翻译。

在学校的时候,英汉互译做过一些练习,老师布置的,自己找的,但是所关注的领域和工作中所遇到的全然不同。学习中,老师想的更多是提高学生们的语言水平和翻译技巧,工作中面临的问题绝不仅仅囿于翻译本身,更多的是对综合能力的考察,细心、效率、格式、计算机操作、排版等。

一开始要做各种证件,真的像是打开了新天地的大门。做证件,能翻译姓名性别等信息只是起步,重要的是在信息准确无误的前提下保证排版简洁明了,尽量与原件看齐,这种任务对于我来说是从未体验过的。慢慢地,才发现表格的强大功能,才舍得抛弃惯用的文本框,才发现准确无误地复刻一组数据不是随随便便就能做到的,精神高度集中才不容易出错,做完后更不能就扔到一边,仔细检查才能发现此前忽略的问题。

此外,Trados的大名早有耳闻,自己也曾尝试下载过,为此电脑还安装了一堆莫名其妙的软件,但由于缺乏语料库,后来就作罢了。在这里幸得农老师悉心教导,学会了用Trados来处理银行流水等重复性较高的文件。自己本身就很喜欢学习操作各种软件,在使用Trados过程中,直观地感觉到翻译软件的神奇之处,人工处理流水效率低下,计算机辅助翻译大大地解放了人工且提高了工作效率。机翻取代人工翻译的言论甚嚣尘上,然而翻译软件同人工翻译并不是两个互不融合的对立面,二者的关系并非要谁取代谁,而是要互帮互助。人之所以长于其他生灵,就是因为能较好地利用工具。译员能够长于其他人除了较高翻译水平外应该也是因为译员能够比他人更熟练地操纵翻译工具。前面也曾说过,翻译任务其实不仅仅是翻译本身的行为,其背后的文化因素、审美因素都使得机器翻译不可能单独承载翻译任务。

除了翻译证件和银行流水,有时还会翻译各种证明以及论文。各领域的文件让我感到专业课老师挂在嘴边的那句“Know something about everything”绝非空谈。加强自身的储备,对各种事物保持旺盛的好奇心才能够走得更远。

翻译过程中要对文件中不熟悉的词汇要进行查证,要对模糊的印章证件进行考证,这个过程有时很快就能完成,有时却抓耳挠腮也找不到合适的信息,搜商对于译员来说是一项必备基本素质,如何能快速有效地搜集到想要的信息并对信息进行有效甄别是一项永远都需要学习研究的课题。听了很多前辈的事迹,尤其是于大神与在线医生交流的故事,让我觉得自己在这方面做的很是不足。其一就是整理机打数字时,如果首位数字距离前面的文字距离较近或有重叠部分时,容易漏看第一位数字;其二是对于连笔字体辨别能力不强,此前没有练过连笔字体,所以对连笔字的识别能力亟待提高。

每一件任务都是考验任务接受者的个人素质,仅凭翻译水平绝不能决定任务完成水平。就像李培姐谆谆教诲,工作任务就像木桶,你的粗心就是你的短板,无论翻译水平多高,你的总体水平总是局限在那块板子上。建议非常实际诚恳,我很幸运能收到这样的建议。

翻译的各种文件中,出现了不同的问题。

数字是错误之首,重中之重。数字从来没有像现在这样禁锢住我,以前数学学习上会有不仔细,但问题从未像现在这样大规模地密集地爆发出来。做文件时,各类证件号码安安然躺在冒号后面,似在嘲讽我的没用,在翻译文件时冷不丁伸一脚出来,让我栽一个甚至是数个跟头,甚至栽得鼻青脸肿还在栽。我心底里感谢我的老板同事,因为在我栽跟头时,他们会告诉我怎样去避免栽跟头,他们始终对我抱有期望没有直接放弃我。今后在处理数字问题时,要做到首先做文件时全神贯注专心致志,争取第一遍不要出错,其次要加强检查,检查中着重看数字的对错,每一处都要一一对应。

中英标点问题说实话工作以前从来没有人对我强调过,如果不是从事与文字相关的工作的人,估计很难注意到这二者的区别。但是对这小小标点的执著,正体现了公司的专业精神以及职业素养,是对文字的负责、对客户的负责、也是对自己的负责。得益于在公司中英文标点的训练,在撰写毕业论文时对标点多检查了几遍,导师还有说我论文里中英标点几乎没有什么问题,不像其他同学那样泛滥。在中英文字都存在的文件中,除了翻译文件时要留意标点问题,翻译后对标点进行统一替换有时也可以检查出难以发现的问题。

译文要保持前后一致这点对于译文质量来说也非常重要。就像老板说的:“错也要错的一样,这样有利于你整体改正。”尤其是采用术语的情况下,更不可以只顾自己的翻译习惯,要联系模板或是先前的文件内容,对同一名词(包括但不局限于专有名词)的译法在一批文件里要统一。

进入公司一心想要为公司创造价值不成,却发现自己的错误有可能会给公司造成损失,给他人造成麻烦。别人的时间也是时间,即便是一个错误也会造成不必要的时间、经济和名誉上的浪费损失。这样的译员绝不是一个成熟的专业的译员。翻译能力要提高,工作素养也要提高,想做一个敬业的译员不可以舍弃其中的任何一个。

短时间内没能好好检查文件必然导致后续的时间成本流失,错误的改正是需要时间的。一次性完成既避免了不必要的麻烦,也省去了之后与客户沟通修改的时间。优秀的侦探小说家智商总要比笔下的侦探人物智商要高,译员永远不知道客户能有多仔细认真,所以译员能做的就是在做文件时要比客户更要认真仔细。虽然话说起来容易做起来难,但仍要不断向这个目标努力靠近,改正自己的性格中的缺陷。

错误是我的一个较为失败的开局,但不能让它成为我的影子。即便粗心现在化作标签,也不能让它长久地在我额头上粘下去。问题暴露出来,就要解决问题,迎头而上才不会一辈子都处在问题的阴影之下。以后要多做这一类型的文件,补齐自己的短板,数字暂时处理不好,就多向李培姐索要有关数字的任务;对户口本有心理阴影,就多翻译校对户口本,向农老师学习,多查多看多总结。

过去一个多月里无疑是我一生中最重要的时间段,从学校大门走出来面临着地点与身份的转变,门前门后是不同的世界,很开心能走到翻译的门前。

翻译员实习工作总结(二)

一. 实习目的:

为了使自己更加深入了解英语在社会和实际工作中的应用,丰富已学过的专业课内容,培养理论联系实际的能力,提高在语言应用中分析问题及解决问题的实际能力。为了更好地为完成毕业论文打下基础,为了以后工作的顺利进行。通过实习,还应了解英语在外贸,及涉外和服务行业中的重要地位,了解和积累更多的实践经验,培养热爱专业,献身国家建设的思想。我们使用相关专业课教材,及实习单位提供的相关材料通过参与一个完整的笔译过程(资料,情报翻译)或口译过程(涉外接待,贸易谈判等), 使自己掌握和提高熟练使用英语的技能。

实习单位的介绍:

翻译公司是本市的一家经工商局审批注册的专为国内外各机构和个人提供专业翻译服务的企业。拥有各行业的专业翻译人员、高级审译顾问、外籍专家、审译人员、留学回国人员等组成的优秀工作团队。本公司坚持“以人为本”的指导思想,本着“团结拼搏,勇创一流”的精神,恪守“追求卓越 挑战极限”的原则,积极为焦作地区的经济、文化和对外交流与发展,作出我们应有的贡献。公司长期对外承接的翻译服务有:英、日、法、俄、德、韩、蒙、越南、阿拉伯、西班牙、意大利,等近40种语种与汉语不同形式的笔译,陪同口译,交替传译,同声传译等业务。涉及机械、化工、汽车、金融、文学等各个领域。我们实行的是“翻译—副译审—总译审”的三级质量管理体系。合理的翻译运作流程、严格的质量控制体系、独特的译员审核标准以及完善的跟踪回访服务是我们优质翻译的保证。我们始终信守诚实做人,踏实做事的原则。秉承“竭诚为客户服务”的宗旨,用我们的辛勤工作换来沟通无限和您的微笑。

二.翻译过程的基本环节与具体要求

(一)实际翻译程序可以归纳如下:

1.快速翻译,侧重文体。有些译者认为口述的译文更新颖、更流畅。但无论译者是口述、打字、还是手写,重要的是要使译文节奏流畅;

2.初稿应该保留约一周左右。这样,修订译稿时就可以获得全新的感受,排除翻译初稿时留在耳边的余音,更加客观地评估译文;

3.认真检查译文内容,特别着重译文的准确性和连贯性。删除不必要的增补词语和补充初稿中的疏漏。特别要注意关键概念在翻译上的一致性,理顺拗口的词句;

4.从文体上检查译文。其实,这一步骤应该反复进行多次。朗读译文是一个非常重要的办法,因为听觉对连贯性和节奏感方面的问题比视觉要敏锐得多;

5.检查译文拼写、标点符号和格式。有些译者错误地认为,对译文内容、文体和正字法这三方面的检查可以合并起来一次完成,这种看法是大错特错的。对译文上述三个方面的检查应该分别进行;

6.译文送交三审审阅。

(二)汉译英的具体要求:

1. 符合写作的一切规则

a) 格式要求

i. 拼写正确

ii. 标点正确(英语中不用汉语标点:英语无顿号、逗号是圆点,所有符号语汉语大小不同;逗号后面有空格,前面没有;英语标点和汉语没有必然对应关系)

b) 语法要求

i. 注意每个名词的单复数是否正确

ii. 注意时态是否正确

iii.人称和数是否照应

c) 词和句子的要求

i. 每个单词的意思准确、符合上下文需要

ii. 每个单词的搭配符合英语习惯

iii. 每个动词的句型符合英语习惯

iv. 每个介词的用法符合英语习惯

翻译的三个基本要求是“信”、“达”、“雅”。“信”要求忠实原文的内容和每个句子的含义,用现代汉语字字落实、句句落实直译出来,不得随意地增减内容。“达”要求翻译出的现代文要表意明确、语言通顺、语气不走样。“雅”要求用简明、优美、富有文采的现代汉语把原文的内容、形式及风格准确地表达出来。

(三)在翻译中遇到的困难及其分析:

基于翻译的具体要求,我还不能完全达到这种水平,虽然可以句句落实直译出来,做到不随意增减内容,但却做不到“达”的要求,翻译出的材料表意不明确,译不出原材料的那种语气,“雅”的要求更是离的太远,还有涉及到专业性的材料就会觉得一头雾水,不知从何下手,此翻彼翻都觉得不太贴切。

在中国青年报上看到这样一则消息:把“保税仓库”译为“保证税收的仓库”,“五四运动”成了“五四体育运动”……译文中国人看不懂外国人不明白——

“一个英语专业8级的大学毕业生,语法结构错误百出,认为‘小康’就是‘富有’,译文做成中英文字符的简单对应……”说起前两天来应聘翻译职位的一位大学毕业生的表现,北京一家翻译公司的负责人直摇头。其实,考试的题目并不是很难——一段关于“我国实行按劳分配制度,允许和支持一部分人通过诚实劳动先富起来”的100字左右的中译英试题。这家翻译公司的负责人说,像这样拿着英语专业8级证书,却当不了合格翻译的大学毕业生,并非极端个别的例子。现在合格的翻译太少了。

伴随着中国加入世贸组织,对外交流的日益频繁,翻译人才的缺口越来越大。业内专家表示,翻译市场巨大,合格翻译人才紧缺,学了外语就能当翻译的老观念该改一改了。

这则消息正说明了一个现实问题,我深有体会,我们在工作中翻译用词不准确,专业领域背景知识缺乏,写作水平又差,真觉得不能胜任翻译工作。把“数控发电机”译成“数字化发电机”,把“保税仓库”译为“保证税收的仓库”,这样的例子比比皆是。由于历史背景和专有名词的缺乏,单纯从字面意思出发,把“五四运动”中的“运动”直译为“Sport”(即体育运动),这样的笑话也出了不少。由于自己的中文基础不扎实,词汇变化少,语言贫乏,翻译出来的东西语言不通顺。外语的学习则是从认知语言学起,我们掌握了大量的词汇、语法后,再串成句子连成段落。老师在讲述外语的过程中不可能一篇文章或一段话地讲解,学习效果很不地道。学完外语专业只能表示具备翻译行为,而并不具备职业翻译能力。换句话说,学完外语专业不是就能做翻译了。本科生在大学学习阶段,大多没有接触过系统的翻译课程训练,即使有翻译课程也是在大三下学期或大四才开课。没有平时的训练怎么能成为合格的翻译呢?由于高等教育的日益普及,本科教育已不是终端教育。学生在本科阶段主要打好语言基础,在研究生阶段进行集中翻译学习培训。专家普遍认为,要成为一名合格的翻译,需要在本科毕业后,用2至3年进行专门的翻译课程学习,在工作中磨练若干年,并学习相关的专业知识和术语等。

三.那么在以后的学习和工作中怎样才能做一名合格翻译呢,具体有一下几点需要注意:

1.扎实的语言基本功。一名优秀的译员应具备良好的英语修养和扎实的汉语基本功,掌握英汉两种语言的特点和互译规律,拥有快速、准确地遣词造句的能力。译员要有良好的语音基本功,掌握英汉两种语言基础,敏锐的听力,超常的词汇量,良好的语感,灵活的表达能力以及广阔语言文化背景知识。需要特别强调的是译员的听力理解能力,他是口译成败的一个关键因素,也是一名译员的综合语言和知识水平的反映。

2.广博的知识面。译员光有扎实的语言基本功是远远不够的。常常有译员因缺乏主题知识或百科知识而出现“卡壳”的现象。译员的接触面很广,接待的对象在职业、年龄、身份、阶层、志趣、爱好、生活习惯、民族性格、社会习俗、宗教信仰等方面都会有很大的差异,随时随地都有可能遇到各种话题。因此,译员必须掌握丰富全面的百科知识,例如专业常识、社会常识、法规政策常识、国际常识以及背景知识、国情地情、风土人情、名胜古迹、花草树木、昆虫动物等百科知识,拥有较高的文化修养,能上知天文、下通地理、博古通今,并熟悉各行各业,努力做一个“杂家”或“万事通”。

3.出众的记忆力。译员需要有非凡的记忆力,这一点是由口译工作的特点所决定的。首先,译员在口译过程中不可能有机会查阅词典和工具书,或请教别人,因此,译员必须记住大量的词汇(包括专业词汇)、成语、典故和缩略词等。其次,译员要把讲话人所讲的内容准确详尽地用另一种语言表达出来,也必须有相当好的记忆力。

4.口齿要清楚。

5.严谨的工作作风。

6.良好的心理素质。

四.实习收获及总结:

经过为期两个月的实习,我学到很多东西知道了翻译的具体过程和基本要求,了解到自己不足的地方,清楚了自己应向哪个方面努力。在实习期间从事大量中英文文字翻译,例如各种出国证明书(出生证明,亲属证明,成绩单等),合同,财务报表,公司章程及法律文件。以后,我在学习上应理论联系实际,从点到面的全面学习,避免拿以前应付考试的态度来学习;在工作中应该实事求是,细心认真的独立完成自己的工作,并要培养与人协作的精神;在生活中就我个人而言应学会更好的与人相处和沟通,即将离开学校走入社会,我必须更好的完善自己的性格。

我是一名大三翻译专业的学生,在大三的上半年里我们进行了童谣翻译物联网翻译和文学翻译,学到了很多东西,我们每个小组平均有4.5个人左右,把我们近一年所学的基本的英汉互译知识和方法全面地结合起来,经过三年的英语学习,大家的英语水平都有了很大的提高。在这次的翻译实习过程中,我虽然遇到很多困难,但也收获颇丰使我们能相对忠实、准确、流畅地将各种文体进行英汉互译,以此提高自身翻译各种文本

的实际能力。

老师给了我们份小说英文材料,包括前言和三章内容。我们实习的任务是完成所有

材料的翻译。我们计划将所有材料在一周内翻译完成。

翻译是一门必须亲自动手实践的课程。不亲自动手,翻译水平如何就永远无法得知,也永远提高不了。这次的翻译实习暴露了我在翻译上的缺点和不足,也为我今后的努力指明了方向。在今后的学习过程中,我会针对不足之处加以训练,并且多读多看各方面书籍和新闻来扩大自己的知识面。这不仅仅是翻译的要求,对于提高我们的自身素质也很重要。 我们的主要任务是进行英译汉和汉译英的翻译实践,为此在实践的过程中,我总结了四种必备的翻译工具:一是灵格斯翻译工具,里面可安装各式的词典;二是百度搜索工具;三是有道词典;四是英汉词典;五是汉英词典。翻译的过程如下:首先可以现在灵格斯里查询不懂的单词和词组,寻找最符合原文的解释。然后采取同时在百度和有道词典搜索的做法,并对同种搜索工具搜索结果进行比较。他们有着各自的优缺点。所以我们最后用到的就是英汉和汉英辞典,可以对我们翻译之中的词汇,进行最后的确认,确定出最最准确的译法。 在翻译过程中也遇到到了一些困难,这说明在漫漫的英语学习过程中我还要继续努力。学如逆水行舟,不进则退,只要每天我认真学习,那就是一种进步。人生总归会有许多挫折,但我们若不跨过这道坎,就不会有进步,滞留不前。我们要用有限的生命创造无限的价值,勇敢面对每一个挑战。

翻译是运用一种语言把另一种语言所表达的思维内容准确而完整地表达出来的语言行为。当然纸上谈兵是无稽之谈,光有理论知识而不实践操作也是没有用的。有位翻译家这么说过,“学翻译犹如学游泳。只在岸边看别人游,或只听教练讲解,是学不会的。”所以要想提高自己的翻译能力,一定要通过实践。实践可以分为两类,直接的实践和间接的实践。 所谓直接的实践,就是自己亲身参加的实践,也就是自己动手翻译。一回生,二回熟,日积月累,第一手经验多了,做起来得心应手,翻译能力有所提高。所谓“熟能生巧”,就是这个道理。但自己能译的东西是有限的,从这种实践中得出的经验也是有限的。因此,还需要借助于间接的实践。 所谓间接的实践,就是研究别人的译文。比如,一篇文章在手,准备翻译,这时先找一些有关的资料或同类文章的译文看一看,在词语和风格方面定会有所借鉴。别人的译文是别人直接实践的产物,看了别人的译文,就是从事间接实践。为了通过实践,总结自己的不足,以便在今后的语言实践中自己翻译水平和能力能够得到相应的提高和发展,我在完成计划工作后,我开始了我的翻译实习工作。

其一是加强沟通能力。专业知识固然重要,但良好的沟通能力是让别人发现你能力的前提。如果以后将从事商务方面的工作这点更为重要。表面上看来,它只是一种能说会道的能力,可实际上它却包罗了一个人从穿衣打扮到言谈举止等一切行为的能力。

其二是要发扬团队精神,不论是在学校生活还是在社会生活中,只要是处在一个集体中这一点都会起到非常重要的作用。而因为是独生子女的关系,在这一方面我做的很不够。

其三是要加强英语的学习。作为自己的专业,在这样的小城市中虽然因为就业面太窄可能无法频繁的应用,但却可以成为我的优势。但在实习的过程中这个优势却并不突出,这都是因为我的专业水平有待提高。

在今后的学习,我要通过扩大词汇量增大阅读面来提高自己的英语水平。并且要拿到大学英语四极证,否则作为英语专业的学生就太没有说服力了。这样就会在我求职的过程中增加一快很有分量的砝码。

一.实习目的:

为了使自己更加深入了解英语在社会和实际工作中的应用,丰富已学过的专业课内容,培养理论联系实际的能力,提高在语言应用中分析问题及解决问题的实际能力。为了更好地为完成毕业论文打下基础,为了以后工作的顺利进行。通过实习,还应了解英语在外贸,及涉外和服务行业中的重要地位,了解和积累更多的实践经验,培养热爱专业,献身国家建设的思想。我们使用相关专业课教材,及实习单位提供的相关材料通过参与一个完整的笔译过程(资料,情报翻译)或口译过程(涉外接待,贸易谈判等), 使自己掌握和提高熟练使用英语的技能。

二.翻译过程的基本环节与具体要求

(一)实际翻译程序可以归纳如下:

1.快速翻译,侧重文体。有些译者认为口述的译文更新颖、更流畅。但无论译者是口述、打字、还是手写,重要的是要使译文节奏流畅;

2.初稿应该保留约一周左右。这样,修订译稿时就可以获得全新的感受,排除翻译初稿时留在耳边的余音,更加客观地评估译文;

3.认真检查译文内容,特别着重译文的准确性和连贯性。删除不必要的增补词语和补充初稿中的疏漏。特别要注意关键概念在翻译上的一致性,理顺拗口的词句;

4.从文体上检查译文。其实,这一步骤应该反复进行多次。朗读译文是一个非常重要的办法,因为听觉对连贯性和节奏感方面的问题比视觉要敏锐得多;

5.检查译文拼写、标点符号和格式。有些译者错误地认为,对译文内容、文体和正字法这三方面的检查可以合并起来一次完成,这种看法是大错特错的。对译文上述三个方面的检查应该分别进行;

6.译文送交三审审阅。

(二)汉译英的具体要求:

1. 符合写作的一切规则

a) 格式要求

i. 拼写正确

ii. 标点正确(英语中不用汉语标点:英语无顿号、逗号是圆点,所有符号语汉语大小不同;逗号后面有空格,前面没有;英语标点和汉语没有必然对应关系)

b) 语法要求

i. 注意每个名词的单复数是否正确

ii. 注意时态是否正确

iii.人称和数是否照应

c) 词和句子的要求

i. 每个单词的意思准确、符合上下文需要

ii. 每个单词的搭配符合英语习惯

iii. 每个动词的句型符合英语习惯

iv. 每个介词的用法符合英语习惯

翻译的三个基本要求是“信”、“达”、“雅”。“信”要求忠实原文的内容和每个句子的含义,用现代汉语字字落实、句句落实直译出来,不得随意地增减内容。“达”要求翻译出的现代文要表意明确、语言通顺、语气不走样。“雅”要求用简明、优美、富有文采的现代汉语把原文的内容、形式及风格准确地表达出来。

(三)在翻译中遇到的困难及其分析:

基于翻译的具体要求,我还不能完全达到这种水平,虽然可以句句落实直译出来,做到不随意增减内容,但却做不第一文库网到“达”的要求,翻译出的材料表意不明确,译不出原材料的那种语气,“雅”的要求更是离的太远,还有涉及到专业性的材料就会觉得一头雾水,不知从何下手,此翻彼翻都觉得不太贴切。

在中国青年报上看到这样一则消息:把“保税仓库”译为“保证税收的仓库”,

“五四运动”成了“五四体育运动”„„译文中国人看不懂外国人不明白——

“一个英语专业8级的大学毕业生,语法结构错误百出,认为‘小康’就是‘富有’,译文做成中英文字符的简单对应„„”说起前两天来应聘翻译职位的一位大学毕业生的表现,北京一家翻译公司的负责人直摇头。其实,考试的题目并不是很难——一段关于“我国实行按劳分配制度,允许和支持一部分人通过诚实劳动先富起来”的100字左右的中译英试题。这家翻译公司的负责人说,像这样拿着英语专业8级证书,却当不了合格翻译的大学毕业生,并非极端个别的例子。现在合格的翻译太少了。

伴随着中国加入世贸组织,对外交流的日益频繁,翻译人才的缺口越来越大。业内专家表示,翻译市场巨大,合格翻译人才紧缺,学了外语就能当翻译的老观念该改一改了。

这则消息正说明了一个现实问题,我深有体会,我们在工作中翻译用词不准确,专业领域背景知识缺乏,写作水平又差,真觉得不能胜任翻译工作。把“数控发电机”译成“数字化发电机”,把“保税仓库”译为“保证税收的仓库”,这样的例子比比皆是。由于历史背景和专有名词的缺乏,单纯从字面意思出发,把“五四运动”中的“运动”直译为“Sport”(即体育运动),这样的笑话也出了不少。由于自己的中文基础不扎实,词汇变化少,语言贫乏,翻译出来的东西语言不通顺。外语的学习则是从认知语言学起,我们掌握了大量的词汇、语法后,再串成句子连成段落。老师在讲述外语的过程中不可能一篇文章或一段话地讲解,学习效果很不地道。学完外语专业只能表示具备翻译行为,而并不具备职业翻译能力。换句话说,学完外语专业不是就能做翻译了。本科生在大学学习阶段,大多没有接触过系统的翻译课程训练,即使有翻译课程也是在大三下学期或大四才开课。没有平时的训练怎么能成为合格的翻译呢?由于高等教育的日益普及,本科教育已不是终端教育。学生在本科阶段主要打好语言基础,在研究生阶段进行集中翻译学习培训。专家普遍认为,要成为一名合格的翻译,需要在本科毕业后,用2至3年进行专门的翻译课程学习,在工作中磨练若干年,并学习相关的专业知识和术语等。

三.那么在以后的学习和工作中怎样才能做一名合格翻译呢,具体有一下几点需要注意:

1.扎实的语言基本功。一名优秀的译员应具备良好的英语修养和扎实的汉语基本功,掌握英汉两种语言的特点和互译规律,拥有快速、准确地遣词造句的能力。译员要有良好的语音基本功,掌握英汉两种语言基础,敏锐的听力,超常的词汇量,良好的语感,灵活的表达能力以及广阔语言文化背景知识。需要特别强调的是译员的听力理解能力,他是口译成败的一个关键因素,也是一名译员的综合语言和知识水平的反映。

2.广博的知识面。译员光有扎实的语言基本功是远远不够的。常常有译员因缺乏主题知识或百科知识而出现“卡壳”的现象。译员的接触面很广,接待的对象在职业、年龄、身份、阶层、志趣、爱好、生活习惯、民族性格、社会习俗、宗教信仰等方面都会有很大的差异,随时随地都有可能遇到各种话题。因此,译员必须掌握丰富全面的百科知识,例如专业常识、社会常识、法规政策常识、国际常识以及背景知识、国情地情、风土人情、名胜古迹、花草树木、昆虫动物等百科知识,拥有较高的文化修养,能上知天文、下通地理、博古通今,并熟悉各行各业,努力做一个“杂家”或“万事通”。

3.出众的记忆力。译员需要有非凡的记忆力,这一点是由口译工作的特点所决定的。首先,译员在口译过程中不可能有机会查阅词典和工具书,或请教别人,因此,译员必须记住大量的词汇(包括专业词汇)、成语、典故和缩略词等。其次,译员要把讲话人所讲的内容准确详尽地用另一种语言表达出来,也必须有相当好的记忆力。

4.口齿要清楚。

5.严谨的工作作风。

6.良好的心理素质。

四.实习收获及总结:

经过为期两个月的实习,我学到很多东西知道了翻译的具体过程和基本要求,了解到自己不足的地方,清楚了自己应向哪个方面努力。在实习期间从事大量中英文文字翻译,例如各种出国证明书(出生证明,亲属证明,成绩单等),合同,财务报表,公司章程及法律文件。以后,我在学习上应理论联系实际,从点到面的全面学习,避免拿以前应付考试的态度来学习;在工作中应该实事求是,细心认真的独立完成自己的工作,并要培养与人协作的精神;在生活中就我个人而言应学会更好的与人相处和沟通,即将离开学校走入社会,我必须更好的完善自己的性格。

海洋运输货物保险条款(附英文

一、责任范围

本保险分为平安险、水渍险及一切险三种。被保险货物遭受损失时,本保险按照保险单上订明承保险别的条款规定,负赔偿责任。

(一)平安险。本保险负责赔偿:

1、被保险货物在运输途中由于恶劣气候、雷电、海啸、地震、洪水自然灾害造成整批货物的全部损失或推定全损。当被保险人要求赔付推定全损时,须将受损货物及其权利委付给保险公司。被保险货物用驳船运往或运离海轮的,每一驳船所装的货物可视作一个整批。推定全损是指被保险货物的实际全损已经不可避免,或者恢复、修复受损货物以及运送货物到原订目的地的费用超过该目的地的货物价值。

2、由于运输工具遭受搁浅、触礁、沉没、互撞、与流冰或其他物体碰撞以及失火、爆炸意外事故造成货物的全部或部份损失。

5、被保险人对遭受承保责任内危险的货物采取抢救、防止或减少货损的措施而支付的合理费用,但以不超过该批被救货物的保险金额为限。

6、运输工具遭遇海难后,在避难港由于卸货所引起的损失以及在中途港,避难港由于卸货,存仓以及运送货物所产生的特别费用。

7、共同海损的牺牲、分摊和救助费用。

8、运输契约订有“船舶互撞责任”条款,根据该条款规定应由货方偿还船方的损失。

(二)水渍险。除包括上列平安险的各项责任外,本保险还负责被保险货物由于恶劣气候、雷电、海啸、地震、洪水自然灾害所造成的部份损失。

(三)一切险。除包括上列平安险和水渍险的各项责任外,本保险还负责被保险货物在运输途中由于外来原因所致的全部或部分损失。

二、除外责任

本保险对下列损失不负赔偿责任:

(一)被保险人的故意行为或过失所造成的损失。

(二)属于发货人责任所引起的损失。

(三)在保险责任开始前,被保险货物已存在的品质不良或数量短差所造成的损失。

(四)被保险货物的自然损耗、本质缺陷、特性以及市价跌落;运输迟延所引起的损失或费用。

(五)本公司海洋运输货物战争险条款和货物运输罢工险条款规定的责任范围和除外责任。

三、责任起讫

(一)本保险负“仓至仓”责任,自被保险货物运离保险单所载明的起运地仓库或储存处所开始运输时生效,包括正常运输过程中的海上、陆上、内河和驳船运输在内,直至该项货物到达保险单所载明目的地收货人的最后仓库或储存处所或被保险人用作分配、分派或非正常运输的其他储存处所为止。如末抵达上述仓库或储存处所,则以被保险货物在最后卸载港全部卸离海轮后满六十天为止。如在上述六十天内被保险货物需转运到非保险单所载 明的目的地时,则以该项货物开始转运时终止。

(二)由于被保险人无法控制的运输延迟、绕道、被迫卸货、重行装载、转载或承运人运用运输契约赋予的权限所作的任何航海上的变更或终止运输契约,致使被保险货物运到非保险单所载明目的地时,在被保险人及时将获知的情况通知保险人,并在必要时加缴保险费的情况下,本保险仍继续有效,保险责任按下列规定终止。

1、被保险货物如在非保险单所载明的目的地出售,保险责任至交货时为止,但不论任何情况下,均以被保险货物在卸载港全部卸离海轮后满六十天为止。

2、被保险货物如在上述六十天期限内继续运往保险单所载原目的地或其他目的地时,保险责任仍按上述第(一)款的规定终止。

四、被保险人的义务

被保险人应按照以下规定的应尽义务办理有关事项,如因未履行规定的义务而影响保险人利益时,本公司对有关损失,有权拒绝赔偿。

(一)当被保险货物运抵保险单所载明的目的港(地)以后,被保险人应及时提货,当发现被保险货物遭受任何损失,应即向保险单上所载明的检验、理赔代理人申请检验,如发现被保险货物整件短少或有明显残损痕迹应即向承运人、受托人或有关当局(海关、港务当局等)索取货损货差证明。如果货损货差是由于承运人、受托人或其他有关方面的责任所造成,并应以书面方式向他们提出索赔,必要时还须取得延长时效的认证。

(二)对遭受承保责任内危险的货物,被保险人和本公司都可迅速采取合理的抢救措施,防止或威少货物的损失,被保险人采取此项措施,不应视为放弃委付的表示,本公司采取此项措施,也不得视为接受委付的表示。

(三)如遇航程变更或发现保险单所载明的货物、船名或航程有遗漏或错误时,被深险人应在获悉后立即通知保险人并在必要时加缴保险费,本保险才继续有效。

(四)在向保险人索赔时,必须提供下列单证:

保险单正本、提单、发票、装箱单、磅码单、货损货差证明、检验报告及索赔清单。如涉及第三者责任,还须提供向责任方追偿的有关函电及其他必要单证或文件。

(五)在获悉有关运输契约中“船舶互携责任”条款的实际责任后,应及时通知保险人。

五、索赔期限

本保险索赔时效,认被保险货物在最后卸裁港全部卸离海轮后起算,最多不超过二年。

附件

ocean marine cargo clauses

(i)scope of cover:

this insurance is classified into the following three conditions- free from particular average (f. p. a. ), with average (w. a. ) and all risks. where the goods insured hereunder sustain loss or damage , the company shall undertake to indemnify therefor according to the insured condition specified in the policy and the provisions of these clauses :

1. free from particular average (f. p. a. ).this insurance covers :

1)total or constructive total loss of the whole consignment hereby insured caused in the course of transit by natural calamities: heavy weather, lightning, tsunami, earthquake and flood. in case a constructive total loss is claimed for, the insured shall abandon to the company the damaged goods and all his rights and title pertaining thereto. the goods on each lighter to or from the seagoing vessel shall be deemed a separate risk. constructive total loss refers to the loss where an actual total loss appears to be unavoidable or the cost to be incurred in recovering or reconditioning the goods together with the forwarding cost to the destination named in the policy would exceed their value on arrival.

2)total or partial loss caused by accidents the carrying conveyance being grounded, stranded, sunk or in collision with floating ice or other objects as fire or explosion .

3)partial loss of the insured goods attributable to heavy weather, lightning and/or tsunami, where the conveyance has been grounded, stranded, sunk or burnt. irrespective of whether the event or events took place or after such accidents.

4)partial of total loss consequent on falling of entire package or packages into sea during loading, transshipment or discharge.

5)reasonable cost incurred by the insured on salvaging the goods or averting or minimizing a loss recoverable under the policy, provided that such cost shall not exceed the sum insured of the consignment so saved.

6)losses attributable to discharge of the insured goods at a pert of distress following a sea peril as well as special charges arising from loading, warehousing and forwarding of the goods at an intermediate port of call or refuge.

7)sacrifice in and contribution to general average and salvage charges.

8)such proportion of losses sustained by the shipowners as is to be reimbursed by the cargo owner under the contract of affreightment both to blame collision clause.

2. with average(w. a. ). aside from the risks covered under f. p. a. condition as above, this insurance also covers partial losses of the insured goods caused by heavy weather , lightning, tsunami , earthquake and/or flood.

3. all risks. aside from the risks covered under the f. p. a. and w. a. conditions as above, this insurance also cover all risks of loss of or damage to the insured goods whether partial or total, arising from external causes in the cause of transit.

(ii)exclusions:

this insurance does not cover : .

1. loss or damage caused by the intentional act or fault of the insured.

2. loss or damage falling under the liability of the consignor.

3. loss or damage arising from the inferior quality or shortage of the insured goods prior to the attachment of this insurance.

4. loss or damage arising from normal loss, inherent vice or nature of the insured goods , loss of market and/or delay in transit and any expenses arising there from..

5. risks and liabilities covered and excluded by the ocean marine (cargo) war risks clauses and strike , riot and civil commotion clauses of this company.

(iii)commencement to termination of cover:

1. warehouse to warehouses clause :

this insurance attaches from the time the goods hereby insured leave the ware-house or place of storage named in the policy for the commencement of the transit and continues in force in the ordinary course of transit including sea , land and inland waterway transits and transit in lighter until the insured goods are delivered to the consignee s final warehouse or place of storage at the destination named in the policy or to any other place used by the insured for allocation or distribution of the goods or for stories other than in the ordinary course of transit. this insurance shall., however , be limited to sixty (60) days after completion of discharge of the insured goods from the seagoing vessel at the final port of discharge before they reach the above mentioned warehouse or place of stories. if prior to the expire of the above mentioned sixty ( 60) days , the insured goods are to be forwarded to a destination other than that named in the policy , this insurance shall terminate at the commencement of such transit.

2. if, owing to delay , deviation , forced discharge , reshipment or transshipment beyond the control of the insured or any change or termination of the voyage arising from the exercise of a liberty granted to the shipowners under the contract of affreightment, the insured goods arrive at a port or place other than that named in the policy, subject to immediate notice being given to the company by the insured and an additional premium being paid, if repaired, this insurance shall remain in force and shall terminate as hereunder :

1)if the insured goods are sold at port or place not named in the policy , this insurance shall terminate on delivery of the goods sold, but in no event shall this insurance extend beyond sixty (60) days after completion of discharge of the insured goods from the carrying vessel at such port or place.

2)if the insured goods are to be forwarded to the final destination named in the policy or any other destination, this insurance shall terminate in accordance with section 1 above.

(iv)duty of the insured:

it is the duty of the insured to attend to all matters as specified hereunder , failing which the company reserves the right to reject his claim for any loss if and when such failure prejudice the rights of the company :

1. the insured shall take delivery of the insured goods in good time upon their arrival at the port of destination named in the policy. in the event of any damage to the goods, the insured shall immediately apply for survey to the survey and/or settling assent stipulated in the policy. if the insured goods are found short in entire package or packages or to show apparent traces of damage , the insured shall obtain from the carrier, bailed or other relevant authorities (customs and port authorities etc. ) certificate of loss or damage and/or sbortlanded memo. should the carrier, bailed or the other relevant authorities be responsible for such shortage, the insured shall lodge a claim with them in writing and , if necessary , obtain their confirmation of an extension of them the time limit of validity of such claim.

2. the insured shall , and the company also, take reasonable measures immediately in salvaging the goods or preventing or minimizing a loss or damage thereto. the measures so taken by the insured or by the company shall not be considered respectively, as a waiver of abandonment hereunder , or as an acceptance thereof.

3. in case of a change of voyage or any omission or error in the description of the interest , the name of the vessel or voyage, this insurance shall remain in force only upon prompt notice to this company when the insured becomes aware of the same and payment of an additional premium if required.

4. the following documents should accompany any claim hereunder made against this company :

original policy, bill of lading. invoice, packing list, tally sheet, weight memo, certificate of loss or damage and/or shorthand memo, survey report, statement of claim.

if any third party is involved , documents relative to pursuing of recovery from such party should also be included.

5. immediate notice should be given to the company when the cargo owners actual responsibility under the contract of affreightment n both to blame collision clause becomes known..

(v)the time of validity of a claim :

the time of validity of a claim under this insurance shall not exceed a period of two years counting from the time of completion of discharge of the insured goods from the seagoing vessel at the final port of discharge.

The end of the year is often a time of many events -- wrapping up business for the year while also wrapping holiday presents. This article presents something you can give to yourself -- something that you can get done during the holiday lull or over some vacation days -- a quick and easy process for examining what youve accomplished in your career this year and where you want to go with it next year.

Of course, you may have already done at least some preliminary work on reviewing the year -- especially if your employer hands out year-end bonuses or conducts year-end performance reviews -- and if so, thats a good place to start your year-end review.

But unlike your on-the-job performance review, the purpose of this article is to suggest you consider conducting an even more important assessment -- taking stock of your career. Now is the perfect time to review where you are, where youve been, and where you want to go.

Before you begin your assessment, take a moment to ask yourself the most important question: Am I happy and fulfilled by my job and career? No matter how successful youve been in the past 11 months, if you are fundamentally unhappy with your work, spend the vast majority of

Dont rush your review. Consider using a weekend or one or more of your vacation days to reflect on your career. You dont need to -- and probably shouldnt -- complete all six steps in one sitting. Break it up over several days if you like.

Step One: Review Career Goals. Did you set any goals for your career this year -- formally or informally? Most people have some idea of what they want to accomplish next in their careers, such as getting a promotion and/or raise or perhaps achieving better work/life balance. Setting some goals is an important activity because goals help provide the focus you need to move your career forward -- and to avoid distractions or activities that may slow your career progress (or worse, devalue you). So, if you had any goals for this year, answer these questions:

* Did I achieve my career goals?

* Am I satisfied with what I did relative to my goals?

* Did anything happen to change my goals over the course of the year?

* How should I modify my goals for next year?

Step Two: Review Your Career Year. What have you done this year? This step is about documenting your career progression and identifying key achievements. Thinking about all youve done over the past 11 months or so, ask yourself these questions:

* What have I accomplished?

* What new skills have I acquired?

* What have I learned?

* What opportunities were gained and lost?

* How am I better today than I was at the beginning of the year?

Step Three: Develop Your Career Synopsis. Where are you in your career? Review all aspects of your career and examine where you stand at this juncture. Some questions to ask yourself:

* Am I where I should be in my career?

* What has helped or hindered my progression?

* Am I happy with my current employer?

* What are my strengths and weakness?

Step Four: Envision Your Future. Whats your next career step? Take some time to plan for next year (and perhaps beyond), picturing the path you want your career to take. Again, here are some questions to help you:

* What do I want to be doing more of in my career?

* What do I want to be doing less of in my career?

* Whats the next step in my career?

* When should I be taking this next step?

* Whats my ideal/ultimate career dream?

Step Five: Action Steps for Your Future. How will you get to that future career? Make a list of what you need to do -- career goals for the coming year -- to get to where you want to be next in your career. These might be things such as building your network, gaining additional experiences, changing employers, strengthening your career brand, or pursuing additional training/education/certifications. Questions to ask yourself:

* What do I need to prepare myself for this next step?

* Do I need to find a new employer to make the next step?

* How do I position myself for this next step?

Step Six: Share Your Career Vision. Are your career goals and action plans feasible? Schedule a meeting with your mentors and to get reactions to your plan, as well as advice for achieving it.

Final Thoughts

Once youve completed these six steps, you should not only know yourself and your career better, but have some specific goals and action steps to help you progress along a career plan.

Another benefit from completing this year-end review is that the results from part of the analysis should assist you in updating your resume if you have not been keeping it current as the year progressed. Even if you are extremely happy with your employer, it makes sense to have a current resume for that once-in-a-lifetime opportunity, or worse, if your employer decides its time to downsize the workforce.

Contract No: Date: The Buyer: The Seller: The Contract, made out, in Chinese and English, both version being equally authentic, by and between the Seller and the Buyer whereby the Seller agrees to sell and the Buyer agrees to buy the undermentioned goods subject to terms and conditions set forth hereinafter as follows: 「章名」 SECTION 1 1 Name of Commodity and specification 2 Country of Origin & Manufacturer 3 Unit Price (packing charges included) 4 Quantity 5 Total Value 6 Packing (seaworthy) 7 Insurance (to be covered by the Buyer unless otherwise) 8 Time of Shipment 9 Port of Loading 10 Port of Destination mark shown as below in addition to the port of destination, package number, gross and net weights, measurements and other marks as the Buyer may require stencilled or marked conspicuously with fast and unfailing pigments on each package. In the case of dangerous and/or poisonous cargo (es), the Seller is obliged to take care to ensure that the nature and the generally adopted symbol shall be marked conspicuously on each package. 12 Terms of Payment: One month prior to the time of shipment the Buyer shall open with the Bank of _______an irrevocable Letter of Credit in favour of the Seller payable at the issuing bank against presentation of documents as stipulated under Clause 18. A. of SECTION II, the Terms of Delivery of this Contract after departure of the carrying vessel. The said Letter of Credit shall remain in force till the 15th day after shipment. 13 Other Terms: Unless otherwise agreed and accepted by the Buyer, all other matters related to this contract shall be governed by Section II, the Terms of Delivery which shall form an integral part of this Contract. Any supplementary terms and conditions that may be attached to this Contract shall automatically prevail over the terms and conditions of this Contract if such supplementary terms and conditions come in conflict with terms and conditions herein and shall be binding upon both parties. FOR THE SELLER FOR THE BUYER 「章名」 SECTION 2 「章名」 14 FOB/FAS TERMS 14.1 The shipping space for the contracted goods shall be booked by the Buyer or the Buyer‘s shipping agent __________. 14.2 Under FOB terms, the Seller shall undertake to load the contracted goods on board the vessel nominated by the Buyer on any date notified by the Buyer, within the time of shipment as stipulated in Clause 8 of this Contract. 14.3 Under FAS terms, the Seller shall undertake to deliver the contracted goods under the tackle of the vessel nominated by the Buyer on any date notified by the Buyer, within the time of shipment as stipulated in Clause 8 of this Contract. 14.4 10-15 days prior to the date of shipment, the Buyer shall inform the Seller by cable or telex of the contract number, name of vessel, ETA of vessel, quantity to be loaded and the name of shipping agent, so as to enable the Seller to contact the shipping agent direct and arrange the shipment of the goods. The Seller shall advise by cable or telex in time the Buyer of the result thereof. Should, for certain reasons, it become necessary for the Buyer to replace the named vessel with another one, or should the named vessel arrive at the port of shipment earlier or later than the date of arrival as previously notified to the Seller, the Buyer or its shipping agent shall advise the Seller to this effect in due time. The Seller shall also keep in close contact with the agent or the Buyer. 14.5 Should the Seller fail to load the goods on board or to deliver the goods under the tackle of the vessel booked by the Buyer. Within the time as notified by the Buyer, after its arrival at the port of shipment the Seller shall be fully liable to the Buyer and responsible for all losses and expenses such as dead freight, demurrage. Consequential losses incurred upon and/or suffered by the Buyer. 14.6 Should the vessel be withdrawn or replaced or delayed eventually or the cargo be shutout etc., and the Seller be not informed in good time to stop delivery of the cargo, the calculation of the loss in storage expenses and insurance premium thus sustained at the loading port shall be based on the loading date notified by the agent to the Seller (or based on the date of the arrival of the cargo at the loading port in case the cargo should arrive there later than the notified loading date)。 The abovementioned loss to be calculated from the 16th day after expiry of the free storage time at the port should be borne by the Buyer with the exception of Force Majeure. However, the Seller shall still undertake to load the cargo immediately upon the carrying vessel‘s arrival at the loading port at its own risk and expenses. The payment of the afore-said expenses shall be effected against presentation of the original vouchers after the Buyer’s verification. 「章名」 15 C&F Terms 15.1 The Seller shall ship the goods within the time as stipulated in clause 8 of this Contract by a direct vessel sailing from the port of loading to China port. Transhipment on route is not allowed without the Buyer‘s prior consent. The goods shall not be carried by vessels flying flags of countries not acceptable to the Port Authorities of China. 15.2 The carrying vessel chartered by the Seller shall be seaworthy and cargoworthy. The Seller shall be obliged to act prudently and conscientiously when selecting the vessel and the carrier when chartering such vessel. The Buyer is justified in not accepting vessels chartered by the Seller that are not members of the PICLUB. 15.3 The carrying vessel chartered by the Seller shall sail and arrive at the port of destination within the normal and reasonable period of time. Any unreasonable aviation or delay is not allowed. 15.4 The age of the carrying vessel chartered by the Seller shall not exceed 15 years. In case her age exceeds 15 years, the extra average insurance premium thus incurred shall be borne by the Seller. Vessel over 20 years of age shall in no event be acceptable to the Buyer. 15.5 For cargo lots over 1,000 M/T each, or any other lots less than 1,000 metric tons but identified by the Buyer, the Seller shall, at least 10 days prior to the date of shipment, inform the Buyer by telex or cable of the following information: the contract number, the name of commodity, quantity, the name of the carrying vessel, the age, nationality, and particulars of the carrying vessel, the expected date of loading, the expected time of arrival at the port of destination, the name, telex and cable address of the carrier. 15.6 For cargo lots over 1,000 M/T each, or any other lots less than 1,000 metric tons but identified by the Buyer, the Master of the carrying vessel shall notify the Buyer respectively 7 (seven) days and 24 (twenty-four) hours prior to the arrival of the vessel at the port of destination, by telex or cable about its ETA (expected time of arrival), contract number, the name of commodity, and quantity. 15.7 If goods are to be shipped per liner vessel under liner Bill of Lading, the carrying vessel must be classified as the highest ____________ or equivalent class as per the Institute Classification Clause and shall be so maintained throughout the duration of the relevant Bill of Lading. Nevertheless, the maximum age of the vessel shall not exceed 20 years at the date of loading. The seller shall bear the average insurance premium for liner vessel older than 20 years. Under no circum -stances shall the Buyer accept vessel over 25 years of age. 15.8 For break bulk cargoes, if goods are shipped in containers by the Seller without prior consent of the Buyer, a compensation of a certain amount to be agreed upon by both parties shall be payable to the Buyer by the Seller. 15.9 The Seller shall maintain close contact with the carrying vessel and shall notify the Buyer by fastest means of communication about any and all accidents that may occur while the carrying vessel is on route. The Seller shall assume full responsibility and shall compensate the Buyer for all losses incurred for its failure to give timely advice or notification to the Buyer. 「章名」 16 CIF Terms: Under CIF terms, besides Clause 15 C&F Terms of this contract which shall be applied the Seller shall be responsible for covering the cargo with relevant insurance with irrespective percentage. 「章名」 17 Advice of Shipment: Within 48 hours immediately after completion of loading of goods on board the vessel the Seller shall advise the Buyer by cable or telex of the contract number, the name of goods, weight (net/gross) or quantity loaded, invoice value, name of vessel, port of loading, sailing date and expected time of arrival (ETA) at the port of destination. Should the Buyer be unable to arrange insurance in time owing to the Seller‘s failure to give the above mentioned advice of shipment by cable or telex, the Seller shall be held responsible for any and all damages and/or losses attributable to such failure. 「章名」 18 Shipping Documents 18.A The Seller shall present the following documents to the paying bank for negotiation of payment: 18.A.1 Full set of clean on board, “freight prepaid” for C&F/CIF Terms or “Freight to collect” for FOB/FAS Terms, Ocean Bills of Lading, made out to order and blank endorsed, notifying ___________at the port of destination. 18.A.2 Five copies of signed invoice, indicating contract number, L/C number, name of commodity, full specifications, and shipping mark, signed and issued by the Beneficiary of Letter of Credit. 18.A.3 Two copies of packing list and/or weight memo with indication of gross and net weight of each package and/or measurements issued by beneficiary of Letter of Credit. 18.A.4 Two copies each of the certificates of quality and quantity or weight issued by the manufacturer and/or a qualified independent surveyor at the loading port and must indicate full specifications of goods conforming to stipulations in Letter of Credit. 18.A.5 One duplicate copy of the cable or telex advice of shipment as stipulated in Clause 17 of the Terms of Delivery. 18.A.6 A letter attesting that extra copies of abovementioned documents have been dispatched according to the Contract. 18.A.7 A letter attesting that the nationality of the carrying vessel has been approved by the Buyer. 18.A.8 The relevant insurance policy covering, but not limited to at least 110% of the invoice value against all and war risks if the insurance is covered by the Buyer. 18.B Any original document(s) made by rephotographic system, automated or computerized system or carbon copies shall not be acceptable unless they are clearly marked as “ORIGINAL.” and certified with signatures in hand writing by authorised officers of the issuing company or corporation. 18.C Through Bill of Lading, Stale Bill of Lading, Short Form Bill of Lading, shall not be acceptable. 18.D Third Party appointed by the Beneficiary as shipper shall not be acceptable unless such Third Party Bill of Lading is made out to the order of shipper and endorsed to the Beneficiary and blank endorsed by the Beneficiary. 18.E Documents issued earlier than the opening date of Letter of Credit shall not be acceptable. 18.F In the case of C&F/CIF shipments, Charter Party Bill of Lading shall not be acceptable unless Beneficiary provides one copy each of the Charter Party, Master‘s of Mate’s receipt, shipping order and cargo or stowage plan and/or other documents called for in the Letter of Credit by the Buyer. 18.G The seller shall dispatch, in care of the carrying vessel, two copies each of the duplicates of Bill of Lading. Invoice and Packing List to the Buyer‘s receiving agent, _______________at the port of destination. 18.H Immediately after the departure of the carrying vessel, the Seller shall airmail one set of the duplicate documents to the Buyer and three sets of the same to ______________________________ Transportation Corporation at the port of destination. 18.I The Seller shall assume full responsibility and be liable to the Buyer and shall compensate the Buyer for all losses arising from going astray of and/or the delay in the dispatch of the above mentioned documents. 18.J Banking charges outside the People‘s Republic of China shall be for the Seller’s account. 「章名」 19 If the goods under this Contract are to be dispatched by air, all the terms and conditions of this Contract in connection with ocean transportation shall be governed by relevant air terms. 「章名」 20 Instruction leaflets on dangerous cargo: For dangerous and/or poisonous cargo, the Seller must provide instruction leaflets stating the hazardous or poisonous properties, transportation, storage and handling remarks, as well as precautionary and first-air measures and measures against fire. The Seller shall airmail, together with other shipping documents, three copies each of the same to the Buyer and___________________ Transportation Corporation at the port of destination. 「章名」 21 Inspection & claims: In case the quality, quantity or weight of the goods be found not in conformity with those as stipulated in this Contract upon re-inspection by the China Commodity Import and Export inspection Bureau within 60 days after completion of the discharge of the goods at the port of destination or, if goods are shipped in containers, 60 days after the opening of such containers, the Buyer shall have the right to request the Seller to take back the goods or lodge claims against the Seller for compensation for losses upon the strength of the Inspection Certificate issued by the said Bureau, with the exception of those claims for which the insurers or owners of the carrying vessel are liable, all expenses including but not limited to inspection fees, interest, losses arising from the return of the goods or claims shall be borne by the Seller. In such a case, the Buyer may, if so requested, send a sample of the goods in question to the Seller, provided that sampling and sending of such sample is feasible. 「章名」 22 Damages: With the exception of late delivery or non-delivery due to “Force Majeure” causes, if the Seller fails to make delivery of the goods in accordance with the terms and conditions, jointly or severally, of this Contract, the Seller shall be liable to the Buyer and indemnify the Buyer for all losses, damages, including but not limited to, purchase price and/or purchase price differentials, deadfreight, demurrage, and all consequential direct or indirect losses. The Buyer shall nevertheless have the right to cancel in part or in whole of the contract without prejudice to the Buyer‘s right to claim compensations. 「章名」 23 Force Majeure: Neither the Seller or the Buyer shall be held responsible for late delivery or non-delivery owing to generally recognized “Force Majeure”causes. However in such a case, the Seller shall immediately advise by cable or telex the Buyer of the accident and airmail to the Buyer within 15 days after the accident, a certificate of the accident issued by the competent government authority or the chamber of commerce which is located at the place where the accident occurs as evidence thereof. If the said “Force Majeure” cause lasts over 60 days, the Buyer shall have the right to cancel the whole or the undelivered part of the order for the goods as stipulated in Contract. 「章名」 24 Arbitration: Both parties agree to attempt to resolve all disputes between the parties with respect to the application or interpretation of any term hereof of transaction hereunder, through amicable negotiation. If a dispute cannot be resolved in this manner to the satisfaction of the Seller and the Buyer within a reasonable period of time, maximum not exceeding 90 days after the date of the notification of such dispute, the case under dispute shall be submitted to arbitration if the Buyer should decide not to take the case to court at a place of jurisdiction that the Buyer may deem appropriate. Unless otherwise agreed upon by both parties, such arbitration shall be held in ________, and shall be governed by the rules and procedures of arbitration stipulated by the Foreign Trade Arbitration Commission of the China Council for the Promotion of International Trade. The decision by such arbitration shall be accepted as final and binding upon both parties. The arbitration fees shall be borne by the losing party unless otherwise awarded.
