出租方将房屋交给承租方后，承租方的装修及修缮，出租方概不负责。如承租方不再使用出租方的门市后，承租方不得破坏已装修部分及房屋架构

第五条 各项费用的缴纳

1、物业管理费：承租方自行向物业管理公司交纳。

2、水电费：由承租方自行缴纳，（水表表底数为_________度，电表底数为_________度，此度数以后的费用由承租方承担，直至合同期满）。

3、维修费：租赁期间，由于承租方导致租赁房屋的质量或房屋的内部设施损毁，包括门窗、水电等，维修费由承租方负责。

4、使用该房屋进行商业活动产生的其它各项费用均由承租方缴纳，（其中包括承租方自已申请安装电话、宽带、有线电视等设备的费用）。

第六条 在租赁柜台经营活动中，出租方应当履行下列义务：

1、必须制作租赁柜台标志并监督承租方在承租的柜台或者场地的明显处悬挂或者张贴。

2、监督承租方遵守经营场所内的各项规章制度，对承租方违反法律法规和损害消费者权益的行为要及时报告有关部门。

3、不准将柜台出售给与柜台原有经营范围不符或反向的承租人。

4、违反城市规划及城市管理规定，擅自在商店门前或占道设置的柜台（包括在店内自行设置妨碍顾客出入的柜台），禁止出租并予以撤销。

5、不准为承租方提供银行帐号、票证和服务员标牌。

6、不准为承租方非法经营提供方便。

第七条 在租赁柜台经营活动中，承租方应当履行下列义务：

1、不得超出核准登记的经营范围。

2、必须在承租柜台或者场地的明显处悬挂或者张贴租赁柜台标志。

3、不得私自转租、转让承租的柜台，不得以出租方的名义从事经营活动。

4、文明经营，礼貌待客，出售商品时，要明码标价，出售商品后，要向消费者提供正式的销售凭证。

5、不得销售假冒伪劣商品和腐烂变质、有损健康的食品，不得销售无厂名、厂址的商品以及从事其他违反国家法律法规和损害消费者权益的活动。

6、必须按税务部门的规定，办理纳税登记，依法纳税。提前停租的，应向原纳税机关办理注销税务登记和缴清税款等有关手续；

7、禁止转借、出卖、出租和涂改租赁经营许可证和营业执照。

8、自觉接受工商、税务、物价、卫生、城市管理等部门的监督检查，服从出租方的指导与管理，执行营业场所管理的有关规章制度。

第八条 出租方与承租方的变更：

1、如果出租方将房产所有权转移给第三方时，合同对新的房产所有者继续有效。承租人出卖房屋，须在3个月前通知承租人，在同等条件下，承租人有优先购买权。

2、租赁期间，承租方如欲将租赁房屋转租给第三方使用，必须事先书面向出租方申请，由第三方书面确认，征得出租方的书面同意。取得使用权的第三方即成为本合同的当然承租方，享有原承租方的权利，承担原承租方的义务。

第九条 违约金和违约责任

1、若出租方在承租方没有违反本合同的情况下提前解除合同或租给他人，视为出租方违约，负责赔偿违约金_________元。

2、若承租方在出租方没有违反本合同的情况下提前解除合同，视为承租方违约，承租方负责赔偿违约金_________元。

3、承租方违反合同，擅自将承租房屋转给他人使用的，应支付违约金_________元。如因此造成承租房屋损坏的，还应负责赔偿。

第十条 续租

1、承租方若要求在租赁期满后继续租赁该处商铺的，应当在租赁期满前_________日书面通知出租方，出租方应当在租赁期满前对是否同意续租作出书面答复。如出租方同意续租的，双方应当重新订立租赁合同。租赁期满前出租方未作出书面答复的，视为出租方同意续租，租期为不定期，租金同本合同。

2、租赁期满承租方如无违约行为的，则享有同等条件下对商铺的优先租赁权。

第十一条 合同中止

承租人有下列情形之一的，出租方可以中止合同，收回房屋：

1、承租方擅自将房屋转租、转让或转借的；

2、承租方利用承租房进行非法活动的，损害公共利益的；

3、承租方拖欠租金累计达30天的，并赔偿违约金_________元。

第十二条 合同的终止

1、本合同期限届满，双方不再续签合同的；

2、双方通过书面协议解除本合同；

3、因不可抗力致使合同目的不能实现的；

4、在委托期限届满之前，当事人一方明确表示或以自己的行为表明不履行合同主要义务的；

5、当事人一方迟延履行合同主要义务，经催告后在合理期限内仍未履行；

6、当事人有其他违约或违法行为致使合同目的不能实现的；

7、_________。

第十三条 免责条件

若租赁房屋因不可抗力的自然灾害导致损毁或造成承租人损失的，双方互不承担责任。租赁期间，若承租方因不可抗力的自然灾害导致不能使用租赁房屋，承租方需立即书面通知出租方。

第十四条 争议处理方式

1、本合同受中华人民共和国法律管辖并按其进行解释。

2、本合同在履行过程中发生的争议，由双方当事人协商解决，也可由有关部门调解；协商或调解不成的，按下列第_________种方式解决：

（1）提交_________仲裁委员会仲裁；

（2）依法向人民法院起诉。
