强化环境管理 严格环境执法力促环保工作上台阶

各位领导、同志们：

20__年，在市环保局和区委、政府的领导下，商州区环保局紧紧围绕“促进全区经济率先突破发展”这个主题，与时俱进探新路，真抓实干求突破，重拳出击搞治理，工作取得了一定成效，尤其是在环境执法工作方面，能够坚持从宣传教育入手，扎实推行行政执法责任制，强化环境管理，严格环境执法，使全区环境质量得到明显改善，有效的促进了全区社会、经济和环境的协调健康发展。20__年,先后开展了建设项目“环评法”及“三同时”制度执行情况专项检查、“两高一资”企业、重点企业、重点减排企业、西商复线各各标段、高速路沿线砖瓦窑企业、砂石厂，高中考期间噪声、城区燃煤锅炉、餐饮业、洗车及汽车美容行业、畜禽养殖场等十余项执法检查，共出动执法人员800余人次，下发限改正通知、监察意见书46份，纠正违法行为60多次，立案16起，行政处罚10起。依法办理行政审批、行政征收280余件，其中行政许可类事项188件(“环评”审批158件，排污许可35家);行政征收类100余件;无一例行政复议和行政强制案件。

在肯定成绩的同时，我们也清醒地认识到，我区环境保护工作还存在着许多突出的问题，环保工作的任务依然很严峻，如污染减排任务大，农村面源污染依然没有得到有效的

治理，区域环境质量还有不尽人意之处，我们将进一步增强做好环保工作的责任感和紧迫感，在今后的环境执法工作中努力从以下几方面推动全区环保工作迈上新台阶。

一、加大环保法律法规宣传教育力度，不断提高执法工作水平

一方面，加强系统环保法规的学习、培训和考核。局领导很重视环保法律法规的学习培训,将法律法规的学习培训和考核工作放在更加突出的位置，按照“缺什么补什么”的原则，年度制定学习计划，采用各种形式开展学习培训活动。一是采取“走出去，请进来”的办法，定期邀请专家授课指导，认真组织环保执法人员参加省、市举办的各类培训，以提高全系统执法水平。二是开展执法案卷大讨论活动，针对执法人员对查到的环境违法案件进行案情分析，形成“两人查案，全局质疑，总结归纳，共同提高”的螺旋形上升的工作方法，不断提升环保执法水平。三是积极向兄弟县学习先进工作经验，取长补短，完善执法工作制度，不断提高全系统职工依法执政、依法行政、依法决策的能力和水平。另一方面，加强环保法律法规的宣传教育工作。坚持“五个面向”,即面向领导、面向企业、面向社会、面向中小学生、面向群众，把握好“三个注重”，即在形式上注重把重大节日的宣传教育与系统性、连续性和经常性宣传教育相结合;对象上注重重点污染行业与具有普遍性的城镇居民、乡镇企业、第三产业相结合;内容上注重法律法规与环保科学知识、地方性规范相结合。通过广播、电视、报刊、网络多种媒体和绿色示范工程等宣传阵地，大力宣传环保法律法

规，进一步增强全社会的环保国策意识和公众支持参与意识。

二、推行行政执法责任制，明确职权和职责，严格规范执法 推行行政执法责任制,分解执法责任，规范执法程序，

落实监管制度，加强监督管理。采取一把手与分管领导、分管领导与股(室)负责人、股(室)负责人与工作人员层层签定了行政执法目标责任书的方法，做到执法职责、任务、目标纵向到底，横向到边，形成一把手负总责、分管领导负实责任、工作人员负具体责任的执法责任机制。

在执法过程中，以解决环保执法随意性为突破口，通过明确执法程序，严格执法行为，规范执法文书，保证执法部门、执法岗位和执法环节之间环环相扣，相互制约，实行源头控制，强化事中监督。在依法查处环境违法行为中，坚持日常工作与开展专项行动相结合，查、纠、改并举，一是对重点排污单位、重点挂牌企业、重点区域流域，增加监察监测频次，加大查处力度，整改细小的环境违法行为，对存在主观故意或恶意偷排环境违法行为坚决依法予以严厉处罚;二是对每个环境违法行为下达责令停止违法行为通知书，并提出整改意见和时限;三是对存在环境违法行为的业主加强沟通、教育，使其能充分认识违法排污行为对环境、群众的危害性和做好企业环保工作的重要性，从被迫去做环保工作的思想观念转变为主动要求做好环保工作。四是加强后督

察，对各项整改内容予以时间限定，定期回访核实事情情况，确保整改到位，努力做到查一案改一案。

三、转变职能，强化服务意识，将执法寓于服务之中在环境执法工作中，把服务与执法相结合，在执法中服务，在服务中执法。一方面做到“三实行”：一是实行企业审批管理跟踪负责制。对已列为市区重点项目的，建立领导包抓负责制，从项目的前期选址、审批到建设、投入运行进行全过程跟踪服务，在市政府招商引资的商洛市鑫丰源矿业公司，我们曾多次对其进行指导，并协调办理环保手续。二是实行环保审批时限承诺制。凡是辖区企业的新、改、扩、迁项目，确保其环保审批时限均实行五个工作日内办结。重点项目实行简化审批程序，开辟“绿色通道”，做到特事特办，快速审批。三是实行审批责任承诺公开制。加强效能监督，对不负责任，办事拖拉，损害企业利益的行为，按照相关规定，追究审批责任人员的行政责任。另一方面，对已建成的企业积极提供环保技术、政策、信息咨询，协助企业开展环保技术、产品的考察论证，加强了环境管理体系认证，大力倡导循环经济，指导企业进行清洁生产，推广应用环保新产品、新技术，提升企业的治污水平，促进企业环保效益双赢。

四、上下联动，多方协作，全力整治违法排污企业，确保群众的环境权益

一方面充分与区直各部门加强协作与沟通，对存在环境

问题的企业进行通报，借助各方力量，全力整治环境违法排污企业，确保群众的环境权益;另一方面在执法过程中，发现不属于自己职权范围内的，立即与有关单位或上级部门沟通，做好协调工作。逐步形成各级各部门分工协作，全社会广泛参与、齐抓共管的工作局面。

五、完善执法监督体系，打造阳光执法

充分发挥执法机构的执法职能、公众的外部监督、企业的内部监督作用，形成相互制衡的“三元环境执法监督体系”。一是通过开展企业环保监督员试点工作，探索新型企业环境管理体制，促进企业提高自主守法水平和能力。二是积极推进环境信息公开工作，及时公开环境违法重点案件的查处情况。三是广开参与途径。包括聘任环保监督员、加强与社会团体参与、开展环境保护问卷调查、24小时环保投诉电话、完善环保网站、呈请人大代表视察等形式，以扩大公众参与环境执法工作。

此次全市环保工作会议,让我们的思路更加清晰，目标更加明确，信心更加倍增。在新的一年里，在市环保局和区委区政府的统一领导下，在各部门的大力支持下，我们有信心和决心，再添新举措，通过不懈的努力，全面履行好环境管理的各项职能，为商州的天蓝、水清、山绿做出应有的贡献!
